we're live in oakland, where a 9-year-old boy is in the hospital after falling through a skylight at an elementary school. we'll tell you why he was up on top of the roof and what his condition is now. plus, this well-known waterfront restaurant is ordered to shut down by the port of san francisco. we'll tell you about the deadline that passed this past weekend and the action that could be taken later today. 7:00. you are looking live at one of the longest-standing restaurants along the san francisco bay. it's called sinbad's. according to reports, the port of san francisco has been trying to evict the restaurant for some time now but the owners are not going down

.10. we are gating some really good rain over walnut creek here but it's on the back side now gone through berkeley, emeryville, piedmont, oakland. and then heading over highway 24 and 680. highway 242 as well. concord, pleasant hill, that's the cell that went through walnut creek heading towards mt. diablo. it looks like it ended in la fayette. 40s and 50s on the temps. our system will swing in a lot of clouds and some rain. it's light and it's not widespread. it's kind of hit or miss. a little cooler, breezy for some. 60s on many of these temperatures. this will be the coolest day of the week. we'll have more on a warmup later this week in about ten minutes. here he is, sal, any issues out toward the east bay. yes, steve, the rain has slowed traffic down especially where the rain has just hit. on the eastshore freeway, we have slow traffic this morning

coming in as you drive from the carquinez bridge to the macarthur maze. the traffic is slowing down. usually it's not quite this much time to go between the carquinez bridge and the macarthur maze. but there it is. you can see the traffic is slow getting to the bay bridge toll plaza. i want to mention when you get to the toll plaza, it's more like a normal delay as you drive through. 680 has been very slow from the get-if. we had an earlier accident, 680 at 8 4. 580 westbound, traffic is backed up all the way into livermore. if this is your commute, you need to give yourself extra time. more people are on 880. they are avoiding 680. that's backed up all the way down to fremont in a some id line. all of this -- some -- solid line. all of this is slow. 7:03. back to the desk. >> thank you, sal. a 9-year-old boy from novato suffering from severe head trauma and spine arinjuries after falling

through a skylight at his elementary school. tara moriarty is live where he is now in intensive care. >> reporter: well, good morning. 9-year-old william wells suffered head trauma when he fell. they say he will make it. but it will be a long road ahead. he will need most likely a full body cast. while doctors were doing a scan, they discovered a previously undiagnosed condition, a benign cyst on his brain. let's take a look at pictures taken from inside the hospital. this is william wells. you can see the large bump on his head. he also suffered seven fractures in his spine as well as internal bleeding. >> while they were playing basketball, aparently one of them kicked the ball. they went on the roof. he's very lucky. he could have landed on something, he could have landed a lot harder. it could have been fatal. >> reporter: school officials at hamilton school have not commented on how the 9-year-old

was able to access the roof. but they have said that their hearts go out to the family. as for william's cyst, doctors say they are going to observe him before going forward with any treatment. live from children's hospital in oakland, i'm tara moriarty, back to you. >> thank you for the update. the search will continue today for a missing hiker in yosemite national park. 20-year-old michael dahl was last seen on saturday. he's described as 6'1" with reddish-brown hair and green eyes and was wearing jeans. he was last seen in lower yosemite falls. that's about half a mile from the yosemite valley visitors center. we've circled both places in red. anyone with more information is being asked to contact authorities. a well-known san francisco waterfront restaurant is fighting to keep its doors open despite being ordered by port

officials to move out. fox 2's alex savidge is joining us live this morning with more on this battle over sinbad's. >> reporter: good morning. >> reporter: good morning. the owners are -- the owners are not going quietly. they are pushing back against an order to vacate. the deadline to leave was this past saturday. that deadline has come and gone. the port of san francisco is ordering this restaurant here along the water front at pier 2 to close down so the building can be demolished to make way for more piers. they've been serving up seafood and drinks with spectacular bayviews for the past four decades. they said on their facebook page the restaurant remains open. now, the port has been trying

to close sinbad's down since 2012. the plan is to use that space to expand ferry and water taxi service near pier 2. the brothers who own the restaurant told the chronicle that they are trying to work out a deal to keep the restaurant open for one more week. the end may not be here just yet but it is in sight. and this is told a fight that could heat up as we move throughout the day as the owners may be served with an actual eviction order at some point later on today. >> all right. alex savidge in san francisco. we'll talk to you later. thank you. >> okay. well, today, the la fayette city council will consider whether to extend an agreement about a hotly debated development plan. the proposal would allow a large apartment complex or houses to be built on land along highway 24 across from the high school. the agreement, which would be extended to july, stops the clock on a lawsuit over the

terrace's apartment complex. the city considers the smaller development of houses. some of the neighbors have actively opposed this project for years. they are really concerned about traffic and what they say is an already congested area. 7:07. without acknowledging the threat is real, the pentagon is urging vigilance this morning after an online threat from isis against the families of u.s. military members. the pentagon is concerned about an online hit list posted by a group claiming to be the hacking division. the posting shows the pictures, names and addresses of 100 military members. they say the list is like marching orders for lone wolves and isis inspired operatives. >> they have a hacking disk vis. they have all of these different divisions. they are getting to a point where they are very organized and are pressing just as hard in social media and online as

they are on the battlefield. >> u.s. political sas say it doesn't appear that the information came from any hacking activity but rather from public records and social media postings. the marine corps is urging its personnel to check what kind of information they've posted online and limit how much information is available. tensions are increasing in yemen. rebels have taken over one- third of yemen, including the capital. that's prompting the u.n. security council to demand an end to the conflict. there's growing concern that tension will lead to yemen becoming like iraq, yemen and syria allowing groups like isis to benefit from the deterioration. >> okay. 7:09. back here at home, the supreme court is taking up issue of how disability laws affect the

police. coming up, the closely-watched case and how it involves san francisco. conversation over. the reason starbucks says it's decided to stop writing "race together" on coffee cups. we're looking at a commute here that's a little bit affected by wet weather. we haven't said that in a while. although on the bridge, it's dry and traffic is moderate. well, not often we can say morning rain. but that's what we've had. not for everybody. but a good cell from marin county to the east bay. we'll take another look at it -- coming up.

welcome back to "mornings on 2." 7:12. a former engineer at twitter is suing over what she calls a secretive promotional system at the san francisco-baited company. now, tina wang says twitter create as glass ceiling for women that can't be explained by any reasonable business purr pots.

her lawsuit says twitter does not have a meaningful promotion process and that she was overlooked for promotions. she also claims when she complained to twitter's ceo, she was put on administrative leave. she won $16 million to settle her gender discrimination lawsuit. also, ellen powell, who is suing klineer perkins for gender discrimination, on saturday, the judge hearing the case ruled klineer perkins can be ordered to pay punitive damages. that could possibly mean millions more if she wins. the judge said there's enough evidence for jurors to find malice or other grounds for punitive damages. the menlo park firm denies powell's allegations. 7:13. starbucks is no locker encouraging its baba reese das to engage conversations about

-- baristas to engage conversations about race relations and the ceo said they can stop writing the words "race together" on cups. the campaign has been advertised as on tunis tick -- opportunistic. the effort is far from over, he says. california created more jobs in the last year than any other state in the country. california added 498,000 new jobs in 2014 and that's almost 30% more than texas which ranks second. florida, georgia and new york rounded out the top five. southern california saw an unexpected increase in job creations boosted by tourism

construction and international trade. overtime spending topped more than $1 billion last year. state prisons accounted for more than half of overtime payments at $543 million. more fires meant more spending for calfire at 139 million. the highway patrol and the department of state hospitals also spent more than $100 million in overtime. overall, spending was up 20% from the year before. in fact, the last time overtime spending was that high was in 2008 when there were 20,000 more state employees. 7:15. a college baseball player from bloomsberg university in pennsylvania has been kicked off the team because he posted a tweet about monet davis, the little league world series star. now, junior first baseman joegy castleberry posted his reaction to hearing about a movie from davis, saying "disney is making a movie about monet davis.

what a joke." he then called her an offensive word while referencing her team's loss to nevada during the series. now, monet davis, from philadelphia was the first girl to earn a win and pitch a shutout in the little league world series. you've seen her on "sports illustrated" and bloomsburg was saddened by the tweet of that player. that player's account has been deactivated but not before he said "one stupid tweet can ruin's someone's life. i could not be more sorry about my actions." the warriors will celebrate something that's happened just once in their history. this was 40 years ago that the warriors won the nba championship. they were the underdogs when they swept the washington bullets in four games back in

seconds. 5, 4, 3, 2, 1. ♪ >> that's enough air time for the spider. let's move along. thank you. let's move to another picture. the 25-minute delay at the toll plaza, this is a look at the san mateo bridge. the traffic has been moderately heavy here as you drive through. i do want to mention that the worst commute in the bay area has been 580 to 680. we can go right to it. all of it is slow. we've had a couple of minor accidents along the way. 680 has been backed up getting down to fremont because of an accident on the sunol grade. people have been trying to use 880 as an alternate. it's backed up to marina boulevard. the east bay commutes are very slow. bring your patience with you. back to the desk. a santa clara convenience store is open again it morning after a deadly shooting yesterday just outside of its doors. ktvu fox 2's janine de la vega joining us now. the police are still checking evidence. and you can tell us more on how two officers had to make a

split-second decision. janine? >> reporter: yes, police say this parking lot at 7-eleven was pull of customers and they were there when an armed robber walked out of the 7-eleven. officers were concerned for the people and now police are reviewing the surveillance video of what unfolded here. it happened just after 2:00 a.m. yesterday morning. two officers just happened to pull up to the 7-eleven on scott boulevard and saw a suspect point a gun at a clerk. the officers say he didn't follow commands and they fired killing him. the clerk in the store was not hurt. the bullet missed him and grazed the floor leaving a dent in it. >> i'm glad he didn't get hurt. i'm glad the cops did what they have to do. pretty scary having to fire the gun, too. >> reporter: police won't say how many shots officered fired but neighbors say they heard several. the clerk working this morning

told me that she was filling in for the clerk because he was too shaken up to come to work. she's also mentioned she has been robbed before here. she says it goes with the territory. the two officers involved in the shooting are on paid leave. dave? >> and looking over your shoulder, it looks like it's quite busy at that store. >> reporter: yeah, it is. it's been like that all morning. people are sort of buzzing around talking about it, asking what happened. >> right. all right. janine de la vega, thank you. 7:35. happening today, the san francisco police department is set to hold a community meeting to talk about last tuesday's deadly officer-involved shooting. officers say 24-year-old alice brown was driving recklessly on van ness and pine street. they say she drove the one way on a one-way street -- grieve

the wrong way on a one -- drove the wrong way on a one-way street. brown's sister said she lived a troubled life. the u.s. supreme court will hear arguments today in a case over how police in san francisco dealt with a mentally ill woman who threatened to kill her social worker. back in 2008, police forced their way into teresa's woman at a group home and then shot and wounded her after she came at them with a knife. attorneys for her say the merning with disabilities -- say the americans with disabilities act, the city says the ada won't require accommodations for those mentally ill and pose a threat to others. santa clara police are warning residents about a phone scam involving someone impersonating a police officer. so far, four cases have been

reported of a person pretend be ing to be a police sergeant going by sergeant gomby or sergeant gandy. the person was caught on video speeding, they say, and then the man says purchase a prepaid debit card in the amount of $300 to $800 to avoid arrest. police say they never make calls on warrants or payments. a debate is really heating up over a controversial plan aimed at making the air cleaner but it could also make your home harder to sell. brian flores joining us live now in san rafael. what does this plan have it -- have to do with fireplaces in bay area homes. >> reporter: well, bay area air quality management officials are proposing a rule change when it comes to winter spare-

the-air days. particularly fireplaces. some owners say the changes could be very expensive. now, the proposal calls for homes not to be sold or rented if it has a wood burning fireplace. home would have to be installed with gas or electrical fireplaces or a certified stove. hrnls could make the fireplace inoperable. they hope this rule goes into effect by november 1st of next year. opponents of the proposal say it will cost homeowners to comply. it could cost anywhere from $2,000 to $3,000. supporters say it would make bay area air quality heather. they say say there's a program for those who use fireplaces for heat and they can register

devices. there's been complaints for burning these excessively. over 150 tickets were issued as well. the main concern, simly to get the word out. nothing set in stone as of yet. they are holding a series of public workshops. nine throughout the counties. the first one is scheduled for march 25th in morgan hill. more information go to the bay area air quality management website. back to you. >> thank you. a deadly rockslide at point reyes national seashore killed one person and sent another person to the hospital. it happened saturday afternoon near arch rock. this image shows how big the collapse was in comparison to the people at the top of the photo. a spokesperson says a fissure or crack in the land was discovered on wednesday. morning signs were posted but no one expected the trail to give way. >> i think what shocked us just as much is how quickly we saw

this crack in the ground there and then how quickly is broke off. we've never experienced anything like this. >> there were several people on the trail when the collapse happened. two people fell about 70 feet. one of them died. area leading up to arch rock is now closed. a gofundme account has been set up for the victims. you can find that link at ktvu.com by clicking on web links. the aging sea wall along ocean beach is getting a face- lift. they have tarted to repair cracks and hole oses on the concrete -- holes on the concrete wall. construction is expected to last through next year. funding comes from the settlement of the 2007 cosco busan oil spill which closed the beach for a week. earth day is approaching. volunteers can sign up to to be part of the 2015 california state parks restoration and cleanup april 18th. this is video from a past

roof of an elementary school. tara moriarty, you are at the ucsf bennyoff children's hospital where he's being treated for serious injuries. >> reporter: that's right. there are still a lot of unanswered questions about how 9-year-old william wells got off the roof of the school. he will make it but not without a long road ahead. >> you are okay. you are okay. you are okay. >> reporter: yesterday morning, novato paramedics worked to pull william from his mother's suv as she drove him to the hospital. he was transported to children's in oakland when staff saw how severe his injuries were. >> i was in shock. >> he was seven fractures in his spine and trauma -- trauma to the head. >> he fell through a skylight and landed on his back. >> reporter: pictures show the large lump on his head.

he also suffered internal bleeding. william climbed on top of the roof of hamilton school to retrieve a ball when the accident happened. while doctors were assessing his injuries, they found something unpreviously diagnosed, a benign cyst on his brain. they will observe him further before deciding on treatment. in the meantime, he will most likely have to be put in a full- body cast. back to you. the search will continue for a missing hiker in yosemite national park. 20-year-old michael dahl was last seen on saturday. he's described as 4'1" with reddish-brown air and green eyes. he's -- he was wearing a light blue hooded sweatshirt and jeans. he was last seen at lower yosemite falls. that's about a half-mile from the yosemite valley visitors center. we've circled both places in red and lower yosemite falls is the circle on the left.

two santa clara police officers now on paid leave after a deadly shooting. ktvu fox 2's janine de la vega reports timing played a very important part in the death of a robbery suspect. >> reporter: if police officers would have arrived a few minutes earlier this robbery suspect may have gotten away. and he could have been alive. he took the day off. police are reviewing the surveillance video from the store but the department says they already have eyewitnesses. two of their officers just happened to pull up to the convenience store on scott boulevard early sunday morning and saw a suspect point a gun at the clerk and fire a shot. he exitrd the store and was confronted by the officers who say he didn't follow their commands. they feared for their life and fired at the suspect killing hi. a loaded gun was found near the body. neighbors at a nearby apartment complex say they heard several gunshots but police won't confirm how many were fired

$300 to $800 to avoid arrest. santa clara police say they never make calls on warrants or payments. a new proposal for the air qar tull district could make the air cleaner. but it may also make it harder to sell your house. this plan is calling for a banning wood burning fire plates. brian flores joining us live in san rafael. why do they want the plan. air quality officials say the fireplaces are the main culprit, if you will for the harmful particulates in the air. a new proposal that still needs to be approved calls for changes when it comes to your fireplace. some homeowner, especially say it could be expensive. this calls for homes not to be sold or rented if it has a wood burning place. instead, they need to be installed with gas or electrical fireplaces or a certified stove. homeowners could also make the

at live pictures. the demonstration outside of the mission district police station, 18th and valencia street. a lot of people out there with signs and carrying things. some of the protesters are chained together in front of the police station. others are blocking traffic on valencia. our camera is taking you to where they are right now. you can see them up against the -- the gate right there. they say the demonstration is against police violence and it's also in commemoration of the one-year anniversary of the killing of alex nieto. he was shot and killed at bernal heights park by police officers who said he pointed what looked like a weapon at him. it was later reportedly determined to be a stun gun. now, again, you can see what's happening in these live pictures. we'll keep falling this and bring you an update on the ktvu news at noon. 8:50. three south bay students are showcasing their science

projects today. more than 100 students were across the country were selected to attend. there's a device by someone that measures the capacity and design of stitched fabric. there's a model that predicts the spread of breast cancer cells more accurately and there's an 18-year-old from san jose, she created a sensor that only needs a single drop of blood so people at risk of heart disease can test themselves at home just like people with diabetes and heart disease i believe is the number one killer. to be able to get a simple way to detect that would be amazing. >> bravo for them. 8:51. a woman from kentucky struggles to finish her race. we'll tell you how police officers stepped in to help her reach her goal.

the bodies of seven children killed in a brooklyn house fire are headed to israel for burial. the children were sleeping upstairs when a fire broke out in their home early saturday morning. they ranged in age from 5 to 16 years old. their 14-year-old sister and their mother survived but both remain hospitalized in critical condition. the children's father was out of town at the time of the fire and he's asking people to pray for his wife and surviving daughter. he says the only way to get through the tragedy is to rely on religious faith. a police officer from kentucky is making a lot of people smile. touching hearts for helping a struggling runner finish a six- mile race. these foe foes from twitters show aubrey gregory joining air shaw ford for the last two miles -- asia ford for the last two miles of the race in louisville. she used to weigh almost 500 pound. she was forced to lose weight.
