the city attorney accused management of illegal evictions, and beating up tenants. for the first time today had mayor of oakland is talking -- the mayor of oakland is talking about it. >> reporter: this week it was a leaky pipe in what was sewage running down the wall. the latest of many problems in downtown oakland. exposed by 2 investigates. >> the piping, the electricity. still goes out. >> reporter: code enforcement signed off on most of the violations and told us they were fixed. now a different message from city hall. >> reporter: are you convinced that place is a habitable place to live? >> we are not. >> reporter: the city attorney is suing alleging unsafe and unsanitary conditions. including a broken elevator and other problems going back to 2011 when then owner went to prison for trying to burn the

place down. >> what you discovered concerns me. >> reporter: today the mayor sat down with us. we asked about ongoing problems at the hotel and whether inspectors doing enough. >> it concerns me about the veracity of the owner and whether or not something was covered up, about the performance of our city employees, but it concerns me about our system. >> reporter: she wants a more proactive inspection process and supports a demand in this lawsuit to place the towers in receiver ship, taking day to day control away from the owner. >> i can tell you some tenants will say what is taking so long. >> i believe that what we need do is be pro active. that claimed a man's life in san francisco. the family announced they are suing the city and police. they say their son wasn't an threat to the officer who killed him. the parents say they lost a hard working son who helped support them by sending money back theme guatemala but -- home to guatemala but police say it was self-defense. ktvu's rob roth where a vigil is just getting underway. >> reporter: people are just arriving at the vigil for the young man shot to death by police. it is where the shooting happened. attorneys are asking for a federal investigation into what happened. >> reporter: attorneys say the two police officers were not acting in self-defense when they shot to death the 20-year- old native of guatemala. they say he was running away

from officers and not towards them. >> we have evidence that is not going to lie. we have evidence that they will never explain. >> the attorneys say their autopsy shows the man was shot from behind. they filed a lawsuit against the chief, the two police officers and the city. attorneys are asking for a federal investigation. >> we have given them all of our case to this point. okay? so that they would take and run with it and do the right thing and bring a federal prosecution. >> reporter: they called the shooting justified based on accounts his office has seen. at today's announcement where the parents of the man shot to death by police after he pointed a taser at them which they mistook for a gun. the officers were cleared.

some say police shootings are happening too often. >> reporter: we are back live where people are gathering that vigil. they plan to march in protest to the police station and then to a neighborhood church. >> rob, they hired a person to conduct a private autopsy, he was shot six times from behind. do we know what the medical examiner in san francisco found during their autopsy? >> reporter: we have been asking about that. what the attorneys for the family say they told them is that that autopsy is still being conducted. it is not complete. still a work in progress. yes, it will be interesting to see if there is differences between the two autopsies. >> rob roth in san francisco, thank you. the city of san francisco agreed to a $725,000 settlement in a lawsuit against the police

ktvu's cristina rendon is live at the coliseum station with more on the project. throwing a curveball into people's plans. >> reporter: yeah. fans that use b.a.r.t. to get to the stadium are already flowing in for tonight's game but sunday may be more challenging because b.a.r.t. is closing the tracks between fruitvale and the coliseum and that work starts at 7:00 p.m. tomorrow and he think lasts till 4:00 a.m -- tomorrow and he think lasts till 4:00 a.m. crews will replace the tracks. you need oplan ahead. -- to plan ahead. because of that factor in an extra 45 minutes to an hour. and don't bring bicycles on to the buses, if you have an alternative form of

new at 6:00 p.m. caught on camera. hundreds of thousands of library books thrown out in the east bay. and one watch dog group says 400,000 books have been dumped. tonight member of the group hand over video that shows a woman throwing books into a dumpster. ktvu's mike mibach reports it comes when officials placed a moratorium on book disposal. >> reporter: seeds of dreams

grow, pages of knowledge turn. >> easier to come to the library than to buy them. >> reporter: in some branches she says it is a different story. >> i am horrified that the people who were supposed to be in charge of our legacy of knowledge don't care. >> reporter: children's books, fiction, non-fiction, the claim from the book lovers is that thousands of them tossed off the shelves, discarded. she played us this video of someone tossing library books into a bin. she says it was recorded by a anonymous employee outside the main branch last month. >> we pay taxes to buy those books. they are controlling our access. >> reporter: the president of the board of supervisors told me there is a moratorium on book disposals till a new

policy is approved by the county. >> says nothing about public input. says nothing about giving the public a say. >> reporter: she says the public should not be involved. >> i think the library should know what books are popular or want to be read. >> reporter: officials were not available for comment. she says the moratorium is being ignored. based on the video. she hopes the pages of knowledge no matter how old remain in the stacks. mike mibach, ktvu fox 2 news. san jose airport recognized a good samaritan today who helped save a man who was suffering a heart attack. he is the hero. he says he happened to be in the right place at the right time and he knows cpr that he learned as a volunteer firefighter. he noticed a man in distress sunday and jumped into action. he credits other people who
