good today. coming out of the gulf of alaska, have you been? i will fine-tune the details as we get closer. sunny, nice, breezy, windy for some. 60s and 70s. north wind for a few. that could be warm. fire field. also santa rosa. sal, so far, so good, or something popped up here? is he there? are you there? steve, as we look at some of these commutes, i am looking at he them all in front of my screen. one of the things i noticed lighter in somers why. however, in san jose a new crash has popped up northbound 101 at oakland road. it's on the shoulder but it's a hit-and-run crash. the police are there taking a report. people are slowing down and taking a look at this. northbound 101 at oakland road is where the crash is. against it's outs of the lanes. it's clearly impacting traffic. to the bay bridge toll plaza that is backed up for a 20-minute delay before you make it onto the bridge. no problems across into san francisco once you are actually on that span. and we do have some stop-and-go

traffic on the altamonte pass. 7:02 back to the desk. new information about the public memorial for a san jose police officer killed in the line of duty. organizers are planning a touching tribute for veteran officer michael johnson. thousands of his police brothers and sisters from across the nation will fill up sap center to give their final good-byes. janine de la vega is live. >> reporter: i spoke with a officer who helped train johnson in the police academy. he is organizing the memorial for johnsoned to. he told us they are bringing in his patrol car into the sap center. there will be pictures and flowers. it will be emotional for him and thousands of others. johnson was a 14-year veteran

from the department who spent most of his career in patrol and was recently assigned to be a field training officer. he was shot and killed last week while responding to a 911 call about a suicidal man who was armed. he was a native of san jose. graduated from gunnederson high school and married his wife in 2013. we will hear from the police chief and the attorney general. johnson's sister and a fellow will also be speaking. we know there is going to be a slide he show with music shown and after a moment of silence police helicopters will be flying over possibly up to ten in formation. now, here is a map that shows the route of the procession which starts at 10:00 a.m. at a funeral home on north santa cruz avenue in los gatos. the motorcade heads to winchester boulevard and on to steven's creek and san carlos which leads into downtown where it ends at the sap center. there will be a private funeral later today for the family. keep in mind there is going to be rolling road closures along that procession route.

something else that the san jose police department wants you to know is that they don't want anybody to worry about how the city is going to be protected since there will be so many police officers inside the sap center. the chp and the santa clara sheriff's department will be helping calls for service while the other officers for san jose are inside attending the memorial service. >> that's pretty common for other police to help out in this time of need. thank you, janine. it is 7:05. we have received a list of some of the dignitaries will who attend today's service. they include chp commissioner joe farrow, california attorney general camilla hair irks congressman mike honda and san jose mayor sam liccardo. officer johnson's sister will be one of the speaker. stay tune to ktvu and ktvu.com for complete coverage of the memorial service. our online service begins at 10 a.m. television coverage at 11. time is 7:05. one of the largest preschools in the east bay that service

low-income families may be forced to close its doors. it's the kids club preschool and it's lease runs out at the end of june. last night school leaders met with parents and staff about options for keeping the cool open. school district officials say they have suggested other locations for the preschool, but the parents, they don't want to lose what they have. >> i don't know what we will do if we lose the school. we don't have a lot of options around here. >> i would encourage the kids club administration to continue conversations with the property openers that we have identified and encourage them to look at those properties. >> now, the kids club preschool still wants to expand the current lease, but other options include finding a generous and charitable landlord or generous sponsor to help pay for a new and probably more expensive location. well, both san francisco police and the san francisco

cab driver are hoping dashcam video help catch a suspect in a violent attack on a cab driver this week. ktvu fox 2's brian flores in our newsroom to tell us about an unusual weapon in this attack and a possible motive. >> reporter: the victim in this case is ben valis. he has been a taxi driver for 11 years. he says he never experienced anything like this and he certainly hopes someone knows who this person is. he says that he was just picking up a male passenger at 7th and townsend ar midnight on tuesday. the ride started normally with the passenger wanting to go to a bart station. he initially tried helping the passenger out at first. >> actually, you know, there is a bart station straight ahead. >> for real? >> yeah. you want to go there? >> yeah. that will save you a couple bucks. >> seconds later the passenger

started hitting vallis in the head and arms with a padlock while the car was moving. luckily, he was able to pull over safely. meanwhile, the attacker ran away towards the civic center bart station. >> he knocked my glasses loose. at that point like i was like i got to find them and i got to make sure -- i didn't even know if the cab was in park or not. i was worried it was going to get going. the situation was a little out of control. >> reporter: vallis is glad it was caught on his dashcam. he believes the passenger was trying to get a couple of cellphones he attaches to the meter and perhaps cash in his pocket. he had 40 or $50 on him. he described the passenger as light skinned in his early to mid 20s and he mentioned living mere the fruitvale bart station. police looking at surveillance foot am to see if he went on train. back to you.

>> brian flores, thank you. it is 7:08. criminal charges have been dismissed against two homeless men arrested after a fight with hospitality ambassadors in berkeley. it was this video that led to the charges being dropped. it shows a male ambassador repeatedly striking one of the homeless men. a female ambassador appeared to be giving orders to a second man. the ambassadors nibblely told police the men -- initially told police the men made threats. the male ambassador has been fired. the female ambassador suspended. the palo alto school district is taking steps to address a high suicide rate among students. the school board voted to set aside $250,000 to hire as many as four licensed mental health therapists who would work full time on the district's two high school campuses. the superintendent says they have lost three students to suicide in the past year. the most recent happened last month. some students say therapists are a resource they could use. >> in the past, you know, i

struggle with kind of giving advice to one of my good friends. you know, she never would have reached out to anybody. >> the superintendent says the job postings will go online this morning. they hope to have the therapists working on the campuses before the end of school year. time is 7:10. more information about the woman who walked out into the runway of the san jose airport tuesday night. 20-year-old diana per del is facing challenges of trespassing and resisting arrest after she was captured. ktvu's ann reuben talked to deanna's uncle who asked us not to show his face. he is wondering whether his niece went to the airport hoping to visit her mother in arizona. she has been going through hard times lately, which included moving to san francisco with her boyfriend and then they broke up. >> and if she wanted to go on a plane she should have said i want to fly somewhere. we could have probably figured out a way to get her a plane

ticket. it's just dumb. it's just a dumb, dumb move. >> now san jose's mayor says security upgrades are coming soon. the airport is testing radar, motion detection, as well as infrared technology. there are also plans to raise the height of the fencing out there from six feet to ten feet and add barbed wire. tori, that same technology let's people get around security lines at the airports, it's coming to at&t park this season. the giants just signed a deal clear. you have heard of them. the company that airports also use to prescreen passengers. the program is free. for now it will only be available to 300 season ticket holders. now, to sign up any fans will have to give up -- give their fingerprints, their driver's license information. and if you are selected you will get to bypass metal detectors, but you still have to go through having your bags checked. this particular program will

welcome back to "mornings on 2". a man from anitoch who police say was involved in a dispute over his blocked driveway was arrested after showing up at the hospital with a gunshot wound. it started yesterday 10 a.m. near g street and 10th street. police say 73-year-old anwar hughes got into an argument with people inside a car blocking his driveway. police say he went back into his house and came back with a gun. according to police hughes started fighting with one of the people in the car and the gun went off wounding him in the foot. the people in the car drove away and police say hughes fired shots at the car. police officers stopped that car nearby after getting reports of gunfire. now, the people in the car were not hurt. hughes was arrested at the

hospital. his girlfriend was also arrested for her alleged involvement in the incident. united states senator robert menendez of new jersey says he will fight federal corruption charges after being indicted yesterday for committing conspiracy, bribery, and fraud. >> i am angry because prosecutors at the justice department don't know the difference between friendship and corruption. >> now, the justice department is accusing senator menendez of accepting gifts from a florida ophthalmologist in exchange for using the power of his senate office to ben fight the eye doctor's financial as well as personal interests. menendez says he will step down, but he will keep serving as senator and he will fight the charges. 7:16. a texas state trooper is in trouble after an instagram post by rapper snoop dogg. trooper billy spears was working

at the south by southwest music festival when the rapper asked to take a picture with him. snoop posted the picture on instagram but spears was later cited with taking a picture with a, quote, known criminal. snoop has been arrested for possession of drugs and acquitted of murder. a lawyer says his client was not aware of snoop's background. no secret. americans love their smartphones. now we have the numbers to prove it. according to a new study by the pew research center, 46% of americans say they just could not live without their smartphones. 54% say the gadgets are not always needed, but they do improve their lives. however, there is a downside to these addictive devices. experts say using your smartphone at night can hurt your sleep and productivity. work related smartphone use increases stress and high levels of smartphone use actually makes downtime less enjoyable. >> i believe all of that is true. >> yes.

that's where we will have lots of sunshine today. then we focus our attention right there. i love this guy. seriously. where have you been? coming out of the gulf of alaska. it will weaken as it moves towards us. it will be here saturday. today, tomorrow are fine. but sunny. nice but breezy. probably decreasing winds tomorrow. we will swing this system in on saturday. looks like overnight saturday into sunday some rain and highs on sunday, monday will be in the upper 50s. so get ready. there will be snow in the sierras. increasing clouds saturday right there. watch how this line right there swings overnight. it could be delayed a little bit but it's going to move in on sunday as well. sunny, nice, breezy today. temperatures windy for some. coast, higher elevations, east, out to the east as well with, out to the valley 60s and 70s. a little bit warm for some. not too bad for others. but some temperatures will struggle to get out of the upper 60s. others will settle in maybe some mid 70s. overall, this will be an area where most locations are close. coast bay and also inland. changes on the weekend.

welcome back to "mornings on 2". time is 7:24. cal fire training some new firefighters and doing it early this year because we had such a dry winter. about 75 seasonal firefighters will train in yuba county this week. the cal fire says more people have been hired and hired earlier than years past and now they are training on a variety of ways to attack a wildfire. >> it's everything from ground fire attack operations to bulldozer operations and integration with the dozer ren the fire line. >> 450 wildfires have burned through the state since january. an unusually high number for winter. in the meantime, some new

devices are being tested in southern california that could help detect a potential wildfire as soon as it starts. now, it's called a flame sniffer. they are installed on top of power line towers in the foothills of santa barbara county. if they detect smoke, they look in all directions for the source of the heat. that information is quickly sent to dispatch centers so the fire crews can respond. it is 7:26. one of the men involved in the infamous school bus kidnapping has been granted parole. james schoen feld is now 63 years old. he, his brother and another man stopped a school bus in 1976. they kidnapped the driver and 26 children on board, then drove them to livermore. they were then put in a railer and an underground bunker. 16 hours later the driver and two children managed to escape and get help. schoen feld's parole ruling has to go through an internal

of about 20, maybe 25 minutes if you are at the end of the line for the cash payers. that's about all. we to have a lot of slow traffic on highway 4 this morning as you come over the hill from pittsburg. it's solid into concord. and 680 is slow from 242 to highway 24. westbound 580 better than usual. a little slowing in livermore. that's about all. we are lucky to see that. and traffic on the south bay commute is primarily slow on 101. 85 and 2280 some slowing. 7:33. back to the desk. >> thank you, sal. time is 7:33. thousands of police officers from all across the country, they will attend a public memorial later this morning for fallen san jose police officer michael johnson. here is his photo. the 14 year veteran was shot and killed last week responding to a 911 call about a -- suicidal man. he was married in a civil

ceremony in 2013. he was reportedly planning a formal wedding in santa cruz in august. also a fundraiser for officer johnson's family will be held today at the bri tanya arms pub and restaurant. it includes a silent auction and raffle. this is a map of the route of this morning's funeral procession for officer johnson. it begins at 10 a.m. in los gatos at the darling and fisher chapel of the hills funeral home on north santa cruz avenue. organizers estimate it will take the motorcade a half hour to reach sap center in san jose. the memorial there should then last a couple of hours. organizers of the memorial have given us a bit of a timeline of some of the major events happening this morning. now, at 10:30 the police motorcade is due to arrive at sap center in san jose.

about 11:28 the song amazing grace will be sung. afterwards san jose police chief layer will make some remarks. at 12:57 there will be a moment of radio silence honor of officer michael johnson. don't forget you can watch the entire memorial on ktvu fox 2. we are going to stream the procession live beginning at 10:00 this morning on ktvu.com. and our television coverage will start at 11 with the service at sap center. 7:35. two elk grove police officers crashed their motorcycles about an hour ago while on their way to the memorial in san jose. police say the officers hit a diesel spill about four miles away from the station south of sacramento. both officers went down on their motorcycles. one was taken to the hospital but the extent of his injuries are not known. police say the other officer was okay. new this morning some people are on edge after three earthquakes hit the bay area in less than than 24 hours.

it did wake me up. it was quite a jolt. registered as a 3.6 magnitude and was felt by people all over the bay area. 20 minutes before that a 2.6 quake struck west of morgan hill. those two quakes followed the 72.6 shaker in san pablo that we told you about yesterday morning. no damage or injuries though were reported in any of those quakes. all right. time is 7:36. for the first time in 73 years yesterday's snow survey was conducted on dry grass. not a flake of snow. ktvu's tom bay car was up there. he is showing us how bad the state's water situation has become. >> reporter: how bad is bad? until today this was the worst ever. this was last year. a pretty bad year. this is the average depth around here this time of year and way up there the most that was ever recorded. >> that's a wow. now, after the snow survey

governor brown announced historic statewide water use cuts. now it's up to the individual water districts to issue restrictions and penalties. ktvu fox 2's tara moriarty joining us live in walnut creek. some of the ideas people are coming up with on how to cut back on using water? >> reporter: yes. a lot of creative ideas. we have been receiving a lot of comments on our ktvu facebook page. a lot of people are very angry. lenore navarro writes her household has been con serving on her water bill for the past two years by 50%. and she says she is frustrated that southern california isn't con serving at all. she says that a lot of homes in sacramento don't even have water meters. so keep those comments coming on facebook. we really do appreciate that. in light of this ongoing drought, the governor has enacted a 25% cutback to all of

the water agencies in the state. some people in northern california received letters saying they will be allowed to water their lawns three times a week. >> my brother-in-law who just visited from chicago, we were talking about how bad it is in southern california and how brown everything is right now. you know, just turning into like a desert climate. so it's been tough. i know the sierras have gotten less rainfall this year and snowfall. it's impacted all of us. >> i like grass, but it's just maybe aerated the water less or maybe a different time of day or something so it doesn't evaporate off. >> reporter: are you going to be taking shorter showers these days? >> absolutely. >> reporter: the reduction in water use does not apply to the agricultural industry. it prompted criticism as agriculture uses 80% of california's supply. the executive order calls for replacing 50 million square

feet of lawns statewide with drought-tolerant landscaping. it bans using drinking water for outdoor irrigation at new homes and businesses not delivered by drip or microspray systems. it places restrictions on water use at commercial and industrial sites such as golf courses, cemetaries and schools. so shorter showers. dirty cars. fewer toilet flushes. using dishwater to water the plants. it's time to get creative once again. and maybe to help you get creative, to give you a sense of just how dire the drought is we want to show you some before and after pictures. this is what half dome looked like in march of 2011. blanketed in patches of snow. and this is what it looked like in march of this year. barely any snow in sight. just a little patch right there. half dome is completely uncovered with snow. these photos are from the

yosemite conservancy. we want to show you a picture of lake orville. this again is from 2011. this is the largest reservoir in the state water project. see all the water there just filling the lake right there? now look at what it looked like last year. 2014. look how dry things are in the photo. this is from the fall. no water at all. just lots of dirt there. and this was taken by the california department of water resources. one more comparison to show you. this is noaa's drought monitor a year ago. that patch right there, the dark red is where the driest part of the state is. look at the size of the patch now. it spreads all the way up north and east over much of the state making this basically an exceptional drought. on ktvu.com we have posted the full text of the governor's executive order in case you want more information on that. dave. >> tori, thank you. time is 7:40. firefighters in palo alto where

a high school teacher was burned in a science experiment. this is a photo from the pali voice. yesterday afternoon she was filling an empty milk carton with methane so it could launch off the desk when the gas escaped and erupted in flames. as she was able to put out the flames and the classroom's emergency shower, but we are told she suffered first and second-degree burns. she is expected to make a full recovery. we are also told none of the students were hurt. it is 7:41. new this morning investigators say the germanwings co-pilot who crashed the plane in the french alps appears to have researched suicide methods and also cockpit door security in the days before the plane crashed last week. prosecutors announced today that they found a tablet at andreas lubitz's apartment and they say it appears that he researched suicide methods as well as cockpit door security in the days leading up to the crash.

investigators say the 27-year-old pilot locked the captain out of the cockpit and deliberately crashed the plane last week. all 150 people on board died. today investigators also announced that they found the plane's second black box recorder. a cab driver attacked all caught on camera. in 22 minutes, the footage police want you to see to catch the culprit and his unusual weapon. plus, it's throwback thursday. up next some video of "mornings on 2" nine years ago and how this is connect today a big announcement about the future of the show. those are hideous glasses. geez. good morning. we are looking at the east bay commute. highway 4 is going to be okay. highway 24 is a little bit slow heading up to the willow pass grade. we will tell you more about that coming up. we have an interesting weather forecast. cool and breezy, yes. lots of sunshine.

big name athletes and city leaders around the country who have protested indiana's law about this latest development. so far this morning republican lawmakers in indiana announced that they are rewriting the religious freedom act to make sure it does not give businesses the right to discriminate, particularly against gays and lesbians. >> it was never intended to discriminate against anyone. the goal was to create a new standard that's the common standard across the country in the federal courts and 30 other states in scrutinizing whether someone's religious rights had been infringed upon. >> businesses are caught in the middle of this firefight. an empty pizza shop one of the casualties of the law. it is closed temporarily after saying it would not cater a same-sex wedding when the religious freedom act was signed into law. hundreds of people from all over the country posted negative comments on that restaurant's yelp page. so they decided to shut down at least temporarily. they have lost quite a bit of

money. a gofundme page was set up by supporters of the pizza restaurant amid all off this negative feedback. that page has now raised $98,000 so far. now, in our next hour of "mornings on 2", we will get some reaction from business leaders and city leaders around the country to this latest fix in indiana. tori and dave. >> what a story. very interesting. some strong feelings on both sides. time is 7:53. an angry confrontation between a new york city detective and an uber driver. >> do you understand me? do you understand me? >> that rant that was recorded has now gone viral and the punishment handed down on the officer involved. and a company hit with protests about how much it pays workers is increasing what some of its employees make.

welcome back to "mornings on 2". time is 7:56. new this morning we are just getting word that famed television evangelist robert schuler has died at the age of 88. reverend schuler was famous for his power of power television ministry. at its peak it had 20 million viewers. in 1980 he built the crystal cathedral in orange county. in 2010 the church went into bankruptcy because of declining donations. his daughter says reverend schuler died early this morning in los angeles at a care

facility. mcdonald's plans to raise hourly pay for 90,000 of its restaurant workers. the pay hikes are expected to increase the hourly rate to one dollar above the minimum wage starting july 1. mcdonald's will also give vacation time to workers at the company-owned stores. that's about 10% of all mcdonald's restaurants. mcdonald's expects average wages to be more than $10 an hour by the end of next year, and workers across the fast food industry have been pushing for a pay rate of $15 an hour. time is 7:57. this will be a very emotional day for the san jose police department. also law enforcement officials around the bay area and around the country. after the break, more details about the funeral procession and the public service to honor fallen officer michael johnson. and a violent assault on a taxi driver in san francisco caught on tape. what the driver says happened and the unusual weapon used by

for a long time. i know it's maybe the timing is not the best. it's on its way. today lots of sunshine. first baseball forecast of the young, young season. a's-giants tonight at at&t park. clear. chilly. no clouds. rather breezy and cool. 40s and 50s. fairfield yesterday 38. today 55. napa was 35. today 52. that's because of that north breeze. if you have any kind of breeze at napa, 10. northwest gusting 21 that votto. gusting almost 30 for some. so it will be clear. it will be nice. we are good to go. the system we are waiting for is right there. boy, that's a lot of cold air. this is going to dive south. won't get here until saturday or late saturday into sunday. but it is a sign of a change here. sunny. nice. breezy. windy for some. higher elevations on the coast 60s and 70s. not too bad for some, but a little cool for others. sal, i think i don't want to jinx it, but we have been okay so far? >> yeah, we have been okay.

we have had some crashes, but they haven't been as major as, for example, some of the things we had last week. we do have a problem on city streets in brentwood i will tell you about in a moment. eastshore freeway is doing pretty well if you are driving on 80 westbound. it's a typical delay as you drive from the carquinez bridge to the macarthur maze of about a half hour. maybe a little bit more. but you will see the traffic is not -- it's not really affected by a major problem. we are also looking at a commute at the bay bridge toll plaza where traffic is going to be okay if you are driving through. the traffic is looking a little bit slow here at the toll plaza. the morning commute is going to be okay on highway 4. it hasn't been all that bad as you drive through. the task continues to move along well. we are working on a problem on brentwood city streets that we will tell you about next time. just trying to confirm some details. but we will let you know more

about that when we come back next time. back to the desk. >> thank you, sal. 8:02. thousands of police officers from all across the nation will converge on the bay area today to honor the life of one of their own. a public memorial for officer michael johnson will be held at san jose's sap center. he was known as a loving father, a loving husband, rather a well respected mentor, and a decorated police officer. ktvu fox 2's janine de la vega is live with details of a touching tribute being planned today. >> reporter: good morning. officer johnson's death devastated his family and the department, but it also struck a nerve with the community. so that's one of the reasons why they are making this memorial for him this morning public. it begins at 11:00 a.m. you can see officers have already started putting up barricades here near santa clara and autumn street outside the sap center. we have also seen officers go inside to prepare for the service. we have learned that johnson's

patrol car will be brought into the sap center. it will be next to his pictures and casket. johnson was well liked and respected by fellow officers. weighs 14 year veteran of the department who was recently assigned to train recruits in the field. last week he was shot and killed when he responded to a 911 call to help a suicidal man. he graduated from gunderson high school. we will hear from the chief and a fellow officer who attended the police academy with him. johnson's sister will also be speaking at the memorial celebrating his life. we know there will be a slide show with music shown and a moment of silence. then outside taps will be played and a formation of police helicopters will be flying over. let's go to a map that shows the route of the procession which starts at 10:00 a.m. at a funeral home on north santa cruz avenue in los gatos. the motorcade heads to winchester boulevard and on to

stevens creek and san carlos which leads into downtown which leads to the sap center. a private funeral will be held later today for the family. so take that into account if you are going to be driving around those streets near los gatos, campbell, and san jose because there will be rolling closures. also, the department wants to let you know that while many, many officers are going to be attending the memorial inside, many san jose officers, the city will still be protected. they are bringing officers from other cities in as well as the santa clara county sheriff's office and chp to handle calls for service while everyone else is paying their respects to officer johnson. tori. >> thank you, janine. and we received a list of some of the dignitaries who will attend the service. it includes the commissioner, the attorney general, and san jose mayor. officer johnson's sister jamie will be one of the speakers. stay tuned to ktvu and ktvu.com for complete coverage of the

memorial service. our online coverage begins at 10:00 a.m. our television coverage starts at 11. time is 8:05. more information about a woman who walked out on to the runway of the san jose airport tuesday night. 20-year-old deanna predel is facing charges of trespassing and resisting arrest ar she was captured. ann reuben talked to deanna's uncle who didn't want us to show his face. he wonders whether his niece went to the airport hoping to visit her mother in arizona. he says she has been going through hard times lately that included moving to san francisco with her boyfriend, but then they broke up. >> if she wanted to go on a plane she should have said i wanted to fly somewhere. we probably could have figured out a way to get a plane ticket if she wanted to do it. this is a dumb, dumb move. >> the san jose mayor says there will be security upgrades at the airport. they are testing radar, motion detectors, and infrared technology. there is also plans to raise

the height of the fencing to ten feet and add barbed wire. 8:06. criminal charges have been dismissed against two homeless men arrested after a fight with hospitality ambassadors in berkeley. it was this video that led to the charges being dropped. it shows a male ambassador repeatedly striking one of the homeless men. a female ambassador appears to be giving orders to a second man. the ambassadors initially told police the men had made threats and assaulted them. the male ambassador has been fired. the female ambassador has been suspended. the palo alto unified school district is taking steps to address its disturbing suicide rate among students. the school board voted last night to set aside $255,000 to hire as many as four licensed mental health therapists who would work full time on the district's two high school campuses. the superintendent says they have lost three students to suicide in the past year. the most recent happened last month. some students say therapists

are a resource they could use. >> in the past, you know, i struggle with kind of giving advice to one of my good friends. and, you know, she never really would reach out to anybody. >> the superintendent says the job postings will go online this morning. they hope to have the therapists working on the palo alto handgun high school campuses before the end of the school year. san francisco police are asking for your help after a taxi driver was violently attacked earlier this week. ktvu fox 2's brian flores in our newsroom now. brian, both the investigators and the cab driver hope the dashcam video you are about to show will help catch this suspect? >> reporter: yeah, certainly, cave. good morning to you. the victim in this case has been a taxi driver for national veterans cab company for 11 years. he tells us he has never experienced anything like this and, as you mentioned, dave, he certainly hopes someone knows who this person is. val says he was picking up a male passenger at 7th and

townsend just after midnight on tuesday. the ride started normally with the passenger just wanting to go to a bart station. he tried helping the passenger out at first. >> he knocked my glasses loose. at that point, like i was like i got to find them and i got -- i didn't know if the cab was in park or the not. i was worried the cab was going to go rolling. yeah. i had to get control of everything because the situation was a little out of control. >> well, seconds later the passenger started hitting valis in the head and arms with a padlock while the car was moving. luckily, valis was able to pull over safely. the attacker ran away towards pacific center bart station. he believes the attacker was trying to get a couple of cellphones that attached to the meter, perhaps cash in his pocket. he only had 40 bucks on him. he is light skinned in his early to mid 20s that he mentioned living near the fruitville bart station in oakland.

bart police are currently looking at surveillance cameras. valis is doing okay. he says as a result of the attack he won't have any passengers sitting directly behind him any more. back to you. >> what a story. brian, thank you. time is now 8:09. meantime one of the largest preschools in the east bay that serves low-income families may be forced to close its doors. it's the kids club preschool. it's leased with the anitoch school district. that runs out the end of june. last night school leaders met with parents and staff talking about options for keeping the school open. school district officials say they have suggested other locations for the preschool, but the parents don't want to lose what they have. >> to lose this school, i don't know what we will do. we don't have a lot of options around here. >> i would encourage the kids club administration to continue conversations with the property owners that we have identified and encourage them to look at those properties.

>> now, the kids club preschool still wants to extend the current lease. they say other options include finding someone very generous to help pay for a new and probably more expensive location or they may have to shut down. >> those kids are so cute. it is coming up on 8:11. unprecedented changes in the bay area in the wake of a disappointing snow survey. in 25 minutes governor jerry brown's mandate on water use in the state and how it affects you. first, racial tension at a prestigious university. after the break the object that was found that is sparking outrage this morning and the promise from the school's president. good morning. we are looking at a commute where if you are going to marin it's not going to be too bad. a little bit of slow traffic heading west on the richmond bridge. well, wall-to-wall sunshine, but a rather breezy pattern and windy. we will see how long this lasts.

8:14. a teenager from atlanta once given a second chance at life thanks to a heart transplant has died after crashing a stolen car. two years ago anthony stokes made headlines when his family fought to get him the

transplant. at first stokes was told he did not qualify because he had a history of non-compliance. they changed their mind and performed the surgery. tuesday police say he was in a stolen car and lost control and crashed. administrators at duke university says they are as angry as students after a noose was found hanging on students. students protested immediately when the news was discovered yesterday. it was a yellow rope hanging from a tree at a campus plaza. school officials took down the noose and are promising an investigators. time is 8:15. new jersey senator robert menendez plans to fight federal corruption charges after he was indicted and accused of conspiracy, bribery, and fraud. >> i am angry because prosecutors don't know the difference between friendship and corruption. >> the justice department is

accusing the senator of accepting gifts from a florida eye doctor in exchange for using the power of his senate office it benefit the eye doctor's financial as well as personal interests. senator menendez, the top democratic on the senate foreign relations committee, will be stepping down from that position but says he will keep serving as senator and fight the charges. a new york city police officer is being transferred after his profanity-laced tirade at an uber driver went viral. >> do you understand me? i don't know what [bleep] you think you are on right now. >> i am not planning, sir. i am here. >> planning? it's a planet. >> i am not here. >> don't ever do that again. the only reason you are not in handcuffs going to jail and getting in the precinct is because i have things to do. that's the only reason that's not happening. because this isn't important enough me. you are not important enough. >> it started a as the uber

driver reportedly honked at the officer who suddenly blocked his route. a passenger recorded the video. at one point the officer asked the driver how long he had been in the united states. >> no good cop can watch that without a whince because all good cops know that the officer just made their jobs a little bit harder. >> the detective is identified as a member of the city's joint terrorism task force. bratton says the officer has been placed on desk duty and will be transferred. the civilian complaint board is also investigating. it's the type you never know, a camera could be recording you anytime. time is 8:17. sal is watching our commute this morning. you are watching the toll plaza. everybody behaving? >> yeah, we are watching the toll plaza, dave. we are also watching contra costa county. we are going to start there because we are looking at highway 4. still a little bit slow on highway 4 westbound as you drive through the anitoch area. but i want to mention an accident in brentwood on city streets. dante avenue at griffen lane.

a serious crash at that intersection. avoid that intersection. they called for two medical helicopters and two people were trapped inside vehicles. very serious crash. again, avoid that area to avoid some slow traffic and also to let the emergency workers work without any distraction. let's move to the bay bridge toll plaza right now and traffic is backed up for a ten minute delay. no major problems getting in the estimate and 280 and san jose, that he is cleared up nicely. we had some slow traffic earlier, but now the south bay commute is getting much better. 8:18. let's go to steve in the weather center. sal, thank you. the breeze has picked up. the breeze has picked up. >> yes. >> hopping on those clouds. >> hopping on the clouds. it's cold. >> all right. well, we have another cool kind of weather-related story, i guess, regarding the sky. for the third time in two years the moon will cast an eerie glow on earth but you only have a few minutes to see it. this is cool video. it's a spectacular moon set over the beautiful set from this morning. it's called the pink moon. on saturday there will be a blood moon. it may not be as spectacular looking but it's caused by a rarer event. that would be a lunar eclipse. that starts about 2:00 saturday morning. three hours later when the moon is completely in the earth's shadow it will glow an orangish red color. it will end five minutes later. it will actually make it the shortest total eclipse this century. we should have a good view of the eclipse here if there are no clouds. again, that's very early saturday morning. have to see. >> i normally wake up early.

i will probably be peeking outside looking for it. time is 8:21. you love going to games at at&t park but you hate those security lines out there? coming up in 30 minutes the technology that could make your security line experience at the ballpark a whole lot easier. first a better bart experience. after the break the changes to ease congestion and prevent major delays.

8:24. bart has a new set of cross over tracks in the east bay that it says will help keep trains moving nor efficiently. they are near the pleasant hill station and opened yesterday. another set opened earlier this year near walnut creek. the cross-overs make it easier for trains to reverse direction or shift extra cars from one train to another. they also make it easier for trains to go around a disabled train. time is 8:25. dozens of people in richmond say they are going on a rent strike. the tenants gathered yesterday outside their building. they are upset with the landlord for raising their rent by an average of $200 a month. rents for the two bedroom apartments average about $1,000 a month. >> the rent increase is too much. maybe if i can pay the rent, but i am not going to have any food for my kids, you know. that's the reason why we are fighting. >> these tenants say they plan to only pay what was charged to them before the increase.

starting today american travelers can book home rentals in cuba through airbnb. we checked the airbnb website this morning. it shows 600 rentals available in havana this month. the prices start at 30 bucks a night. for the last 50 years the u.s. trade embargo has blocked most american businesses from operating in cuba, but airbnb has been talking with homeowners there for the last three months after the obama administration started ease be restrictions on cuba. americans heading to cuba, you still have to fill out paperwork and list the reason for your visit. tourism is not one of the approved categories. time is 8:26. we have team coverage for new morning. the community in the south bay is ready to honor san jose police officer michael johnson and his life. look at the pictures we are already taking. the outpouring of support. and with a man who was in the police academy with officer johnson told us about his

westbound 80 a motorcycle crash blocking lanes as you head out towards the macarthur maze. it's been there 15 minutes now. someone was injured. looks like they are taking that person away. that's why the traffic is so bad suddenly on eastshore freeway here as you drive through. you can see that the vehicles are kind of moving up into a tighter pattern. but a motorcyclist has been injured. we do have lanes blocked east shore freeway. it's going to be slow. bay bridge toll plaza is backed up. not so much any more. and when you get to the commute there you are going to see maybe a five-minute delay. slow traffic in hayward heading south into fremont. it's 8:32. back to the desk. >> thank you. today is a day of mourning here in the bay area for the law enforcement community, for bay area leaders, and for the public paying last respects to a fallen police officer. ktvu fox 2's paul chambers joining us live. you are outside the san jose police department, and they are still dealing with the loss of officer michael johnson, paul? >> reporter: dave, very true.

there is memorials closer to the police department and right here as here, as you can see. there are a lot of flowers here. this is an overfill of flowers, cards, pictures, posters and decals out here for officer michael johnson. a few minutes ago we got caught up -- an hour ago we caught one a member of his academy who made this poster for johnson. >> i wanted to us a an image of michael smiling, you know. we all see his id card photo of everyone. but michael was really, this is how he would show up to your call. smiling. with a smile. and he left you smiling. >> reporter: michael johnson served the people of san jose for 14 years. that came to an end when he responded to a call about a potentially suicidal man threatening his wife. it was there johnson was shot and killed by scott dunham, a man police describe as mentally unstable. there has been an outpouring of support for johnson's family. the san jose sharks sent out this tweet asking for a moment of silence prior to the game.

what seems to be police protocol, the mourning band covering a badge seems to be on almost every department's website as a tribute in a way to pay respect to a fallen officer. that was here the case at the santa clara's twitter page. now officers and deputies from every department within santa clara county will be taking over the duty of san jose police officers. that way sjpd can attend today's service. >> it's very upon for everybody to be there at the funeral to honor, but especially for san jose pd. that was one of their own and they all need to be there. every agency with the county is assisting in some way, somehow to make sure that's happening today. >> reporter: now, they will have at least 80 from the sheriff's office. they had to turn some people away because they wanted to be out there to help take over the area so san jose explosives can go -- police officers can go to the sap center at 11:00. that's the time that it will happen. we willle have you on top of that and bring you the latest as it develops. dave. >> paul chambers. >> i am going to show you the

route of the funeral procession which begins at 10:00 a.m. in los gatos at the darling and fisher chapel of the hills funeral home on north santa cruz home. it's expected to take the motorcade a half thousand get to the sap center in san jose. then the mull will last -- the memorial will last a few hours. they gave us a timeline of some of the major events that will take place. at 10:30 the police motorcade expect today arrive at sap center. about 11:35 san jose police chief will make remarks. he is followed by attorney general camilla harris. then at 12:57 there will be a moment of radio silence in honor of officer michael johnson. governor jerry brown is not on the list of scheduled speakers. we contacted the governor's office in sacramento to confirm that he will not be attending today's service. he traditionally goes to memorials of fallen police officers, but it's important to note the governor is also dealing with his own family

loss. his 81-year-old sister cynthia died last weekend. make sure you stay tuned for complete coverage. memorial service. our online coverage begins at 10:00 a.m. our television coverage starts at 11. it is coming up on 8:36. two elk grove police officers crashed their motorcycles about an hour ago while on their way to the memorial in san jose. police say the officers hit a diesel spill about four miles away from their station just south of sacramento. both officers went down on their motorcycles. one was taken to the hospital but the extent of his injuries is the not known. police say the other officer was okay. time is now 8:36. new morning some people are still talking about three earthquakes that hit the bay area in less than 24 hours. the latest one hit just after midnight near san ramon. i felt that one. it registered a 3.6 magnitude.

a lot of people all over the bay area felt it. 20 minutes after that a magnitude 2.6 quake hit just west of morgan hill. and those two quakes followed the 2.6 magnitude quake in san tableau we were talking about yesterday morning. so far no damage or injuries reported in any of those quakes. yesterday's snow survey gave a really grim picture for california's water situation. for the first time in 73 years the snow survey was conducted without a flake of snow in sight. in fact, ktvu's tom bekar can show you how bad the situation has become. >> how bad is bad? until today this was the worst ever. this was last year. a pretty bad year. this is the average depth around here this time of year, and way up there the most that was ever recorded. >> wow. now, the governor has issued statewide water use cutbacks.

now it's up to individual water districts to determine restrictions as well as penalties. ktvu fox 2's tara moriarty joining us live from walnut creek. what are people saying about it? >> reporter: a lot of people are venting, especially on our ktvu facebook page. they say, you know, we had to conserve last year by 20%. the year before that by 20%. what really is the difference this year? others admit that the situation is dire, but they say it's the people who are con serving the most who are going to be the most impacted especially by this new restriction that is being put into place over the next nine months. lawns are going to go brown. pools may evaporate. we may see a lot of dirty cars over the next nine months. the governor enacted a 25% cutback to all water agencies in the state. some people in northern california have already received letters saying they will be allowed to water their lawns three times that week. >> we knew that bare bones is needed and just trying to be

conscientious as much as we can knowing it is a drought. hopefully, next year it's a big winter. >> reporter: now, others say they will only use water when it's absolutely necessary, which is pretty much what they do anyway. >> you can't just, you know, register water usage. i can't do it. if i need to take a shower two times a day, i would do it. >> reporter: now, the reduction in water use does not the apply to the agricultural industry except for the requirement that farmers report more information on their groundwater use. the exclusion that is prompted criticism as agriculture uses about 80% of california's supply. now, the executive order calls for replacing 50 million square feet of lawn statewide with drought tall rent landscaping. it bans using drinking water for outdoor irrigation at new homes and businesses.

it places restrictions on water use at commercial and industrial sites such as golf courses, cemetaries, and schools. so shorter showers, fewer toilet flushes and making using dishwater or bath water to take care of the plants outside is going to be the wave of the future. live from walnut creek, tara moriarty. bart talked about how it will reduce water use. it has changed the train carwash schedule from every four days to every eight days. they say that will save 50% of water use. it will also update their irrigation systems and their water fixtures. bart is also recommending its contractors who power wash the area around the bart stations, they switch to recycled water. yeah. to give you a sense of just how dire the drought is, we want to show you some before and after pictures that really tell the story. for example, this is what half dome looked like. this was back in march of 2011.

blanketed with snow down there. quite a bit of snow up on the dome itself. now take a look at this. this is what it looked like in march of this year. just a few weeks ago. barely any snow in sight. tiny little patches way off in the distance. by the way, these photos are from the yosemite conservancy. now let's take a look at orville. this is lake orville, the largest reservoir in the state water project. see all this water here stretching all through this picture and right under the bridge? and this is what it looked like in 2011. take a look at what it looked like this 2014. this was taken in the fall. so much dry area. hardly any water in sight. this picture, by the way, was from the california department of water resources. and now one more comparison we want to show you. this is what noaa's drought monitor looked like a year ago. the dark red area, that is the driest part of the state. so just pretty much down in the southwest corner. now look at 2015.

an even larger part of the state is covered with that dark red color marking an exceptional drought. on ktvu.com, by the way, we have also posted the full text of the governor's executive order concerning the drought. dave. >> okay, tori. time is 8:42. firefighters in palo alto investigating how a high school teacher was burned yesterday during a science experiment. the "mercury news" said that teacher is silja palmer. yesterday afternoon miss palmer was filling an empty milk carton with methane so it would launch off a desk. when the gas escaped and then erupted in flames. she was able to put out the flames in the classroom's emergency shower but she suffered first and second- degree burns. she is expected to make a full recovery. we are told none of the students were hurt. there are new allegations of racial bias within the san francisco police department. federal public defenders filed court documents claiming police

worked with the drug enforcement administration to crack down on drug dealing near schools in the tenderloin. 37 people were arrested in stings over the past to two years. everyone arrested was african-american. now, these allegations follow the discovery of racist and homophobic text messages among a group of police officers in a separate police case. all right. it is 8:43. americans and their smartphones. kind of a love story. after the break the new numbers showing how many people just can't live without the handheld devices. plus, lawmakers in indiana announcing a quick rewrite of that controversial religious freedom law that's caused so much trouble for the state. how they say they fixed the law trying to please the critics. good morning. we are looking at slow east bay traffic on 80 westbound. this is partially due to an earlier crash involving a smotecal. we will explain. it's clear. it will be sunny.

8:46. after harsh criticism, lawmakers in indiana say they are going to change the religious freedom restoration act.

ktvu's fox 2's pam cook in the studio with actions and reactions. >> good morning. indiana's governor and other lawmakers have been working this week to rewrite the law to make sure it does not give businesses the right to discriminate. it's all going to be about wording. that was after a huge backlash which companies and city leaders around the country. this morning gop house speaker brian boss ma spoke from the capital to announce the state legislature has agreed on new language. they apologized for the harm that has been done and they want to make it clear that the state of indiana does not endorse discrimination. >> we can unequivocally say that refra cannot be used to discriminate against anyone. the conference committee report you will see will clearly address that and what people think they can and can't do in the general port angeles, that's for the -- general public, that's for the courts to

decide. >> reporter: many tech companies, including salesforce.com, have been very vocal against indiana and the religious freedom act. there are several employees asking to relocate out of indiana because they are no longer comfortable working and living there. he told cnn the company won't be completely able to pull out of indiana given the size of operations there, but that the company is helping individual employees who feel opressed to leave the state of indiana. businesses located in indiana, small and big, have really suffered through all of this this. especially retailers that do business with out of state customers. they have heard a lot from those customers. it's going to take a lot to recover business-wise in indiana. >> thank you. time is 8:48. it's no secret. we love our smartphones. there is a new study by the pew research center that says 46% of americans cannot live without

their phones. 54% say they don't need them all the time, but they do improve their lives. but these addictive little things do have a downside. the experts say using your smartphone at night, and i'm proof of that, it hurts your sleep and productivity. work-related smartphone use increases stress, and high levels of smartphone use makes your downtime less enjoyable. >> yeah. so you got to be careful. everything in moderation. yeah, it's hard to imagine life without them. >> i get hollered at all the time, you know. >> all the women in your life. >> they do. >> all right. 8:49. smartphone helps with traffic, too, because sometimes we are stuck in traffic. i am like, okay, where can i get around this and stuff. >> exactly. it's like having a computer in your hand. i will do the work for you right now. let's go to the east shore freeway. i want to show you that the east shore is backed up a little bit more than it would be. we had an earlier crash at powell street. it just cleared moments ago. traffic is backed up a few miles.
