now, this is the 10:00 o'clock news. dry yards and dead lawn, now that conservation in four years of drought could cost water users in the form of a big rate hike. >> we can't take it anymore. at some point it's got to stop. >> good evening. >> water users in the south bay may soon be asked to deal with a huge budget hike, and that's angering customers saying their efforts to conserve shouldn't cost them. the water intersect met tonight to discuss a proposal to

increase rates. >> reporter: the meeting is still under way, and they weren't meeting to set the rates, but hear options for a significant rate increase. >> and the water would run down ask the hill and into the gutters and waste water. >> reporter: last month he took drastic measures for his home. he replaced grass with drought resistant plants and artificial turf. >> it's green all the time. >> reporter: but he's not thrilled the water district is considering a huge rate hike because people are using less water. >> to charge me more when i'm using help doesn't make much sense to me. >> reporter: the district says the brought caused a budget short fall, and at tuesday's meeting, they lowered the recommendation from 32 percent to a 19 percent rate hike which would translate to about $5 more a month for residents in north county, san jose and north, and cost an additional

$1.34 morgan hill and south. >> i'm the face of your rate pay irish payer. -- payer. we have been taxed to the max. >> we take it extremely seriously. >> reporter: the district said in a normal year they pay per acre of water. they anticipates if the drought continues the price will skyrocket to $7,000. still some leaders question the large hike. >> i think we have an affirmative obligation to look at the totality of the program, and not just say here's some cost and we're going to directly pass them on. >> reporter: in the last 20 minutes i got an update after three hours of discussion, the

board decided to review how they use the reserves, and also look at vacant position, and they do expect all these considerations to drop the proposed 19 percent rate hike further. now the board is setting the new rates in may. >> thank you. two other water districts also addressed the situation today, east bay mud says the water outlook there is grim, and now it's looking at buying water. it has to determine how much to buy, and at what cost. another district plans to spend $2.2 million to buy a four- month supply of water for 20,000 people. and now to weather, as you'll see from this time lapse, the clouds have rolled in, and some parts of the bay area could see sprinkles.

they're wondering if this hospital and others will be able to stay open. generations of people turned to seton for care. >> >. the prior mary doctor i've -- primary doctor i've been to for about 20 years. >> reporter: they were hoping to be bought by prime health care, but employees got a shock today with an e-mail that the deal fell through. >> it's hard. people are scared now. >> reporter: prime health care issued a one-page statement outlining the reason, saying quote unfortunately the conditions placed on the sale by the california attorney general are no burdensome and restrictive, it would be impossible to make the changes needed to operate and save the hospitals. some are angry at the attorney general. her approval for the sale. needed, and she imposed some 300 restriction, including they

must stay open for ten years, instead of prime's five-year offer. the attorney general said today in a statement her decision came from advice from independent consultant. she said by walking away prime is confirming many of the concerns heard at community meetings. the ceo of the daughters of charity health system says they are disappointed, and we strongly disagree with prime's position on the attorney general's position. employees now worry about their patients and their own futures. >> i have two children, and yeah, my husband's the one that stays home to watch them, so i really need to be the one to work. >> my blood, sweat, and tears working with seton, so not being sold is a loss for the community. >> reporter: the management has

scheduled three meetings tomorrow to give employees more information about what might come next. thank you. the san pablo city cancel is keeping the -- council is keeping the medical center open for a little longer. $2million from a sale will keep doctor's hospital in business for a few more weeks. backers are still hoping for a permanent solution to the hospital's financial problem. the board is expected to vote on the deal tomorrow. we have developing news from the south bay where the fbi and police conducted a series of raids, targeting businesses are illegal video gambling machines in east san jose. there were 11 places in the area where search warrants were executed, and here's new video

showing machines removed from the bar and placed in fbi vehicles. the raids are the culmination of a year and a half long investigation. authorities say the video gambling machines are linked to violence in the city, including at least one killing. so far there's no word on any arrests from tonight's raids. a beloved member of the san francisco 49ers announced he's walking away from football. >> patrick wilson is retiring, mark is here, watching him, he got emotional saying he's done. >> yes, everybody thinks about the game tied hour and big -- glamour and big money, but it shows how emotional it is. not just the superstar, but it's rough when these guys pull away from the game, and i imagine it's a pretty emotional time for 49 fans with everything that's transpired,

by now you've heard the song and controversy. today a multimillion dollar select is in regarding the 2013 megahit blurred lines. a jury in los angeles found the writers ripped off a 1977 hit by marvin gaye, and awarded his family more than $7 million. >> heather talked to a music critic that told her why he

contact, but not this time. >> we had almost no success in actually being able to contact anybody or anybody willing to work with the police, so you know, we can put it an olive branch there, but it doesn't mean anybody is going to want to engage withs. >> >. police also said they've been able to reduce the number of side slows with 16 officers dedicated to curbing them. also, we have a picture of the young mother killed by a stray bullet in oakland as she was trying to protect her kids. she had just picked them up from school when the shooting starting about 5:00 p.m. police are offering a 20,000- dollar reward to find her killer. >> reporter: they say bullets have no names, but one traveled down chestnut street before 5:00 in the afternoon striking this woman. she was simply trying to get her children into the house, and away from the gun fire.

>> children nearly started run, she was running with him, unfortunately -- them, unfortunately due to the senseless violence taking place up the street she was fatally struck just feet from her front door. >> reporter: down the street is this car with a back window blown out near the intersection of 30th and chestnut street where an argument turned violent and shooting began. >> they got into a fight, this physical altercation turned into a lot of people bringing firearms and shooting a lot of rounds. >> reporter: pierce worked were kaiser hospital, and they released this statement saying their hearts go out to her friends and family. a local pastor spoke out tuesday about the shooting police called senseless. >> wear at a crisis conscious -- we're at a crisis epidemic

in our neighborhood. >> reporter: two other teens were shot and taken to the hospital, and they're expected to be okay. >> we can't 100 percent confirm it, but there are connections we're exploring. >> reporter: they'll work hard to get the killer off the street, in hopes of bringing justice to the family. >> please come forward with information and help us solve this. >> reporter: deputies did detain several people, police haven't release any suspect information at this time, of course if you know anything you're asked to give them a call. paul chambers. tracking light showers in the area, i have been checking around looking for reports of any sprinkle activity along the coast, haven't seen any yet, but i wouldn't be surprised, especially the higher elevations. a lot of moisture, which is good, but light on the dynamics, and lift and upper

level jet speeds that would induce rain. just a few light moisture from half moon day, the darker green, maybe a drizzle there, but the way it goes tonight, more of this moves in, but in the same pattern just widely scattered. not enough to go hey it's going to rain from this time to this time. widely scattered through the day tomorrow as well. tomorrow morning when you get up it's cloudy, maybe a sprinkle. lunchtime, maybe a sprinkle. 60, and then by afternoon it should be clear, and we're looking at temperatures getting to the mid-60s. so 3:00 a.m., that looks like the best opportunity for showers, that's not north bay. the blues light drizzle, and then about 5:00 a.m., and then a.m. the morning -- 7:00 a.m. the morning commute looks to be dry, but that's a nonevent. hopefully it will produce more, but right now looking very

light. when i come back we'll dial in the timing throughout the day. this is just until 7:00 a.m., we'll push it through and look at the five-day forecast. california has a 99 percent chance of being hit by a strong earthquake some time in the next 30 years according to a report from the usds. they also found a 95 percent chance of a magnitude 6.7 quake similar to the north ridge quake in 94. there's a similar chance of one hitting here in northern california. they said the fault is the most dangerous in the state because it hasn't ruptured in a long time, they also say it's a forecast and not a prediction. a bay area deputy accused of beating a homeless man inside a hospital. >> my head and face. >> up next, when the alleged victim says happened, and what

police investigating the first killing in albany in ten years. family members tell us the 37- year-old woman was found shot to death yesterday in her apartment. they say her name was paul, and she moved to the bay area back in 2001, she was a dental student at ucsf and a year away from graduating. when she didn't show up for appointments yesterday the school contacted family members, and one of them went in her apartment and made the horrible discovery. the homeless man that said he was beaten by a san francisco sheriff's deputy inside a hospital is telling his story. here's why the man still has high regard for law enforcement

officers. >> reporter: each step is a struggle for the 59-year-old san francisco native and self- admitted felon has been homeless for three years, and awaiting for knee replacement surgery, and he claim he was assaulted by a deputy, and it was caught on camera. he came to seek pain pills ahead of knee surgery scheduled later that day. he says he fell asleep, and was awakened by a deputy whom he says ordered him to leigh, and then -- leave, and then began beating them. >> i felt punches on my head, face, somewhere, and i was being choked because i couldn't breathe. >> when he couldn't instigate a fight he just beat him. >> reporter: prosecutors say video shows the assault. the deputy was arrested and faces four felony charges including perjury and filing a faults police report.

the man himself was initially booked on assaulting a police officer, and taken to jail, but he says they treated him with dignity at the jail. >> the treatment there was clearly wonderful in comparison to the general hospital. >> reporter: they're filing a 25,000-dollar claim against the city, and called for the deputies that assisted the other to be investigated and prosecuted. the district attorney's office says the investigation is still on going. clinton speak out about the controversy surrounder her e- mails. >> no one wantings their personal e-mails -- wants their personal e-mails made public. >> why she used her personal account to do government business. >> and surviving ship wreck, how scientists and historians are conducting research right off the bay area coastline using state of the art technology.

a bipartisan group of three senators want to change federal marijuana laws. booker of new jersey and gillebrand of new york joined paul of kentucky to sponsor the bill. it would allow people in states that have passed legal medical marijuana to use it without fear of federal prosecution. >> a lot of people say it work, and i think states and people

should have the freedom to try this. >> the law would also change marijuana status from a schedule 1 drug to a schedule 2 allowing research and recognizing marijuana as having acceptable medical uses. currently 23 states have legalized medical marijuana. and police interception of cell phone calls here in the bay area is under investigation. it forces mobile phones to route calls and texts through it to give police access. the aclu is suing the sacramento county sheriff's department for allegedly refusing public records request. they say the public has a light to know -- right to know how police are using the technology. president obama is headed back to california thursday for a swing through the los angeles area. he came to the bay area in his last trip here to speak at

ship wreck. scientists and his historians eventually gathered to use it. >> we got an up close look on how they're use us it and what -- using it and how -- what they hope to learn on it. >> reporter: it's unmanned relying on a computer program to look at a aircraft scuttled by the navy in 1951. >> >. to get a detailed sense using sonar mapping to get a look at the deepest ship wreck in the national marine sanctuary. >> researchessers have pinpointed the location -- researchers located the ship. >> we do a pre-mission program, and load it into the vehicle, tow it off the coast, release it, and then the vehicle executes the mission we programmed in. >> reporter: for the past week and as recently as yesterday afternoon, the research team

conducted multiple test launches. on this afternoon, more preparation including testing different components to ensure even if the computer program fails the echo ranger will surface. it's an expensive piece of equipment worth millions of dollars. scientists say it will help them if i can your out what's left of the 600-foot aircraft carrier. they'll tow it out to see and back. >> this gets us down there, flying over that wreck and getting a real detailed picture of it. is it upside down, upright, what shape is it in. >> reporter: one historian says there's significant and value about finding out more about it. >> it's a rich part of naval history. >> reporter: and preserving it's memory, especially for those that served on the carrier and their families. >> it's important for them to know what they did in the war,

and there's a lot of pride in the vessel. >> reporter: they plan to launch the echo ranger on the actual mission later this week. they say the goal of this project is to preserve history. a new computer testing system made it's official debut in california. california schools got rid of old paper-based tests. they said it's going to take students some time to adjust to the new tests and standards, and they cautioned about comparing results of new tests to results of the old tests. the feeling fat status update is no longer available on facebook. the company pulled it from the list other of options today after an online petition by people that wanted it removed feeling it made light of a serious subject, and could reinforce negative feelings

nice, tenth of an inch, and 8:00 a.m. tomorrow morning, quickly it blows out of there, and 1:00 o'clock, cloudy, starts to clear out in the afternoon, and there's your wednesday. pushing into thursday, thursday morning, no fog to speak of really. few clouds thursday afternoon, and that's it, so clears out, this one and done system, not even one and done, it's like a tenth and done. there's the cloud cover in the morning, lunchtime starts to clear out, and temperatures start to warm. mid-60, maybe upper 60s tomorrow with cooler areas to the north, there will be some rain, maybe a half inch in northern cull california. forecast highs tomorrow 65 in napa, 66 in the brentwood area. another nice day. despite the cloud cover and chance of sprinkles, temperatures well above what you might expect this time of year. the five-day forecast. a chance tomorrow, but don't bet on it.
