thousands in the bay area put their life on hold after a judge in texas blocked immigration reform that were set to take effect tomorrow. >> this put them in a position of being afraid of what is going to happen now. >> reporter: good evening everyone i'm frank somerville. >> i'm julie haener. the white house is vowing to fight back tonight after a texas judge stopped president obama's immigration reform from taking effect tomorrow. the administration says it will appeal but for now, the president will comply with the decision. the federal judge ruled the president's executive orders overstepped his authorities and that means for now millions of illegal immigrants cannot start applying for work permits and

stays of deportation. maureen naylor is live where for many hope has turned to apprehension. >> reporter: more than 150 people came here tonight to st. mary's catholic church to get some clarity after that last minute move leaves thousands of immigrants in limbo. what was supposed to be a celebration of a new immigration program was changed organizers organizers. with her 7 -month-old son and two other children at home, this gilroy mother was ready to be one of the first to fill out a new work permit application. instead she says she won't be able to look for a better job as she had hoped. >> i am really sad. and my son was too yesterday. he said, mom now we don't know what's going to happen. you have to wait more time. >> reporter: after a texas

judge blocks the start of a plan that would have granted legal status to millions of undocumented immigrants allowing them to get driver's licenses, and work permits. >> i disagree with the texas judge's rulings and the white house will appeal. >> reporter: the judge ruled the president did not have the authority. once the president's action, this genie would be impossible to put back into the bottle. it would also allow parents who's children are u.s. citizens to defer deportation and seek benefits. >> it does leave people in limbo. the people where the president promised them, if you sign up for this program you're not going to have to worry about deportation, they're going to have to worry a little longer. >> reporter: supporters are confident the reform will move forward. >> i think it provides one more avenue from which to scam the community. because they can say, give me a little bit more money and i

will get you an application or i will slide it in the back door. >> reporter: organizers say santa clara county has the third largest immigration number with more than $110,000 of them that would qualify under the president -- 110,000 of them that would qualify under the president's plan. the justice department is still deciding what the next move is. saying it could ultimately be decided in a higher court. maureen naylor . a man is now behind bars in connection with the burglary and the death of an alleged accomplice. police arrested tyler richard. he was taken into custody after police found michael thorton a the scene of the crime. it happened at chiropractic

college. authorities found a damaged truck that was damaged when they tried to burglarize the school. thornton died of blunt force trauma. we're learning more about a father and son who lost their lives when their canoe capsized. they had gone fishing north of sfo with the younger man's girlfriend. the young woman is the only person who survived. >> reporter: the bay draws fishermen of all kinds to its shore and deep into its waters. monday afternoon, three people set off from oyster point in their canoe only one made it back alive. >> we bare heavy hearts right now. our thoughts and prayers go out to the family. >> reporter: just before 9:00 this morning the coast guard found the body of 22-year-old luis rubalcaba. overnight they launched a search for rubalcaba and

larissa castaneda, the sole survivor. she told her sister the boot took in water. >> they couldn't get back on the boat. that's all she remembers. >> reporter: castaneda is in the hospital lucky to be alive. >> there were reports that they heard cries for help. >> reporter: the older rubalcaba was found half an hour later and died at the hospital. >> that's terrible. very sad. >> reporter: al salchi owned the waterfront restaurant in san francisco where the elder rubalcaba work in the kitchen for the last year. >> there's a lot of grief. when you work with somebody and you enjoy having them around you for eight hours a day, it's a big difference. >> reporter: what a difference a day has made in the lives of two families. >> everybody is devastated right now. and really upset and sad. you know. it's very sad what happened. >> reporter: the three were wearing life vests but it wasn't enough. if they had over safety things with them like a vhf radio they

didn't use it because that call for help calm from their family when they didn't come back to shore. maureen naylor. we're learning more about a police shooting in oakland of a man who officers say was armed with a gun. authorities released this picture of a gun today. they said the man was holding it in the a threatening manner when the officer opened fire. he was hospitalized in critical condition. relatives have identified him as 29-year-old cory power the father of three. police say powers mother had called for help saying her son had bipolar disorder and wanted to commit suicide by getting police officers to shoot him. one of the officers fired after they said pollock launched at his mother and officers. police plan to release more information in the coming days. and from san jose we obtained this surveillance video of a robbery at a liquor store that led to a security

guard being shot and killed. you see a man walk into the store, grab a box of cigars, stumble and run away. about a minute later a shot is visible in the upper right hand corner. the store owner says he thinks that is one of the shots that rang out outside. friends say zuniga didn't have to help but that's the kind of guy he was. at this point, no arrests have been made. a woman in her 20s who was shot during an armed robbery at a little cesar's pizza restaurant in el cerrito is home from the hospital. police are looking for help identifying the people who shot her. officers released this surveillance video of the crime. it happened at 8:20 last night. you can see the man holding a gun. this picture was one of six surveillance cameras all pointed toward the cash register. while the cameras don't show the robbers faces the weapon is

clearly visible in the video. >> if you have seen that weapon in the possession of someone you know. it's not a very common firearm. we believe if someone has recognized it. they may be able to help us solve the crime of whoever did this. >> reporter: the gun looks to be a break action pistol or shortened shotgun, says police. it captured their attention because it's not typically the type of gun used in a robbery. it's the new hot topic for lawmakers and regulators. what to do about drones. through makers at the state capital said our laws in particular are laws not keeping up with our technology. ken pritchett is live with how

celebrations are wrapping up at this hour in new orleans. but as you see here hundreds of people are still on bourbon street ahead of clean up crews and the police. traditionally around midnight or so, new orleans police ride down bourbon street on horse back to clear the streets and officially close mardi gras.

for the people of her neighborhood then marched over to her masquerade. >> we try to give the babies an alternative to the violence they're exposed to. it lets them know there's a bigger world out here that is full of all kind of adventures. >> reporter: all the money raised from that masquerade ball will go for kids for summer camps and aftercool programs. >> paul chambers live tonight in san francisco. paul, thank you. also in san francisco, police say they are increasing patrols at dolores park after vandals caused tens of thousands of dollars. the vandals hot wired a construction cart and did donuts on a newly sodded field. they also damaged a newly placed irrigation system and lit a campfire to make s' mores. need less to say, park workers are not happy. >> we want people to enjoy it but don't trash it.

don't vandalize it. don't demolish it. don't disrespect it. >> reporter: the city plans to remove plastic sheets that cover a chain linked fence to make it easier to see if anybody is causing trouble. police in san francisco are asking for a couple's help asking for help to find an elderly man. he was last seen on february 11th, he is described as black and has white hair and a gold front tooth. he stands 5'10" tall and weighs 180 pounds. investigators say smart is not familiar with san francisco and has medical issues that could cause him to become disoriented. calfire is getting ready for an early fire season by launching an aggressive hiring campaign. azenith smith went to calfire headquarters where hundreds

showed up hoping to be hired. >> if it looks anything like last year i would say yes it's going to be a very active year. >> reporter: active given the combination of warm sunny days. possibly ignite larger drier field. calfire says a dry spring also means fires could spark sooner ahead of the typical fire season that starts in april. >> statewide we've had 160 fires already since the first of the year. typically we're looking at half of that normally. >> reporter: that's why calfire started interviewing 300 firefighter candidate -- candidates a few weeks sooner than normal. a competitive process, calfire says to ensure they hire quality firefighters. >> every fire season they say it's going to be the worse fire season of all time. so i guess we'll see. >> reporter: nicholas ernest

drove three hours from san luis obispo. he's up for the challenge knowing he can help keep families out of harm's way. >> concern for the welfare of everybody who lives around the wild land areas are at risk definitely. but that's why we're here. >> reporter: calfire plans to hire 100 new firefighters, 20 of them here in the bay area. they hope to have these firefighters trained and ready to go by the beginning of may. in morgan hill, i'm azenith smith, ktvu knew. checking -- ktvu news. checking in on the rain, we had a few drops. and temperatures cooled off. tomorrow we get the same fog footprint. there's a lot of it. we have a lot of fog already around the bay. and showing up in the central valley but it'll warm up more quickly tomorrow so it'll be a warmer day. everything is going to the north. there's no rain in the five day

forecast this week. you can kind of see the fall footprint here. this is all the coastal stuff that's pushed inland. we have the valley fog trying to form right now and the two shall merge. it set us up with a pattern that we kind of had this morning that is kind of her -- kind of murky and cool. all right, only a few places cooled off today. you can see the coastal fog. there's the valley fog. and they merge up. this pattern is often tough to break up. we didn't have really horrible visibilities today but it was slow to burn off. watch what the model does. 6:00a.m., 7:00, 8:00. it burns off pretty quick. by lunchtime looks most of the fog will be gone. highs tomorrow will warm just a few degree. mid-50s, maybe some upper 60s. maybe low 70s south toward

police in mountain view are hoping a new video will help them find two burglary suspects. the video shows burglars arriving in a van outside an audio store on moffet boulevard on february 9. they break the door with a sledge hammer. pull apart several display cases and steal equipment. several people drove by that store during the robbery. they want to hear from anyone who may have seen the van or the burglars. a student at santa clara university is behind bars tonight. he's accused of stabbing his roommate several times at their on campus. they arrested dillan kim this afternoon. they say the victim is suffering from several knife wounds but is expected to recover. kim is also being treated for self-inflicted wounds. it's unclear at this point what

led up to the incident. kim is due in court for arraignment on thursday in santa clara. a major development in an unusual case involving a police officer in the east bay. a prostitute in reno and the officer's gun. the police chief in kensington is now being forced out in part because of what happened. as john sasaki tells us the officer at the center of that controversy, he still has his job. >> reporter: nestled in the hills between berkeley and el cerrito the town of kesington is not even a town. >> many people like to refer to it as mayberry or our little hamlet. >> reporter: it's the kind of place where everybody knows the police. they want everything to go as expected, and if not they want accountabilities. on a ccountabilities --

oakland now to explain what's holding up thousands of containers of cargo. jana. >> reporter: well, there is still a long way to go. secretary perez met with both sides today and describes the meetings as positive and productive. that's good news but the bad news as you mentioned is there's no deal. productivity here at the port is still lagging behind schedule. >> reporter: as the port reopened tuesday from the holiday weekend shut down, the show down between port operators and the long shore workers union took a new turn. u.s. secretary of labor thomas perez brought new negotiations to san francisco. joining talks at 5:55 market street. the third floor headquarters of the pacific maritime. shortly after the department of labor issued a statement saying american businesses have millions of billions of the dollars at stake and quote secretary perez stressed that it's imperative that the two sides come to an agreement to

prevent further damage to our economy. harley shaken says that the secretary of labor could make a big difference. >> he's a labor attorney who's been in tough negotiations before. so he's going to bring the power of his office, the power of the president. and some real skills to reach some compromise. the compromise has been sitting for years without a compromise. >> the sticking point is arbitrators. they're like judges during the life of the contract interpreting differences between management and labor. >> reporter: shaken says the union wants an option at the end of each contract to get rid of any of the arbitrators they might consider biased. secretary perez putting calls to governors of washington and california as well as mayors of seattle, tacoma, san francisco, oakland, los angeles and long

beach. >> if he can help he's more than welcome. because he has to basically find an end to it. >> reporter: late today the union said that they were rescheduling a meeting for 8:00 a.m. on thursday. essentially shutting down the port. the labor secretary is planning to meet with both sides tomorrow. >> so many people being affected. let's hope they can find a solution soon. jana katsuyama, at the port of oakland tonight. jana, thank you. attorneys for former state senator leland yee are asking for more time to prepare before his case goes to trial in june. the san francisco democrat is facing federal corruption and racketeering charges. yee was forced to withdraw his bid for secretary of state after his arrest last year. he's accused of accepting bribes in exchange for political favors. attorney james lacer filed papers asking that the trial be pushed back to mid-august. san jose international airport is looking at several options to improve security following a number of security breeches in the last year.

a man scaled a fence at about midnight on january 29th. we requested this video from the airport. it's a little difficult to see what's happening but officials say workers driving on the airport perimeter spotted the man they know called san jose police. the airport says it's now considering raising the height of its fence and possibly adding new technology to improve security. san jose international is also starting new service to china. mayor sam licardo announced that there will soon be flights from maneta to china. >> people are tired of sitting in traffic. getting to sfo waiting for fog delays. folk can get to beijing from san jose faster than they were

>> carnival festivities in haiti took a horrifying term when a parade float carrying a band snagged high voltage wires overhead. at least 18 people were killed in the ensuing panic and more than 40 others suffered injuries. first responders had to navigate through the crowds to get to the scene. haiti's carnival kicked off sunday in the capital city of port-au-prince. the celebration is the largest of its kind in the caribbean. the white house opened a three day summit. joe biden said the world needs more than a military response. >> they have to work from the ground up and engage our communities and engage those who might be susceptible to being radicalized. because they are marginalized. >> and the terror attacks in

denmark this past weekend and france last month. president obama will address the summit tomorrow and thursday. new secretary of defense ashton carter was sworn in today as the 25th secretary of defense. carter replaces chuck hagel. he will be president obama's fourth defense secretary in the past six years. carter worked as the secretary of defense. he was also an international affairs professor at harvard university. nancy pelosi is in cuba leading the delegation of eight democrats. >> we're very pleased with the president's announcement of the change in policy. >> reporter: pelosi and the others are expected to meet with cuban leaders to try to continue to normalize relations a move that president obama announced a month ago. the president is expected to be in cue -- cuba for two days. apple stocks are up today

ahead of its debut of the apple watch. the wall street journal reported that apple had ordered more than 5 million watches for the initial run. there's also a buzz that apple has hired staff to design an electric car. the dow was up 28 points, the the nasdaq rose five and the s & p500 closed up three points. not a big gain but enough to reach a new record high. coming up next, b.a.r.t. given millions of the dollars in federal funding for a specific purpose. >> the transit agency has big plans for all that cash. including creating a first of its kind system which it says will benefit employees and passengers. plus the fog is back but is it going to stick around. our chief meteorologist bill martin has your complete bay area forecast. >> new developments in the race for barbara boxer's senate seat. a republican throws his hat into the ring.

that's the first step to becoming a candidate. he says he stands out on the other republicans on at least one issue. >> in other issues important to me is working on the energy issue. i'm one of the republicans who came out and said you know what there is a problem with our energy. >> reporter: he is the best known republican to announce a possible candidacy. on the democrat side, camela harris is the biggest name in the race. temperatures took a big tumble from the 70s. down to the 50s today in some places like oakland and san francisco. that's because we had so much fog out there. a dose of it last night and a dose of it again tonight. we talked about that. i've already got fog pretty much in all bay area counties and that fog is going to spread its way into the central valley. here you can see these dark edges. it's not real dense. the fog is not right down on
