when you come to the game tonight. good morning. a protest over free speech just about to get underway this morning in the south bay. we're live in morgan hill at a school that's been the flash point of a controversy that escalated all the way to the supreme court. it started when a group of teens wore t-shirts showing the american flags on cinco de mayo. janine de la vega will tell us how the controversy has evolved and the message today's protesters are trying to send. good morning, welcome, once again, to "mornings on 2." it's tuesday, may 5th, cinco de mayo. i'm tori campbell. >> i'm dave -- dave clark. let's talk about weather and traffic. steve paulson has the forecast. >> a little chilly. some fog kind of dancing around. petaluma is getting thick here. there will be morning fog. there are some low clouds. not yearly as many as --

neeshly as many as -- nearly as many yesterday. there's a breeze. it's chilly. warmer in san francisco. today we'll go 63. napa a cool morning, 45. there might be cool readings north of town. plenty of activity over the sierra. the low clouds, more of a northerly breeze for some. that's kind of chewed it up and the air mass is so cool. 40s on the temps. mid-40s, a couple of upper 30s. one report in redwood city is 20, gusts to 28. 16 gusts to 25, concord, fairfield. this low will drop like an elevator and come right toward us on thursday and friday. that will give us a lot of shower activity, maybe some snow. it will be close here thursday/friday. fog, sun. cool to nice. breezy, windy. mainly 60s or low 70s.

sal, anything new to report? >> not a lot of new stuff but there's slow traffic. let's go to the bay bridge toll plaza. you can see traffic is moving along relatively well. if you are driving at the toll plaza, it's -- well, it's well for this time of the morning. there is a delay but nothing that you can't handle getting on the bridge. southbound -- southbound 880 slows in hayward. and you will see slow traffic on highway 4 as you come up to the willow pass grade. 680 is beginning to show wear and tear. if you are driving on 580 westbound, we have a lot of slow traffic coming into livermore and leaving dublin on 680 heading south. back to the desk. >> thank you, sal. on this cinco de mayo, some protesters are outside a morgan hill high school, waving american flags. it's the same school where some students wore american flag t- shirts five years ago setting

off a legal battle that went all the way to the u.s. supreme court. janine de la vega joins us live to explain the purpose of this morning's protest. good morning. >> reporter: good morning, tori. you can see behind me, there are a bunch of people standing in front of live oak high school holding these american flags. they are waving in the wind here. now, they are trying to prove a point. they want to let people to know that nobody cannot show the american flag. when students were wearing t- shirts with the american flag, they were told they had to turn the shirts inside out. the decision struck a nerve among some who say it violated free speech but the courts ruled it was justified how it handled the situation and this past march, the supreme court declined to hear another

appeal. the father of one of the students involved is taking part in the demonstration this morning. >> what they were educating on was we're going to bow to political correctness. we're not go -- we're not gonna stand up for what the nation is about. so somebody has to say hey, folks, students, united states citizens, here we are, we're all americans and we need to stand up for the nation. >> reporter: last year, the patriots held a peaceful protest. that's the same group out here. but a chain-link fence was eecketted around the -- erected around the school. he told me there's no racial tension at the school and students are welcomed to wear patriotic clothing, whether that's american flags or mexican flags. they say it's it doesn't

matter. it won't violate their dress code policy. the demonstrators will be out here from 7:00 to 8:00. school starts at 8:00 a.m. they do plan to leave and right now there is not expected to be any sort of trouble. tori? >> at least this has generated quite a conversation on this issue. thank you, janine. police in the south bay anticipate big crowds at cinco de mayo celebrations. thousands are expected in downtown san jose packing the streets and bars. some business owners say it's their busiest day of the year and they have stockedden up with thousands -- storked up with thousands of bottles of beer and hundreds of gallons of tequila. police will be out to keep things under control. >> we'll have plenty of officers to let people know it's okay to come over here and have a good time. but don't come over here to start trouble. >> no matter what day of the week it is, it will still be

busy. people will still come out and celebrate cinco de mayo. >> last year, san jose police made no arrests on cinco de mayo itself. but 44 people were arrested during the weekend leading up to cinco de mayo. law enforcement agencies will be very visible looking for drunk driving tonight. you may have seen signs flashing on the freeway saying, buzz driving is drunk driving. san francisco police spokesman says having more officers on the streets this cinco de mayo will help save lives. if you plan to go out tonight, he says have a plan on how you will get home safely. 7:07. the stepdaughter of a gilroy police officer is recovering now after accidentally shooting herself with the officer's gun. it happened yesterday afternoon at the family's home on el cerrito way. police say the 13-year-old girl shot herself in the leg with the officer's personal gun. not his service weapon. the gilroy police department is investigating. >> there are laws that govern

the storage of weapons, firearms specifically. the circumstances involved in this case, i'm really not sure at this point. >> police say the case will be sent to the santa clara county district attorney. the girl was treated for non- life-threatening leg injuries. the giants will submit a proposed ballot for a major redevelopment right across from at&t park. this project includes 1300 new homes, eight acres of parkland, new shops and restaurants. the giants have been working on this project for eight years. in an effort to make sure it's approved, the giants tweaked the plan. they lowered the heights of the proposed buildings to fall in line with the voter measure that puts limits on buildings. they are offering twice as much

welcome back. the suspected drunk driver accused of hitting and killing a mother and her 14-month-old daughter in livermore, he will go before a judge for the first time today. police say 35-year-old brian jones was driving drunk when he lost control of his car saturday night on muir et day boulevard and -- murrieta boulevard and crashed in the backyard of her home. a woman and her 14-month-old daughter were killed. two other young children were hurt. police say jones had been at the livermore wine country festival before the crash and his blood alcohol level was almost twice the legal limit. well, in texas, the islamic state terror group is claiming spops interfor that --

responsibility for that terrifying attack at a contest that encouraged artists to draw cartoons of the prophet muhammed. isis said two of the soldiers carried out the attack on sunday but didn't give any proof to support the claim. one of the men accused in the attack, elton simpson, has been on the fbi's radar since 2006. he was charged with lying to a federal agent but never sent to jail. police are still searching the phoenix apartment where the two men lived. the fbi is trying to figure out if they acted alone or in connection with an international terror group. testimony scheduled to continue today in the he -- in the sentencing face of the boston marathon trial. yesterday, dzhokhar tsarnaev showed emotion for the first time in the courtroom. he actually cried as his aunt sobbed on the witness stand. he also blew a kiss to his family members on the way out of the courtroom. five of his family members,

they testified on his behalf. dzhokhar tsarnaev was convicted last month for his role in the 20 -- 2013 attack. and now he faces the death penalty. san francisco's muni is set to get a $48 million boost. the new money is part of the proposed budget mayor ed lee will present to the board of supervisors. it comes from proposition b, approved by voters last november to help fund muni improvements. the money will pay for new buses and metro cars as well as bike and signal upgrades and street improvements. nearly 250 new employees will also be hired. california lawmakers are looking for ways to collect unpaid traffic fines. california has more been -- more than $1 billion in outstanding debt. most of the money is from traffic fines. critics blame a backward

coming up at 8:15, eric will join us live to tell us what he found. a san francisco police officer is being praised for reuniting a man with the stolen ashes of his late life. his car was stolen last week from the inner richmond district. inside the car were the ashes of his wife, amy thompson who died this year of cancer. he had driven to san francisco from new mexico. he was on his way to oregon to scatter his wife's ashes. a police officer heard what happened, told him that he would track down that car and he did. just a block away from where it was stolen. and the ashes of amy thompson, they were undisturbed inside the trunk. >> hardly been able to sleep, and i was just kind of getting past the shock of my wife passing and it's still a long process. i still have a long way to go. >> he says his suitcase, his

let's move to the san mateo bridge and this traffic is also getting busy on the way out to the peninsula. the dumbarton bridge has slow traffic especially from the high rise down to university avenue. if you are on the peninsula. if you take highway 92, there is a crash on lower 35. that's closest to 280. it's eastbound but it will probably affect both directions. chp is on the way to evaluate that. the traffic on the peninsula is moderate on san mateo and last but not least, 680 is slow from 232 through walnut creek and down into alamo. back to the desk. >> thank you. if oakland had more police officers out on the streets could it have helped control the may day violence and vandalism that occurred? the mayor thinks so. libby schaaf is pushing to beep up the police department. tonight, she will go before the city council to talk about it. tara moriarty joining us live.

you are at broadway's auto row and one business owner in particular out there was hit pretty hard. >> reporter: business owners here are very angry about fallout from the protestsle they are getting the -- protests and they are getting the mayor and the business know. one business owner said opd, you failed your city again. he said it echos sentiments of many business owners. 70 to 80 cars were targeted causing hundreds of thousands of dollars in damage. one man said his store -- said his storefront windows were shattered. mayor schaaf told ktvu on friday that city leaders would not toll late violence but -- would not tolerate violence. >> friday night was a night

where we had two jobs -- to protect people and protect people. we did a good job of protecting people but we did not do a good enough job of protecting property. >> reporter: so tonight, schaaf will go before the council and ask for 40 more officers. that would brings total number of officers to 762 over the next two years. the highest number the department has seen since 2010. this plan would cost about $6.7 million. live from oakland, i'm tara moriarty, back to you. >> thank you. oakland police cited or they arrested 13 people during friday night's demonstration. the charges range from failure to disperse, assaults on officers, public intoxication. firefighters in contra costa county are investigating the cause of a grass fire that burned near homes on westbound 80 near richmond. it started at 7:30, near fitzgerald drive and the richmond parkway offramp.

the fire burned about two acres, grass, brush. firefighters were able to keep it from spreading to nearby homes. no one was hurt. people in east contra costa county are learning the reality about how they will be affected by budget cuts after they failed to pass a parcel tax. an overflow crowd of a few hundred people packed a meeting last night. the east contra costa fire district laid out the plans to move forward. the district which used to have eight stations five years ago will soon have only three. the fire district voted to close the downtown brentwood and firehouses on monday. the president of the firefighters union says service calls that do not require lights and sirens, such as an odor investigation or minor medical call will likely be cut. >> biggest fears, people are gonna die. there will be an emergency. nobody will be able there to

help him -- know will be there to help them. >> they will be staffed with three firefighters each. the president of the firefighters union says that leaves just nine firefighters serving an area that covers 100,000 people every day. >> although east contra costa property owners avoided paying the new parcel tax, now we're learning they could be hit with increased fire insurance rates instead. >> in some cases, it could be to the point where we, the company itself, can't insure you. and it would have to go to a standard premium. >> the company that tells insurers how to rate risks is saying the holes will be rerated an charged -- and charged. 7:37. at&t trying to restore service to customers in terra linda after a car crashed into an at&t vault.

it happened early sunday morning on freitas parkway. police say a suspected drunk driver hit two at&t vaults and a street sign. according to the marin independent journal, at&t restored service to a small small number of customers sunday night but it's still not clear when service will be restored to all customers. today in sacramento, the state water resources control board, they will consider a proposal to require a ta% -- a 25% cut in water use statewide. the waterboard is responding to jerry brown's executive order last month calling for mandatory water use reductions because of the drought. the 25% reduction in water use would only apply to urban areas. the drought is also having an impact on oakland's kitten population. the oakland animal shelter has seen a 38% increase in the number of kittens there. workers say the drought and warmer winter weather led to

>> thank you, sal. a grawp of demonstrators has -- group of demonstrators have been waving flags. five years ago, they wore t- shirts with the flag on it and were told to turn the t-shirts inside out. janine de la vega has more. this group, they they are upset over -- they are upset over a recent supreme court ruling? >> reporter: yes. they are just wrapping up this rally. they are rolling up their american flags. they were lining the street. they wanted to send a message to everyone that the american flag should be displayed 365 days a year. that's what happened here back in live oak high school in 2010. they are saying what happened here is a violation of free speech. as you can see, their demonstration is wrapping up right now and they are walking away.

let's go to some video now of this demonstration of this rally. this group known as the gilroy morgan hill patriots, they showed up at 7:00 and lined main street proudly holding american flags. this was five years ago that several students decided to wear shirts with american flags on cinco de mayo. school staff told the boys they needed to turn their shirts inside hout because it could -- inside out because it could spark an incident. they said they were experiencing gang-related violence between white and latino students. in march, the supreme court declined to hear the appeal. >> we feel the court decision was wrong. we're offended that the court found our american flag offensive and made a ruling basically that said it's okay to bully others. >> reporter: school traffic was rerouted this morning for safety reasons. the principal said he expects

it to be a normal day of school. kids who attend the school were not even here when the incident happened. the principal said there's no racial tension and won an award for having a great campus climate that was tolerant and accepting. school is just about to start. we didn't get a chance to talk to any of the students. but what we've been told, the students want to get past this, apparently it is finals week and are gonna go in and have a normal week of school. there will be a cinco de mayo celebration we're told put on by the club at the school. >> they got finals. they have to focus on those. that's pretty important. some business owners in san jose say cinco de mayo is their busiest day of the year. thousands are expected in san jose tonight, packing the streets and bars. restaurants and bars have stocked up with thousands of bottles of beer and hundreds of

gallons of tequila. police will be out in force to keep things under control and prevent violence that's occurred in years past. >> we'll have plenty of officers to let people know it's okay to come over here and have a good time. but at the same time, don't come over here to start trouble. >> no matter what day of the week it is, whether it's a monday or a saturday, it will still be busy. people will come out and celebrate cinco de mayo. >> last year, san jose police made no arrests on cinco de mayo itself but 44 people were arrested during the weekend leading up to cinco de mayo. there were no major problems this past weekend. law enforcement agencies throughout the bay area will spread out and be very visible looking for drunk drivers tonight. you may have seen signs flashing on the freeway saying buzz driving is drunk driving. a police spokesman said having more officers on the streets this cinco de mayo will help save lives. if you plan to go out tonight, have a plan on how you will get home.

a car has been found at the bottom of a cliff on yerba buena island. this is near the yerba buena lighthouse. our newschopper2 is showing it there. you can see the white car at the bottom of those rocks there right near the yerba buena lighthouse. initial reports say that when the rescuers got there, they did not find anyone inside the car. we did see boats from the coast guard come up. we saw firefighters and they are up on land there. initial reports are that they have not found anyone in the car and we're not sure how that car ended up on the rocks but it is pretty badly damaged and we'll let you know more about this when we find out. back to the desk. >> thank you, sal. baseball and beer. it's a match made in sports fan

protests. tara moriarty joining us live. you are in oakland with more on why police officers are demanding protection. >> reporter: one business owner was so frustrated by the lack of police response, he created this sign, "opd, you failed your city again." may day protesters targeted 70 to 80 cars at the hyundai dealership. the auto repair shop owner says his storefront windows were shatter and insurance will not cover the damages -- all of the damages. >> you go up and down the block. you see much more damage. i think nothing was done to prevent it. if it doesn't get better, many businesses will leave the city. >> reporter: mayor schaaf told ktvu on friday, that city leaders would not tolerate violence. but some of the worst damage was caused that the city has

boulevard and crashed into the backyard of a home killing a woman and her 14-month-old daughter. two other young children were hurt. police say jones had been at the livermore wine country festival before that crash. police say his blood alcohol level was almost twice the legal imlit -- limit. people in east contra costa county are learning how they will be affected by budget cuts in the fire district after a parcel was not passed. an overcrowded meeting last night. they laid out plans to move forward. the fire district which used to have eight fire stations five years ago will soon have only three. the fire district voted to close the downtown brentwood and the niteson fire houses on monday. service calls that don't require lights an sirens like an odor investigation or a

a private memorial will be held for a leader in silicon valley. pam cook has more. >> david goldberg's life will be celebrated today at stanford memorial auditorium. no ties are allowed because he hated wearing them. the invitation says no pictures or posts to social media. david goldberg was just 47 years old, the ceo of survey monkey, married to facebook's coo sheryl sandberg and died friday night after he collapsed on a treadmill and hit his head in a fitness room at a private resort in mexico. he and his wife were on vacation with his family and friends. his brother found him on the gym floor. friends and family say he was a genuine leader who represented the heart and soul of silicon

investigators in philadelphia want to know how a little boy in diapers ended up on the roof of a three-story house. his neighbor jacob durant looked up. look at that little boy up there. saw him there, called the police. durant said he begged the little boy to stay still, don't move. the police, firefighters got there. put up the ladder quickly and a police officer ran inside. now, durant, he kept talking to that 2-year-old. >> i was hoping for his safety. baby reached out for the ladder. we were yelling, don't move.
