plaza but the lights are on. 101 san francisco looks good, southbound 280 at 101, clearing an accident. traffic will be busy as you drive through on 101 southbound out of san francisco. now let's go back to the desk. it is the first homicide in hercules in almost 2 and a half years and right now the police are busy going through evidence. they want the know what happened out there. one man was killed and a woman was critically injured. >> reporter: there was a trail of blood, black cap and ripped screen door, all clues that neighbors believe point to a home invasion robbery. the 911 call came in around 2:45 p.m. yesterday. neighbors said two men were

fighting outside the home and one appeared to be choking the other. police arrived and saw the blood, and found a woman alive but critically hurt inside the front door of the house. inside the garage, they found the body of leroy sandoval, who bought this house 15 years ago and lived here with his girlfriend. the back screen door appeared to have been ripped open according to neighbors. >> normally it's not like that. so probably somebody broke in. he comes home at different times. there's no schedule. >> reporter: police found a black hat nearby and arrested a suspect a few blocks away. later this morning police should be releasing more details. three men are under arrest this morning, accused of holding a woman hostage inside

a santa rosa home and sexually assaulting her. alex savage is in santa rosa with all the disturbing details about this case. >> reporter: a girlfriend of one of the three men in this case says the victim made up the story entirely. she said that woman was never held against her will. authorities say she was held captive inside this home for nearly two months here, according to investigators. a woman who just came out and spoke with us told us that story is made up. she believes the victim made that story up. authorities say the 22-year-old woman was held at that rural property on stony point road. authorities say the homeowner in this case was the mastermind

behind the crimes. three men were arrested yesterday when they showed up at the sheriff's office to get property that was taken during a search of the home last week. that's when deputies took them into custody. we spoke a few minutes ago with the girlfriend of one of those three men. she didn't want to show her face. >> you're saying she made this story up? >> everything. i met her months ago but i didn't know her by the name she's going by. i know her by a different name. she's my facebook friend. >> was she ever at this house? >> she lived here. she moved in before christmas. >> reporter: again, that woman we spoke with is adamant that the victim in this case was staying here of her own free will, that she was the girlfriend or had a relationship with the homeowner here who also is married, according to the woman we spoke

with this morning. he's being held on suspicion of rape with bail at $6 million. the two other men in custody are accused of guarding the victim and prevents ing her from leaving the house. they are all three scheduled to be in court tomorrow morning. time now 6:07. we have new details on the high speed chase and crash in martinez we told you about yesterday. five people were in the car, scattered into a neighborhood near 680. all five were arrested. the chase started early yesterday morning in sacramento. investigators say the suspects may be tied to a smash and grab robbery of a jewelry store in colorado. police found several weapons and a significant amount of

stolen property in that car. new this morning, there are reports one of the main isis fighters that we have seen on videos has been identified. the bbc is reporting his name is mohamed amwazi, born in kuwait an grew up in london, believed to be about 27 years old and a college graduate with a degree in computer programming. he's seen on videos beheading at least five western hostages. we are learning more this morning about the arrest of three new york men who planned to leave the u.s. to join the terror group in syria. they were living in brooklyn. one was arrested as he tried to board a new york flight bound for turkey. he appeared in court yesterday along with another plan who planned to travel to the middle east next month. they had a backup plan as well.

>> if they were not able to go, that they would seek to acquire weapons here, handguns, machine guns, and seek to attack very specifically police officers. >> a third man was arrested in florida and is accused of helping fund the operation. one of the men drew the attention of federal agents when he posted messages on a website stating his desire to join isis and talked of killing president obama or planting a bomb at coney island. congress has till tomorrow to extend the funding for homeland security. republicans agreed to hold a vote on the clean bill without any provisions on the immigration reform. the hangup is now in the house. it passed the localland funding measure with the provisions to block the president's actions.

the next move is up to speaker boehner. >> i don't know what the senate is capable of passing. until i see what they're going to pass, no decision has been made on the house side. >> the department of homeland security is preparing for a partial shutdown. about 20,000 employees would be furloughed but the vast majority deemed essential to protecting the nation would have to keep working without pay. sounds like a no-call list for your house. san carlos passed an ordinance that bans people from dropping off flyers or literature at homes there or face fines. the daily news says they can sign up for a registry to keep people from leaving materials. the u.s. mail and nonprofit organizations are exempt. time is 6:10.

san francisco's alders police officer a retiring after more than 50 years on the job. the one thing he did every day when he went to work. >> looking at the east bay commute, slowing down coming out of pittsburgh and getting to concord. we'll look at the commute straight ahead. >> not much in the way of fog yet. there's a little patchy fog out there and mostly clear skies with warm temperatures. this will be it for the warm.

welcome back. the secret service wants your help finding counterfeit money, a growing problem for bay area businesses. the secret service says counterfeit bills are very sophisticated and a lot of store owners are victimized. they are targeted when they are the busiest and don't have time to check the money. the fake billings are hard to spot. >> they basically bleach off a $5 bill and digitally enhance a $100 face plate on this. >> according to the secret service, only 1/100 of 1% of u.s. currency is counterfeit but when this doubt, store clerks should check the bills and compare them to a real bill. a new twist in gift card theft. the scheme was uncovered when

authorities busted a couple in northern california. investigators say they stole gift cards from stores then removed the security strips covering the pin numbers. they then reapplied the security strips after writing down the pin numbers. then they returned the cards to the store where shoppers bought them. the thieves could then check online to see when they were activated and use them to make purchases. >> we are still in the wild west of cyber crime. we are just grateful that we gained some expertise, stopped a lot of people from losing a christmas. >> deputies seized hundreds of cards from the couple and they both pled no contest.

this is an $800,000 truck that can reach up to 7 stories high and it's the department's first new truck in 25 years for piedmont. firefighters say it has a lot more safety features, including guardrails that are a foot and a half tall. they were only 4 inches tall in the old truck. >> it was our turn. we have three-point seat belts, which are new, air bags, which are new. >> they say there are wildfires an plenty of hills there and say they will share the truck with nearby fire departments including berkeley, albany and oakland. all the department's 24 firefighters will be trained on how to operate this new truck and it's expected to be in service in a couple weeks. san francisco's oldest police officer is retiring

after more than 50 years on the job. fellow officers held a surprise party for 78-year-old mark deangelo, known for bringing two sandwiches to work. one for him, the other for a homeless person. he started his law enforcement career in 1960. >> i always thank god, keep myself in pretty good shape. do i look like i'm 78? >> he's money. he's great. >> the officer says one of the first things he'll do in retirement is take his wife on a cruise. >> he's the man. that's a great story.

right now we are looking at the bay bridge. we'll start with the macarthur. we'll start with highway 4 actually. i like to keep traffic promises. this is highway 4 westbound. traffic is moving along a little slowly. it is slow in pay point as you drive through. 680 nearby still looks okay from concord to walnut creek, then when you get to the bay bridge toll plaza, about a 20 minute delay before you get on to the span. no major problems driving through. we have had an accident

southbound 880 and southbound traffic already slow from at least highway 92. looks like it will start blending with the backup from 238. off to a bad start to this commute so give yourself extra time. this is highway 101 and it's still looking good. slowing on southbound 101, though. let's go to steve. we have high clouds moving over and it will be another nice warm day, compared to the rest of the country that won't stop. mostly sunny for us, but this will be the last time we are warm for a while. we'll get scattered showers and cooler, more of an event for the sierra than for us. some rain on the weekend and we

are rounding third and heading for home for february. we started off great, two good systems then after that, nothing nothing. looks like a colder, breezy pattern. today starting off at 52, 67 for the high. 25 in tahoe and there will be big changes starting friday and up into saturday. down towards southern california, 44 in blue canyon tomorrow. right now a lot of high clouds cruising on by. the higher elevations, some are near 60 degrees. 9

below in bismarck, 1 below in minneapolis for the temperature. wind chill, 19 below omaha, 0 in chicago, green bay 25 below, and denver is getting snow, from the carolinas and all the way up to maine. some even coming through the great lakes. for us, everything starts to dive down through the northwest. everything has been coming in from the west or southwest. this won't give us much rain but it will give us colder temps and snow in the sierra. temperatures above average here but that will change starting tomorrow as the next system stops in. temperatures are going to take a plunge and there's some rain

to die law in california. she took her message to a class at uc berkeley. jennifer glass has been fighting lung cancer for two years and urged them to tell california lawmakers to pass and aid in dying law. oregon and four other states allow doctors to help terminally ill people end their lives on their own terms. she's hoping sharing her story will motivate people to support that bill. >> i think it's very exciting that it's come this far. i feel very optimistic about the level of support that we've seen. >> the bill is expected to come up for a vote in the state senate in the next couple months. despite objections from

republicans, recreational marijuana use is now legal in washington, d.c. anyone who's 21 years or older can now smoke pot and have up to 2 ounces and grow up to 3 plants. this is the first place east of the mississippi river to legalize marijuana. >> it is a huge deal. it's a fight that's been in progress for a while. >> i want to help and make sure people are legally allowed to do what they can do. >> republican lawmakers threatened to throw officials in jail, arguing the federal government already passed a measure that bans legalizing marijuana in the district of columbia. levi stadium preparing to host the super bowl next. coming up, the next event they have their sights set on. >> and bus drivers who shuttle tech workers have a big

san francisco. we talked about a crash southbound 880 near thornton and traffic is very slow as you drive. it is backed up solid and this is off to a bad. 680 also slow, so this area not off to a stellar start. back to the desk. new questions this morning after three men were arrested and accused of kidnapping a woman and holding her hostage. alex, you spoke with someone who knows one of the suspects? >> reporter: the girlfriend of one of the accused in this case says the victim made up the story. she says the victim was never held against her will.

she says the 22-year-old woman had an ongoing relationship with the homeowner here. but investigators are telling a different story and have arrested three men. they say the woman was held captive inside the home for nearly two months before escaping last week through an open door. detectives say the homeowner here was the mastermind behind this, and he was arrested yesterday along with two other men, accused accomplices. the girlfriend of one of those accomplices says the victim had a relationship with the main suspect, and she doesn't believe he hurt her. >> she bought him valentines balloons and presents for his kids. she was cooking dinner the day before. >> why are you saying she would

make this story up? >> i wish i knew honestly, so i could ask her, because this is hurting a lot of people. >> reporter: the accused mastermind here is held on $6 million bail because he is considered a flight risk. the other two men in custody are accused of guarding the victim and prevents her from preventing her from leaving the house. the woman we spoke with this morning told us that she's reached out to authorities and try and offer them evidence that would show the victim has made up her story. time is now 6:35. investigators want to know whether a 3-week-old baby found

dead died from an accident or foul play. the baby and his mother, samantha green, were reported missing on monday. the mother was found the next day, crying and distraught near a waterway. crews found the baby's body yesterday morning and are now trying to determine the baby's cause of death. people who drive apple and other companies' workers are drawing attention to the issue of pay. >> reporter: teamsters just arrived here with all their signage. they are going to be rallying the bus drivers, a lot of them making under $40,000 a year. the union wants to help them make more. they are encouraging the drivers who pick up and drop off workers from apple and e-

bay and others to vote to join the union. they make about $18 and hour and shuttle around workers who make six figures. the union wants the company to recognize the value of the drivers. the drivers work for compass transportation which contracts with the tech companies. to learn more about how the union will go about this, we have stacy here, a teamsters spokesperson. you guys just struck a deal and represent the drivers shuttling around the facebook employees. is this building momentum? >> absolutely. we run a great campaign with loop transportation, the company that delivers the facebook drivers to and from their job. compass contacted us on the same day that the facebook

drivers voted yes. they were sitting in the wing, waiting to see what happened. we met with them a day later and have had a campaign running with them since then. >> reporter: i know some of the things you were able to get is guaranteed overtime after an 8- hour day, better retirement benefits, and also they are working split shifts where they work in the morning and have a big long break then have to go back to work in the afternoon. is that one of the things you'll be fighting for if they vote to unionize? >> absolutely. the split differential is one of the hugest complaints among the tech drivers. we were able to negotiate a 10% differential for the facebook drivers, which is groundbreaking. they will finally be compensated for their time off. >> reporter: thank you very much. they plan on standing outside

here near the apple headquarters holding up signs and encouraging drivers to vote yes. that vote will take place tomorrow. 6:39 is the time. today the fcc is scheduled to decide if the internet should be regulated like phone companies, voting on net neutrality. the fcc is expected to approve a plan that would prohibit internet providers from slowing down or speeding up plans for certain users. it's only the beginning and whichever way it goes, opponents are expected to appeal in court. >> time is 6:39. president balm is telling immigrants in the u.s. illegally he's confident his executive actions on immigration won't be thrown out by a court. yesterday in miami, he urged

undocumented immigrants to keep planning on eventual relief. a federal judge in texas blocked the president's executive actions that would protect 5 million undocumented immigrants. that was after a 26-state coalition led by the state of texas filed a lawsuit claiming the president overstepped his legal authority. the president also met with steph curry to talk about the initiative. curry takes part in fact nothing but nets campaign. he's donated 3 treated nets to africa for every 3-pointer that he makes. and he makes a lot of them.

the warriors also visited the pentagon and arlington national cemetery. they laid a wreath at the tomb of the unknown soldier. and this trip was especially meaningful for david lee there on the left. his grandfather is buried there. they spent the day in washington after playing the wizards and now they are in cleveland to play the cavaliers tonight. the 49ers will bid to host another major event, the 2018, 2019 or 2020 college football championship game. the cities interested in hosting have until may to bid. the stadium already hosted the pac 12 championship game and of course the sharks game last weekend. preparations are underway to host the super bowl next year.

welcome back. it is 6:45. santa rosa police arrest add man they say used a sticky mouse trap to try and get money of a safe deposit box. security called police after they noticed him acting suspiciously at the exchange bank yesterday morning. police arrested the man and a woman in a nearby car. inside the car police found

more sticky traps and stolen mail. investigators say there have been 15 other similar cases since november. police in danville are warning businesses about several break-ins and the latest one was yesterday. brian, we have new video released by the police they hope will catch these thieves? >> reporter: that is the hope. we are at the cross roads of danville shopping there here with several shops, couple of restaurants here. danville police say the most recent break-ins happened yesterday morning here, two businesses burglarized. police have not said which ones were targeted but say it happened between 3:00 a.m. and 5:00 a.m. tuesday morning, then another one not far from here at a business in the rose garden

shopping center. now to the video just released by danville pd of another break- in at a jamba juice off railroad avenue just after 3:00 in the morning. they broke through the glass door, walked to the cash registers and trying to open them. didn't look like they were successful. so they took the drawers out with them. so far police say no suspect description given by police but they hope the video can bring more light on who the thieves are. it's also unclear how much cash was taken there. police are telling businesses until thieves are caught, remove all the cash from the drawers at the end of business day and leave the cash drawers open to discourage thieves from getting in to steal anything,

there. go outside and take a look at pictures. traffic is busy on i-880. it's not stop and go but it's busy as you drive south. let me tell you something. southbound 880 is a mess from heyward to fremont because of an earlier crash. so this looks good but if you're heading a little farther south, it's been very slow because of earlier problems. let's take a look at the bay bridge toll plaza. it will be backed up with a 20 minute drive all the way out to the bay bridge toll plaza metering lights, which are on. northbound 280 getting slow getting up into the valley, so we have had a lot of slow traffic in the last few minutes. nothing on 280 reported but we

are looking closely to see if anything pops up. we have high clouds and a little patchy fog but it will be mild to warm. beautiful sunrise here, already a couple pictures coming in. very nice here, all showing the higher clouds. mostly sunny, mild and warm, turning cooler as we head into tomorrow. scattered showers for the weekend, and more for the sierra than for us. but a cool, breezy pattern. it was a big system there. really good on the 6th then after that it was it. we'll end the month with a little bit. at least we'll get some rain out of it. higher elevations could get a food of snow but more likely 4 to 8 inches.

today mostly sunny here, 40s on the temps and near 50 degrees. up on some of these temps, 42 with a little fog, everything coming down out of the north. the system is still a day away. starting to turn. when they do that, there's not a lot of moisture with these. but they are colder and will focus energy on the sierras. highs above average for almost everybody here. there will be mountain snow, which is a blessing here. gusts maybe 40 miles an hour in the higher elevations. cloud forecast, not much through friday night. in the sierra, begins to pick up all the way down to san jose. the snow will be on the go in the higher elevations. by saturday night, most of this

welcome back. the former police chief who handled the investigation of jon-benet ramsey says the investigation was botched. in 1996 her mother called 911 to say her daughter was missing and a note was found. the former chief said there was a lot of confusion at the scene and he was short staffed because it was a holiday. he also said the district attorney's office interfered in the investigation. no one has been prosecuted in that case. uc berkeley researchers say they have evidence showing human behavior is harming the environment. experts say we have known there was a cause and effect but this study is the first time anyone successfully recorded carbon dioxide's effects on global warming. the study found the emissions

can block the earth from reflecting the sun's radiant energy, in the process raise the planet's temperatures. time 6:56. a strike is threatening the upcoming season for a youth baseball league. they play the games on fields owned by the oil company that's locked off the area. they say it's because of safety concerns that the kids would have to go across picket lines in an ongoing labor dispute. the 12 teams are now sharing one field four miles away in concord. >> there's no safety hazard. the picketers are nowhere near the fields. they are using our children as a pawn in the game. >> my team is 7 to 8-year- oldings. to not have a backstop, i can't pitch to kids, we can't do grounders. >> they say the fields will open when the strike is over.
