we continue to follow developments in the case of a 9- year-old stabbed to death in discovery bay. a man accused of killing him made his first court appearance. william schultz appeared before the judge. ktvu's allie rasmus has more. >> reporter: his arraignment was postponed till may 22. he did not enter a plea and he was in court for 5 minutes. during that time he was luced and didn't show much emotion. outside the courtroom his attorney spoke about the issues that will come up in the defense. . >> no question that mental health was the main factor here. >> reporter: william schultz is charged with murder. he is accused of stabbing to death a 9-year-old boy on sunday. his attorney says he has a history of mental health

problems. >> the family tried to get help for their son who was exhibiting systems and signs of mental health. yes, they tried very hard in the weeks and months leading up to this. >> reporter: he had no prior criminal history and his attorney wouldn't go into how often the family tried to get help. he admitted he killed his friend's brother jordan almgren. he said i wanted to see what it would be like to take a life before someone tried to take mine. he said i wish that i hadn't. i think what if that was my brother. i feel bad. i have remorse for what i did but there is a reason for everything that happened. >> i think it was unfortunate the press was allowed to speak with him. >> reporter: he explained his family sent him to the hospital saturday because of concerns about his behavior. a doctor released him. that night he spent the night

at his friend's house and he stabbed to death his friend's brother sunday morning while the child slept. >> it sent shock waves through the community. we learned it is not safe for kids to go to school, it is not to send children to other people's houses and now we are finding out it may not be safe to have people come to our homes. >> his attorney says his family is devastated and that they have already expressed their concerns and condolences. >> thank you. governor jerry brown is ramping up efforts to control green house gases with a 40% reduction from 1990. he issued an executive order. saying california sets a high bar for itself and other states and nations but it is one that must be reached. the governor's goal is similar to that set by the european

there is concern in san francisco tonight about an increase in high school drop outs. the latest figures show the drop out rate in san francisco is now higher than the state average. rob roth is live in the city. you have been talking with the district and students there? >> reporter: right. graduation rates are down, the

drop out rate is up and administrators say perhaps a more stringent actdemic factor is a factor -- academic factor is the factor. >> they don't have enough support from other people. especially african american students. >> reporter: here is a look at the numbers. san francisco's rate increased by 3% last year and 12% is higher than the state average. we asked what is going on. >> we increased the graduation requirements this year. >> reporter: last year students were required to take upper level math and foreign language classes to make them eligible to apply for college. >> we need to look at what are the supports that may be needed to help the students achieve. >> reporter: they say too often

followed the shooting. >> reporter: giving commands over a loud speaker oakland police surrounded a home early this morning. the s.w.a.t. team was called out as police search for the people who opened fire on police officers. none of the officers were hit but it was tense time for the department and for the police chief who rushed to the scene. >> this is scary stuff. shows people are not afraid to use guns and it is -- we need it continue to work hard to reduce violence. the shooting happened around 1:30 a.m. this morning near brookdale and 35 avenue. detectives were doing surveillance on a gang member as part of a homicide investigation. one person in a car fired towards officers. >> i think they saw the officer in the area and wondered what

4:00 a.m. this morning. thieves smashed a van through the store in pacific heights. you can see workers removing the broken doors. three people ran inside the store and grabbed bags and clothes. police are hoping surveillance video helps them find the one man and two women. san francisco pub went up in flames today. it is off lumbart street. ktvu's tara moriarty reports, it is a familiar institution to natives and tourists alike. >> reporter: a san francisco main stay up in smoke. >> we thought it was our apartment. i was panicked. fire. >> reporter: after 7:00 a.m. this morning liverpool lil's a restaurant and pub for 40 years was engulfed in smoke and surrounded by firefighters. >> everybody is in shock about it. not good. history going down right now. been here forever. >> reporter: one worker was

now turning to the earthquake in nepal and the rising death toll. 5200 people declared dead, 100 more in china and india. officials say the number of injured has risen to 10,000. nepal needs half a million tents for all the people forced from their homes. amid the death and destruction a baby boy was found alive. this is a photo from the newspaper katmandu showing his rescue on sunday. he is doing well at a hospital there. we also know the parents

survived as well. a group of friends from san jose survived the earthquake, they were there on earthquake, hours from boarding the plane to head home when the earthquake hit. ktvu's azenith smith is live. i can't imagine how happy they are to be home. >> they are really happy and they just got back yesterday. i have been gathering all week and earlier we told you how two people died in nepal from the south bay. there is also this group of survivors, they experienced california earthquakes before but nothing like this. >> reporter: it was supposed to be a relaxing get away. four friends on a hiking trip. everything they had dreamed up till their last meal when the restaurant began to shake. >> being from california we knew immediately what it was. it was violent and long. i was knocked off my feet and crawled to the doorway. >> reporter: she says worry and

not the first attack in the area. good evening everyone. i am mike mibach. >> i am julie haener. police are searching for a man tonight accused of attacking a woman last night. today police added extra patrols along the trail. that is where they found the 29- year-old victim who was sexually assaulted. ktvu's john sasaki is live where he learned about three other sexual assault cases on the same trail. john? >> reporter: that is right. this place may now be known as the place where women are getted sexually assaulted and including -- getting sexually assaulted and including yesterday it happened four times in three years. >> reporter: peace and serenity but residents are concerned about using it. >> i walk on the streets but not the path. i heard there was an attack before. >> reporter: on tuesday, 6:00 p.m., police say a 29-year-old

woman was sexually assaulted here. the victim is being treated for her injuries. >> the police woman came to the door last night and we didn't know what happened. >> reporter: what did she say? >> she said had i seen anything. you know? you know? >> reporter: [ inaudible question ] >> no. >> reporter: there have been three attacks in three years. >> scares me. i live really close to this bridge. down the street from it. my mom just, like, came home and said, like, there is a lot of cops around the bridge. i am, like, somebody must have been attacked. >> reporter: investigators won't say what the woman was doing here. walking, running or where it happened but they warn people to be aware of their surroundings, stay out of seclude areas, avoid using head phones and never come alone. >> know what is going on.
