dead body has been found in a swimming pool at a high school. i'm mike mibach. that body was discovered in san jose. what can you tell us, ann? >> reporter: school was released early. students were offered counseling and told about the body. it was a second period swim class that made the discovery.

the body of an adult male was at the body of the diving poolment they do not believe it is someone affiliated with the school. they took inventory of staff and students. it had been locked yesterday evening. they can't understand how someone one might have gotten in. >> all of the pools are secure. they have an extra high fence, barbed wire around it. all of the doors from the inside are locked so you are to be intentional to get into the pool. >> reporter: they say the person was not carrying any identification. again, school has been released for the day. there was question about whether a school spirit event scheduled for tonight would be taking placement we think we just heard on the public address system it may have been canceled. we'll send it back to you. >> do you know when they locked that pool up if they also locked down the pool cover on

top of that pool? >> there was a question about that. one parent said her son was in that class and said he was pulling the cover off the pool when the body was found. that would lead me to believe the cover had been placed on it. >> all rightment we'll look for you later on at 5:00. new at noon authorities say they have rounded up members of a prison and street gang. here are pictures of the 24 people they say are lanked to the gang. they used coded communications to carry out robberies, sell drugs and handle removals, code for killings. trial is set for april 13th. six of the suspects have not been found. president obama today issued a statement on the marin

county men as the country celebrates the holiday. he has been detained for more than eight months. the president says it is painful that on a holiday ridding one self of the past year his family will continue to carry the concern of his health and well being into the new year. jason who is 39 years old grew up in marin and also holds dual iranian citizenship. he was working for the washington post when he was detained in july. no word on the charging he faces. a week ago we brought you an interview with jason's brother. he talked about how tough this has been for jason. >> it takes a big toll on him that he is not getting the kind of iranian justice he believes he deserves, the protections he has as an iranian. >> they are committed to bringing him and three others

of murdering a woman in 1980. they asked tough questions. they say one of the worst areas is a block surrounded by interstated 580 and 880. it was just north of there two people were seriously rounded in a gun battle that went from oakland to emoryville. it wound up in the parking lot of the best buy store. oakland police were in the midst of a community meeting focusing on the mother of three. pierce was killed last week. they say it began up the street outside of what was described as a drug house. they got 911 calls aba heat -- about a heated verbal argument. >> the call initially came in as an argument which is not an

uncommon call for the oakland police department to get. we want to respond quickly but it is all a function of how many officers are available and how many other calls are standing. >> he points out the department is chronically under staffed but they are working with the city to shut down known drug houses as fast as possible. one person was hurt in a fire. it happened near brazil avenue. they say the garage was engulfed in flames. they had it under control within 20 minutes. one person was taken to the hospital. we don't know the extent of his or her injuries. the cause of that fire is under investigation. also in san francisco a 13- year-old girl died after a fire in the mission district. she is the second person to die from that fire. the girl's father died from his injuries last weekend. a family's apartment is above a liquor store. it caught fire the morning of

march 11th. a mother and two young boys did suffer from smoke inhalation. the cause of the fire is still under investigation. ahead, more fallout after he is caught on an open mike. plus governor jerry brown in oakland today, why he says businesses should hire excons. and it is cooling off for the weekend. a chance of rain out there. we'll have more after the break.

new at noon, the sheriffs department told us they arrested two men in connection to a shooting investigation. it started when someone called 911 at 4:00 this morning saying a neighbor had been shot near petaluma. they stopped at 7-eleven to ask for directions. they say the man was bleeding. the injured man was gone when officers arrived. deputies arrested a 22-year-old man and a 20-year-old from fairfax for assault with a deadly weapon. it is not clear what lead to the shooting. deputies say the case will remain open. the victim's injuries are said

to be nonlife threatening. if you're an employer would you hire a person that committed a crime or exconvict? the governor met with employers this morning, brian. >> reporter: yeah. the governor spoke to employers and employment specialists who cater to giving exconvicts jobs. he said giving them jobs will keep criminals off the streets. >> any time someone puts you in a cell and shuts the door and locks it you're being punished. now, they can give you a book to study but you're still being punished. that doesn't mean to get people working, studying, working on mental illness, upgrading skills, reading, getting degrees, all of that. >> reporter: and we caught up with governor brown after he spoke for about 15 minutes here at oakland's merit college. it is hosted by several

organizations that help offenders get jobs after they have been released. they help about 8000 exoffenders get job in service, manufacturing. it helps exoffenders give back to society instead of being a revolving dow door. many that we spoke with agree. >> if there's a punishment let's let it be what it needs to be not more than that. let's provide skills. let's provide work opportunities. once a person has served their time and sentence they need to come home to some opportunities to give back and one way to give back is to be employed. >> reporter: many say getting employers to understand that hiring people who served their time can often be ben official because it lowers prison overcrowding, gives more ex- convicts a sense of pride knowing they can provide for

themselves and their families. this is something the governor says he will continue to work with. according to the california department of corrections it is right here in the state. still roughly around 51%. it is one of the highest statistics in the nation. back to you. >> interesting to see how they will respond. thanks for that report. calling the deaths of two men a murder-suicide but the motive is not known. the double shooting happened at the apartments for low income seniors yesterday afternoon. fire crews found one man in an elevator and a second man in an office. he had been shot multiple times. >> we'll continue to look into any possible relationships they had to see whether there was some kind of ensuing argument or something that occurred in the past that may have lead up to what happened. >> one was in his 60s and the

other in his 70s and both live in the complex. shug night collapsed in a courtroom after a judge set his bail at $25 million. night is charged with murder and attempted murder for allegedly rung over two men in january with his truck after an argument to an upcoming movie. prosecutors accused night including money louderring and threating and extortion. another bat with rabies has been found in the east bay. the first was found in san leandro. the latest rabid bat was discovered last saturday. they known as mexican free tailed bats. they are not big or

bloodthirsty. they feast on insects. it is a potentially deadly disease and they are trouble bid number of rabid bats found so early in the year. >> we have four rabid bats and last year we only had two for the whole year. >> wildlife experts suspect about 1% have rabies. avoid touching bats which can transmit the disease through bites or saliva. this is what it looked like this morning in maryland. up to 6 inches of know expected today in some northeast and mid- atlantic states. they say new york will be the hardest hit city. it is expected to get up to 6 inches of wet snow. boston could get another inch or two. no snow here in the bay area but possibly some rain out there. >> you're right. the first weekend of spring
