has been charged with dui before. ktvu's noelle walker spoke to the victim's family today and she is at the scene where people are gathering for a vigil. >> reporter: they have been coming by steadily since this crash but now there is a vigil organized and they are remembering the mother and daughter who were killed and the family and friends who witnessed the crash, we talked to a boy who was injured in the crash. doing what other boys do, playing in his backyard. >> he was -- [ indiscernible ] >> reporter: she cries remembering her 7-year-old brother's fear. he has scraichs and stitches -- scratches and stitches. >> all he said was mom let me pray to god i am okay. >> she was pinned under a fence after a drunk driver plowed

through the family's back porch saturday night killing esperanza morales and her 14- month-old daughter. >> we don't want him to be out doing this to more families. killing more people. >> reporter: police say the driver, 35-year-old brian jones had a blood alcohol twice had legal limit and was at -- the legal limit and was at the livermore wine country festival before the deadly crash. the mayor says he doesn't see a needs it change anything that festival that is set up for sipping is, not binge drinking. visitors wait 20 minutes to get a one ounce pour of wine. people are waiting in line again at the next testing. vendors are trained to spot people who had one too many and they post reminders to use common sense. >> when you have people that choose to be irresponsible that is when you have a tragedy like

these hoodlums took my baby and cancer is taking my other daughter. so, no, i am not happy. >> the next court date is june 8. prosecutors haven't decided whether to seek the death penalty. new at 6:00 p.m. more fall out over the closing of fire stations in east contra costa county. we are learning the closures could mean an increase in fire insurance rates. this comes after residents vested to keep their fire district in tact. ktvu's tom vacar with more. . >> reporter: folks in the east contra costa county fire protection district will get the bad news. the district down from 8 stations 5 years ago will soon have only three. the downtown station is already closed and the one in the rural town will soon be gone too. leaving three stations and nine

firefighters to cover the 250 square miles. a company told the district that homes here will be rerated and charged for much greater risk. >> in some cases it could be to the point where we, the company itself, can't insure you and now we are talking thousands of dollars above what we would call a standard premium. >> that leaves folks farrest away from the closest open fire house. -- it all boils down to location, location, location. . >> that will hurt them. >> reporter: properties 5 miles from a fire station have twice the losses that closer ones do. >> puts us in grave danger. our response time is 15 minutes. coming out of oakley and if it

is on rush hour, coming down east cypress, it makes it longer than that. >> reporter: the rejected assessment will be eaten up by higher insurance rates. tom vacar, ktvu fox 2 news. the san francisco woman whose rent went up by thousands of dollars is in the process of moving out. she said she had been informed her rent was going from $2,100 a month to $8,900 a month. the new owner decided to turn the building into a single family home. she said she couldn't afford the rent hike so she is now couch surfing. more and more tourists are visiting oakland but some say more needs to be done. >> do you think oakland has been aggressive enough? >> no. >> how they are trying to catch up and why now is a critical

governor jerry brown presided over a ceremony in sacramento honoring california law enforcement officers who died in the line of duty this year. one of those honored was a b.a.r.t. police officer while conducting a search last year. >> b.a.r.t. police department, end of watch, january 21, 2014. >> this group here for these few hours embodies the best of california. solidary, camaraderie, memory and dedication. >> governor jerry brown said today's ceremony was wonderful tripitute california peace officer whose sacrificed their lives serving and protecting their fellow citizens.

18 officers were recognized today. an organizer says he is not upset with those who chose to break windows and vandalize. police say 13 people were sited or arrested. 9 booked on failure to disperse. one for assault on an officer. he understands business owners are upset but he says what happened doesn't compare to the violence the black community sees every day. >> they recollect replace the glass. they can still run a business and still make money where as people lose their lives and that is irreplaceable. i can't equate human life with broken glass. >> business owners don't understand why police didn't arrest people as soon as they
