developing news in the south bay, that's where a teenage girl shot herself in the leg with a police officer's gun. good evening, i'm gasia mikaelian in for julie haener. >> news of that shooting just broke in the last two hours. we've learned that the stepdaughter of a gilroy police officer accidently shot herself at home with her father's gun. the shooting happened around 3:00 at their home on el cerrito way. we get this developing news from maureen naylor. she's live outside gilroy police headquarters. what can you tell us? >> reporter: i spoke with police in the laugh last hour, they tell me this was not the

officer's service weapon, but his personally owned gun. this all started about 3:00 this afternoon, when gilroy police and fire were called to the officer's home, where he lives with his stepdaughter on the 500 block of el cerrito, after getting reports that the teen girl shot herself in the leg. once there, emergency crews realized it was the home of a police officer. the girl was given first aid, and taken to a trauma center. police say she will survive and is stable. police say their initial investigation indicates she was able to access the officer's personal firearm, and accidently fired a shot into her leg. >> there are laws that govern the storage of weapons. firearms specifically. the circumstances involved in this case, i'm really not sure at this point. the preliminary investigation has been started, and we have to wait until we get the results of that investigation. >> reporter: the police

department has now launched one investigation along with an internal review. they'll ultimately hand off their findings to the district attorney's office for an additional review. i asked tonight if officers are given gun safes, or any other safety precautions to store their city weapons. again the girl is expected to survive tonight and is undergoing treatment for her injuries. police are not releasing any information about the officer tonight, including how long he has been with the department. back to you. >> maureen, do we know anything at all about where the weapon was and how the girl was able to get it? >> reporter: at this point, it's not clear exactly where the weapon was, or how she was able to get it. police tell me they will be looking to see if the gun was properly stored, and criminal charges could be filed if it was not properly stored. however, the too early to tell if that was the case. >> maureen naylor in gilroy tonight. venal police in the south bay are getting ready for cinco de mayo tomorrow.

saying their plan is to ensure everyone stays peaceful. in downtown san jose, businesses, including the tequila bar say it's their busiest day of the year. police say they'll be out in force to keep things from getting rowdy. >> we're going to have plenty of officers to let people know that hey, it's okay to come over here and have a good time. but at the same time, don't come over here to start trouble, because if you do, we're going to take care of business. >> last year, they made no arrests on cinco de mayo itself, but officers did arrest 44 people during the weekend leading up to the big day. aaa is offering its tipsy tow service. the offer is good for one ride home for free up to 10-miles away. it lasts until 6:00 a.m. wednesday. the number to call is 1-800-222- 4357. aaa says you don't have to be a

member to call for a ride. there is growing criticism for how oakland police responded to all the van callism during last friday's may day protests. healther holmes is live outside headquarters with downtown from businesses and also the mayor. >> reporter: the mayor is apologizing to those business owners. those businesses that were hit, even calling some of them personally. she told me that she's working with the police chief here to evaluate the response. in between the politicians, police and protesters are those business owners tired of being targeted. on oakland's auto row, a trail of bloken glass, boarded up windows and anger. >> i'm disappointed. i think like many other people. >> reporter: here he had two of his storefront windows shattered. this evening, he replaced the broken glass with this large sign. critical of the police response when a small group of vandals

went on a destructive rampage. >> you look up and down, you see more damage, i think nothing was done to prevent it. >> reporter: this area has been hit during past protests, but this latest vandalism is among the worst. the general manager tells me, the vandals cost several hundred thousand dollars worth of damage, spray painting 70 to 80 vehicles, even setting one of them on fire. at an event, the mayor admitted, the strategy for handling protesters was ineffective. >> we did not do a good enough job of protecting property. >> reporter: the city is working with business owners to help make repairs as quickly as possible. deferring permit fees, and building requirements, and that a review of the police response

is underway. >> we are doing a full evaluation of our tactics of how we responded that night, and looking for new tools that can be used to plan for effectively. >> reporter: but for the business owner, the new tools come too little too late. he says the ongoing violence may drive him away. >> if that doesn't get better, i think many businesses are going to leave the city. >> reporter: 14 cars at the honda dealership were also hit. in addition to repairs, the dealership must disclose when there's $500 or more worth of damage to a vehicle. that could potentially force them to lower the vehicle's price. >> going back to the business owner, does he have insurance? will that pay for the damage to the business? >> reporter: one of the signs will cost at least $5,000 to replace. when asked about insurance, he told me he doesn't have it. he says it's just too expensive, the deductible to

cover that kind of loss. he has other insurance, but not to cover those two windows. oakland police say 13 people were cited or arrested during the march last friday night. 9 booked for failure to dispurse. 1 for assault on an officer, 1 for tools of violence, 1 for burglary, and 1 for public intoxication. the memorial is growing for the mother and baby killed by a suspected drunk driver in livermore. people gathered to lay flowers and balloons at the spot where the crash happened. authorities say the corvette was speeding when it jumped the road and plowed into the victim's backyard. she was killed along with her 14-month-old daughter julie. the drive is identified as brian jones of livermore. police say his blood alcohol level was nearly twice the legal limit. >> i hope he goes to jail and

never comes out. >> livermore police said yesterday, jones was at the livermore wine country festival boyfriend the crash. friends and family of the victims have set up a gofundme sight to help pay for the bodies to be flown back to mexico for a memorial. authorities say the two men were shot friday night. they're identified as 26-year- old carnell taylor jr. and jason johnson. they were both from san francisco. there was also another home invasion robbery at that same house earlier last week. four people were arrested in that case. investigators say they still don't know if the two incidents are linked. this afternoon, a chp helicopter team rescued a woman who was stranded on the rocks at tennessee cove on the marin county coast. the chopper lowered a rescuer to the woman, and brought her back onboard. she had been swept out to sea by large waves, but was able to

get back on cliff. it was a dangerous maneuver for the crew. the helicopter blades were only 10 to 15 feet from the sheer rock wall. the woman was tired and cold, but otherwise uninjured. san francisco's muni is set to get a financial shot in the arm, in hopes of increasing the reliability, and cleanliness of its fleet. mayor ed lee announced a $48 million boost to muni's budget. to help fund muni improvements. >> the best thing we can do in terms of congestion management, and we are seeing more congestion in our seats is making muni more reliable making it a better option for more people for more trips in the city. making it easier and more inviting for people to get around. >> city leaders say more than half of the money will go forward buying about 200 new streetcars, and 120 new buses. plans are also for almost 150

new drivers, mechanics, and cleaners. a huge honor tonight for the golden state warriors star player, steph curry. he has been named as the nba's most valuable player. in fact, he's the first warrior to receive that honor since wilt chamberlain in 1960. that's when the warriors were still back in philadelphia. >> sports director mark ibanez is here. he got a little choked up when he was talking today. >> you really can't blame him. i think it was emotional for warriors fans too. the honors just keep on coming, proving to all, that great ambition, and passion can blend beautifully, with humility and gratitude. in the big picture, the championship, the ultimate goal, but as far as individual honors, this is the most coveted, and prestigious the league has to offer. voting was a landslide. james harden of the houston

at the meeting, closing fire stations and slower response times. voters failed to pass a tax to pay for fire services just last month. >> reporter: gasia, we're just outside of oakley city hall. there were a lot of upset residents inside, attending that meeting held by the east contra costa fire district. they came to find out which stations are closing, when and what services they'll be losing. the fire station is among two firehouses in the district that the fire chief proposes to close by next monday. the drought is adding to the fear and anxiety among residents, concerned about the station closure. >> very nervous that our safety is in jeopardy. >> as we go into the presentation -- >> reporter: there was an overflow crowd of a few hundred people at tonight's meeting. the fire chief is proposing that three stations remain open, down from five. each serving a 250 square mile area. the president of the

firefighter's union says either the discovery based fire station, or the one in downtown brentwood, that's already closed temporarily, will be the second firehouse to be shuttered. he says service calls that do not require lights and sirens, such as older investigations and minor calls will be cut. >> the number of calls that they have in this jurisdiction, you can't handle that with just three engine companies. >> reporter: residents recently voted down a $100 a year parcel tax assessment for five years. this owner expressed frustration with those who didn't support the parcel tax. >> the biggest fear is people are going to die. somebody is going to have an emergency, and there's going to be nobody to help them. and i'm just talking about every day emergencies. >> reporter: i just received word that the fire district board voted to close the downtown brentwood, and the

nicen firehouses, and that will be affective next monday. another small earthquake rattled the city of concord this evening. the aftershock hit at 6:52 this evening. the latest in a series of small quakes along the concord fault line over the past day and a half. the largest quake hit yesterday afternoon, and measured 3-point #. a lot of people in the east bay felt a sharp jolt. there have now been eight small quakes in the concord area. it is capable of the 6.5 quake or larger. this weekend, this upcoming weekend, it will carry none. caltrans is closing the bridge for road repairs. ken pritchett is at the san mateo end of the bridge to explain the work that's being done. >> reporter: you can see some of the equipment is already in place here behind me for what will not only be a major resurfacing of this bridge.

but it will be the first time that the roadway surface on this bridge has been replaced since it opened. the signs are everywhere. along the interstate, at onramps and overhead. this weekend, the san mateo bridge is shutting down. >> the bridge will close beginning at 10:00 p.m. friday evening, and reopen the following monday. >> reporter: there's plenty of warning. the signs have been up for weeks. of course, not everyone is happy with the inconvenience. >> i don't see why they can't close half of it, or make some other type of adjustments. >> reporter: caltrain says closing the entire bridge is safer and makes the work go faster. >> you get in, get it done, and get out. >> reporter: regular commuters know it can be a bumpy ride. >> sometimes it's very loud. i don't know the reason why. but sometimes it's very loud. >> reporter: the reason why may be because this is the original

surface of the bridge from 1967 when it opened. the 39 million-dollar repair and resurfacing project will give the roadway new life. >> using a polyester concrete, that will not only preserve the structural integrity, and preserve the life of the bridge it itself. >> reporter: it will take two full weekends to do it. this weekend, and memorial day weekend, which will take some commuters out of their way. >> probably longer. >> reporter: in addition to the resurfacing work, much of the old electrical system on the bridge will be replaced and energy efficient streetlights will be installed. caltran says that the weekend work will be completed on both monday morning before the busy monday morning commute begins. >> obviously the dumbarton bridge, a good alternative here. ken, thank you. the ktvu news app can help you navigate around that closure this weekend. it's available for both

android, and apple devices. a lot of fog and low clouds out there right now. the marine layer is really deep. fog on the he is chair, and low clouds. in the north area around bodega bay, it's actually clear. the inversion got so deep because of this low pressure to the north of us. the fog and the clouds has dissipated. temperatures were really cool. check out san francisco. the high was 55 degrees. it was windy as well. this is the system i'm talking about. this low pressure system. fog, and as that low gets closer, just lifts everything up. i suspect, there will be patchy fog and low clouds again tomorrow morning. a slightly warmer day, as we see more sunshine in the forecast. as we look at the forecast for tomorrow, we're looking at temperatures warmer than today. these are the current numbers, which makes sense. moisture everywhere. the winds have been blowing,

tonight, 2 investigates goes undercover at bay area ballparks, and popular beers are being sold with less alcohol than advertised. we've heard fans wonder if they're beer is watered down. we put several big names to the test. >> live at at&t park in san francisco with what we found out. >> reporter: giants fans leaving pretty happy with a victory here tonight. but in some cases, our tests showed you may not getting what you paid for. we turned to a lab to find out exactly what's coming out of taps at the ballpark. baseball and beer. for many fans, the two go

together better than peanuts and cracker jacks. yet in a sport where stats mean so much, some fans are suspicious that beer in bay area ballparks is coming up short. >> does this beer taste watered down to you? >> reporter: 2 investigates went undercover. >> can i have a small bud light and a stella please. >> reporter: in order to order a few cold ones, followed by a few more at at&t park in san francisco. following strict instructions from anresco labs in the city. we poured the beer into vials before rushing them back to the lab. ten beers in all. five from each ballpark. a few days later, the results. >> the first one was 3.7%. >> reporter: 3.7% alcohol by volume for a bud light at the coliseum. half a percent lower than the advertised avb of 4.2.

8 out of our 10 beers tested lower. coors light was .3% under. and .2% under at at&t park. fat tire and stella tested just .1% under. federal law requires alcohol to be within .3% of what's advertised. budweiser fell outside of the range. so did a san francisco favorite. anchorstein. anchor brewing declined to comment. we shared our scorecard with charlie cruz and his beer drinking buddies before an a's game. >> give us what we pay for, bottom line. >> reporter: they referred us to the individual beer manufacturers. millercoors told us avb test results can vary for several reasons, but also revealed that coors light at area ballparks is slightly different than what

you might get elsewhere. in a statement, millercoors said it makes 4.0, and 4.2% kegs available to distributers who sell those to concessionaires. in this case, the 4.0 kegs were sold to the concessionaires. the giants confirmed choosing the lower alcohol when offered is part of a strategy. blue moon and shock top came in absolutely above their advertised content. wait. $11.50 for a beer? now that's enough to make you sober up. just this afternoon, anheuser busch also confirmed it offers two types of its light beer keg to stadiums. in a statement the company said its beers are tested for and monitored for quality. it also said many variables, of course could have affected our lab results. >> i still can't get over

for the first time today, the first time, the boston marathon bomber showed some emotion in court, but it didn't happen when one of the victims was testifying about their injuries, it happened when one of his russian relatives took the witness stand. she was too overcome to speak to the jury and was excused by the judge. four other family members though, did take the stand. three cousins and another aunt. this is the penalty phase of his trial. the jury has to decide whether he should be executed or spend life in prison without parole for his part in the deadly boston bombing marathon attack in 2013. new details emerged about a deadly shootout at an art show

in texas. it showcased lampoon cartoons depicting the prophet mohammed. one of the gunmen was described as an american convert to islam, who had been on the fbi radar for a decade. he tweeted messages sympathetic to isis prior to the attack. the second suspect is simpleson's roommate. the investigation turned to phoenix, where the pair lived. >> this is not going to be a real fast investigation. we've got our suspects. we continue to monitor social media, and gather other intel to make sure that we're not getting any threats. >> reporter: police say the two suspects wore body armor, and were armed with assault rifles. one security guard was wounded during the shootout. a coalition of health groups filed initiatives to raise california's state tobacco tax. the group includes the american heart association and the

american cancer society. they submitted two initiative summaries saying they'll pick one before the 2016 ballot. both would hike the tax on cigarettes. one version includes e- cigarettes in case the legislature decides that they are tobacco products. the coalition says the current california tax on a pack of cigarettes is 87-cents. they say that is one of the lowest tobacco taxes in the country. the dow is up 46 points. the nasdaq up 11. the s & p 500 added 6. mcdonald's is looking to turn around slumping sales. mcdonald's revenue fell 11% in the first quarter. the company plans to restructure into four segments based on locations worldwide. it also wants to sell off 3500 company run restaurants to local franchisees. mcdonald's has already begun

tonight, silicon valley is mourning the sudden death of an online pioneer, officials say david sandberg died of head trauma, after he collapsed in a fitness room at a private resort. azenith smith with how the tech world is remembering him. >> reporter: calling the death of david goldberg an accident. the 47-year-old on vacation with his wife, facebook's cheryl sandberg, when he reportedly collapsed at a mexican resort. survey monkey issuing a statement saying the company is heartbroken. >> he was very gracious, and you know, everyone that i know that knew him talked very highly about his entrepreneurship. the way he led people.

tomorrow at stanford memorial auditorium. in palo alto, azenith smith, ktvu, channel 2 news. i mentioned a little bit of clear sky out there. we've got clouds along the coast. high clouds in part of the north bay, and parts of the inland valley, we got a little clearing. you see lights there, as you look out at the city. temperatures today at 68. look how chilly it was in san francisco. that's the daytime high today. which, a week ago, would have been the overnight low. 70 in fairfield. 70 in antioch. these highs tomorrow even around the bay are going to cup up a couple degrees. we'll see more upper 60s, even low and mid-70s tomorrow. there's the fog trying to clear off. a lot of swell on the coast. there are storms in the southern hemisphere generating these south swells. new south facing beaches getting hammered with real big

surf. up here we've got waves that are pretty good size. 8 to 10-footers. but down by the ridge, 18-foot today. the south swells are dangerous, because they have those long intervals. even at our beaches, places like stinson beach, it will be flat for a long time, then all of a sudden, seems like out of nowhere comes this set of waves much larger than anything you've seen. fishermen tend to get caught with those sneaker sets on the south swell. this low pressure system wants to linger. that's what's unleashed the inversion as well. even allowed for clearing out there on the north bay. partly sunny, but certainly by tomorrow afternoon, or mostly sunny. tuesday through thursday, temperatures kind of remain flat. that means warmer tomorrow and warmer the next day. we're talking 75 degrees. 76degrees, 74, it's going to hover in the low to mid-70 range. san jose tomorrow, a little

for real? i just break down crying, and hugging. it was a great moment that i'll remember for the rest of my life. after things settled down at the curry household. i'm sure they had a little viewing party. checking out the clippers who were without their star chris paul. didn't matter. they're scary good right now in houston they've got blake griffin picking up the slack. triple-double. 13 assists, he scores there. a runaway with a 12-0 spurt in the 4th quarter for the clipper against houston. matt barnes plays a role. he hit a three with 20. that is very much agreeable to chris paul. they lead the series 1-0. back east, the bulls sneak up on the cavs. beat lebron and company. two surprises. the warriors will play the winner of the clippers/houston series. they're looking at that closely. >> game 2 against the grizzlies
