i am not hurt. i need help. get me out. get me out. i still can't get out. where are people? help, i need help. i am on fire. get me out. >> reporter: last year they said as much. >> suffered from severe burns that caused his death. >> why the slow response? he received a letter saying other firefighters were busy elsewhere. >> from what we understand the firefighters weren't in the station at all. they were across the field taking pictures of airplanes. >> reporter: the air force shows fire and rescue crews should have been ready. the demonstration team was also performing that day. >> they have their own rule. and in those rules it says have trucks ready to go, right at show center with immediate access to the runway. >> reporter: to make matters

worse, since the death the family has been trying to get an explanation from the air force, even filing a lawsuit. officials said the pentagon is handling the matter. >> and the family is seeking $20 million. you were that air show when it happened. >> reporter: i was there enjoying it. i didn't see the impact. but i saw immediately afterwards, i saw the smoke. thinking it was part of the show but then realizing it wasn't. we stood there, looking where are the firefighters. time seems to stand still at this point. the longer we are standing where, we are wondering what is going on. you can see the plane wasn't in damaged condition except for the fire. you are wondering what is going on with him. >> it was the fire that killed him. >> reporter: yeah. >> thank you. we have learned new details about the arrest of a teenager for the killing of a mother of

three. she died after being hit by a stray bullet during a gun battle. ktvu's cristina rendon was at oakland police headquarters as investigators and police spoke about the arrest in the past hour. she is here now with what they said. >> reporter: very clear that other arrests could come within the next few days or weeks. this case is unfolding as we speak. we can tell you within the last few hours today, anthony sims, a 19-year-old man from oakland was charged with murder. we have his mugshot here. police tell us he participated in a gun battle that led to chyemil pierce's death. that is coming from witness statements and anthony sims himself. police say he was with a group of people who got into an argument with another group and the two sides felt the need to settle their dispute with gunfire. anthony sims was shot in the battle and he was arrested at the hospital. that is why police say it took several days to let us know

about the development in the case and they are telling us anthony sims had a brother that was one of two victims in a double homicide on january 20. in that case there were two men who water shot inside a van. police didn't want to talk about that case but here in this case on monday this gun battle that left a mother of three dead, they said they were able to pursue anthony sims through witness statements and they are thanking the public for stepping forward. >> there were several persons that fran that decided to use firearm -- that afternoon that decided to use firearms. >> for this crime we will take this to the full extent of the law and punish this individual who carelessly murdered this very wonderful woman in front of her kids.

cell phone. that broken phone could be a factor in whether charges are pursued. >> he also broke her cell phone which is a separate charge, and can be more serious in some ways if it was done to prevent her from contacting law enforcement. >> the 49ers said miller has not been suspended and the team is conducting its own review. arraignment is set for april 20. in case the district attorney decides to file charges in the case. miller is free on $10,000 bail. san jose police are asking for the public's help finding a man wanted for a violent robbery. this is a sketch of the suspect. the man is white, hispanic, 22- 29 years old. 5'6", 5'10". thin, black hair and blue eyes and police released a picture of the suspect's vehicle that

came from surveillance video. dark pick up with a cover on the back that has windows. anyone who knows this vehicle or the suspect is asked to call san jose police. six kidneys, 12 patients and 12 surgeries. a first of its kind kidney transplant chain in san francisco. today we talked to one of the patient whose donated a kidney. >> reporter: she is getting a lot of attention these days. one week after being on the operating table oo donate a kid -- to donate a kidney that she didn't know. lots of people want to donate but they aren't always a match. that is why swapping with another pair can work. but her rare blood type started a swapping chain reaction. a record of sorts. clearing six patients from the

kidney waiting list. >> she -- she multiplied the number. >> i know all these people have time back and quality of life. that is just worth everything to me. >> reporter: it means a lot to her. she lost a son to cancer cancer and her husband 14 months ago. a person willing to donate a kidney is rare. she didn't think twice. >> i would do it again. i only have one to give but i would do it again. >> reporter: her kidney contribution did more than save six lives. she made it a point to publicize her feet. >> some people who heard about her story and you want to do it too. >> there is a huge need for organ donations. >> reporter: she has done her share to fill those needs.

florida governor rick scott working to lure companies away from california following the labor crisis at west coast ports. he sent a letter to the shipping industry today urging them to move to california and away from west coast ports. he is planning to visit california next month to make his case. he takes shots at governor jerry brown's tax and spend administration. the san jose city clerk's office is under fire over the ballot for a special election next month. 10 candidates are 1ing for the city counsel seat. -- running for the city counsel seat. all candidates have a symbol next to their name. that means the candidate agrees to limit their campaign spending. the problem is, he didn't actually agree to that cap. even though there is a diamond

challenges of being a transgender correctional officer at san quentin. >> reporter: on a clear day one of the best views in marine county is from a gated community where no one wants to live. this is san quentin state prison. home to some of the most hardened criminals. and the place where corrections officer set herself free. >> i came out to my family 5 years ago. i only came out here three years ago. >> reporter: we spent time with mandy who used to be called michael. she is the first openly transgender guard at san quentin. the prison opened in 1852. it is known as the "q." one of the toughest places

imaginable. the long standing rule here, don't stand out. a tall order for a 6-foot tall transgender female female corrections officer. >> putting yourself out there. most people hide their trueselves. >> reporter: mandy spent years hiding. working male jobs. before becoming a corrections officer she was a damage control officer in the u.s. navy. one of the burliest jobs on the boat. she played the part by mimicking other man. >> learn how to puff up like they did. i had to teach myself how to be a guy. they bought it. >> reporter: transitioning hasn't always been easy. she almost quit san quentin before coming out. a super visor convinced her to stay. she says the administration is supportive. and surprisingly so are the

inmates. >> the only thing i can come up for why that is, they understand what it is like to be looked at and judged. >> reporter: turning the tied takes time. one step at a time. she is leaving foot prints for others to follow. >> i started at san quentin in 2007. >> reporter: in a diary she chronicled the day michael went to work at the "q" for the first time as mandy. >> facing down the toughest people in the state in lip stick. >> reporter: she wrote it was the scariest day of her life. >> i felt anything but brave. >> reporter: a supervisor pulled her aside -- >> what is with the make up. it hit me. i was stuck in a situation of my own making. i responded with the words i spent a life time avoiding. i am transgender. >> reporter: she said behind

prison walls she has been supported and bullied and shamed. >> he told me i would spend an eternity rotting in hell for my choice. >> words hurt. even a prison guard trained to be tough. >> it is not easy being different. people are always going to look at you in those negative ways ways and they will always speak behind your back and laugh in your face. in two weeks i will be gone. >> reporter: she plans to have gender reassignment surgery. >> a new person. being able to be like everybody else while still being myself. >> reporter: she hopes her coming out improves the view for others going forward. at san quentin state prison, noelle walker, ktvu fox 2 news. >> that is fascinating. >> such a personal account what
