ktvu's rob roth is in the middle of the crowd outside the mcdonalds. rob? >> reporter: right. i am standing in the middle of the street which is closed because of the protesters. the protesters filled the streets and right now there is a program going on right now, speeches, extremely peaceful. they arrived a half hour ago. traffic has been diverted. we have seen no signs of trouble other than the blocked streets. police are keeping a low profile. we have seen a hand full of officers on bicycles. the protesters were coming here to protest outside the mcdonalds but that mcdonalds closed before the protesters got here. the protesters are calling calling for a minimum wage increase to $15 an hour. some people come from sacramento.

they tell me the protest will go on for maybe another half hour, 40 minutes. and then some of the people will catch buses and go back to where they need go and the rest tell me they plan to hold another protest in front of city hall. >> they are going to march from mcdonalds to city hall? >> reporter: yeah. that is the plan. it is not far. maybe 8-10 blocks. over martin luther king. that is the plan. they plan to end this at berkeley 80 is haul -- city hall. >> rob roth in doubt berkeley. -- downtown berkeley. thank you. new at 6:00 p.m. a man beaten and left for dead. now 7 months later police and his famerally still looking for answer -- family are still looking for answers. .

stadium. the team lost to the bears. after watching the game on television, 9:30 p.m. that night, he went walking walking to the grocery store in san jose. he never made it back. >> he was found the following morning. left for dead. with a fractured skull. with a structured jaw. injured eye. in a coma. >> reporter: hospitalized for two months. a victim of robbery. >> reporter: do you believe he was targeted? wearing a 49ers jersey? >> we don't know. it is potential it could have been but till we can find witnesses or somebody that could provide us with information about what happened we don't have much to go on. >> reporter: he is learning to walk and talk. his sight and memory are cloudy. while leads have died up. >> you look at the injuries, 7 months later the victim is

still recovering from his injuries. >> reporter: she retired to take care of her son and she wants justice for a crime that almost took her son's life and she says it already has. >> right now he is aware of what he lost. he is going through grieving and i am as well. i can't help but be emotional when i see what is happening to him. >> reporter: he took this photo of a car with his cell phone. the mom hopes whoever owns the car will come forward or anybody who sees the photo will -- it will jog their memory. it will be long term care, perhaps finding who did this will help him heal. anyone who has information about this case, think about that man and that mother and call police. >> azenith smith reporting live in san jose.

thank you. we have breaking news from oakland of a officer involved shooting. sky fox is over the scene at 105 avenue and creek side. not far from 880 and the oakland airport. police tell us police were conducting an investigation in oakland when they shot a suspect. that person was taken to a hospital for treatment. the officers called oakland police for assistant. this happened at 4:35 p.m. this afternoon. we haven't heard reports only whether officers were injured. if we get new information during the newscast we will bring it to you. the coroner identified a man shot to death at a pittsburg gas station. the incident happened at a chevron station at california avenue at 1:00 p.m. yesterday afternoon. police say he was in the parking lot with several

acquaintances when the suspect opened fire. a motorcyclist killed in a crash on 880 this afternoon in richmond before 3:00 p.m. the motorcycle rider fell in the westbound lanes. he was then hit by a big rig or an suv or both. the truck then over turned as the driver swerved. and pushed the suv into a sound wall. both of those drivers suffered minor injuries. the chp would like to hear from anyone who witnessed the accident. learning more abouta construction worker -- about a construction worker killed this morning. he was part of a crew working to widen highway 101 when he was crushed to death by a 8,000- pound pipe. ktvu's paul chambers is live now with more on the victim. plus what he learned about the

construction company's history. >> reporter: a tearful good-bye for the family of a man killed on the job. >> he loved what he did. he loved what he learned. he will be missed. >> nobody should have to lose anybody that says i love you all the time like he did. he was a loving, caring person and a hard worker. >> reporter: he worked as a pipe layer. wednesday morning his life ended tragically. investigators say he was working on the highway 101 widening project when they sat down a metal pipe, it broke loose, that is when he tried to stop it but wasn't able to do so and it crushed him. >> sat by hid body this morning. talk -- his body this morning. talked to the siblings so we

could be there with him. >> i am going to miss him. really hard. >> reporter: they released a statement, our concern and priority at this time is to the family for their sudden loss. and ask that your thoughts and prayers go out to them during this difficult time. we did some digging and we found five cal-osha reports with three violation. two violations that listed as serious. they classify as it as a incident where death or serious harm could happen. cal-osha is heading up an investigation and the company is cooperating with them. paul chambers, ktvu fox 2 news. >> a vote was delayed on a

vaccine bill today. the bill would eliminate the personal belief exemption and require parents to vaccinate their children as a condition of enrolling them in school. opponents say they pose a health risk. supporters site outbreaks of measles that put others at risk. . >> it will go from california to the next state and next state and so on. [ indiscernible ] >> it has to stop here. >> i am pregnant. i don't think -- [ indiscernible ] >> i don't think that our children should be forced to get risk. >> california is one of 19 states allowing parents to use a personal belief exemption. a vote is expected next wednesday. california could limit the flying of drones over public schools. a bill would require anyone flying a drone to get

permission from the principal first. they are concerned about flying drones during school hours. there is language that would allow the news media to use drones reporting purposes. progress following the crippling labor dispute. cargo volume in march is up compared to a year ago. ktvu's tom vacar is at the port of oakland tonight. there are still delays? >> reporter: there are. the port dispute was settled two months ago but it still hasn't been ratified. while operations are improved the fact is there is still presentee of containers thought yet delivered. >> reporter: they were getting down a bear shelves when we met them in january. lack of product caused canceled orders and financial stress for this firm. >> we have had a lot of loss,

probably thousands of dollars a week waiting for the containers. >> reporter: some finally arrived. all at once causing a storage challenge in this small warehouse. >> they departed four months ago but a lot are still blocked. in the port. >> reporter: their stores don't import but all of their suppliers do and that is a problem. >> strollers. car seats. clothes. i still have to -- [ indiscernible ] >> reporter: the biggest problem, cribs and basinets. 4-5 month wait. vintage store in san francisco is the latest casualty of a smash and grab burglary. surveillance video captured what happened. the most recent happened at a store on valencia street. ktvu's david stevenson tells us why police are looking to see

if the case is connected to others. >> reporter: filled with vintage furniture and cart but the owners are counting on surveillance video to catch the burglars. >> they used people on the streets as look outs. >> reporter: surveillance video captured four burglars using what police say appears to be a slingshot to bring through the front door at 4:30 a.m. this morning. they race in and head to displays show casing silver jewelry and other items. one smashes a case and fills a bag. another takes down two tv monitors and runs out of the store. they are in and out in 2 minutes with the stolen goods. he estimates he lost $5,000 in silver jewelry. >> just trying to clean up my mess and start all over. >> seems like they are happening more frequently. >> reporter: they see it as

part of a trend of smash and grab robberies. in some cases they have used cars to crash through store fronts. no arrests have been made. >> like yeah it could happen to me one day and today it did. >> we will have to look at if they are copy cats, or are they all related to a larger organizational crime spree. >> the surveillance video shows some of the burglar's spaces and they hope that will help lead -- faces and they hope that will lead to arrests. david stevenson, ktvu fox 2 news. a huge whale is on the beach in pacifica tonight. scientists and vets say there are no obvious signs for what killed the whale. it is 50 feet long and there were a lot of people who came out to the beach today see it. scientists say tissue samples are too decayedcayed for lab work so it is unlikely they

will have an answer on what killed the whale. they will probably leave the whale where it is and hopefully let nature take its course or if that doesn't work they may burry it in the sand. a new recycling system is in place at a popular san francisco park that generates mountains of trash. a pop up recycling and compost center. it will be open on weekends and holidays starting saturday as a pilot program. volunteers will help sort the trash. one employee says it will make people more responsible for the trash they create. >> encouraging folks, come in, enjoy your day, but please bring it out and make an effort to help our environment and recycle or compost. >> officials say right now the city collects 7,000 gallons of trash at the park each weekend

ripped up. when you don't see white caps your -- it is still windy but not as windy as last night. these are visual clues you can determine what is going on. fly over the san francisco bay in a jet and see how windy it is based on water caller. 22 miles per hour at sfo. pretty normal. san jose gustier than you expect, 18 miles per hour. jet stream is to the north. no rain. this is the ridge. i don't know how many miles that is. 3,000 -- 2,000 miles. a broad ridge. it is tough for systems to cut through. when they are amplified, tall, you can cut underneath it. a ridge like this it is tough. when i see that, you are not getting rain. that is a shame. for the next week. next five-day forecast is dry.
