be crucial to his future. >> good evening everyone. hello. i am frank somerville. >> and i am julie haener. >> former 49ers defensive lineman ray mcdonald filed a lawsuit against the woman who says he sexually assaulted her back in december. ray mcdonald's lawyer says the move is to put pressure on the district attorney but others say suing an accuser is the wrong move. new at 6:00 p.m. ktvu's azenith smith is live with the attempt to clear his name. >> reporter: his attorney tells me if the ackizations weren't made he would still be with the 49ers with a contract. now he is selling his home and his career is on hold. >> it has been tough on him. he has a lot of uncertainty. >> reporter: he says ray mcdonald would want nothing more to play in the nfl but no team is willing to touch him with a criminal investigation hanging over his head. >> she understood what was going on.

>> reporter: in december the woman told police she woke up in his bed and was the victim of rape but the lawsuit alleges it was consensual. it says video cameras inside and outside of his home captured him and the woman had consensual sex the day after the rape. >> this will be difficult. a person's statements to the police as a victim or a witness to a crime are privileged. >> reporter: he says the lawsuit could harm him since victim statements are protected in court. three months prior we caught up with ray mcdonald. after his fiance accused him of domestic dispute. >> the 49ers weren't releasing him based on the rape, they were releasing him based on bad

adjustment. >> reporter: his attorney argues the woman's accusations weren't made in good faith therefore they are not protected. as for ray mcdonald to go after the 49ers, his focus is on vindication. >> that hasn't been looked into. he is concerned about moving forward with the future. looking at how can he become marketable to nfl teams. >> there are reports prosecutors do not plan to file charges but the district attorney says the case is still under review. >> all right. azenith smith reporting live in san jose. thank you. a san jose police officer charged with rape has changed his plea for the third time. the 39-year-old initially pleaded not guilty in 2013. and then changed it to no contest after prosecutors filed an amended complaint with

enhancements that carry life sentences. today he changed his plea back tonot guilty and asked the judge to drop the enhancement charges and grant bail. she charged with raping a woman who called police after a domestic dispute with her husband. >> reporter: we learned 100 cases could be reviewed after a series of racist and homophobic texts were sent between san francisco police officers. the four officers have been reassigned and don't have any contact with the public. the texts target gays, philippineose, latinos and blacks -- filipinos, luteen suppose blacks. -- law teenoes and blacks. -- latinos and blacks. . >> the notion of this case is that we no longer have privacy. >> the police police police police officers association

called the texts disgraceful and the chief plans to fire the officer physical the accusations are true. two men are dead after a shooting and a police chase. shots rang out around noon today. dispatchers received a call from a man saying he had been shot and needed help. when police arrived they found two men, one was dead, the victim of a gun shot wound to the head. police say the other man jumped into a suv and took off. officers followed followed the suv till the driver ramped into a gate. police say the driver stayed inside the car refusing to come out. when officers approached the vehicle they made a gruesome discovery. >> ultimately s.w.a.t. teams arrived. first thing they did was clear the vehicle and at that point the s.w.a.t. team from the sheriff's office here found the suspect inside

the vehicle dead from a self- inflicted gun shot wound. >> police are not releasing the men's names but a friend tells thos they knew each -- us they knew each other. new developments now in the shooting death of this young mother trying to protect her children outside her home in oakland. police announced two more arrests in the case. ktvu's cristina rendon with how the community helped investigators track down the suspects. >> reporter: it has been one week since gunfire rang out killing chyemil pierce. the street quiet today with messages of love for the mother who was protecting her children. now police announced additional arrests. three male adults have been arrested. shelton mcdaniels and jerry harbin were arrested on murder charges. anthony sims is already charged with murder. >> i ask for forgiveness. >> reporter: speaking saturday at a celebration of life for

chyemil pierce and others killed, she thanked the community for their support. >> this main is something that i never expected to ever experience. what makes it more tragic is this didn't have to happen. >> police say there were a lot of winds and several shooters -- witnesses and several shooters. they plan on pushing the investigation forward in an effort to bring justice and they credit the community for being crucial to the case. >> this shows how working together we can move this case forward to identify individuals who are responsible for this tragic crime. >> woman was also arrested over the weekend on suspicion of being an accessory to murder but the district attorney has declined to file charges against her. the two men arrested could go

before a judge this week. cristina rendon, ktvu fox 2 news. witnesses say a truck driver appeared to be trying to save lives as he trashed in pittsburg this morning. he truck two vehicles and smashed into a restaurant on railroad avenue and caught fire about 8:20 a.m. this morning. video shows the flames. witnesses told us the driver was flashing lights, hanking his horn and down shifting. >> he clipped me on the left hand side. totaled the truck next to me and went into the shopping center. he tried to go between us. so that, you know, he was -- he did everything he could. >> the truck driver died in the fiery crash. tonight there is no word on his identity. police are looking into the possibility of a mechanical failure. look at this. new video of the crash and fire inside the caldecott tunnel this morning. this video is from a

firefighter's perspective. it shows the emergency situation that crews trained for. all of that starred after a stalled car in the non-commute direction, created a chain reaction crash. ktvu's tom vacar live from above the tunnel with how bell first responders and the tunnel reacted. tom? >> reporter: i tell you what, this proves if you are prepared and plan for the worse, if you do what you need to do and you are familiar, you save lives. >> reporter: according to the video posted on youtube firefighters who responded to the wreck inside the caldecott tunnel were confronted with flames and smoke. the first responders drilled on this scenario just a few weeks ago. >> all four bores, in regards how to process an incident or accident of this particular magnitude. >> reporter: fire in a tunnel is always a very dangerous

law. >> ktvu's rob roth spoke with restaurant owners who are hoping now for some help. >> reporter: lunchtime today at the restaurant in the heart of china town. >> today not that many people coming in. >> it is been like that since he raised his prices to curve the new minimum wage hike approved last november. the minimum wage increase from $9 an hour to $12.25 an hour. >> tough time for us. i think we not going to make it. >> reporter: if he closes he will join 10 other restaurants that have shut down in part because of the increased minimum wage. many businesses layed off workers or cut their hours. restaurants operate on thin margins and owners are reluctant to raise prices. they are encouraging businesses

to hang in there. >> we hope the city will help us. providing discounted parking and putting resources to promote businesses over all. including china town communities. >> the price of a patty gone up a dollar because of the minimum wage increase but so far no customer back lash. >> so far no troubling signs. traffic is steady. as compared to before the price increases that we have done. revenue is up, our crew noticed tips are up. >> the minimum wage will stay, some businesses may not. rob roth, ktvu fox 2 news. san jose police have a plan to put cameras on officers by next year and a drone in the air by 2017. officers would begin field testing cameras this september and get them fully implemented a year later. that would include use by officers on patrol and on

special operations. the drone would be used during bomb squad operations and hostage situations. a police group is trying to persuade congress not to limit the use of license plate readers. they sent a letter to congress urging lawmakers to oppose bills that would restrict use of the device. they are used by police in several cities, including san francisco, oakland and san leandro. last year ktvu fox 2 news uncoved concerns over what happens to the personal information -- uncovered concerns over what happens to the personal information. the police group said they generate investigative leads that help law enforcement solve murders, rapes and property crimes, recover abducted children and support terrorism

ground. you can see that line right now. showers might be going on. again, not getting records of slick roadways, wet roadways. when that happens you know the traffic slows way down. when it hasn't rained in a while the roads, the oil comes up, the first real rain, that is not happening. over night lows inner 40s. low 50s. like last week. the forecast model sets us up, 9:00 p.m. tonight, weak wave that slides through. i would die for rain for my lawn. my lawn is getting hammered. same with you guys. the trees and the plants could use rain. this is not enough. in most cases. i am routing on anything. that is not going to be rooted.
