his friends. >> that happened with us earlier and he followed them and kept instigating them. police are investigating a shooting that wounded at least two people. it happened at about 4:30 this afternoon. police responded to 25th and wisconsin on potrero hill on reports of shots fired. they didn't find anyone. but three men later showed up to potrero hospital and gunshot rounds. a medical examiner has identified a body found in a burning camper. the man has been identified as canata perkins. authorities did not release an age. police made a discovery at 6:45 this morning after firefighters

put out the flames. the camper was parked near the intersection of engles and van dyke. there's new controversy surrounding officers. there's word that the officers were running a club fight with inmates. >> probably some of the most troubling and outrageous conduct that i've ever seen. >> reporter: inmates named officers involved in the ring.

adachi played audio of an inmate that says he was injured after getting into a fight with an african american inmate. >> if i didn't fight, that i would be faced with beat up by themselves, by deputies. >> reporter: lawsuits in 2006 and 2007 allege new sexually harassed male and female inmates. the city offered a settlement in the latter case. in 2009 the city settled another suit that alleged new sexually harassed another male inmate. >> i'm extremely disturbed by it. >> reporter: the deputys are now on leave and the sheriff has launched an investigation. >> i do not accept any culture that would result in barbaric

joseph carter was taken into custody in lodi. investigators say he helped his brother janel after his escape. now joseph is accused of being an accessory after the fact. a $6,000 reward is now being offered in the escape of carter. they think he has left the an jose area. he was behind bars awaiting trial on child molestation charges when he escaped. mike pantes signed the religious restoration act which allows businesses and individuals to deny service to gay people. san francisco mayor ed lee calls it discriminatory and has now barred city employees from traveling to indiana using public money. and mark benion the founder of sales.com says his company won't send any employees or

customers to indiana. the cockpit voice recorder indicates it was a deliberate act. it now appears the co-pilot deliberately slammed the plane into the alps and it now appears the pilot was locked out. jana katsuyama has the story. >> reporter: this all comes as investigators have listened to the black box. families of the victims walked in a long line. coming together in brief to the mountain where 150 people lost their lives. french investigators say they could hear passenger screams just before the plane crashed into the mountain. >> reporter: we are speechless

that this aircraft has been deliberately crashed by the co- pilot. >> reporter: that co-pilot had logged just over 600 hours of flight time. lubis and the captain patrick could be heard talking normally after the plane left in barcelona. the captain asks him to take command of the plane and left the cockpit presumably to use the lavatory. lubitz then set the plane to 1,000 feet. the captain is heard knocking and then pounding on the door increasingly frantic. investigators say it appears lubitz flipped the switch that

did not allow the pilot to get back into. police surrounded his family's home in a town in western germany. neighbors say he was calm and low key. a regular jogger who dreamed as a child of becoming a pilot. lubitz did come to the 2008 to the u.s. for flight training outside of phoenix. lubitz training was interrupted for several months but they gave no reason. they say he passed all tests. >> when we choose our candidates we not only look for skills but we look mentally healthy pilots.

new information tonight on the shooting that killed san jose police officer michael johnson. investigators now say a fellow officer returned fire killing the gunman on the balcony of his apartment. that officer is identified as doug potwora a 16 year veteran of the force. ktvu's azenith smith with more on the investigation. >> reporter: according to a study released it was an officer that killed scott dunham. >> the weapon that was found next to the suspect was very inconsistent with the type of wound that he had. >> reporter: san jose police assistant chief eddy garcia says a veteran police officer was standing next to officer

michael johnson when the gunfight occurred tuesday night. >> the officers were ambushed. they had no time to react. >> reporter: dunham from his apartment balcony first shot at officers killing johnson. that's when another officer 44 feet away returned fire. police are not releasing how many times dunham was hit or where. >> this individual that returned fire, i wish i had a better word than bravery for what this officer did. but he certainly not only did he save his own life, he may have saved the lives of other police officers and may have saved the lives of other police officer members. >> reporter: garcia says that officers are on high alert. police took this suspect into custody after he had broken into his ex-girlfriend's home. police say this unregistered loaded rifle was found lying

basis. a 70-year-old man drove his car right through the front window of a 7/11 in daly city today. it happened this morning on hillside boulevard. the store owner was quoted as saying the driver appeared confused. first backing up then accelerating forward right into the store. no one was hurt inside the store. but the driver of the cadillac escalade was taken to the hospital. a 13-year-old boy from martinez is in juvenile hall accused of stabbing a classmate at school. it happened at martinez jr. high on court street. as cristina rendon reports, there are two accounts of what caused the attack. >> reporter: it was a disturbing day, a seventh grader used a knife to stab a fellow student inside the boy's locker room at the end of the third period p.e. class. >> you expect your children to

four people were critically injured after an explosion sent rubble and glass flying from a new york apartment building today. the explosion and fire also caused that five story building in the east village of manhattan to eventually collapse. a preliminary investigation found that it happened while plumbing and gas work were being done in the building. a utility company said it had checked the work and it failed the inspection. 250 firefighters were called in

to put out that fire. a federal appeals court agreed to strike down a california law dealing with concealed weapon permits. that law required an applicant to demonstrate a real danger or other reason beyond self- defense to obtain a concealedded weapon permit. but then a year ago, the ninth circuit court ruled 2-1 that the requirement violated the second amendment. now an expanded 11 judge panel of the court will reconsider that decision. gavin newsom is moving forward with efforts to legalize marijuana in california and hold town hall meetings to vet the idea. newsom is leading a blue ribbon commission that has outlined the requirements of legalized pots. one issue is how marijuana would be taxed. and whether medical marijuana users would have to pay that tax. he says he's also concerned about the health and well being of children and adolescence. >> children are telling us it's much easier to buy marijuana today than it is to buy alcohol. so no one can argue for the status quo. i mean either we have to get

tougher on that or we have to say maybe we can move in a new direction. >> reporter: another concern is how to test drivers for marijuana intoxication. newsom is beginning a process to get feed back from residents all around the state. it was a rare moment of bipartisan ship in congress that helped solve a problem with medicare. the house overwhelming passed the so called doc fix bill. it was authored by republican house speaker john boehner and nancy pelosi. president obama praised the house saying this is how congress is supposed to work. he says he hopes the senate approves it and sends it to him for his signature. new at 10:00, a bay area auto body chain known for its generous giving each christmas surprised a deserving young

a high school in wine country is using cork not in bottles but on the football field. it is a move they say will keep students safe. ktvu's john sasaki spoke with officials today and they said the cork is actually a healthier alternative replacing a controversial material being used on many high school fields. >> reporter: the days are numberedded for the grass football field in sebastapool's high school. >> why move away from grass to synthetic. >> ongoing maintenance costs, the cost of water. >> reporter: the west sonoma county district decided several years ago to revamp the stadiums and replace the fields here and at el molino high school using synthetic fields with shredded cork filler.

we met off campus were pleased to hear about the cork plan. >> i trust that they know what they're doing and they know what's best for us. >> i think it's safer decision thinking about the kids. >> reporter: the stadium with their cork fields here and at molino are expected to start this summer with completion in december. meaning neither school will have home games this fall. a food market is set to fill about 20,000 square feet of the old sears building in oakland. the project is called uptown station. an investment firm is renovating the building that sits at 20th and broadway just about a block or so away from the fox theater. the market is expected to open next year. on wall street, they closed lower today, stocks did. the dow dropped 40 points and has lost ground four days in a row. the nasdaq dropped 14.

the s & p500 also closed lower and is now in the red for the year. we talk about some of that record warmth. there were a number of records out there above average temperatures. we showed you that 90-degree reader in gilroy. 85 in san jose. not as warm tomorrow. we talked about the fog that's forming right along the coast. you can kind of see it in here. i have reports of fog now showing up around daly city. the fog will be in tomorrow morning but it won't get that far. it won't linger in. i don't think it'll get that far inland. current temperatures i think the fog is going to do something like this. it's going to run this ridge line here. i don't think it's going to spill into concord but it will be in the petaluma area. the noscasio gap and pushing that way. it's just what you would expect for this time of year. it's been warm, the warm air rises into the valley.
