with paint and hate. >> i looked out and thought, what is that on her car. i walked over there and oh man. >> reporter: the car's owner is a single mom with a young daughter. >> we talked to the neighbor and she came out and started crying. i cried because it was awful. >> i have no idea what the purpose was. other than just hate. >> reporter: no cameras or security guards or anything like that. >> no, no. >> reporter: around the corner an suv marked the same way. still showing red paint smears. and here the vandals also smashed windows with a baseball bat. this owner also a single mom. also african american. >> what was written on there was very disturbing. threatening and derogatory. >> reporter: the police chief says this is intolerable in his city of 30,000. the police have canvassed the neighborhood. >> we're going to look at this as that was a message that was

spent to somebody. >> spray painted die, the word die. >> reporter: another resident's suv was spray painted but just one word. >> it was in red paint. die. i tried to clean it up a little bit so my kids won't see the lettering. >> reporter: he tends to think this is a prank not a threat. >> most people here like i mean there's like different kinds of people that lives here. we're like this. you know. we ain't like back in the 60s or 50s you know. >> reporter: the apartments next door another car was mark with a vulgarity. another car next to it numerals associate with a street gang. both parked near the range of street cameras. police don't know what to make of the racial slurs but want to a reassure the victims they are safe. >> we have a duty to them to find out what happened. if it is just an act of

vandalism, we're going to get to the bottom of it. >> reporter: the chief is asking for the public's help on this. and he says even better, whoever did this, turn himself in. the appearance of swastikas at a home in sacramento is sparking a debate over freedom of speech. today more than a dozen lawmakers demanded a homeowner remove the swastikas displayed on the front of the house. the homeowner told police he considers what he's done to be art and people just don't understand that. the chairman of the legislative jewish caucus called it racist and vulgar and said it desecrates the memory of 6

million jewish that died. a body was found just before noon on a home in rose avenue. the death was reported by someone who went to the home and found the body. when investigators arrived they roped off the area with crime scene tape. neighbors say a man and his sister lived in that house. they say they rented out space in their barn for storage and other parts of their property including the pastures. >> i know they rented these pastures out for horses but as far as actually seeing who, i'm not here enough to see what happened. i mean as far as any wrong doings going on. >> reporter: authorities said little when our crew was at the scene. we were told the investigation would likely last well into the night. people in the bay area's tech community are weighing in on a long awaited vote on the fcc to regulate high speed internet service. the panel decided that the internet should be regulated

like a public utility. and internet service providers cannot manipulate speeds to charge more for faster service. jana katsuyama live where supporters of net neutrality held a party. >> reporter: that party is still going on. people packed the streets. despite the fcs ruling today. it was a wine and pizza party at san francisco's internet archive building. hundreds celebrating the net neutrality. >> it's a huge victory. if you asked me a year ago if we think this would happen i would have said no. we were up against huge lobbies, very rich corporations. >> the ayes have it. >> reporter: the fcc vote was close and partisan with three

democrats in favor of extending the fcc east authority to regulate the internet. two republicans voted against new rules. they and other opponents say regulates the internet would overstep the fccs authority and would overstep commerce. >> it causes lower prices and more invasion and a better consumer experience. >> the internet is simply too important to allow broad band providers to be the ones making the rules. >> reporter: some say the fccs new ruling on net neutrality are important because they prevent internet providers such as at&t and comcast from striking deals and charging companies such as netflix, amazon and others for faster speeds or preferential treatment. >> if you didn't have net neutrality, comcast or at&t whoever your provider is could enter into a relationship with you tube to say we're only going to serve you tube

content. or we're going to treat video con at the -- content better. >> when apple first rolled out face time, at&t actually went ahead and blocked it on their customer's devices. >> reporter: something that will not be allowed under the new regulations. >> reporter: some telecom companies are threatening to file a lawsuit. >> it may not be done just yet, jana katsuyama in san francisco tonight. jana, thank you. congress needs to act by tomorrow or else funding for the department of homeland security will run out at midnight. the senate has scheduled a vote in the morning on a so called clean bill. in the meantime the house is considering a short term funding measure that would last three weeks that vote is also set for tomorrow. without funding there would be a partial shut down of homeland security. most workers would still be on

the job. but they wouldn't get paid until the matter is resolved. the san francisco zoo has decided three chimps will remain at the zoo but they'll need a new home. there was concern about the fate of the chimps following the death of the may matriarch talula three years ago. they say it will be costly and are hoping the community will step forward to help. no word yet on the price tag. a change in bay area weather is forecast for tomorrow. our chief meteorologist bill martin says it's going to feel a lot like winter after a few several beautiful days here. >> after temperatures today in the 70s tomorrow they drop into the low 60s. even upper 50s. we saw a big cool down. we get a chance for showers out there as well. so here's what's happening you see the jet stream starting to

kink there at the top. it's going to drop temperatures first of all. you're going to see temperatures go from where they were today. 73 today in santa rosa to 61 tomorrow. 73 in livermore today. 63 tomorrow. so first thing you notice is a much cooler day as you go through the day. feel that shower activity starting to move in. this is tomorrow about noon. you can see all this activity kind of moving over the top of us with that cool air so showers in the forecast, maybe a thundershower at times. maybe a bay area weekend. we'll give you an idea of what you're going to expect over the next 72 hours. >> stay with us bill. we'll be back to detail tomorrow and his extended forecast and the ktvu fox weather team will be here all weekend as those showers move in. the family of a man who burned to death inside a car after it crashed in alamo while chp officers were responding to a dii stop near by has now filed a claim against the california highway patrol --

dui stop near by. those chp officers declined to check out the accident even after a witness asked them for help and repeatedly call 911. the driver of that car michael savano died in the car from second and third degree burns. his family's claim against the chp names the officers on duty that night accusing them of gross negligence. the chp said the officers were dealing with a drunk driver and did not know someone was trapped in the car. >> we have a lot of car fires. sometimes they're occupied, sometimes they're not. that would have been a great piece of information for officers to have. >> couldn't they have known just by taking a peak 30 feet down the road. >> un unfortunately they were in another investigation. >> a chp spokesperson said they could not comment on pending litigation. a san francisco police

officer is accuse of using excessive force after rousing a man who was asleep. there are two very different perspectives on what that tape shows. >> hey buddy, hey buddy. are you all right? >> reporter: the surveillance video was filmed february 11th on a munni bus. the bus driver told police a sleeping passenger refused to leave and that he had threatened him. the situation escalates when warren mumbles to stop touching him and that he could beat up the cop. >> [ bleep ], [ bleep ]. >> dude. get down. >> he makes comments to the officer who immediately takes the situation and turns it into something violent. >> reporter: he uses his police baton and pepper spray after he

is does not immediately leave the scene. >> the officer makes it seem like he was under attack. >> reporter: police chief greg suhr says the use of the baton and pepper spray were justified and that the video matches the official report that warren threatened the bus driver and the officer several times. >> the suspect has not walked off. he continues to tell the officer that he's going to beat his behind. which is a crime. >> reporter: the video is one of several released by the chief meant to highlight what police go to. the public defender's office wants the charges dropped. in san francisco, david stevenson, ktvu fox 2 news. a hawk hit by a remote control plane. we learn why it's not just the

riders may have been exposed to the measle. officials say it is their county's fourth confirmed case of the measles. earlier this month another person with measles road b.a.r.t. from contra costa to san francisco. that person came in contact with at least 20,000 riders. and the person road between 4:30 and 5:00 a.m. the trip was against the commute so exposure was limited. again the number of people potentially exposeed in this latest case is estimated at 1,500. the marine county sheriff's office is warning about a possible resurgence of polio. that disease was eliminated years ago in the u.s. but now officials are warning that low vaccination rate could be putting the public potentially at risk. ken pritchett is live with the concerns of that health service. >> reporter: as we heard during

this measles outbreak, when compared to other california counties, marin county has a high percentage of parents who choose not to vaccinate their kids. and health officials say of the vaccines most omitted is the polio vaccine. children crippled by the tens of thousands each year, victims placed in iron lungs to keep them alive. polio was a terror in the u.s. in the 50s and 60s. the vaccine was seen as a miracle that people rushed to get in line. >> my parents and grandparents lived in the fear. we were not allowed to swim in the swimming pools. >> reporter: you wouldn't know by looking at him. by vetron's right leg bares the

result of polio. the organization has raised billions of the dollars to fight polio. >> polio is only one plane ride away. and all it takes is one. >> reporter: that's a concern shared by marin public health officer willis. >> we have a community that enjoying international travel. combined with a lot of families that are choosing not to vaccinate that's a dangerous combination. >> reporter: until polio is eradicated it's a concern. polio was one of the most skipped vaccines perhaps because poilo has been gone from the u.s. for so long. >> i'm shocked and appalled. >> it does not cause medical

problems. >> reporter: currently there is legislation making its way through the state capital that would end the personal belief exemption allowing people to opt out of vaccinations for their children. a measure that would be sure to raise controversy if it passes. ken pritchett, fox 2 news. we have breaking news from san francisco at this hour. we just received a report of a police shooting. initial reports indicate that it happened just a few minutes ago just before 10:00 at 24th and mission. we do have a crew headed to that area. sfpd is also sending a public information officer we're working to get more information as soon as we do, we will bring it to you. demonstrators staged a noisy protest against google and one of his top employees tonight at the san francisco offices. dozens of people rallied

against the evictions of people on guerrero street. google bought the property and evicted one tenant and is now trying to evict four others. they claim that's immoral and unethical and against google standards. >> we're here to protect our own homes and raise awareness about the eviction epidemic that's happening. >> reporter: he and the other tenants were supposed to be evicted today but they're refusing to move and plan to fight. we now know the name of the executioner who is seen on those isis videos beheading hostages. he's been identified as a 26- year-old muslim raised in london. up until now he was known as jihadi john, but now they've identified him as mohammed emwazi. >> reporter: a west london man

new at 10:00, the rescue of two suspected vandals in the marine head lands. this is of the young men being lifted from the cliff there. park rangers said he had to be rescued with helicopter. the over was pulled up with ropes. the pair was first spotted at a military base. they got stuck because that cliff was so steep. both were pulled to safety and taken into custody pending investigation. a homeowner on the peninsula was greeted by a mountain lion this morning. check out these pictures of the mountain lion snooping around

their home on mountain wood lane in wood side. at one point the mountain lion even seems to be looking right in the window. a woman who lives in the house took the pictures. san mateo county sheriff deputy came out to help and the big cat ran back into the hills. there was another mountain lion sighting in the same area last week. that one had two cubs with her as well. oakland's minimum wage workers are getting a raise next week. >> reporter: at the homestead's oakland busy restaurant, customers were getting ready for lunch, but

the owners were getting ready to give their workers a raise. >> it's not up to the consumer to go out and make an assessment about whether that person did a good job at their job. they should just be getting paid a fair wage. >> everyone is going to do something different. you can't just wait it out. >> reporter: the minimum wage increase comes courtesy of oakland voters. they passed proposition sf last november with more than 80% of the vote. the city of oakland will have to budget at least $250,000 more to cover the increase to some part time employees. city councilwoman campbell washington says the city will have to find more money to increase the pay of their summer workers. >> we need to work together now to make sure we have enough jobs for our young people. >> reporter: at victory burger

a contra costa county sheriff's deputy is fighting to get back to work after losing his leg in what should have been a career ending accident. new at 10:00, amber lee is live after speaking with a deputy about how he's trying to move forward and not look back. amber. >> reporter: frank, the deputy worked here at the jail for three years before losing his leg just above the knee in the accident. now just months later he tells me he's anxious to get back to work. putting on his prostheses where

his leg used to be is dwight morgan's new normal. he says there's some discomfort and pain but he doesn't look back, mainly forward. >> mainly what i want to do is get back to work. >> reporter: morgan says his upbeat attitude keeps him moving guard. >> i never think, oh my goodness i lost my leg. it's in the going to be the way it was. i'm depressed. my mechanics don't work that way. >> reporter: the husband and father of five seriously injured his leg on his way to work in a motorcycle accident. >> i can move my hand good but not completely yet. >> reporter: on september 21st of last year, morgan says he lost control of his suzuki. he says he has no memory of what happened but his love of life remained intact. >> the first thing i remember saying is, oh my goodness i

crashed my motorcycle. don't tell my wife. >> reporter: three months in the hospital surrounded by family, friends and his sheriff deputies helped him. >> we're so glad he's here, because he could have been a paraplegic or dead. >> reporter: he expects to return to full duty, walking the rounds at the jail and overseeing inmates. >> i want to get there as fast as i can. >> reporter: morgan's progress is unusual says his physical therapist. he describes morgan as an optimist and realist. >> his attitude. that's what makes him different. >> reporter: in the five months since his accident. morgan is spending more time with his family and has learned to appreciate life.

new at 10:00, police in hercules have arrested a man accused of molesting a young

girl. police arrested carlos bartolomucci at his home. they said it happened when the girl was 10 and continued for about a year but she hasn't told anyone because she was too scared. the suspect is the boyfriend of the the girl's child care provider. he's expected to be charged with four counts tomorrow. an autopsy has found no signs of trauma in the death of a missing boy. someone found his mom crying and hysterical on tuesday near a slew. search crews then found the baby in that same area yesterday morning. the autopsy found no obvious physical injuries or abuse. but it did not rule out trauma. the measure aims to protect children from eating liquid detergent packets. spears says there have been

more than 17,000 17,000 reports of kids biting the colorful packs and then getting sick. one baby in florida died. spears says the colorful detergent packages look too much like candy. her bill would require new packaging that is child resistant and in colors that don't attract kids. 73% of bay area residents say the drought is serious. here in the bay area 55% of people favor voluntary cut backs while 49% support mandatory water rationing. pg & e crews were out replacing power lines in the east bay today using helicopters and we went along for the ride. doing it by helicopter causes less impact on the environment of the habitat under the towers and it takes fewer workers.

pg & e is installing new power lines that can carry more power to meet the growing demand from its customers. it is now being called the great llama drama of 2015 out of sun city arizona. two llamas were about to visit residents when something scared them and they bolted right out of their trailer. the white llama and black llama were seen dashing in and out of traffic. people were tweeting and cheering them on. the llamas were eventually caught thanks to the quick action and skills of one man who lassoed those llamas. >> that was a good lasso too. >> and they're so pretty. chief meteorologist bill martin will be back with his extend forecast and he's tracking changing including the return of wet weather. up first a rare hawk being nursed back to health.

new at 10:00, an injured hawk is being helped back to health. the hawk was hit by a remote control plane. >> species is rare for our hospital to receive. we actually haven't had one come in in close to 20 years. >> reporter: an even more unusual circumstances rescuers say this guy was hit by a remote control model airplane. >> definitely unusual. we've never seen this happen. >> reporter: the hawk was brought in on valentine's day with a broken left wing.

the accident happened at the santa clara county model aircraft park in morgan hill. the president of the tom cat's group that uses the park says it was purely an accident. rescuers say the pilot of the model plane feels terrible and a ranger was called in to help. >> poor guy. >> reporter: this is an adult male with a wingspan of nearly 4-1/2 feet. they put a sling on its left wing and the bird is now recovering in a box that prevents him from flying or thrashing around too much. >> it's a fracture right above the elbow. it was luckily a clean fracture. so no surgery was needed just stabilization. >> reporter: as for why this may have happened. >> he may have been protecting his territory. thinking it was another bird coming into his territory or he just unfortunately a freak accident and the plane maneuvered into the bird. we're not 100% sure how it happened. >> reporter: but rescuers do say they expect the hawk to make a full recovery and that

within a few weeks they should be able to release him back into the wild, cara liu. more now on that breaking news we told you about from the mission district. where police have shot a man. it happened about 10:10 at 24th and fulsome. earlier we said mission but it's actually fulsome. twenty-fourthand fulsome. police confirm it is a police shooting. area residents are reporting hearing three or four shots. a man in his 20s was hit in the chest. a reporter on the scene can see what appears to be a body covered by a tarp in the street and police have quardoned off that area. if we get more details we will bring them to you. checking in on the temperatures today. we showed them to you earlier. we had lots of 70s. it's going to be a lot cooler as we head into tomorrow.

74 in napa. that goes down to 63 or 62 tomorrow. the jet stream is drifting down over the top of us. not from a great direction. it would be nice if this plume was coming in like this. what's going to happen is we're seeing the area drop down from the polar regions. very dry air mass. so cooler air, snow in the mountains you'll get six to 8- inches over the next 72 hours or so. it's just not going to be a good rain producer for us. it will just produce nuisance showers. maybe a little warmer. and some patchy valley fog back in the forecast but real patchy. maybe low patchy coastal fog. we're thinking about friday. temperatures much cooler than they were today. san francisco you make 60 degrees for a daytime high. san jose you're up in the low 70s. san jose 62 degrees. it's going to be mild to start. the air kind of chilly. then it stays that way. jackets may be needed. it's the first real brush with

neighborhood here who are here. now half way down the block. i am seeing a lot of the yellow tape and we do see something that is covered with a tarp near a line of parked cars here on fulsome street. police have confirmed as we said this was an officer involved shooting. it happened a call came in about 9:50 tonight and area residents report hearing shots fired. now a preliminary report has indicated that the person who was hit might have been a man in his 20s. possibly his in the torso but that has not been confirmed. right now again this part has been cut off. we have seen a lot of crime scene investigators here processing this area. right now it is blocked. we do understand there's a police spokesperson who is coming here to the scene. a lot of police cars coming in and out. so they're expecting to get more information we will be collecting that and bringing it to you both online and at the ktvu morning news.
