may be able to identify them. good evening i'm julie haener. >> and i'm frank somerville. one hour of shopping in union square in san francisco came with a high price for a teenager from san ramon. her beloved cello was taken from a parking lot. she says she was in a city shopping for a recital outfit when it happened. >> reporter: it was a week before her big performance e -- and she just wanted something new to wear. but those behind this theft left their fingerprints and their faces behind. >> music is an outlet for me to express myself. >> reporter: 16-year-old serena strikes a beautiful tone. as she plays the cello she borrowed from her teaching in a

patch of grass in san ramon. >> it was handmade. like any other. >> reporter: this impromptu performance for us comes out of desperation to get her cello back. april11th should have been a wonderful night for the young cellist. after rehearsing she and her mom stopped by union square to pick out an outfit for the performance. they parked across the street from macy's. when they returned the back windshield was smashed and the 8,500 cello was gone. >> how could somebody do this, how could anybody do this to anybody. >> reporter: a woman is seen looking through cars. and then she take it is cello and leaves. >> you can see that they are looking for anything..

this is really good. we have images of both suspects and we have still images of them entering the parking garage. you can take a good look at them and you can pretty much make out their face and their body. >> reporter: surveillance video shows the distinctive tent on the drive's side door of their get away car. with the video so clear, serena hopes it's not long before the two are caught and her cello returned. >> it's just so special to me. and i don't think i can find anything else with such a distinct sound. so i want it back. >> reporter: obviously her parents did not want us to show her face. you cust -- can't just take an $8,500 cello to a pawnshop and

you can't sell it to another cellist without raising some eyebrows. and you can talk to any musician and they will tell you their cello is part of them. and she says she listened to almost 80 cellos and this was the one that felt like part of her. some residents are saying not so fast. maureen naylor attended a meeting where they're set up with a quote give aways, maureen. >> reporter: leaders say they were moved by the community response. and it wasn't just emotional with comments from parents and children but one city council member even complained about a lack of transparency on behalf of the mayor even questioning

the legality of his actions. >> reporter: before the meeting about 200 soccer moms, dads and players held signs and chanted. >> there was a promise made a couple of years ago we were all supporters of the stadium that the kid eventually would have a new location and a place to play. >> reporter: build the facility move us over there, don't just put some deposit down or whatever this deal is and displace the kids in hopes that somehow the plan is going to work out. >> reporter: inside the meeting there was so much interest, firefighters worried about the fire code. at the heart of the debate. these three soccer fields. located on 11 acres next to levi's stadium. the 49ers want to use the fields for parking starting in 2017 and pay $15 million in rent. money to help provide soccer fields elsewhere. >> the truth of the matter is, you're not living up to your promise. >> i understand that there are people who feel we have been

disingenuous because we did not expect to make a proposal like we're making today. >> i see it as a big middle finger to all of santa clara. >> reporter: for two hours, moms, players and coaches took to the stadium. >> people are fed up with give aways from this city council. it's not going to happen again. it's not. >> reporter: council member lisa gilbert called out mayor matthews calling the 49ers proposal cloaked in secrecy. >> you didn't connect with anybody in the community including your colleagues up here with this proposal. >> when the proposal came to me informally i knew i needed to bring the formal proposal through the 49ers directly to the council so that we could have a discussion about it. >> reporter: in the end, the city council cancelled closed session and decided to discuss it more publicly. >> it's a win-win situation for everyone. we're going to work with the community to find that win-win situation.

>> reporter: there was a situation to try to get some soccer fields equal to or better arranged. >> do you know if more public hearings are planned with this or where we are at this point in the game? >> what they decided was to send it back to a committee and also include the soccer league and community more with the 49ers which seemed to please some people. >> maureen naylor live in santa clara, maureen thank you. the city council of carson delivered a message to the 49ers saying we are committed to building you a new stadium. the council voted 3-0 in favor of a new city stadium. the idea is for the raiders and san diego chargers to share the stadium. supporters wanted a yes vote to show commitment to nfl voters and league owners. the carson stadium would be located at the 405 freeway and

del mar freeway. it's said to be the most undeveloped land in urban los angeles. we're still 10 months away from the super bowl at levi's stadium but already the excitement is growing. officials unveiled what they're calling super bowl city. it's a fan village leading up to the big game. the stadium will be located at the foot of the bay. >> reporter: the clock is ticking on super bowl l so now san francisco is working its way toward the goal line. >> the host committee is proud to introduce super bowl city. >> reporter: inside the hyatt regency with the lombardi trophy front and center, they

a rough start tonight for the new owners of a tour bus. the bus caught fire about 30 minutes after they bought it. they were driving on interstate 880 in downtown oakland when the trouble started. a passer by took the video. the new owner and his business partner say they heard rattling from the back. then saw other motorists yelling at them to pull over. once off the freeway they saw the engine was on fire. the fire extinguisher could not put out the flames. fortunately the oakland fire department showed up to extinguish the fire. $12 million that's how much b.a.r.t. says it will spend to make much needed improvements at several stations along market street in san francisco. new at 10:00, paul chamber social security live -- paul chambers is live at the city with the plans and how b.a.r.t. says it will make the passengers safer. >> reporter: i will tell you that $12 million you talked

about is just phase one. and b.a.r.t. says it will go to improve and repair things like this behind me. broken down escalators and other stations. >> this station stucks, it's nasty, it's disgusting. >> reporter: roughly 303,000 people ride b.a.r.t. each weekday. over the years the wear and tear is evident. now they will undergo a make over. >> i think our customers have been extremely frustrated with our escalators, they have been breaking down a lot. we know that's something we have to do. >> reporter: a canopy will be installed over those new escalators. similar to the one they added to the 19th street station in

oakland. the cost of the project, $4 million per entrance. >> they're always fixing the escalators because they get wet and everything else. keep them dry, keep them running that's what it's all about. >> reporter: employees will be able to lock the canopy and added safety feature to keep people from having access to the station after hourless. they also have a plan of brightening the stations by adding lightning. also more elevators and escalators and as far as the homeless problem the woman spoke of earlier, b.a.r.t. is working on that too. >> we're enforcing a code that says if people will are lying down that we have to ask them to sit up or leave. >> reporter: now phase two will have canopies and new escalators on civic center and powell street. after that b.a.r.t. is hoping they can do the same thing at phopbt -- montgomery and embarcadero.

>> paul chambers live in san francisco, paul, thank you. the san francisco board of supervisors voted today to allow munni security guards to keep their guns. less than 20% of nummi's guards are armed. munni's director says guards are needed. surveillance video was released today showing the most recent security breach in san jose maneta international airport. it happened back on march 21st. one angle shows diana prieta at the fence.

the breach is one of five at maneta san jose. in response these fences are being raised around the airport to 10 feet with more barbed wire on top. they already started installing the higher fences on the southwest corner of the airport. health officials confirmed today a student at st. mary's college has a case of meningitis. the student got sick and is said to be improving today. in a worse case scenario, meningitis can cause brain damage and 5% of the cases are fatal. the health department says it doesn't expect an outbreak. >> however we want the community to be vigilant. any signs of meningitis whether it's a fever, stiff neck, nausea, vomiting or confusion,

students must seek medical attention immediately. last minute changes before a key vote tomorrow by the state senate education committee. the proposed legislation would require children attending public and private schools to be vaccinated. and would eliminate california's personal belief exception. some children would be denied their right to a public education. so now the bill's author has amended the bill to allow unvaccinated children to be home schooled in groups as part of the public school system's independent studies program. it's unclear if that will be enough to salvage the bill. san francisco is one step closer to banning performances that use exotic animals. today supervisors approved the ordinance and it's now headed to the desk of mayor ed lee. the ban would apply to circuses and sets for movies and tv shows. tang introduced the proposal. it's designed to address animal

abuse and inhumane treatment. last year, ringlin board -- ringling brothers said they would stop using elephants in their shows by 2018. showers in the sierra nevada. that will happen again tomorrow. same low pressure center that's bringing us this cool weather is creating unstable weather in the sierra nevada. for us we have a lot of clouds and low fog. everybody has got clouds. right now it's real foggy and cool along san francisco at the waterfront and it's been windy. windy conditions right now. 21-mile an hour gusts. blowing 24 in concord and 14 in napa. there's a weak system, not enough to bring us rain but enough to stretch out the fog and the inversion.

will cool everybody off and bring temperatures down and keep us there for a little while. overnight lows will be in the 40s. maybe low 50s. you wake up tomorrow morning this is what it looks like. this is tonight and enter the fog and low clouds. all nine bay area counties will see the fog. then it will burn off. we'll see a few more low 70s tomorrow but still a cool day. more sunshine, more blue sky tomorrow. slightly warmer but this cool weather pattern this chance of drizzle sticks around as we head into the next several days. i'll dial it in. tomorrow morning drizzle and very cool as you head off to work. something you don't see every day. a killer whale washes ashore on a northern california beach. plus their son was the subject of an amber alert. now his parents say police treated them like criminals. >> also your water bill under fire. a judge rules that an effort to enforce conservation is illegal.

san jose city leaders set a new goal of reducing water use by 30%. and that could lead to increased fines for people who waste water. under the new rule san jose homes and businesses will only be allowed to water twice a week. no new outdoor landscaping can be installed between may and october except for drought tolerant and native plants. people with pools won't be able to top off as much and sidewalks and building exteriors cannot be hosed down. a state appellate court may have delivered a blow to water agencies. >> reporter: this ruling is seen as dramatic by some essentially removing a key tool from water agencies that are

desperately trying to meet state conservation goals. but in the end, this all may come down to accounting. heavy water users or water hogs should pay an extra rate for the water they use. it's a notion many may agree with. >> i believe there should be higher rates for higher water usage. >> maybe they should pay a little bit more. >> reporter: but a water agency was slashed down for using a tier system that charged heavy water users more, solely to promote conservation. the ruling is based on proposition 218 passed by voters in 1996. the so called right to vote on taxes act that in part was interpreted by the court to mean that water agencies cannot charge more than what it costs to deliver water to customers. governor brown said the ruling put a straight jacket on local government at a time when flexibility and conservation

is needed. east bay mudd does as does san francisco's puc. >> you can't have a conversation reasoning for setting your tiers and that you have to start with that cost of service justification for because that's what proposition 218 requires. >> reporter: pucs tiers are based on cost not conversation. from how much it costs to bringing water from mountain sources to the cost of treating it in the end. >> if you're using a lot of water it takes a lot more effort to deliver that same amount of water to those customers. >> reporter: these higher tier systems used by east bay mud and san francisco puc which is based on cost. of course also have the benefit of encouraging conversation. the san francisco puc used to have a tier system that was aimed at conversation alone but they changed it anticipating a ruling like this could come down some day. >> all right, thank you, ken. the death of a killer whale along the mendecino coast is

giving scientists an opportunity to study its remains. the male orca was found saturday morning beached three miles north of st. bragg. the whale had a crab pot tangled around its tail and fins. they have decided to reassemble the skeleton for display. they say what they learn will help with conversation efforts. their car was stolen with their son inside. now a fairfield couple says police treated them like criminals even handcuffing and arresting them. the family of a bay area missing girl is asking for help in finding her. hear why they think social media may have played a role in her disappearance.

developing news now involving a police chase through berkeley and emeryville. officers chased a car containing two men wanted for an armed robbery in berkeley. the car blew out its front tires on the ramp on to interstate 80 and the two men took off on foot. the passenger was caught but we watched as the driver then ran on to the freeway crossing both lanes east and westbound in those two directions. it's dark out there but you might be able to make him out. he runs down the freeway and jumps off. police eventually caught up with him in the parking lot of a chevy's restaurant. the 16-year-old daly city girl with mental disabilities has been missing for two days and her family is desperate and pleading for help. >> reporter: police tell us they put out these fliers in

areas where the teen has been known to frequent and her family is asking for help in finding her. >> she can appear to be her 16- year-old age, but mentally she is just not 16. >> reporter: laura eda peeples is the girl's grandmother and standing next to her is destiny's twin brother. destiny was found at the parking lot of this restaurant near her home and someone at the business called police. officers took her home but she left again. >> we just want to get her back home so that she can get her medication and try to get her

some help. >> reporter: peeples says destiny is troubled with a desire to connect with her mother. and she recently befriended a man online. >> that's the scary thing about it. that she would go with someone who could potentially hurt her. >> reporter: destiny's twin brother says they have a close relationship and hopes his sister can hear his plea. >> destiny please come back home. because it's dangerous outside in the night. and the family is missing you. >> reporter: police say they are treating this case as a missing juvenile at risk. destiny doesn't have a cell phone. her family is asking anyone who sees her or has information to contact police. >> amber, thank you. new developments tonight involving that amber alert early yesterday morning from a young boy, for a young boy from fairfield. the boy's parents claim fairfield police mistreated

them when officers first arrived at their home. >> we're grateful that it worked out but we also need to let it be seen how we were treated. i mean it's, in my opinion i don't know you guys it was wrong. it was not a professional way to handle it if your son is missing. >> reporter: 8-year-old brock guzman was asleep in the family car with the engine running when the car was stolen. fortunately brock was unharmed. his father paul released a cell phone video today showing the alleged mistreatment. susan guzman is in a panic when paul guzman says officers slammed his wife to the ground on the driveway as she screamed i can't breathe. >> listen, listen to me. there's a statewide amber alert for him. there's a county wide, all the media people are out. >> reporter: both parents were

detained and handcuffed for interfering as the officers tried to search their home. it's been seven months since the young brother was shot and killed by a stray bullet in the south bay. today her family is still struggling trying to cope with their loss. anne rubin says they're dealing with more than just grief. >> reporter: it happened on her grandparents doorsteps as they way waited for a relative to park. >> in a split second my entire life completely changed. >> reporter: malia watkins lost her husband, her best friend and the sole provider of her family. >> people don't think about having to listen to your kids cry. and ask you questions why this happened. and i don't have the answers. >> reporter: in the time since, malia has given birth to their

third child, a boy named kai. she went back to school to become a medical assistant and since then has gotten a driver's license. the family has in the been able to get subsidized housing. >> it seems like everywhere we turn we're hitting a brick wall. >> reporter: housing wait lists are long. >> pew -- bureaucracy is what it is. it doesn't change because you're going through a loss. >> reporter: no rental units available even for those who have vouchers. >> there's so many people in need right now that all the sources are nearly tapped out. >> reporter: -- >> there's a lot of people out there that are going what i'm going through. this isn't just me. and we need help. >> reporter: watkins hopes to draw attention to the problems victims of crimes are facing and she says although her life was shattered that day, she is working hard to pick up the pieces. >> i have more of a drive to make sure i succeed.

and you know, the people who took my husband away from me they love -- they robbed me but i'm not going to let them leave me with anything. >> reporter: six people have been charged with her husband's murder. san francisco sheriff ross mirkerimi announced a pilot program for surveillance cameras in the jails. the plan is to buy 40 cameras. deputies in all shifts will start wearing them and that move will make san francisco the first jail system in california with body cameras. san jose's police chief takes down a man trying to escape. the question that ordeal is facing with security. >> and cool breezy weather, even drizzle in store for

doctors medical center in san pablo closed its doors for good today after 60 years of providing medical care. the hospital staff was emotional this morning as they said goodbye to coworkers after the last shift. that public hospital had been losing millions of the dollars every year. the medical center served about a quarter of a million people in west contra costa county. most were low income and the majority were on medicare or medical. >> i feel for the community. it hurts a lot for me to have to walk away from this place. >> reporter: many patients will now have to travel farther.

they'll have to go to kaiser hospital in richmond, alta base or john muir medical center. the daughters of charity hospitals are reportedly cutting staff in order to save money. the organization operating four hospitals in the bay area. daly city, o'conner, seaton coast side in moss beach and san luis regional. the san francisco regional times says about 240 workers out of 7,000 are losing their jobs. the charity says it is also still looking for a new buyer for the hospitals. you will recall an earlier deal fell through. people gathered at san francisco to mark 100 years since the armeniangenocide. community members have been fighting for recognition of the 1.5 million armenian christians who were killed under the

ottoman empire. as we get ready to celebrate earth day. the number of people getting rid of their water guzzling lawns has reached record numbers in the bay area. just about all of the water districts in the bay area have some kind of lawn conversion rebate program where the agencies give credits for people who replace their lawns. east bay m.u.d.d. will give people 50-cents for every square foot of lawn they get rid of up to $2,500. and hundreds of people have applied for the program. >> i have looked at this thing. i used to have kids. we used to need a lawn area to play on. i certainly don't need that anymore. >> last year east bay mudd customers converted about half a million square feet of lawn to drought tolerant landscape. this year the water district is expecting to more than double

that number. and at ktvu.com we posted a list of rebait programs around the bay area. there are several of them. you can look for the story in the earth day section on our website. san mateo county is reporting its first sign of west nile virus this year. vector control officials say a dead bird that was found at menlo park tested positive for the disease. west nile is spread by mosquitoes, crews will set traps in the area where the bird was found. elsewhere in the area, santa clara county has already reported three affected birds and alameda county has reported one for a total of five in the bay area so far this year. taking on tobacco, the new rule for at&t park just to prove today. also the giants in action at home tonight against the dodgers at opposite ends of the standings. our sports director mark ibanez will have highlights. >> bill martin's forecast will tell us when we will see a warm up. >> i got to be a cop for just a couple of minutes.

san jose's police chief spoke about tackling a murder suspect that ran off in handcuffs. the chief says he was just doing his job but as ktvu's azenith smith shows us, the incident is now raising questions about security at police headquarters. >> reporter: san jose police esquivel says he did nothing special but others would not agree. >> that's our job. i got to be a cop for just a couple of minutes. >> reporter: the top cop was fully into the police parking lot when he saw a man wearing handcuffs running. after the chief ordered him to stop and he didn't, chief esquizel sprung into action tackling the suspects.

but the suspect got away. ran down the street near highway 87, chief esquivel was finally able to pin him down. >> kind of zigzagging and he was going to traffic. luckily i was able to take him down. >> reporter: this shows a bruise from the take down. fortunately no other officers were injured. this man was wanted for the murder of a 26-year-old man six years ago. the police say he bit two officers and attacked another one in mexico. police say arias in handcuffs was able to flip his hands around in front of him, escaped a locked holding cell and hop a barbed wire fence. i asked the chief how arias was able to escape custody. >> we're looking at his ability to get out of that secured temporary holding facility. that room. so we're looking at that as to

how that happened. how that door was able to be opened. >> reporter: police are now conducting an internal investigation. police tell us an inmate escaping police headquarters has not happened in recent history. they're now reviewing surveillance video which they're not releasing to the public. in san jose, i'm azenith smith, ktvu channel 2 news. the secretary of homeland security was in san francisco promoting a partnership with silican valley to improve cyber security. >> government does not have all the answers. nor do we have all the talent by any means. cyber security must be a partnership. >> jay johnson addressed the ra conference at masconi center. he said the government and private sector need each other and he invited tech companies to go to washington, d.c. he also announced the department of homeland security is introducing plans for a cyber security in silican valley. the dow lost 85 but the nasdaq was up 19.

the s & p500 was down three. analysts say tech stocks got their boost from merger activity. it's foggy out there tonight again as it was last night and right before that. take a look at this picture outside the studios. of course bay bridge is right about here. san francisco should be there. it is there. you just can't see it and the golden gate bridge right here. the fog and low clouds just en enveloping the area. it's almost like an overnight low. 68 in vallejo. we had a lot of clear air there. santa rosa cloudy most of the day. this low pressure center is going to linger offshore. bringing showers into the pacific northwest and into nevada. it's not happening for us. it's just enough to really enhance the marine layer and the fog and push it well in

like i just showed you there. a ton of low clouds, not just extending into san francisco and into oakland but it's extending into fairfield and soon it'll be pushing up into the davis area and even further. there'll be low clouds tomorrow as well. so we have this morning. pretty much everywhere. tomorrow morning 7:00 a.m. there's your fog footprint right all the way into the sacramento valley. then into the afternoon there's the showers and thundershowers again. now we go into thursday morning. we see a little bit of shower activity blow off from the mountains coming this way. so maybe santa rosa, a sprinkle or something and drizzle in the forecast. then we go into your thursday morning. not as much fog but still that system lingers. then a few showers in the mountains. then everything goes this way. that low kind of -- that's your indication as well. showers all around us. light showers but not enough really to deliver any kind of a punch for us is what we need.
