her remarks sparked outrage, cries of discrimination and calls for her to resign. now a bay area school official is apologizing. good evening i'm julie haener. >> and i'm frank somerville. it was a heated debate tonight over air-conditioning at schools in martinez. that after a board member suggested that an elementary school of predominantly white students needed air- conditioning more than a school of latino students. new developments now from ktvu's heather holmes who's in martinez where that board member made a public apology but the question is, is that enough. >> reporter: feeling the heat, that board member tearfully apologized saying she hopes people will look at her 20 some years of history instead of some poorly chosen words. two elementary schools don't have air-conditioning, and when temperatures rise classrooms can become uncomfortable. >> it is hot. it is stuffy. the air does not circulate. >> reporter: participants and

others. she made no response at all to any of the resignation calls. when i asked the superintendent, he too said there will be no steps taken to remove her. and authorities coaxed a distraught man back from the edge. the man was perched from the railing of the 101 crossing to 680. he was threatening to jump and threatening officers with a knife. all lanes of the 280, 680 split were closed at 650 this afternoon. the man eventually surrendered and was taken into custody. the chp identifies him as hector chavez. all lanes of traffic reopened

at 7:30 tonight. a tree fell on to several lanes of highway 880. it happened shortly after 7:00 tonight near the davis street exit in san leandro causing dangerous moments for drivers. the tree toppled over. the driver who's car hit the tree says he's lucky to be alive. >> he was just like, i was just praying for my dear life. thank god i'm alive. >> authorities helped clear the debris from the roadway to help traffic get moving again. it happened at 5:15 off of foothill near 56th avenue in east oakland. investigators put yellow marker. the lee victims were taken to the hospital for treatment. we're told one was hit in the

shoulder. another in the buttox and a third in the chest. the third victim was in critical condition. no word yet on whether there have been any arrests in the case. florida senator marco rubio is now running for president boosting the number of official candidates to four with more to come. rubio made his announcement in miami and emphasized his relative use. ktvu's jana katsuyama is here now with how the race is starting to shape up, jana. >> reporter: certainly getting interesting, julie. marco rubio is now the third candidate to enter the race. and voters will be able to choose from a wide candidate list. >> grounded from the grounds of our history but inspired by our future i announce my candidacy for the president of the united states. >> reporter: marco rubio declaring he will run.

san francisco police are reporting a huge jump in car break-ins during the first two months of this year. a new state law may inadvertently be making the situation even worse. noelle walker tell us about a change that turned felonies into misdemeanors. >> reporter: every day cars crowd into an already congested city. in san francisco parking is at a premium. >> i mean it sucks but it's the price of liveing in san francisco i guess. >> reporter: he's not talking about the meter rate. there's an added cost. >> a lot of glass. multiple times in the day, all times of the day. >> reporter: you will see it if you park along the street. we saw more than a dozen parking spaces marked with broken glass. >> insurance, i mean what are you going to do. >> reporter: if it seems auto break-ins are getting more frequent they are. in the first two months of this year auto break-ins rose a

whopping 49% in the city. >> walking around the city, you will see a lot of glass and that's throughout neighborhoods. >> reporter: items left inside make cars an easy target. but a law turns property crimes that used to be misdemeanors into felonies. frustration tyson sees time after time. >> most of the time there's nothing in there for them to steal but they break-in to see if there's something. >> if you park some where there's a chance you're going to get broken into. there just is. >> reporter: he gets up to 10 cars a day. >> you're not alone. >> reporter: at $150 to $350. >> it's not a matter of if, it's a matter of when.

>> reporter: that's an expensive parking space. many auto break-ins go unreported but they want you to report those crimes because that way police know where the problems are. noelle walker, ktvu news. a judge sentenced a richmond man to three years in jail for being an accessory to the killing of an elderly woman. john bruno martinez pled not guilty last month. he rented a car for a man and woman who are suspected of robbing and killing 84-year-old olga deneli in her home in february. an attorney representing martinez says his client didn't know about the killing. the tax deadline is now just days away. tonight a warning from the irs about people trying to take your money. >> he told me i owed $6,792. >> how one bay area woman got scammed and what you can do to protect yourself. >> also a new survey shows just how bumpy some bay area roads really are. which areas received the poorest mark.

a warning tonight from the irs as the tax deadline approaches so do scammers hoping to trick you into handing over your cash. people impersonating the irs to steal your money. >> tonight one bay area woman is sharing her story so that hopefully others will learn from her experience. debora villalon is live in santa rosa. unfortunately that scam cost her thousands of dollars. >> reporter: it's a $6,000 story. cash withdrawn by a woman who had heard about scams like this but was taken in any way. >> reporter: it starts with a phone call. >> i wish i had listened to my intuition. i felt so threatened.

>> reporter: colleen mcguire is a music teacher. >> i am not stupid, i am a human being and i have feelings. >> reporter: she is telling her story to spare others. >> he said you need to go to your bank and take out cash. don't tell anybody i'm calling you. >> reporter: mcguire took a cab from her home to a bank. guided the whole time by a fake irs agent who stayed on her cell phone. she she cabbed it over to another bank to put that money into a bank account. >> i felt as if i were hypnotized. >> reporter: within hours mcguire went to the bank suspicious about this deposit. she's among 1,600 cases, millions of the dollars stolen

this way. >> they tell you, put us on mute and go to the bank. we do not demand your pay taxes a certain way and certainly don't call you out of the blue. >> reporter: mcguire hopes because she had account information for police her crime is traceable and she will be reimbursed. >> they violated federal tax regulations. >> reporter: she wrote down the callers information and threats. even though he heard of such scams, when she tried to question him. >> anybody time i would make him rebuttal to anything he said. he said i'm going to call the cops on you. he said he would put a lien on my house. >> reporter: scare tactics she says anyone might fall for. >> i mean he's a dead person. he doesn't have any soul. i felt myself going under like quick sand.

down, down. down. >> reporter: mcguire's case is being investigated, remember the irs only contacts people by u.s. mail. any calls, any voice messages, any e-mails out of the blue ignore them. >> good advice, debora villalon, thanks debora. pg & e customers can expect to see a credit on their bills this month or next. it's time for the utility to pass along a climate credit to residential customers. the state public utilities commission estimates the average household will get a credit averaging $27. it's the third time the credits have been issued. the money comes from so called cap and trade payments made by power plants and industries. former san francisco 49ers running back lawrence phillips is suspected of killing his cell mate at a prison in central california. you will recall phillips played for the dolphins and st. louis rams before joining the 49ers. his cell mate at kern valley state prison was found dead over the weekend.

phillips is serving combined sentences of 31 years after convictions for domestic abuse of his girlfriend and for driving his car into three teenagers at a park in los angeles in 2006. the only drug treatment center for teenagers in alameda county is now in danger of closing. the board of directors met to talk about its fate. at one point protesters tried to break into that board meeting. >> reporter: a noisy protest, a plea for help. >> this is a precious resource for the community of oakland and indeed the bay area. >> reporter: for 28 years, nonprofit thunder road alameda county's only drug and mental health facility for teens has rehabilitated hundreds of troubled youth. >> it saved my life. >> reporter: a meth addict at 17, omar gonzalez said thunder roads residential treatment center restored his world. he's a youth counselor. >> i came back to work for two

years. >> reporter: sutter health, alta base tells me, health care made them unable to return. no other agency is willing to take over. activists tried to get inside where thunder road board members were scheduled to meet to decide its fate. because of today's action the thunder board road moved its planned meeting from here to another undisclosed location. >> the county can step in and sutter can step in and other institutions, but we must do it. if we close this down, shame on us. >> reporter: closing these doors social workers say would be criminal. >> it's hard to find the words because there's no other place that kids can go. >> reporter: except back to the streets, back to drugs and too often to crime. norman williams just graduated

thunder road. >> especially in oakland there's nothing for them to do. they're going to keep doing the same thing, robbing and killing each other. >> reporter: the thunder road board put off its vote to wait for talks with officials. orinda is among several cities with poor roads and potholes. the city has made some improvements. orinda ranked 49 out of 100 for 2014. the average score for the entire bay area was 66. about the same as the past few years. >> our goal here at mtc is to boost the local streets and roads network throughout the region to a state of good repair and to boost that score to 75 from the current 66. >> the survey found that the roads in the three major bay area cities san francisco, san jose and oakland were only fair. some of the highest scores went

a bizarre problem today forced an alaska air yet to make an emergency landing. the pilot heard banging noising coming from the cargo hold.

it turns out that a ramp worker had been locked inside the cargo hold after he apparently fell asleep. the airline says the cargo hold is pressurized and temperature controlled. the worker was shaken up but is otherwise okay. prosecutors have charged a reserved deputy with the shooting death of a black suspect. the tulsa county sheriff released a video. in it you can hear 73-year-old reserved deputy robert bating saying i shot him, i'm sorry. eric courtney harris was shot by police. police said beats thought he was holding a taser not his handgun. a murder case that made national headlines came to a close today when 34-year-old jodi arias was sentenced for killing her boyfriend. >> i'm truly disgusted and i'm

appalled with myself. >> arias was cob vicked of murdering 30-year-old travis alexander at their home in 2008 -- was convicted of murdering 30-year-old travis alexander. apple may have its biggest product launch ever with a new apple watch. initial estimates indicate almost 1 million preorders worldwide on the first day and there are estimate sales could hit 3 million for the weekend. the watches should begin shipping on april 24th but demand is so strong some customers may have to wait a few months for delivery. turning now to wall street, the dow dropped 80 points today. nasdaq fell seven and the s & p dropped nine points. this is expected to be a busy week for analysts as corporate earnings reports start coming in. america's past time is bringing some bay area veterans together. >> playing this game here, it's a little bit of a life again. >> how the game serves as

new at 10:00, a group of veterans playing baseball. dozens of veterans are rediscovering a part of their youth. >> many serving in the vietnam war that ended this month. opening day can come in many forms. >> reporter: monday's mean baseball practice on the grounds of the veterans home in

yontville. dozens are on mixed nuts, a teams started by vets for vets. the youngest is 60 years old. some served in world war ii, many in vietnam. >> nice job. >> i was 17 years old. and most of us were just children. >> reporter: decades later a chance to play ball and recapture their youth. >> you know that's a hit, that's a good hit. >> reporter: this 91-year-old is the oldest member of the team and plays shortstop and second base. >> i like the, comrades ship over the ballplayers when they play on a team they become like brothers. >> reporter: for the vets, this is only the second year they played baseball together but they tell me the friendships they've made transcends time. >> boy, that was a clean hit. >> reporter: they tell me new friendships help heal the loss of comrades who never made it home from the battlefield.

that chihuahua that was found severely burned in the east bay recently. this is a new picture of the 8 -week-old puppy named fireman. veterinarians had to remove his outer ears because of the severity of the burns but staffers at the umbrella of hope say he's healing although he is is going to need a little more time to get better. fireman was found outside the antioch animal shelter suffering from burns. he should be ready to be adopted in june and the shelter says there have already been more than 1,000 officers officers -- offers to give him a new home. it's rainy out there tonight. it's going to be chilly and tomorrow's temperatures a lot like today. a chance of a sprinkle pretty much flying on by. right now there's a sprinkle of possibility over an hour or two. look at all the lower

temperatures. 62 in oakland. 58 in san francisco. these temperatures are going to come up a couple of degrees. a bit of a breeze tomorrow. you can see outside, it's clear out in oakland. you can see the tribune building. if you can see the flags you would know it's blowing. winds at 25 to 30 miles per hour. these winds will sustain themselves. and look at all the activity in the pacific and it was all missing us. now look at how will activity there is. you see, the bulk of its way up here now. as the days get longer and things get warmer up here. temperatures rise and the jet stream is lower. opportunities for rain at this time become less and less and less. hopefully there'll be something coming. but right now the models stay pretty much dry. 62 in napa. those are right now temperatures. overnight lows get down to the

mid-40s. even low 40s. gusting to nearly 30 miles per hour. significant santa rosa airport. you're hearing the wind if you're out by the airport. usually you see the stronger winds out by the delta but out there in the urban area, there's lots of -- is you expect the wind. san francisco tomorrow you start out kind of chilly. 60s for lunchtime. we skip over the bay to oakland, you're going to be in the mid-60s. oakland will be a little warm. 66degrees. as we take a peak at the five day forecast you're going to see temperatures that rival what you might see in the summer months inland as we get into thursday and friday. we're going to see numbers easily into the upper 80s by thursday and friday. so it's going to seem a lot like summer. the real story here with the strong winds i think tomorrow morning with the chance of

solo shot first of the year. oh boy. i mean this thing is a monster 3-run home run. the a's win going away 8-1. michael crab tree never quite lived up to the hype as a former draft pick of the 49ers now he will get his chance to do so on the other side of the bay. espn is reporting, crab tree has signed up with the raiders. one year $3 million. plus another 2 million in incentives. his best season came in 2012 when he caught 117 balls for 1,505 yards. and he was simply not an impact player this past season. soon enough we will finally know the warriors first round play off opponent in the meantime. they would affect the balance of power in the west.
