think killed a person and carried the dismembered body in a suitcase last week. 59-year-old mark andrus was freed from county jail last night after the district attorney decided there wasn't enough evidence to charge him in the case. the dismembered body was found on 11th street near market. chief greg said investigators are hoping dna testing will provide name of the victim and lead to the arrest. >> we will do the best we can within the law to make sure we know the where abouts of the suspect in the event we get a break in this case and need to recollect. >> a source close to investigation told ktvu channel 2 news they are trying to determine if the victim is omar shawan. rain and winds in the north bay. that is where the storm will hit first. let's bring in chief meteorologist bill martin in.

we haven't seen a storm or any rain like this for more than a month now. >> this is like what we saw in december where we had all the rain which was great news for us. gots through january which was completely dry. now we go back into a weather system that is custom tailored for what we need. if i was to design a system for the bay area with the rainfall we are at and the snow pack, this system has enough rain to really make a big different in a lot of the problems we are seeing around the bay area and up in the hills. so, here is the koa focus of the system now. around cape mendocino north. as we head into thursday night and friday, this fire hose is going to focus right on the bay area. mainly santa rosa. san rafael, and portions of the north bay. but the rain will head south and we could easily see a couple of inches of rain in san jose as we head into the bay area weekend. there will be a wind advisory as well. wind gusts up to 50 miles an

hour. heavy rains at time. we will see urban and small stream flood advisories in all bay area communities. here is how it breaks down. right now, you see a little fog along the coast. watch the showers up north. thursday morning, at 7:30, you see what is happening there. the system is moving on shore. by thursday afternoon, the system starts to work its way south and by friday, everything is getting wet. when we come back, we will have the complete break down. we will time out the next couple of weather systems headed our way. students at sacred heart in san francisco are rallying against a new morality clause by the archbishop they call hurtful and discriminatory. it would add language against homosexual relationships. katie utehs is live where they are standing up for teachers who won't because they are afraid they will lose their jobs. >> reporter: frank, students, teachers, and parents are upset

about this as is evident by an online petition that garnered some 1600 signatures so far. and many of the student i speak with say the archbishop's actions are not in connection with their beliefs. >> we learn about social justice here. >> reporter: students at sacred heart in san francisco are fired up. >> it doesn't represent what our school is. >> reporter: because of a document released by the archbishop aimed at clarifying catholic teachings. >> i can not describe the shock of reading something like that that discriminates against so many. >> reporter: proposed morality clauses would be added to the teacher handbook. one addresses homosexuality of being contrary to the natural law. >> the teachers also have to respect the mission of the school and the way they live their public lives. what is private remains private. and no one is privy to that. >> i am gay myself.

>> reporter: alumni, parents, and students say they will fight the proposals an take it to a higher power. >> if the school decides maybe, you know, bring this further. talk to the vatican. >> reporter: the archbishop will be holing a meeting on friday to address teacher concerns, kind of a question and answer session and following that meeting, there will be a press conference as well, so we may learn more about the specific morality clause. but at this point, parents and teachers and students say that they are rallying and trying to figure out what they are going to do next to make sure their opinions are heard. frank? >> reporter: so katie, how would they enforce this morality clause and what would happen if you are caught? >> reporter: that is certainly one of the questions teachers are hoping to have addressed at the meeting. the archbishop said teachers wouldn't have to sign anything acknowledging the handbook.

it was a topic of discussion here at school todayened a much of the class time was spent discussing the issues. >> katie utehs, thank you. a large crowd gathered outside an oakland courthouse today to show solidarity with a group of protesters known as the black friday 14. about 100 people rallied this morning before an alameda county judge heard arguments in a motion to dismiss miskey may nor charges against people involved in the protest. they were exercising their constitutional right to free speech like many ores in the wake of the ferguson grand jury decision. >> even people who vandalized or shut down freeways, et cetera endangered the lives of other people, allegedly, those people are being cited and released but this all-black action that was peaceful, we were seeing protests songs and

spirituals. this is an action they choose to make an example of. >> the judge took the motion to dismiss under consideration and said the decision is expected in the next couple of weeks. a $20,000 reward has been offered for information leading to an arrest in the killing of a rapper who called himself the jacka. he was killed in east oakland monday night. they found him with a gunshot wound. he died later at a hospital. there is now a memorial of flowers and candles where he was killed. the woman shot and killed by officers yesterday pointed a gun at police. the shooting happened after 12:30 in the parking lot of a storage facility in west oakland right on the border with emeryville. police say they first received the call from workers at home depot who said a shoplifting suspect had become combative and pointed a gun at them. the suspect took off. investigators say she tried to carjack three different people at gunpoint before confronting officers. >> we have witnesses that tell

happens to the patron saint of candlestick park. they are scrambling to find this statue of saint francis a new home. it weighs several tons and it will take a crane and a flat bed truck to get it to a secure storage site. though the new location is uncertain, the statue will be saved. insalinas, police are looking for a woman who took a selfie with a stolen phone. the person whose phone was stolen found this picture in i cloud account. the victim says she has no idea who this woman is. who took the selfie and she did not have permission to use her phone. police in salinas are asking anyone who knows this woman to give them a call. people who went to the winter ball won't forget it. one young manmade it memorable.

weather now. >> we are going to get through tomorrow, thursday, pretty much dry. in the north bay, they will have showers by the evening. in san jose, you won't see showers until friday morning of afternoon, but the rain is coming. a lot of mid 60s , systems we are tracking, there they are. it is a nice-looking setup. lots of moisture, energy, and a jet stream that is cooperating and was up here the last 42 days. is now going to drift south. slowly, albeit, but it will get south and it will get us some rain. so as we push in close, we can swing the radars around. sacramento up in davis. these are doppler radars. another one in the santa cruz mountains. and there is another one as well. a lot of moisture in the air. the green areas representing just a ton of moisture. origin ifs the tropics.

warm, moist air. game on for rainfall. we have flood watches and concerns in the north bay. we will see urban and small stream flood advisories, the mountains will see snow, but high snow. the storms are not great snow producers. great rain producers but not snow. a flash flood watch. gusts to 50 miles an hour as we head into friday. two of them right? storm number one on friday. storm number two on sunday. friday's storm looks to be the strongest of the two as it moves in. it will have the most moisture. you have two big ones. let's say last december was a 10 on a scale of 1-10. that big series of storms. this is a very similar footprint in terms of where the moisture is comeing from. this is probably an 8. could be a 9. that is not bad considering we got enough rainfall from that december to get us through december and january. january didn't rain. we are still 100% average in san jose. so, this is going to put us

>> at least six people have died after a horrible train crash in new york. it happened after the train slammed into an suv. authorities say all of the deaths on the train, all of the people killed were burned beyond recognition. the driver also died. david lee miller has the latest from new york. >> we intend to find out not only what happened, but we want to find out why it happened. >> reporter: federal investigators are on the scene of the fatal train accident in westchester new york. they are looking into why the suv that the train struck was stopped on the tracks. crews have secured several key devices to aid. >> in addition to the train recorders, there are event recorders on the signals so the crossing gates. they have event recorders in

>> tonight, we are learning about seniors who are terrified to leave their homes at night. they are afraid of crime or being targeted because of their age or race. some say violent robberies are in some ways becoming a bigger problem. >> david stevenson is in the city where people are so afraid, they give themselves a curfew. >> reporter: several asia community activists say the robberies targeting the elderly are encouraging a lot of them to go home early. san francisco police chief greg surr went store to store in the city's china town neighborhood.

>> new at 5:00, a warning in north san jose tonight as police are on the hunt for a man suspected in a number of car burglaries. more than 50 break ins have happened in the past four months alone in the area of first street and brocaw and most of them happened in broad daylight. ktvu fox 2 news' asna smith is live. >> reporter: we are here at the

international airport and police say this area is a hot bed for car travelers here on business. the first street corridor in north san jose, a prime spot filled with out of towners away on business and rental cars. it has become a prime spot for thieves to do business of their own. >> if they notice personal property, computers, laptops, they are smashing the window, taking the property, and fleeing the scene. >> reporter: since november, 53 car break ins have occurred. burglars taking personal belongings. 28 victims have filed police reports. the majority of them happening between the hours of 6:00 and 11:00 in the morning. >> if they are in a hurry, they sometimes don't lock their doors. sometimes, they just don't think they are in a high crime

international bird rescue released 20 birds that had been covered in that mysterious gray goo. this is the second group of birds to be released. hundreds of birds were sickened by the goo along the bay area shoreline. the birds were released on the east bay at shoreline park inside the port of oakland. >> it is important for us to be releasing birds here. that will bring the number of birds released over 100. >> last time, the birds were released up in sausalito. these birds were rehabilitated 2-and-a-half weeks. we called fish and wildlife to see if they have any information on what the goo is yet. they are still not sure. international bird rescue says the last time they found a coated bird was on january 22. two california state senators proposed legislation that would change vaccination laws for school children. state senators richard pan and ben allen are responding to the

he had nothing to do with a string of fires set in alameda but it is what police found during their arson investigation that has them facing new criminal charges. good evening, i'm julie haener. >> and i'm frank somerville. steven peterson and another man were arrested on arson charges last september, but then they were dropped. ktvu fox 2 news' john sasaki is at the scene of one of the fires with the evidence that the police collected in that case that has now led to new charges for both men in two unrelated crimes. john? >> reporter: frank, these businesses were set on fire last september and it led to serious but unrelated charges against andrew gutierrez an steven peterson. several businesses still stand in ruins after eight arsons on the morning of september 28. >> dry cleaning decimated. >> reporter: here is what bright cleaners said at the
