attention because of the hollywood movie. but in the end it came to weather the jury believed that routh killed kyle and his friend. prosecutors did not seek the death penalty. eddy ray routh admitted to killing kyle and chad littlefield. routh shot and killed the men at a shooting range south of dallas a year ago. but the 27-year-old pled not guilty by reason of insanity. routh a former marine corporal who served in iraq was suffering from psychosis an argument the jury did not buy. after the verdict, littlefield's mother was emotional. >> we just want to say that

a police investigation. >> reporter: prosecutors say routh was drinking and smoking during the morning of the crime. >> amber lee in the newsroom tonight. amber, thank you. more developing news, there's late word that southwest airline is grounding planes. southwest is saying they grounded 126 planes after they found they had missed inspections. 90 flights have already been cancelled including flights here in the bay area. inspections are expected to be completed over the next few days. thousands of federal workers including airport security screenings, border patrol agents and others can soon be required to work without pay. right now the department of homeland security is only funded through friday and congress is at an impasse.

jana katsuyama live now at oakland airport with what's at stake and one concession offered today, jana. >> reporter: julie, as you mentioned the tsa agents who work here at the oakland international airport are among those homeland security employees considered essential therefore they have to work without pay but the union leaders tell me that all of this is causing a lot of anxiety. homeland security employees are still feeling the sting of the government shutdown in 2013 when they worked without pay for three weeks. >> they're telling you your job is essential, you have to go to work but you're not important to be paid. >> reporter: tsa officers, border patrol officers and i.c.e. agents would be affected by a shutdown if congress does not pass a bill on time. the republican led house already passed one bill.

senate democrats well in the minority refused to pass a similar bill. instead of an 11th hour budget, they called for a meeting. >> to advance the consideration of a clean dhs bill. >> the senate republicans really worry about losing their majority in the next election. they have a pretty small majority and a bunch of republican senators are running in states for reelection where the states may well vote democratic for president so they face tough races. >> reporter: erik schikler says even though the house approves a bill, the senate should still agree. >> i think there's reluctance to let this drag out like it

did a year and a half ago. >> reporter: there's a sense this could happen again. that is because it would only fund homeland security through september. new at 10:00, a deadly accident involve ago bike rider. she was killed late this afternoon in oakland after a collision with a truck. it happened around 4:30 this afternoon in east oakland at san leandro and prune streets near 98 avenue. officers arrived at the scene and found the woman suffering from mayor injuries she was pronounced dead at the scene. they say she was in her 30s or 40s. the driver of the truck is cooperating with investigators? the wife of a truck driver arrested today following a train derailment says the collision wasn't her husband's fault. police in oxnard say the 54- year-old truck driver took a wrong turn on to the tracks and then abandoned his truck. his wife says the truck stalled and he jumped out before the collision. the impact derailed the five

car metro link train. at least 28 people were hospitalized including four in critical condition. the arizona truck driver is now charged with felony hit-and- run. he was found about a mile and a half away from the scene. here in the bay area, caltrain has released the name of a woman killed in menlo park last night. when her suv was hit by a train. she's identified as 35-year-old jennifer jayane of east palo alto. witnesses say her suv was boxed in by traffic at thewoodland's traffic. the collision is raising new questions about the collisions between traffic and trains. cara liu is live with that story. >> reporter: great separation as you see here at university avenue in palo alto where traffic crosses below the train tracks is not only expensive, the design, engineering and construction can also take years. caltrain says it's one of the

best ways to increase safety. monday's fatal crash between caltrain number 360 and a car at the ravens wood crossing has many calling for increased safety measures. >> i hope something gets done fast because this is a major, major loss. >> reporter: joey davey was working when he heard the crash. >> it was just a pretty traumatized type of experience for a lot of people. it didn't even look like a car. it looked like it was just metal pieces everywhere. >> reporter: caltrain reminded everyone tonight that trains travel up to 79 miles per hour. >> so no one should ever be on the tracks stopped in their vehicles. you should never pull on to the tracks unless you can safely cross to the other side. >> reporter: caltrain says grade separations where traffic crosses above or below the tracks is the best way to prevent accidents. >> any time a pedestrian or vehicle has to cross the tracks there's a safety concern.

tonight. cara, thank you. villaraigosa says he was encouraged to run but in the end decided against doing so. this clears the way for attorney general camala harris. she is the front runner right now. villaraigosa announced his decision on twitter. he said i've decided not to run for u.s. senate. my heart and family are in california, but our work is not done. and neither am i. this comes as the former chairman of the state republican party tom devocaro has formed a committee and may run for the senate. he's never run for elected office before. the arch bishop of san francisco says he plans to add explanations and clarifications to a morality clause for teachers at the diocese four high schools but he's not changing any language as reported earlier today. arch bishop cortilioni stirred.

to change. so, that's always difficult. >> reporter: but slowly one by one almost all of the 51 reform mandates have been met. one was to require officers to wear body cameras. the department says that video more often than not clears officers accused of wrong doing. fbi crime statistics show over all crime in oakland is down. and so are rights attorney shannon says so are complaints of officer misduct. >> this proves to me this wasn't some liberal fantasy or buy in the sky dream but something that you could really do in a police department of the united states in the 21st century. >> reporter: opd also changed it foot pursuit. that leads to fewer injuries to suspects and officers and fewer lawsuits. >> the number of complaints we get leading to any kind of lawsuit is way down. >> in the ends of this with what the city gets is a police

president obama today vetoed republican back legislation that would approve the keystone pipeline. the pipeline would carry oil from canada to u.s. refineries on the gulf coast. republicans planning to try to override the veto next week but it's going to be very difficult because they would need a 2/3 majority in both chambers to do that. a woman who was struck and killed bid a car in sunny vale on sunday has been identified as a 56-year-old san francisco woman. police say michelle devours and her 27-year-old daughter were walking the younger woman's dog when they were hit by a ford focus. devours daughter was hospitalized in critical condition. the driver is cooperating with the investigation. and it could be days before

investigators determine the cause of a fire. they found a body toward the back of the house. neighbors say an elderly man lived there. california's ban on plastic bags is now on hold after a referendum qualified for the november 2016 ballot. the bag ban was supposed to go into effect this year but now it's only old. opponents argue that the ban would cost manufacturing jobs but supporters say it would help protect marine wildlife and cut down on litter. >> raiders fans gather tonight to brainstorm ways to keep their team from moving to southern california. the group met in san leandro. i talked about ways to convince the team to stay in oakland.

vehicles through the internet prevents tesla cars from becoming obsolete. a fundraiser was held today for friends of faith which is a cause close to our heart. nellie's held a fundraiser to raise money for low income patients. faith herself battled breast cancer for six years. she died 12 years ago. while she was sick she inspired a lot of people to get checked for breast cancer and more than a few of them thanked her for saving their lives. and around here we have no rain to speak of. we've got dry conditions. take a look at the percents of average though and you can see they're dropping off. 88% of average in santa rosa. that's down last week. and san francisco just down to 93. san jose 111%. it's pretty impressive that we have that high percentage of average based on how few storms
