evidence related to the case. although they won't tell us what they are looking for. it was on the brink of falling apart and when one investor confronted him about it he ended up dead. >> reporter: row after row of grapevines searching for evidence in the murder that happened here yesterday. sheriff's deputies say around noon he called 911 for help. saying his business partner had shot him and was chasing him through the venyard. deputies arrive -- vineyard. deputies arrived to see him die. when the case ended police say he turned the gun on himself. he had been running the winery since 2013. this is video of him talking to fox news in august. >> scary. >> reporter: before the earthquake his business was in shameables. >> created -- shambles.

>> created wine. in the process the -- the whole enterprise went bad. >> reporter: he has been following the lawsuit for the past year. he says he dime napa valley 5 years ago escaping a troubled past in minnesota. >> two convictions for fraud. a bankruptcy. >> reporter: he created 5 different companies over the years. some investors accused him of taking money out of one company and putting it into another. he was one of his investors. >> he was a nice guy. he was willing to bend, he would bend so far with robert and then he would put his foot down and say no. >> he sued him for unfair lending practices. a judge threw the case out. >> there is a series of really increasingly bitter e-mails

that are part of the court record between them. >> reporter: they were supposed to meet monday morning at a san francisco law office to work out how he would pay back the 1.2 million he owed. >> he was going to lose everything. >> reporter: his attorney said yesterday he made a last minute change and asked if they could meet at his vineyard instead of san francisco. the attorneys were on the phone, the men were in the building when the conflict broke out and police say that is when he ended up shooting him. back to you. >> allie rasmus in napa county, thank you. police in napa today discovered a man's body inside a freezer. they say it may be a case of suicide. police say they went to the apartment to do a welfare check because the man hadn't been seen since february. after they entered the home they found the body inside a

large freezer. the man was 54 years old. police say he had a history of mental illness and may have put himself in the freezer on purpose. new developments in the case of a mother shot and killed while trying to shield her children from stray bullets. two of the men appeared in court and charged with murder. they killed chyemil pierce before 5:00 p.m. last monday night. ktvu's gasia mikaelian joins us with more on today's developments. >> reporter: we reported the arrests yesterday. police say two men were taken into custody over the weekend and booked. today they faced a judge. shelton mcdaniels and jerry harbin, 29 years old, were charged today with murder. the complaint shows shelton mcdaniels and jerry harbin have long criminal histories. both are held without bail.

the charges stem from a gun fight last week. investigators say chyemil pierce was struck by a stray bullet as she tried to shield her children. police say the story struck a cord and prompted the community to come forward with information. >> we have a woman doing what she was supposed to do. an innocent mother attempting to shelter her children from violence. danger. it has to hit a cord with you. you feel inclined to bring information. >> reporter: another man 19- year-old anthony sims was arrested a week ago in connection with this case. he was wounded in the shooting. police say he admitted to being involved. anthony sims has been charged with murder. and a woman taken into custody over the weekend has been released. the woman was arrested on suspicion of being an accessory to murder but prosecutors decided not to file charges against her.

>> thank you. we have breaking news from mountain view. another person has been hit by a cal train. happened just before 5:00 p.m. witnesses say the man jumped from the platform just as the train was going through the station and was killed. right now trains are single tracking on the southbound tracks through the area and that is causing delays with the evening commute. two other people were recently hit and killed by caltrains over the past few weeks. the people of a neighborhood rushed to help a family of five injured in a hit- and-run accident about 9:00 p.m. last night. neighbors said they heard the crash and ran to help. the family was in a car that had been broad sided by an suv. one man took video on his cell phone as she went to help a mother holding her baby and told her to keep breathing. >> whatever you do, stay here

a chase ended in a roll over crash on 280 this afternoon. the driver managed to get out of the suv and was taken to the hospital. the chp says the chase started in solano county and reached speeds up to 95 miles per hour. officers tried to full over the suv for a traffic check and the driver sped away. officers put down spike strips but the driver kept going. police are increasing patrols around the bay area tonight as people celebrate st.

recruit students from a more racially educationally diverse pool and help students trying to get into a four year school. the state water resources board voted for new water restrictions today to help california get through another year of drought. here are the rules. limiting the water of lawns to two days a week, request water in restaurants and no washing cars at home unless you have a shut off nozzle. >> we will have to move to more mandatory restrictions on the things we are doing. the volunteer regulations haven't gotten us where we need to get. >> outdoor water is 44% of home use. and fines are increased. new at 6:00 p.m. the effects of california's drought, a study shows because of the conditions we are paying more for our water and for our

power as well. researchers found the drought cost us more than a million dollars in electric bills. ktvu's tom vacar explores the conditions making matters worse. >> reporter: in normal years it lowers our electric bills, that is because the fuel, water from rain and snow melt is free. >> in a normal year we get 18% from hydro power. when there is a drought, that goes down. in the last couple years it has been 10, 11, 12%. >> they released a study today on what that is costing us. to make up for the loss, they must run more of their power plants. >> burn more natural gas and it is more expensive. produces green house gas
