woodrow is live. there are concerns about the company's inspection history. >> reporter: absolutely. according to these reports, robby trucking company had been unsatisfactory on two occasions. this is one of the terminals chp were investigating. they do it every two years unless a company has violations. they did have violations. inspections occurred more often. two months ago the most recent one. more violations. chp took the vehicles out of service and said they couldn't be driven. >> reporter: the chp says this crash that killed a truck driver could have been avoided. 2 investigates obtained chp safety records that show two

unsatisfactory ratings for robby trucking company. the most severe violations, faulty steering and breaks, resulting in 20% of the vehicles placed out of service. inspections found vehicles were over weight. one by 17,000 pounds. each time the company was given 120 days to fix the problem. chp says they fixed some while other new violations occurred. >> reporter: [ inaudible question ] >> it is our policy to do that. by law we have to give them due process to fix the issues. this could have been avoided if the company made sure the vehicle was properly maintained. >> reporter: still chp doesn't know if the truck that crashed was previously sited. the truck hit two vehicles before crashing into this empty restaurant. witnesses reported it appeared to be out of control and the driver was flashing his lights and honking his horn. >> he tried to go between us so

that -- you know, he was -- he did everything he could. >> chp's reports say the company did not have a preventative maintenance program and didn't maintain records. the company's owner said the truck was recently purchased and checked out fine and he is cooperating with chp investigators. >> reporter: they were due for its next inspection in two months. had they not fixed the problems by then chp could have revoked its carrier license. new at 6:00 p.m. what else chp is doing to stay on top of this investigation as for the crash that is being investigated by pittsburg police department. >> thank you. governor jerry brown today announced a new $1 billion plan to help deal with california's drought. to give you a sense of how dyer the drought is. these pictures were released by

are no traffic signals and cars often whiz by. >> reporter: this may only be short walk but those who do it say it is a dangerous one. >> when there is a lot of traffic it is scary. >> reporter: last night a mother was pushing her son in a stroller when they were struck by an suv inside the crosswalk. authorities say the driver is a 23-year-old woman. california highway patrol investigators say neither drugs or alcohol were factors and it appears excessive speed wasn't either. >> the driver at the time based on statements was taking the ramp at a safe speed. >> reporter: it does have a gradual curve as it approaches the crosswalk and from the crosswalk cars are visible but some say pedestrians need to be more careful too. >> i have seen people, you are driving and they walk out in

one of three men arrested in the killing of a mother from oakland during a gun fight appeared in court today. chyemil pierce was shot last week. 30-year-old mother of three was struck by a stray bullet and killed as she tried to shield

her children from gunfire. anthony sims did not enter a plea. he admitted to being involved in the shoot out that killed her. also today something you don't see all the time. anthonyanthony sims' mother spoke outside court about what happened. >> i praying for the family. and everything. i give them my condolence and for her children. i have grandchildren and everything and children myself so i apologize and i wish god -- god bless them. >> anthonyanthony sims' spoke saying the defense is in the process of gathering information in the case. >> all i can say is it is our believe that he was not the shooter. >> police also arrested two 29- year-old men on murder charges. investigators say along with anthony sims jerry harbin and

involves a woman who is suing a company for pdiscrim-- discrimination. target paying $10 million to settle a lawsuit filed after the data breach. people effected by the breach can file climes for up to $10,000 with proof -- claims for up to $10,000 with proof of the losses. the data breach involved information from 40 million credit and debt cards. attorney fees totaled $6 million. federal accident investigators released findings in the deadly crash involving a commuter train and a truck in ventura county last month. the national transportation safety board says the driver mistakenly drove 80 feet down the tracks tracks and got stuck. the warning lights were not on at the time. the driver had turned on his warning lights and got out of his vehicle. officials say a student

new at 5:00 p.m. accusations that dozens of california wine labels contain illegal and dangerously high levels of arsenic according to a lawsuit filed today in los angeles. ktvu's cristina rendon is in the news room to explain which wines are now under the microscope. >> reporter: frank, the complaint alleges wines from napa valley have high levels of arsenic in them and having a glas or two a day -- glass or

two a day could be toxic. the complaint alleges 28 california wineries are violating law by producing marketing and selling wine contaminated with arsenic and failing to warn consumers about the danger. it is an odorless, colorless and toxicpoiden found in plants and soil, known to cause illness and death in large amounts. they are producing levels far in excess of what is allowed in drinking water in standards by the environmental protection agency. it found 500% or more in what is considered the safe daily intake limit. the sale of the wines poses a risk to the public and uncuts the wine makers and sellers who

do not sell arsenic tainted wines. a lab in colorado tested 1,300 different types of wine and found 83 had elevated levels of arsenic. the results were confirmed by two additional labs. but a spokesperson for the wine institute disputed the findings and said although we are not privy to the litigation we believe this allegation is false and misleading and that all wines being sold in the u.s. are safe. a spokesperson for trader joe's said they haven't seen the complaint and they are investigating with several wine producing suppliers. we put a copy of the lawsuit on our website on www.ktvu.com. >> cristina rendon, thank you. a san francisco police officer who was under investigation for exchanging racist and homophobic texts has

resigned. he was one of four officers to be reassigned. 7-10 other officers are under investigation. the text messages came to light in an appeal of a conviction. an attorney said that he was very proud of the work he did but it is hard to see a successful career after a scandal like this. israeli prime minister benjamin netanyahu appears to be back tracking on his comments about a palestinian state. days before the election he said he would not agree to a two state solution unless conditions changed. that helped him win the votes. but today israeli prime minister benjamin netanyahu said he is committed to palestinian statehood however it climate has to change first and he insisted he hasn't reversed his stance. deal to reduce iran's nuclear capacity is getting

issues. >> janet napolitano also explained that she and governor jerry brown are working to try come to an agreement on how much funding the university system can expect from the state. tesla announced software upgrades that could warn drivers if they are going out of range of a charging station and guide them to the nearest. the ceo says it will go a long way towards ending range anxiety for drivers. the app will function in real time and will be able to tell if a station is busy or out of service. apple made its debuts a part of the dow jones today. the dow made the move after stocks split. apple dragged down the dow today. the dow is down 117 to 17,959. the nasdaq is up 9 to 4,992.

p.m. starts now. this man is under arrest after authorities say he posted threats online targeting a bay area sheriff's deputy and the whole thing may have started over a routine traffic ticket. good evening. i am julie haener. >> and i am frank somerville. >> the sex offender says an alert citizen -- the sheriff's office says an alert citizen notified authorities. ktvu's ann rubin with the specific threats that were made and why deputies are taking this so seriously. >> the threats named the deputy, the department and the weapons. and they say they weren't taking any chances. >> reporter: social media posts, this was the trigger. a ticket. he posted a picture of it online and of the deputy who gave it to him but his social

media post -- >> there were a variety of threats, specific threats involving wanting to kill the deputy. wanting to hurt deputies in general, blowing people up. >> reporter: one post mentioned planting a bomb on the squad car. a citizen hurted authorities to the threat -- alerted authorities to the threat. >> we have seen we can't laugh these things off anymore. very often they do prove to be credible. >> the sheriff's department sprung into action, serving a search warrant to his home and taking him into custody for the threats. neighbors understand why authorities are taking this seriously. >> i would too. >> sounded serious. that is serious in my book. >> the deputy barely remembered the encounter and didn't think a ticket
