this is the 10:00 o'clock news. a gathering to remember a bay area mother shot and killed while trying to protect her children. and tonight, a break in the case as police announce an arrest and murder charges against a 19-year-old man. good evening i'm julie haener. >> and i'm frank somerville. three days after a gun bat toll killed an innocent young mother of three, oakland police announced an arrest, and tonight anthony sims of oakland is behind bars facing murder charges. we have new developments from jane katsuyama outside oakland police headquarters. >> reporter: the oakland police said today that anthony sims

actually told investigators he was involved in that gun battle. candles, signs, and flowers show the concern of the community over the mother that lost her life trying to save her children. 19-year-old sims was arrested after going to the hospital with injuries after the gun fight. sims is in jail now, charged with pierce's murder. >> per witness statements and statements made by sims himself, he was present and participated in a gun battle which led directly to the death of the victim. >> reporter: police say it happened about 4:45 p.m. monday when a group of girls got into a fight, and young men got involved pulling out guns. >> one group of individuals were coming to the aid, and the other group feeling disrespected, the two groups, clashed. firearms on both sides. >> reporter: leaving bum cases

scattered -- bullet cases scattered around the area. >> i came out, and they ran down and street and were gone. >> reporter: today people came by the spot and mourned her. >> it says a lot about her because she loved her kids, she did anything for them, that's one thing you could say about her. she was a great mother. >> it was an innocent mother, young mother, who's trying to do the right thing. >> reporter: and a promise now from the district attorney. >> we will take this to the full extent of the law, and really punish this individual who so carelessly murdered this very wonderful woman in front of her kids, destroying, really effecting the whole neighborhood and city. >> reporter: something new this afternoon is police say sims' brother was shot and killed january 20th in a double shooting on 10th street. sims is expected to be in court

tomorrow to enter a plea, now we also understand that police did get tips from the community that helped lead to his arrest, and they are hoping to get more tips because they say there are more suspects out there they're hoping to find. >> so horrible when you think about those three kids now that have to grow up without their mother, is there any indication this was gang-related? >> reporter: i've been asking that question t district attorney's -- the district attorney's documents had no mention of gun -- gang, and the police couldn't say more until they have the other police in can custody. >> all right, thank you. new at 10:00, a graffiti problem that's left places all over san francisco vandalized, and tonight police have a suspect under arrest. he's cost taxpayers thousands of dollars, but he eluded

police officers for weeks. amber lee has more on how police made the arrest this morning. >> reporter: police tell me they arrested the suspect here at the park armed with a bag of paint and admiring his own work. the $20 million park renovation project is among the tagger's many targets. you can see the graffiti all over. he's tagged mailboxes, payment, and homes -- pavements and homes. the prolific tagger spray paints the word sheep, police arrested an 18-year-old of san francisco. he declined to answer when i asked why he tagged public and private property, but did answer one question. >> reporter: what's sheep mean? >> sheep means conformist and

all that. >> reporter: he was booked into the jail on ten felonies, and 17 misdemeanor vandalism counts. >> i was really grateful. >> reporter: kennedy owns an optometrist office, and he left a tag on her new awning. she hopes he's held accountable. >> i have staff and a lot of ex- pensions, so it's not as -- expenses, so it's not as bad as violence, but it's still bad. >> reporter: a man saw the tagging this morning and called 911. >> he was at the tennis courts holding up a cell phone, and pointing it in the direction of the wall. >> reporter: he had the paints on him. the public works department

says the graffiti has cost thousands of dollars in clean up. >> he put a scar across the city. this is blight and taking a toll on our beautiful city, and we're very glad he was caught, we hope he's the right one, and the criminal justice system takes care of him. >> reporter: i checked with the district attorney, and these typing of cases are hard to prosecute because judges often reduce to felonies to misdemeanors. >> okay, we apologize there, we lost that signal with amber lee talking about that alleged tagger that's been caught. gas prices may be heading lower soon because we're getting word tonight the labor dispute between shell oil and the united field workers union has reached a result. the contract will effect workers in martinez and six other refineries nationwide. they've been off the job since february with management shut

down the refineries after workers went on strike. analysts say when they start producing again, the extra supply should gas a develop in gas prices. -- drop in gas prices. work returned to normal today at the terminals after a dispute yesterday. last month a nine-month labor dispute was over, and rick scott is planning to come to california next month to convince the shipping industry to move its bids to florida. and the state could be headed into a fourth year of drought. the state water resources control board is expected to vote tuesday on whether to tighten water usage ruled. if passed, beginning next month house holds would be limited to two days a week of outdoor watering, and restaurants would be barred from offering water

to customers unless requested. the election isn't until november, but san francisco voters got to hear from the two leading candidates for sheriffs, the incumbent and new candidate took questions at a forum in the mission district, several dealt with cooperating with the federal government regarding people who are in this country illegally. >> i would not contact immigration for anybody, that's not to say immigration wouldn't follow up or try to contact us. >> no transfers, no relationship with homeland security. now to developing news out of ferguson missouri where crowds gathered outside the police department tomorrow holding a vigil for two police officers shot and wounded last night.

many in the crowd say they do not condone violence and want police to be held accountable for a history of racism in the department, and here in the bay area the conflict is on the minds of many high school students in the area. >> ken pritchett has more on the violence in ferguson. >> it's been 24 hours of turmoil in ferguson with two officers shot and an intense man hunt. these events have nationwide implication, and that was evident tonight among youth in the east bay. >> reporter: a house in the focus in the search for who shot two police officers. a woman and two men were led away in hand cuffs. as tensions rhodes among protest -- rose among protesters last night, shots

were fired. two officers in tactical gear hit, their wounds not life- threatening. the attorney general called the attacks an ambush. >> this was not someone trying to bring healing to ferguson. it was a punk trying to cause discourse. >> reporter: the shootings followed the resignation of the police chief after a scathing review of the police department on race relations. one person linked the shooting and resignation. the tensions in ferguson continue to spark national debate, and constructive dialogue here at home. >> mike brown, eric garner, it can be someone here. >> reporter: the social justice academy brought together community leaders to talk about the inequities the students say can lead to conflict.

>> that's a lot of miscommunication between youth and adults of you power, and if it can happen in ferguson it can happen anywhere in the world. >> reporter: the students closely watch the events in ferguson and elsewhere, and say there's a feeling of disconnect and disrespect that drives youth and authorities apart. the social justice academy is made up of about 90 high school students, their presentation was called peace in the streets. clearly not what we see in ferguson, but that's what the students want to have right here. >> ken pritchett, live in the news room. thank you. we can't show his face or let you hear his real voice. >> how easy is it to get a gun? right now. >> it's like getting a soda out of a machine. >> how criminals see the streets, a story he's risking

>> it's gross to talk about of course for people, but it's one of the reasons we should all wash our hands. >> all right, thank you. san jose police are asking for the public's help finding a man wanted for a violent robbery. this is a screech of the man involved in the -- sketch of the man involved in a brutal robbery. he's 22 to 29 year old, hispanic, thin and has black hair and blue eyes. police also released a picture of the suspect's truck from surveillance video.

>> the family of a bay area stunt pilot filed a federal lawsuit today. they said emergency crews didn't respond quickly enough following a crash at the travis air show. they said the man survived the crash, but died needlessly when his plane caught fire. his family says the air force has told them nothing in the ten months since he died. >> reporter: 77-year-old eddie was larger than life. >> it's a tough act to follow. >> reporter: the half moon bay based stunt pilot was in the air show hall of fame, and has been wowing crowds for decades until last may. >> all i know he was alive and

well when he hit the ground, and he wasn't able to get out of the plane, and it caught fire. >> reporter: his sons speaking out saying he should still be here. >> it's on our minds daily. >> reporter: they filed a federal lawsuit arguing he died at the air show because of the slow response of fire crews. the first fire vehicle didn't arrive for four and a half minutes, the necked 30 seconds -- next 30 seconds later. >> why? what happened? what went wrong. i just assume there's multiple layers of failure. >> reporter: performing an upside down maneuver, and some reason he crashed, but it was a gentle crash. last year the coroner said the crash is not what killed him. >> he suffered from severe burns which caused his death. >> reporter: so why the slow response? the attorney received an anonymous letter saying other

firefighters were busy elsewhere, and they should have responded immediately. >> we understand the firefighters weren't in the station at all, they were across the field taking pictures of airplanes on the grass. >> reporter: the air force documents show crews should have been ready and next to the flight path. >> they have their own rules the air force bases must follow, and in the rules it says have trucks ready to go right at show center with immediate access to the runway. >> reporter: the family's attorney believes the air force will respond to the lawsuit, but he says in the end he expects them to deny everything. john sasaki. live camera outside looking to the golden gate bridge over here, and you see the fog creeping in, the sunset district, the fog is low to the ground, so if you see it

tonight catholic high school students in san francisco rallied in support of teachers at four schools. they all gathered outside st. mary's cathedral, and called on the arch bishop to withdraw a controversial morality clause in the new employee hand book including high school faculties to be in line with the church's teaching on gay marriage and contraceptives. police in san francisco are reviewing video in hopes of identifying seven people that dragged a man off a bus and robbed him this morning. the victim said when the bus stopped the men pulled him off the bus, drew a gun and knife and robbed him. >> essentially took his

backpack and belongs, cell phone, wallet, cash. >> the victim was able to get back on the bus and notify the driver. robbery charge, and potential kidnapping charges are possible. richmond police looking for answers in the case of a brutal attack that left a man fighting for his life at 11:30 last night. a mob of about 20 people attacked a 35-year-old man outside his home. authorities say it doesn't appear he's going to survive, and homicide detectives are investigating the incident. so far they haven't released any possible motive. a major housing development prosossed in jack -- proposed in jack london scare. they want to build a -- square. they want to build a 300 unit

building. but those opposed say they'll charge too much. city officials want affordable housing to be included in the plan, but admit it's not likely to happen. a rare look at the life of a gang member. up next hear from one young man who's lived a life of crime, and why he now wants to get back. also the small symbol causing a big problem in the south bay and costing taxpayers thousands of dollars.

>> eric rasmussen sat down with him, and he admits he's not a success story, at least not yet. >> yes, he says he's left his violent past behind, but he has one foot out and one foot still in the gang. it took more than a month of meeting with him and earnings his trust before he agreed to do this interview. >> reporter: have you ever robbed somebody. >> yeah stabbed somebody? >> yeah. >> >> reporter: shot somebody? >> yeah. >> reporter: it was a rough life. >> i grew up in a family that was rough, and there was torture in the house, rape, beatings, everything. growing up in that type of house, the only thing you hope for is safety, security, family, so i left my family and looked for a new family. the gang life is a family open to anybody. >> reporter: how old were you?

>> 11 years old. >> reporter: when you joined in? >> yeah. >> reporter: now 20 he says revealing his identity could get him killed, so why speak at all? >> i've seen, man, parents die, kids die. it's bad. >> reporter: he now says he wants to help keep kids out of gangs to resist the recruiting tactics he once used. >> i used to pull out a stack of money, and show him, and be like you want this? come and get it. >> reporter: only a few months removed from every day gang life here in san francisco, the young man we spoke to compared his view of the streets to a child's game of where's waldo. >> finding waldo, i look for the people that don't fit in.

>> reporter: waldo is the victim? >> yeah, the police, waldo could be anybody. just from how they're walking, looking around, body language. >> reporter: what about the other side? what about the person walking down the street that might be an opportunity? what are you looking for there? >> fear. simple at that. i was just waiting for that victim to show one drop of fear. that's it, that's all it takes. >> reporter: online videos promoting gangs in san francisco only tell part of the story. by some police estimates as many as 45 different gangs currently operate in the city from the mission to the bay to the sunset and beyond. how easy is it to get a gun right now? take me out there? >> as easy as it is for you to

go to the vending machine and get a soda. >> reporter: this man offers some chilling math. >> kill about three to five people a day, just to prove themselves. if you're with them all day, not counting your own, you get 15 to 18 opportunities to hurt somebody, to rob somebody, to kill somebody. >> reporter: do you ever feel bad for one second back then did you think man, this isn't the right thing to do? >> no, it didn't. i conditioned myself so i wouldn't have remorse. >> reporter: he said a number of wake up calls in the last year got him off drugs and away from his gang. with the help of the church and even the police he has an apartment and a job.

>> it doesn't matter what i'm doing, i'm going to do my best at it. the best janitor, the best gardener, the best, whatever i do, i do it 100 percent. >> reporter: i have to ask, why should people trust you? >> i could sit here and look you in the eyes and completely lie to you for three hours and not feel bad about it at all. but at the end of the day, i wouldn't be lying to you, i'd just be lying to myself. >> reporter: if you could go back ten years and talk to your former self, what would you say? >> the same thing a good friend of mine told me. you're a smart kid, you can be much more than this. >> it's important to point out the young man didn't have to give up any specific information to police in

exchange for getting help out of the gang. tonight, i just checked with someone who knows him, he's staying on track, and he says getting his first real pay check believe it or not was the best feeling he ever had. >> that's so interesting. >> so was there one specific thing or a series of events that made him get out? >> obviously to talk about some of the specific events might identify him, and we illustrated why that's such a difficult thing, and there's been trauma, and enough recently so he said he's done. >> it was interesting talking about going out and looking for victim, just look for fear, a little bit of fear, and he knew that was the person to take. >> all right, we hope he stays on track, thanks very much. and if you have a story for 2 investigates we want to hear from you, just e-mail us or

call us. the san jose city clerk's office is under fire over the ballot for a special election next month. ten candidates are running for a city council seat vacant. here's the problem, all the candidates have a diamond symbol next to their name meaning they agreed to voluntarily limit their campaign spending, but this candidate didn't agree to that cap even though he has a diamond next to his name on the ballot. now the office plans to send out brochures alerting 29,000 voters about the error. the correction could hurt his campaign even more. >> it's caused irreparable harm to me campaign, that's the thing i don't want. >> the error is costing taxpayers $15,000 to fix bringing the total to the special election to $645,000. the highway patrol released

dash cam footage of a traffic call that turned into a life and death situation last month on westbound 580-980 connector. the officer was responded to a call of a vehicle blocking a lane, the driver tried to throw himself over the railing when the officer arrived. the officer managed to grab his wrist and jacket, but was fighting a losing battle against time and gravity. >> two off duty police officers, one off duty oakland and one an off duty sheriff's deputy rushed up and were able to help him pull the man, he didn't have a good grip on him so it was a matter of time. >> that man was taken to a hospital for a psychiatric evaluation. up next here, apple's early release of its newest mobile operating system. things warming up around here, temperatures could reach into the low 80s as we head towards the weekend.

take a look, a special player arrived at giants spring training by helicopter, comedian and actor will ferrell. he suited up for the white sox, and then for the giants. acting like a real major league catcher. he played in five games for ten different teams today, all part of a fund raiser for the fight against cancer and an upcoming hbo special. >> mark ibanez was there when he showed up, and it's worth seeing what happened when he went into the a's locker room.

bit of valley fog tomorrow, and that's it. we're talking about temperatures increasing to the upper 70s tomorrow, maybe a few low 80s. so tomorrow is a lot like today, very, very warm, wake up with a little bit of patchy fog, but we're splitting hairs here because it's going away quick. high pressure sets up again much to water watchers chagrin because it's keeping us so dry, but the trend has been for temperatures to increase, since wednesday we've noticed the bump, and tomorrow upper 70s, and by saturday maybe even tomorrow afternoon, a few low 80s poppling up -- popping up. 68 in san francisco downtown, oakland, a little warmer, 74, and san jose downtown talking about mid-70s for the daytime high. lunchtime almost 70 degree, so beautiful day. air quality good.

stanford ends the season 19-13. after a by, the top seed arizona was rested and ready for the cal bears. cal had no answer inside for jefferson. he jams down two of his ten points. bears within striking range, at halftime down 6, but the wild cats put it away in the second half. johnson three for four from to you range, arizona -- three point range, arizona wins. cal has to hope for some consideration in one of the secondary tournament. anything but your standard day in the desert in the cactus league, will ferrell played for ten time, and played ten position, we'll look at that when we continue.

action. he played second base for the mariners in a game the a's won 4-3. after stops two and three he landed in dramatic fashion where the giants and white sox were playing. after a quick uniform change he got behind the plate. the way around catching live major league pitching was signal for an intentional walk, but a non-roster player, and then bruce gave the catcher the hook. the giants won the game, ferrell made one more stop for the dodgers and padres. everyone happy. >> he made the rounds out there today. >> >. i really like him. >> thanks joe. >> thanks. well, that's our report for tonight, thanks so much for joining us. >> and if you missed part of
