[ sniffing ] [ seagulls squawking ] >> this is ktvu fox 2 news at noon, starting now. >> san jose police officers shoot and kill a man. now we obtained a radio recording explaining what happened. good afternoon, i'm tori campbell. it all started with a call to 911. but family members say the moon was crying out for help and should not have been shot. ktvu fox 2 news' janine de la vega has the story. >> reporter: his name is

phillip watkins and she watched as he was shot on sherman street. >> he was disstressed. something i had never seen before. i didn't think things would get to this point. he was upset. he felt things weren't going right. >> reporter: buchanon called the suicide help line worried about her future son-in-law. then, there was a 911 call saying someone was locked inside an upstairs bedroom. it was watkins who called 911 and it was his way of calling for help. the radio captured tense moments when they arrived. >> male walking towards us. >> reporter: they ordered him to drop the weapon, so he fired. >> shots fired! >> they shot him. and i begged the policemen not to shoot him. that he needed help.

they could have tazed him. >> reporter: watkins was taken to the hospital where he was pronounced dead. a police spokesperson says the officers were in fear for their life and they are trained to stop a threat. watkins was 23 years old, attended san jose high school and deanza college where he played football. he was engaged to buchanon's daughter. >> he was thinking of becoming a policeman. ironic huh? >> reporter: it is unknown if this is a case of suicide by police. detectives are trying to piece together what happened here. in san jose, janine de la vega, ktvu fox 2 news. new at noon, a key figure in the san francisco conspiracy case involving leland yee was back in court today. raymond shrimp boy chow and five others were arraigned on an indictment this morning. the charges against him remain the same including conspiracy,

racketeering and money laundering. chow's attorneys are demanding federal authorities allow him to be released on bail. he has been held since his arrest last april. >> he wants to get in front of the jury now and get his story to the jury now. he has faith that the jury is going to make the right decision. >> chow's defense attorneys also asking for the court to set a trial date in the case and try chow first since he has been in jail for so long. a trio of global problems has the attention of lawmakers on capitol hill. the senate hears testimony from a high-ranking general about slowing down troop withdrawal in afghanistan. meanwhile, the obama administration is forced to abandon another overseas embassy as congress considers a request from the president to fight isis. >> reporter: in response to a growing number of casualties

within the afghan security force, general john campbell says the obama administration is considering slowing down troop withdrawals. he is looking to keep 5500 troops behind. >> i have provided options to my chain of command to take a look at as we do this winter update for additional options. >> you provided those options. do you favor them? >> absolutely. >> reporter: in yemen, u.s. diplomats fled the embassy there in the wake of the iran uprising of rebels. now reports that u.s. marines were able to destroy vehicles and weapons before they left to the wrong hands, the question is who is guarding the u.s. embassy itself. >> we expect them to respect international conventions and we expect to be able to return to the embassy in the same condition. >> reporter: back on capitol hill, congress continues to weigh a request from the president for authority to take

islamic state made $1 million a day from oil sales. bob simon has died, police say simon was in the backseat of a car that hit another car stopped at a traffic light in new york city. simon's car then slammed into a metal median barrier. the 73-year-old journalist died at a hospital. simon was a contributor to 60 minutes. he just did a segment last week on the movie selma. he was an overseas correspondent starting in the 1960s and was captured by iraqi forces in the gulf war spending 40 days in a prison. president obama returns to the bay area to head a cyber security meeting in stanford. he will land tonight at 5:30 p.m. and tomorrow attend the summit at 8:45 a.m. some of the biggest names of the tech industry will be there. tomorrow night, the president plans to attend a fundraiser on a private home on san

all parties agreed to a cease fire midnight saturday and an agreement for both side to pull back heavy weapons. vladimir putin was involved in the talks and the ukrainian president, france, and germany. if it holds, it could end a ten month conflict that has killed 5,000 people. most of them civilians. police in milpitas have identified a person of interest in a hit and run crash that killed a 14-year-old girl. they are looking for this man alex alkazar. he owned the truck in the crash, but police don't know if he was driving. investigators found his car a half mile away following a trail of debris. the 14-year-old died from injuries suffered in the crash. turns out that smoking is even worse than previously

thought. according to a new study by the american cancer society. findings are found by health data from more than a million people tracked for ten years. five diseases and 60,000 deaths a year to the toll taken by tobacco. smoking was linked to significantly increased risk of infection, kidney disease, intestinal disease caused by inadequate blood flow and heart ailments. these are in addition to the well known causes like heart attacks, stroke, and lung cancer. a south bay law school is offering a class in the legal issues surrounding marijuana. a class at santa clara school of law this semester focuses on policy regarding legalization of marijuana. the class will take up issues on regulations, taxations and policing as they decide whether

to legalize the drug for recreational use in 2016. it is currently legal in colorado, washington, alaska, and oregon. a group of boards was once covered in a sticky substance is nursed back to help. today, more were released back in the bay. sal castaneda is live in sausalito where the birds were released an hour ago. good afternoon sal. >> reporter: good afternoon. we were right here when they released them just a little while ago and we have video tape to show you of that release that we captured. six birds were released after spending weeks at the international bird rescue center in fairfield. the birds were first spotted last month in the waters off the east bay. they were covered in a gray rubber cement type substance. the birds would have died unless they were treated. the substance still has not been identified and the source of the mystery goo is still underknown. 170 birds were collected by the

center and after today's release. about 80 remain in recovery. >> we are doing this all on our own. there is no responsible party on this because we still don't know what the substance is that was in the bay. like i said, four weeks ago. so we have incurred quite a bit. it is a bit of a hit for our organization. these birds take a lot of care. they are up at our fairfield center right now. >> reporter: now check out this picture. this bird shown here is as it was found covered in the gray mystery goo. now we have video of it being released. it looks healthy as you can see it flowing away. it seemed content, of course we have no way of knowing that but it seemed content to be back in the water. the people doing this say it is very rewarding. >> i always say a release of birds lifts your spirits and this is one of those days, too, that everyday we come back out here to release birds that

should be in the wild. it feels really great letting them go. >> reporter: the birds were here, but they don't cooperate with live tv. they were in the bay here. so they have flown off. i saw one of them taking little flights near the golden gate bridge. we have developing news in this regard. my colleague noelle walker received some information that fish and game department is closer to identifying what this mystery goo is. and that is very important because if it is traced to a source, the people who released it will have to pay for the rehabilitation of the birds an any other mess that this goo created. live from marin county, back to you in the studio. >> all right, and i'm sure that is not going to be a cheap price tag either for getting the birds back to the wild. thank you sal. let's check on the forecast with mark tamayo. pretty nice outside. >> very nice tori.

temperatures approaching the 70- degree mark. we are talking 70s for today. we will continue to work things back up over the next few days. here is the live camera looking out to marin county. at mount tam, 2500 feet. always fun to play up there. lots of clear sky ins this area and the entire region. at least a good portion of central and parts of northern california. we have a few high clouds approaching the north coast. no rain drops to speak of, but some of the high clouds will drift over the bay area the next few hours. maybe partly sunny skies at most in terms of cloud cover. but temperatures, the big story not only here, but across the entire state. in the lower 80s for los angeles and san diego. a little close tore home showing you some 60s and a few spots, 70 degrees out toward half-moon bay. san francisco, 66. san jose, 65. walnut creek in the upper 60s . a forecast headline, obviously sunny and warm for today. the dry weather pattern will continue and it will be a nice

weekend. in fact, a lot of 70s for both saturday and sunday. so high pressure is in charge offshore. it is strengthening and pushing into northern california. that compressing air, the sinking air. it started yesterday, continues into it today and also friday. so fair skies, a few high clouds out there. temperatures mainly in the low to mid 70s . this high weakened a little bit, not much. still no rain clouds to speak of and no drop off in temperatures as well. at&t proam at pebble beach, the place to be. 70s , mostly sunny skies. we have a swell approaching the region so you will see a lot of wave activity near the immediate shoreline. so a dry pattern continues in fact. here, you can see the clouds heading way up to the north this weekend. and even into next week. this is a week away. thursday still keeping us dry. of course, a serious situation, we could definitely use the

rainfall. but unfortunately, the forecast models are not producing much in the way of significant rainfall, but that could change. right now, we are going to keep it dry. san jose, 74- degrees. half-moon bay, 72. a lot of 70s over the next few days for friday and into the weekend. and no rain clouds to speak of. we will shave off a few degrees for sunday. and into monday, but tori, it is beautiful out there. just walking around. you see the sunshine out there and the forecast models will change their minds an open up the storm door once again. >> all right. ly have to enjoy it. thank you mark. a bay area native takes to the national stage on american idol. katherine skinner took a shot at fame.
