ainst her on every claim. ellen pao filed lawsuit against kleiner perkins caufield & byers for gender discrimination. she argued she was realiated against for filing the lawsuit and for things she said in conversation and a memo in 2012. she sued for $16 million. the firm argued she was fired for poor performance. the jury came back with a verdict finding ellen pao's claims were without merit. kleiner perkins caufield & byers was pleased with the outcome and ellen pao read a prepared statement. >> i am grateful to my legal team and to everyone around the world, male and female who reached out to express support and to tell me my story is their story. i have told my story and thousands of people have heard it. if i helped to level the

twitter for not promoting female engineers to leadership positions. and she filed a lawsuit against facebook. she alleges sex and race discrimination. developing news tonight, protesters march to the berkeley police department to rally against the downtown berkeley association and the ambassadors who patrol the street. a dozen people showed up to support the homeless person who was attacked sunday night. video shows the ambassador punching a homeless person. the video was posted on youtube. he can then be seen confronting a second homeless man. the ceo of the downtown berkeley association told us the male was fired and the female has been suspended indefinitely. in a half hour from now one of two vigils will begin for officer michael johnson, the san jose police officer who was killed in the line of duty and

in light of the shooting officers are calling attention to computer issues in their patrol cars. the night officer michael johnson was killed the suspect crashed an hour after the shooting. ktvu's azenith smith is in san jose now with the plan to fix the problem. >> reporter: officers say when the system crashes they can only rely on the radio system and only one person can talk at a time. also, had the suspect been at large it could have put officers at risk. >> reporter: tuesday night was a difficult night for san jose police as one of their own, officer michael johnson was killed by man armed with a gun. but adding to that the computer crashed within an hour after officers responded to the crisis. >> unsatisfactory to have a problem. we are looking at ways, we are

working on riskifying the issues. -- rectifying the problem. >> reporter: the network was bogged down and couldn't handle the high number of officers working that night. he couldn't send messages to officers and couldn't see other police calls coming in and had to rely on radio information. an issue going on for a year. >> our officers are frustrated with the computers not working in their cars because it is a critical piece of safety equipment. >> reporter: we obtained a memo details safety concerns. among them the system's broadband wireless service were slow, slowing down officers getting into the field. >> we don't get information to officers as quickly as we would like to. it is a safety issue. >> san jose mayor says the

message for this year allocates funding. this being one of them. >> the funding would be enough to retrofit the patrol cars with the mobile computer devices. and the budget office and our office has been communicating about the funding. >> reporter: the department plans to upgrade the technology and replace all the computers by the end of the year. until then when the system crashes they will have to rely on dispatch. >> i assume they are expecting a big turn out for the vigils? >> reporter: yes. we have two crews on -- or going to the vigils. one at city hall and another one at the soon of the shooting -- scene of the shooting. i want to show, if we can, there is a wall, there is a wall of letters. apparently it is from school children to the family.

i read some of those letters, they reach out to the wife of officer michael johnson. telling them how sorry they are for the loss and how they are a here to -- are there support. among the flowers are the touching let recalls from students, 8 -- letters from students in san jose. >> glad you showed us those. azenith smith in san jose, thank you. police announced plans for a memorial service for officer michael johnson. thursday at 11:00 a.m. at the sap center. where the sharks place. policepolice officers from across the country are planning on attending. past allegations against a san francisco sex offender accused of organizeinizing a fight club at the county jail. ktvu's david stevenson has more on a lawsuit volving the deputy and -- involving the deputy and how it could play a part in the

case. >> the sheriff's department says investigators scheduled interviews on allegations that deputies forced inmates to fight each other under threats of beatings or sexual assaults. >> taking it very seriously. agreements will be interviewed and the witnesses have started their interviews. >> reporter: [ indiscernible ] >> he is still in a position to do the things he is accused of doing. >> reporter: he won a settlement from san francisco on claims he sexual assaulted a female inmate and two other inmates. >> he took them into areas of the jail where he was not properly supervised and forced them to perform sexual act said on him. >> reporter: -- acts on him. >> reporter: she says the case

raises questions about how the department disciplines deputies. >> troubling that someone with that past history would still be in the departments in any capacity. especially supervising. >> just because there was a settlement doesn't mean that the facts support a termination or discipline. >> the sheriff's department says the case may factor into the investigation. the attorney for the deputy sheriffs association was unavailable for comment but calls the allegations exaggerations. in san francisco, david stevenson, ktvu fox 2 news. 12 years in prison. that was the sentence for a former school teacher convicted of 19 counts of molesting students. this was joseph martin's second trial. the first ended in a hung jury. he was accused of putting his hands down boy's shirts and rubbing their chests.

prosecutors say there was sexual intent. a mother said she was disappointed the sentence wasn't longer. >> not happy about the amount of time but happy he won't be able to victimize children anymore and he will be a registered sex offender. >> joseph martin's wife says her daughters will miss many years of having them as their father and when he is out he will be more like a friend rather than a dad. police in san jose arrested a 25-year-old man who they say knocked out a 17-year-old boy at it the mall. the suspect is facing a charge of felony battery. the victim is 17 years old. investigators say he and another man confronted the teen in the parking lot march 11 after exchanging gestures. his father said his son woke up

from a medically induced coma wednesday. three birds tested positive for the west nile virus. they were found on march 19 and 20. west nile virus is transmitted by mosquito bites. officials say santa clara county had its worse west nile virus season ever last year with 11 human cases and 925 positive dead birds. governor jerry brown signs a new water plan for california. what it means as we deal with the drought. >> fire station 16 in san jose, will it stay or will it go? >> a big cool down today across the bay area. 20 degrees. coming up, the weekend forecast and if we have rain clouds to talk about in the weather. >> a look right now at the

s. new at 6:00 p.m. controversy surrounding a fire house in san francisco. it is slated to get torn down and rebuilt. some neighbors filed an appeal against a plan to rebuild the fire house. residents say rebuilding is a waste of money. ktvu's mike mibach reports,

fire officials say it is necessary. >> reporter: fire station 16 in san jose is about to be torn down and rebuilt. >> we want it immediately operation after an earthquake. >> reporter: [ inaudible question ] >> it is safe but the standards changed. >> reporter: it is funded by a earthquake safety bond. >> as a taxpayer we have rights and i feel like we have been walked over. >> reporter: he filed an appeal to stop had project -- the project. he said it is a waste of money. a seismic retrofit could cost less, $570,000. the department of public works says because of the new building codes it is more appropriate to tear it down. >> we looked at whether we could sustain the facility as it and accomplish the intent, we could not. >> another issue neighbors bring up is a tank. in the tank is diesel fuel.

that fuel is used to fill up the number of engines and trucks that they use. >> there is no environmental review. >> reporter: no environmental review because this particular project is exempt. >> we are not increasing the generation of traffic or the number of workers that work there. 16 like a few other stations are determined to be exempt. >> reporter: he represents the neighborhood. >> it is not being steam rolled but i understand the frustration. >> reporter: there have been some public meetings and firefighters spoke about their concern. >> because of certain legal requirements we just can't accomplish everything we want to do. >> reporter: one legal requirements, being compliant with regulations. >> change is difficult for a lot of people. we build a firehouse not for just the members that are there

but for the next 100 years. >> reporter: if the neighbors lose appeal, construction could begin in the summer. mike mibach, ktvu fox 2 news. after four years of drought california is preparing for another long fire season and just in time california has 5 new fire engines. they will go to fire departments around the sacramento area but will be able to respond to other parts of the state. they are four wheel drive and they have watertack water tanks, tools and equipment. >> urban rescue capability, medical capability. hazmat capability. structure fire fighting. >> the tanks carry a thousand gallons of water. the engines cost $400,000 each and will be used to fight firealize over the state.
