7:00. we're live in sunnyvale this morning, following breaking news. these are live pictures from a house fire that has turned into a crime scene as officials and neighbors fear the homeowner did not make it out of there alive. coming up in two minutes, we tails we just received from the scene. it looks like there's still smoke coming from the roof of the fire. crews still there. there is a long ladder. welcome back to "mornings on 2." it's tuesday, february 24th. i'm tori campbell. >> good morning, tori. >> good morning. >> i'm dave clark. let's check your weather and traffic now. steve paulson is right over there. you know our forecast. >> clear, cold for us. 30s for many. even a couple of upper 20s up in mendocino county and some of the valleys around napa. a lot of 30s inland. 40s around the bay the -- around the bay. 58 and then a high of 65 today. san jose, high 67. average is 66 this time of year. average high is 61 to 66.

the low, 39. that's below. that's not something we've talked about very much. the lows have been much warmer january and february. the record high, 76, 1946 in san jose. the low is moving far enough east. it's allowed the breezy to tail off. for us, 30s for many. napa at 30. the windchill, napa airport, 26. santa rosa in the low 30s. livermore, 35. san jose, i need to update that. 38 now. so the coldest temps are settling in right now. 32 woodside. they are 31. san mateo, foster city at 39. menlo park and palo alto at 34. any breeze, typeny bit. that's -- tiny bit. that's enough to hold the temp up. south and concord, south and fairfield. that's enough to keep us from being colder. it will be sunny. cold morning for many here.

sunny and a nice quiet pattern from friday into saturday. more in ten minutes. a lot of mid-60s. all right, sal. anything going on? you said all of a sudden, it got busy. it did. we've had a lot going on when it comes to incidents and also slow traffic as we come up on the bay bridge toll plaza. we'll start there getting into san francisco. it's a little bit weird because the metering lights went on late. but if you look at the very left where 880 comes. that's a very good approach to the bridge. if you are coming in from 880 and you have fastrack, you will bypass a lot of this traffic. take 880. don't take 580. we have slow traffic beyond the macarthur maze. we're looking at 880. still looks good. at about 8:00, we have a backup that forms from the coliseum. northbound 280 at 85, they cleared an accident there.

there was a brush fire right here. that's gone. 101 near that area. so that has been taken care of. but traffic is going to be busy in the region and 880 southbound is backing up this morning from 238 all the way down into fremont. up fortunately, not a lot of breaks. we have a lot of heavy traffic in the east bay. it's 7:04. back to the desk. >> thank you, sal. breaking news in the south bay. we're getting these pictures in of a two-alarm fire in sunnyvale. the come came in about -- call came in about 5:30 from a home on fisherman drive. this is being treated as a crime scene. neighbors said they scrambled to get to safety. >> my dog barked up. i gout up to see what it was -- got up to see what it was. it was complete orange out there. i yelled for my family to get out. by then, the firefighters were knocking on our door and we

just ran out. >> police say a man there is unaccounted for. neighbors are telling us an elderly man lived in the home alone. we're working to gather more information and will keep you updated as we get new details. caltrain says a train struck and killed a woman in her car who apparently got stuck on the tracks. the chris happened at the ravenswood avenue crossing around 4:45 yesterday afternoon. that street is still closed. janine de la vega joins us live with the warning for other drivers now. good morning. >> reporter: this was a dev dating accident. the vehicle involved in it was stopped here. that's a situation you never want to be in. you can see crews are out here working to replace those crossing gates right now. the accident happened before 5:00 yesterday afternoon and an suv was stopped on the trucks when a southbound train coming from san mateo crashed into it.

it sent the vehicle who feet across the intersection, totaling it. the female driver had to be extricate and was taken to the hospital and died. it's like lick the woman got stuck on the track -- likely the woman got stuck on the tracks because of the traffic backed up ahead of here. >> sometimes at peak commuter hours, traffic will back up across the railroad tracks. that's what happened. somebody stopped on the tracks. >> reporter: trains are back to running on schedule through the ray venswood crossing. crews are working around them to repair the warning gates and lights. cam trains said their thoughts are with the family of the woman who died. they want people to remember, the top speeds of the trains are at 79 miles an hour. it could take five to six miles for them to stop. as far as this repair work goes, these crews have been working overnight and this could take several more hours. the ravenswood cross something

near el ka me -- crossing is near el camino. it's closed to traffic. police are detouring. er -- tori? >> thank you. a commuter train in oxnard hit a truck on the tracks and has detailed. a los angeles area station is reporting at least one person is dead and there may be more fatalities inside the train cars that ended up on their sides. you can see one there on the screen. it looks like a couple of them on the side. metro link's website said the train was on a run from ventura county to los angeles. we'll continue to follow the story and bring you the latest information as it becomes available. these are live pictures from oxnard of a commuter train that derailed this morning near los angeles. santa clara county residents will get a chance to say how they feel about a

controversial system that will let sheriff's deputies track people through their cell phones in a few hours. a 9:00 a.m. public hearing will be held bile the county board of supervisors about a federal grant to buy the tracking system. the sheriff's department says the system would be used to help find criminals, missing persons and others based on court orders. a similar system is already being used in san jose, oakland and fremont. 7:08. two state lawmakers taking action over the new morality clauses for teachers at san francisco catholic schools. according to the examiner, state assembly members are calling for an investigation of working conditions at the catholic schools run by the archdiocese. the archbishop refused their request to remove what they call discriminatory clauses regarding homosexuality, extramarital sex and other acts opposed by the catholic church. the lawmakers say the clauses may violate workers' civil

rights. a young pitcher on the petaluma baseball team, the one that went to the little league world series three years ago, he's recovering from a frightening atv accident. bradley smith is now 15 years old. he had several surgeries since the all-terrain vehicle accident on saturday. we still don't know what happened. the family friends say his right arm was broken and he suffered serious bleeding. smith was riding the atv with a petaluma high school basketball teammate who performed first had -- first aid and called 911. polio was eradicated back in the 1970s in the u.s. but a doctor is raising concern. that crippling disease could be making a comeback. brian flores is in san rafael this morning with the details on, brian, why the doctor is saying this. >> reporter: hi, dave. good morning. there's concern this morning from the public health officer here at marin county. he says he's concerned that

there were several different factors that could lead to a resurgence of polio, something we haven't seen in the country for 40 years. the reason why this concern is because of what he has seen from the recent measles outbreak. now, dr. willis says because of that, he's urging people to get the polio vaccine even though it has not been seen in the country for years. it can be fatal or leave a person paralyzed. an estimated 35,000 a year got polios from the 1930s to the '50s. it got close to 50,000 in the 1950s as well. but in 1979, the u.s. declared the disease eradicated because of the vaccine but, again, with the recent cases of measles, dr. willis is concerned the same can happen with polio. now, he tells the marin independent journal --

>> reporter: now, also in the article, it talks about how fewer than half of marin schools are vaccinated against polio. these are the percentages of kids who are not fully vaccinated against polio. it doesn't mention kids who are partially vaccinated. new village school, 65%. bolinas, 64%. san geranimo, 63%. greenwood, 61% and 52%, marin waldorf school. it's transferred through things like cups, even being in the same swimming pool. >> very interesting. thank you. a california congressman wants an investigation into what the fda is doing to prevent another infection of the superbug. ted lui wants the house committee to oversees the fda

to hold a hearing. last week, the fda issued an alert after seven paints at the ucla medical center became infected with antibiotic resistant bacteria. two people died. the infection was linked to contam named scopes -- contaminated scopes. the fda has acknowledged they are really difficult to clean but says pulling the devices would prevent people from getting life-ive sa -- life- saving procedures. a dog refuses to leave the side of her dead pup. in 20 minutes, what's we being -- being done. but first, a police sergeant speaks out defiantly after being corruption charges.

7:14. veterans affairs secretary robert mcdonald is apologizing for misrepresenting his military record falsely stating he served in the special forces. he made the inaccurate claim while speaking with a homeless veteran in los angeles. he's an army veteran who completed ranger training but never served in any special operations unit. he took over control of the troubled veterans affairs department last year. he says he never intended to misrepresent his military service. the white house says it takes him at his word and expects the incident will not impact the

important work he's doing at the v.a. a former san francisco police sergeant emerged from court defiant and angry after he was sentenced to prison on corruption charges. yesterday, a federal judge sentenced him to 41 months in prison, the maximum sentence possible. the judge said he violated the public's trust. the 48-year-old sfpd veteran was convicted of stealing money and property from drug dealers. the investigation grew out of the 2011 release of these surveillance videos showing plain-clothes officers raiding single-occupancy hotel rooms. he said he was framed and his only regret is he did not testify in his own defense. >> i was papa bear. i rocked. i made it happen. i made everything happen. we caught everybody. >> he and robles were convicted in part because of the

testimony of another officer. he's supposed to surrender on or before april 3rd. 7:16. firefighters in stockton want to know why the girlfriend of one of the bank of the west armed robbers was approved to ride along with a city fire crew for a day. firefighters say last month anjelica shad deed them for a day -- shadowed them for a day. she said toward the end of the shift, she mentioned her boyfriend was a man who died in a fatal shootout with police. firefighters want to know how she was approved by the city for a ride along in the first plate. on her background check, she listed a member of her boyfriend's family as machine contact. >> they will be in people's homes, observing what we do. we need to make sure citizens are safe and firefighters are safe also. >> stockton police say she has a record for loitering with the intent of prostitution.

dates back to 2006. she tells reporters she's a certified emt. she's going to school in san francisco and says she needed the ride along hours for a paramedics program. stockton's fire chief says now that he knows about her connection to that robbery case, he is sore i have she was approved for that -- sorry she was approved for the ride along. 7:18. sal's been pretty busy. been following quite a few things for us in traffic. how is it going? >> it's a little bit slow, tori, dave. approaching the bay bridge, it's kind of unusual because we had a slowdown -- slowdowns that are pretty deep in some areas. for example, here on 80. you can see how slow it is coming around the berkeley curve and heading out to the bay bridge. when up get to the toll plaza -- let's go to the the toll plaza picture. 880, if you are coming in using fastrack is not that bad. as a matter of fact, that can be kind of a little bit of a shortcut for you if you get on 880 and you have a fastrack

transponder. you will bypass a good section of this backup and it's worth mentioning. let's talk about contra costa county. you are driving in concord, it's slow on 24 and 680 as usual to highway 24. not too bad. 508 is finally improving. we had several accidents out here as you drive through the area. they are still on the shoulder but traffic is better as it gets into livermore. still very slow out of pleasanton on 680 and then, of course, 85, 280 and 101 have filled in. 101 had a couple of earlier problems. now it's just mostly slow traffic heading up to sunnyvale and cupertino. today's weather, off to a cold start, steve. that's correct, sir. a lot of 30s coming in on crystal clear skies. even 40s, 30s around the bay. mainly 40s. a couple of reports coming in from napa. napa airport, 30 degrees. a little northwest breeze puts the wind chill at 26 although paul watts who spw at highway 29 says i'm only 33.

i know kathy -- think you are north napa said 37. there is a bunch of 30s. i went with the coldest one. napa airport. i know there is a difference between that one. there was, though, a couple of reports of some upper 20s up towards st. helena and calistoga. we'll go for a high of 66. also some 20s into mendocino county. leggette. 64 for a high. everyone will be close on the highs. it's 9 in truckee. sought lake tahoe, 17. blue canyon at 37. single digits in truckee. it's not been that cold up in the sierra. this morning is cold. the low that gave us the wind an rain -- and rain in southern california is now visiting arizona. flagstaff, more snow for colorado but much quieter for the sierra nevada, central valley and down to los angeles and san diego. 30 at napa. 31 santa rosa. 30s for fair field.

we're officially 50 weeks away from super bowl 50. the search for thousands of volunteers just about to get underway. organizers need almost 10,000 people to help with the events leading up to the super bowl. they are recruiting people to help the more than 1 million visitors to attend events all over the the bay area -- over the bay area. >> the idea, we'll have local bay area natives help people navigate their way through, say, the airports or downtown san francisco or downtown san jose and basically be good

ambassadors for this region. >> in return, they say volunteers will get a special uniform and get to spend time in the middle of the action. they will be able to attend special events. but one of the things that does not come with the job is a free ticket to the big game. >> still sounds exciting. outside land and the bottle rock festival are two events you know about. now a third one may be coming soon. it's being proposed at sonoma raceway for the summer of 2015. the organizers are seeking permission to bring in 55,000 people a day for the music festival and allowing 6,000 of those guests to camp out on site. >> the music festival would be on the scale of nascar. very heavy emphasis of camping and had people stay on site and stay at the erent for multiple -- event for multiple days.

7:30. we're continuing to follow breaking news in oxnard. at least one person may have died and 30 others may be injured after a commuter train hit a truck on the tracks and

has derailed. three cars have ended up on their side. but fire officials tell an l.a. station that so far only the fatality is inside the truck hit by the train. you can see some cars on their side. a triage area is set up near the crash site where first responders are separating people based on the severity of their injuries. metro link's website says the train was on a run from ventura county to los angeles. i want to show you a map of where the crash happened. oxnard is along the southern california coast between santa barbara and los angeles. we'll continue to follow this story and bring you the latest information as it becomes available. welcome back to "mornings on 2." it's tuesday, february 24th. i'm tori campbell. >> i'm dave clark. we're also checking your weather and traffic. outside our door, it is sunny and it is cold. >> it is cold. >> yeah. >> i mean, lows have been very mild. but that system that didn't give us much in the way of any clouds, but gave us a lot of

wind and colder temperatures has moved off. what's significant about the 48 in san francisco, that's the first temperature below 50 this month. normal or average low is 48. so if you think it's cool, it is this morning. 58. we'll go for a high of 64 degrees. oakland starting off even cooler than that at 44. we'll go for a high of 6 a. everyone will be close about 64, 66. there is goes the low. northern arizona on its way to new mexico. you see some of that snow in advance of it. for us, pressure gradients are relaxing. that allows temperatures to take a drop. 30 at napa airport. a few 20s to the north. but a lot of 40s here including napa downtown, 37 degrees. 35 winder, 32 sebastopol and down to the south. 30s for many. but a lot of 40s. pittsburg, antioch an brentwood.

peninsula, woodside, the coldest at 32. menlo park, palo alto at 34. a little hint of a breeze. there is not enough but enough to keep the temperature up. it will be sunny. we'll have a cold morning. highs today will be in the 60s. it's a quiet pattern until friday. more on that in tent minutes -- ten minutes. here's sal. we don't have a quiet pattern on the roads. let's go right to the bay bridge toll plaza, we've had a lot of slow traffic there cueing up to get in the bay bridge. however, if you are driving on 880 you can save yourself time by using the 880 approaches. you have fast track. that's great news. you can bypass a lot of the slow traffic here at the toll plaza. also looking at 880, speaking of which, still not a big slowdown past the coliseum as you drive through. the traffic has been okay. we keep looking at contra costa county because it gets -- it is getting slower on westbound highway 4 and also on southbound 680 and 242. 580 is recovering after early

crashes still kind of low in the livermore valley. then 101 and 85 are the slowest. 28 is slow. we had earlier accidents to blame but right now its just slow traffic in the san jose area. 7:33. back to the desk. thank you. tori, it's hard to believe it's been exactly six months ago today that that big earthquake hit napa in the wine country. it was the biggest quake to hit the bay area since the 1989 loma prieta quake. >> 200 people were hurt. one person died from injuries suffered during that quake. hundreds of home, government offices and buildings were damaged or destroyed in the quake that was centered south of napa. >> well, ktvu fox 2 reporter, tara moriarty, is in napa this morning, and you are saying the recovery is slower in some places, including a major grocery store. >> reporter: yes. we're here at the safeway store on the corner of jefferson and clay. it was supposed to reopen in december. but as you can see, it's still

closed. a lot of people wonder what's going on. >> the building owner, no word from them. you can see all of the food has been moved out and the official estimate for damages throughout the city was $442 million. but a risk management company says that number is really twice that. now, many small business owners say that disaster relief was not enough to recover losses. overall, city leaders say they've seen progress. we spoke to one business owner who lost $38,000 in inventory inside her store. she was able to secure disaster relef but others -- relief but others have not been so lucky. >> we noticed the building was covered in a facade. the side was falling apart during the quake. some other places have been repaired. it's recovering slowly physically but there's recovery. i've heard the relief has been coming slowly and selectively. >> reporter: the city has lost

tax money because some hotels, restaurants and other businesses were badly damaged. the country that owns napa self- storage is about to demolish the red tagged building with all of the contents inside. that's unless the tenants agree to pay for the repair costs. tenants are arguing why should they have to pay since the company doesn't have insurance. most will tell you, napa is well on its way to being back to what it once was. back to you. >> thank you. there is another story to tell you about. nicholas dylan, he was severely hurt during the shake. the chimney at his house collapses -- collapsed on him. he had a broken pelvis. the doctor expected it to take six months for him to walk again. he surprised them. he's practicing soccer already. nicholas says he's not ready to rejoin his team yet. he just doesn't have the stamina. but he says surviving the quake, it's changed him.

now he appreciates every day he's alive. some san francisco crosswalks are about to a get a bold new look to make is safer for people to cross the street. instead of the standard two white lines, crosswalks across the city will be zebra striped with bolder white lines similar to these which are used near schools and at midblock crossings. city trancy officials say the bolder stripes make the crosswalks more visible. this is part of a change to end fatalities by 2024. a 9-year-old boy in antioch was airlifted to the hospital last night after a firecracker exploded in his hand. it happened around 5:30. according to the contra costa times, the boy was at home with two siblings also under 13 years old. there was no adult supervision when the explosion happened. neighbors called for help. the boy was last listed in stable condition. the incident is under

investigation. a woman from san jose expected to be arraigned today in the killing of a man inside his home in gilroy. police arrested 19-year-old gabriella ortiz after getting several tips. she's been lived to the killing of 56-year-old robber hizer. he was found dead in his home on february 16th. d.c.s say a few hours later ortiz and -- detectives say a few hours later, ortiz and others were seen on surveillance video using the man's credit card. police also say she may be linked to similar crimes in more bay area cities. they are still searching for the second woman seen in the video. well, a very disturbing case of animal cruelty in santa cruz county. someone stuffed two dogs inside of sandbags and threw them out of the window of a moving car. the sand backs contained a -- sandbags contained a mother dog and her puppy. the mother cause was able to dhu her way through the bags. when animal got there, the

puppy had already died. the mother refused to leave the sides of the pickup -- the side of the puppy. this happened in watsonville on friday. if you have any information on who may have done this, call the santa cruz county animal shelter. it's dpectsed to be business as usual at the port of oakland all day. itit's been month since the port has been at full staffing. >> i worked more in the last few days than i have in the last few months. >> today was relatively smooth. able to get in and out without any problems. >> even though workers are back on the job, it could take as long as two months to clear the docks of all of the containers waiting document loaded and -- to be loaded and unloaded and it could take just as long to get the deal approved by union members and signed by everyone involved. your time, 7:39.

former santa clara county supervisor george shirakawa changed his play in the mail fraud case. now he's entered a no contest plea. his trial was scheduled to start. his lawyer is asking that he be served to community service. he was already sentenced to a year in jail for stealing $130,000 in campaign donations and public money to finance a gambling habit. hillary clinton will be among today's featured speakers at a silicon valley conference for women. she will be one of the keynote luncheon speakers at the lead- on water mark silicon valley conference for women. this conference raises awareness about the earning power and pope tension as well as opportunities in the fields of science and technology. it also highlights the ground breaking women leading the way.

senate majority leader mitch mcconnep said he's willing -- mcconnell said he's willing to separate a bill blocking president's order from a bill to fund the homeland security department. >> it's another way to get the senate undocument from a democratic filibuster and move the debate forward. >> he says he hopes that a clean bill separating the two issues will pass to fund the department of homeland security before a friday deadline. president obama speaking at a gathering of governors says it's the homeland security workers who will be affected. >> unless congress acts, one week from now, more than 100,000 employees border patrol, port inspectors, tsa agents will show up to work without getting paid. >> because about 85% of homeland security employees are deemed essential, they would still have to show up for work even though they wouldn't get paid until after an agreement is reached. well, you live in a city,

we'll start off with san jose first. start off in the silicon valley and northbound 101 as you drive up to interstate 880, it's getting better. but still a little bit slow hon 101. 2480 and 85. i can show you the map in the south bay. it's slow due to earlier accidents. we had a lot of fender-benders in the area. 5 80 is recovering. at least it's getting better. 608 is very from concord all the way down into danville this morning which is unfortunately kind of the normal morning commute. let's go to the bay bridge toll plaza where that's backed up 15, 20 minutes. we've seen some improvement. if you are driving in on 880 and you have fastrack, that's a good way to bypass a lot of that slow traffic. back to the desk. breaking news in sunnyvale where a person has die in a house fire. the two-alarm fire was called

in about 5:00 this morning at a home on fisher hawk drive. the home is now surrounded by crime tape. that's where janine de la vega is live. what are you learning? >> yeah. this is very sad news. we just spoke to the officer with the department of public safety here and he did tell us that the body was found in the back of the house in the home you see behind me. it's in a neighborhood tucked away near fremont and wolfe road. that's all of the information. they wouldn't say if it was a man or a woman but as soon as the neighbors standing around here heard that they all just shook will head. they do tell meal that the person who lives here is an elderly man in his late 70s, possibly early 80s, although, police have not confirmed that it is the resident who actually lives here. let's go to video we shot earlier where you can see the

smoke and some flames that were coming from this house at about 5:30 this morning. it was called in, not from somebody who was inside this house but somebody who was patting by and it took -- passing by and it took firefighters about an hour to get it under control. it was fully engulfed in flames. they had to go into a defensive mode to put out the fire. even though at this hour, we could still see there is some black smoke that's coming and rising from the roof here. it's completely collapsed. it was a twof story house. if you take a look -- look in there, it's devastating. there is a car. the frame of the house is a bunch of debris and rubble. again, a body was found in the back of the house. they are not saying if it was a man or a woman but when -- but when our crew first arrived,

they did say there was a man unaccounted for who lives here. wee were gonna stay -- we were two na stay on top of this. nobody has been identified yet. this is all fresh and unfolding in front of us. >> thank you, janine. we continue to follow breaking news from oxnard, near los angeles. at least 30 people are believed injured after a commuter train hit a truck this morning on the tracks and three train cars ended up on their side as you can see in these live pictures. that's one of the train cars just on its side there. officials on the scene just said there are no fatalities. yerl yerl -- earlier, a tv station was saying there was one. there are reports the truck driver left the scene but was later taken into custody. metro link's website says the train was en route from ventura county to los angeles. more live pictures here from the ground and from the air. different perspectives for you. again this is a story we'll continue to follow throughout

the day here on ktvu fox 2. also caltrain is back on its regular schedule this morning after two separate deaths along the tracks. at 9:00 last night, a man inside a caltrain tunnel in san francisco that was near 18th street and interstate 80s what hit and killed by a -- 80 was hit and killed. earlier a woman in her car who likely got stuck on the tracks was killed at the ravenswood avenue crossing. the impact sent her car 40 feet. she was taken to stanford hospital where she died. caltrain said she likely got stuck on the tracks because of traffic ahead of her. >> sometimes at peak commute hours, traffic will back up across the railroad tracks. that's what happened. somebody stopped on the trucks. >> caltrain is below minder drivers -- is reminding drivers never to cross the tracks

unless you are sure you can make it across. it can typically take five, six miles for a train to come to a complete stop. the accident shut down the service for the start of the evening commute, delaying passengers up and down the peninsula. 8:06. well, a national conference at uc berke lip -- berkeley on sexual assault, it's coming with controversy. it's one of the offices being investigated for the civil rights for handling sexual assault cases. it was prompted by a complaint last year by students who say the college failed to adequately protect students from an assault. tomorrow, some students plan a protest. they say uc berkeley should fix its own problem before presenting itself as a leader in the campus against sexual assaults. the number of those reporting section supe crimes in u.s. santa cruz has tripled since 2011. the campus has increased its

crippling new disease. brian flores has more on why the doctor is so worried. good morning, brian. >> reporter: good morning. the doctor that we're talking about is the public health officer for marin county. he tells the independent journal there are several factors that could lead to a resurgence in polio. now, doctor mathew willis says because of that he's urging people and kid to get the polio vaccine even though as you mentioned, it has not been seen in this country for years. polio currently present in nine countries worldwide can be fatal or leave a personal paralyzed. an estimated 35,000 a year got polio from the 1940s to '50s. in 1979, the u.s. declared the disease eradicated because of the vaccine. but with the recent cases of measles, dr. willis also concerned the same can happen with polio. he tells the independent journal we have a lot of families that enjoy

international travel combined with a relatively high rate of people who are unvaccinated for diseases that are endemic in other parts of the world. he says that's a dangerous combination. we spoke with people here in marin county, a woman remembers what it was like before the vaccine. she says her good friend has polio to this day. >> he got it when he was really little, came home from school one day and just dropped. he was paralyzed and he still is. he's on crutches and -- all of his life. it's a horrible disease. >> i will do my research and look into every fact i can before i do anything for my daughter. my daughter is the most important thing. i'm gonna do my due diligence to research. once i do the research, i will be able to make a conscious decision. >> you are looking at the percentages of kid who are not fully vaccinated. new village school at 65%.

-- motion picture academy is responding to criticism for leaven joan rivers out. many noticed she was not listed in the memorial segment. the academy said she's among many worthy artists and filmmakers we were unfortunately able to feature. the statement she's included in an online gallery. she appeared in a number of galleries and was well-known for her red carpet fashion critiques. a judge says chris christie broke his own law when he cut more than a billion dollars out of a state pension payment this year. the ruling came after a group of public workers unions sued to stop governor christie from slashing their retirement fund. the judge said he has to work with state lawmakers to try to find a way to restore that money by june 30th. governor christie said he will appeal the judge's ruling.

well, the united states now has its first special envoy for lgbt rights. the state department named randy barry to that post. now, he will promote and defend the rights of lgbt people all over the world. state department says he will work to reduce violence against lgbt people including in the 75 countries where same-sex relationships are crimes. starting today, recreational use of marijuana is legal in alaska. but when voters approved the law back in november, it said use must be only in private. that vague language has some people kind of confused about what is considered a private place. violaters can be hit with a $100 fine. alaska's board that governs alcohol will need to meet to make the details more clear.

sunshine and a little bit warmer temps. today right about where we should be. anything new? >> we're seeing some improvement in the morning commute. the traffic in some commutes is markedly better than it was a half-hour ago. 880, it's slow past the coliseum heading north on the right there. southbound is a little bit slow heading down to hayward. i want to show you what happens when you get to the bay bridge toll plaza. that is much better. in fact, the 880 approach has been stellar all morning long especially if you have fastrack, you can get right through. but not that great on 880 heading south out of san leandro, hayward. all the way down to fremont. look at all of the road sensors and this backup extend all the way down to highway 237. when you get to the south bay, there's still plenty of slow traffic there. some commutes have improved. others are right in the middle of what is a busy time.

recovered but ktvu's tara moriarty, who is live in napa right now in the area, you say the fate of one major business in town, still in limbo. >> reporter: no sign of what lies ahead for the safeway store on clay and jefferson. it was supposed to reopen in december but no announcement from safeway corporate. you can see that all of the food has been moved out here. many small business owners say that disaster relief was not enough to cover the lots. they've been slow to bounce back. overall, city leaders say they've seen progress. we spoke to one business owner who lost $38,000 in inventory inside her store. she was able to secure some disaster relief but others haven't been so lucky. >> physically recovering. this building used to be covered in a facade. the side was falling apart during the quake and some of the other plates down the street -- places down the street have been repaired. it's recovering slowly. but there's recovery. from what i heard, the relief

is coming slowly and very selectively. >> reporter: the city has lost tax money because some other businesses were badly damaged. the company that owns napa self- storage is about to defollowish the red-tagged building with all of the contents inside. that is unless 70% of the tenants agree to pay for the costs. tenants are arguing why they should have to pay since the company doesn't have insurance. the initial estimate throughout the city was $442 million. but a risk management says the number is twice that. so residents say they still have a long way to go. live in napa, tara moriarty, back to you. >> thank you. it's expected to be business as usual at the port of oakland all day today. it was an uneventful night shift at the port which is a good thing for shippers, for the workers out there and for the truck drivers who go in and out of the port. it's been months since the port has been at full staffing on the night and weekend shifts.
