to last at least 9 months. >> this is the first time it's ever been like this. >> california's drought has reached mark's front doors. his front yard now california brown use to be lush green. now the new rule that have passed the control board will mean that all californians will have to watch their water use and the 25% water reduction statewide means california has to save as much water as there is in lake oroville in the next 9 months. it's no easy task, they saved less than 4% in march compared to last march. puc customers had 8% water conservation. san jose, 12% but the clear leaders are pleasanton, and

dublin san ramon. >> i think you know, the community heard the message and they did the right thing. >> the water manager points to two reasons iffer their success. they imposed mandatory water cuts last year of 25 percent and customers responded. >> i put the bucket underneath the shower head and by the time the water gets warm, this is pretty full. then i take it outside and we water outside. >> the second reason it's visible in the lush green lawns. just last year, the water district spent millions of dollars installing purple pipes of recycled water. that helped to boost their conservation numbers. >> it's between 25 to 30% of the water is recycled water which is permanent conservation. >> all of the cuts are expected to take effect on june 1st and customers could face $500 fines

choppers will get water if ponds and rivers are low. people protesting at the city council. a group calling themselves black seed moved to the front of the council chambers, chained themselves together and put up their banners. one read the people's city council. their protest to sell plots of lands to a private developer. long time oakland residents are being forced out and the land would be used for luxury condos. >> we came here tonight to say not behind closed doors, and they're not going to say that the community supports it because the community absolutely doesn't and we made that visibly clear. >> the protesters plan to stay until 11:00 so the city council members decided to call it a night and there is no plan to

arrest anyone. distracted driving may be the cause of a bike accident. it happened at 4:30 on canyon road. a driver was speeding when she plowed into the cyclist sending him into the air. he was air lifted to john medical center. his condition is unknown. the road was closed for hours while officials investigated the accident scene. an incident saturday night that lead to police use of force. an arrest was captured by a cell phone camera and posted on facebook. [ speaking foreign language ] . >> when the video starts, a couple of officers have a man on the ground. another officer arrives to subdue him. they used physical force because the man kept resisting arrest. you may be able to see the suspect being hit. before this was shot, police

said they tried to stop 22-year-old juan lopez but he ran and attacked the officers with a bottle and fought with them. the 22-year-old suspect was taken to the hospital. after he was released he was booked with suspicion and assault with a deadly weapon, and possession of meth. they're looking into the conduct of the officers. >> we're going to conduct a thorough very detailed investigation. we don't want to rush to conclusions. it's ugly to see violence on tape. >> i encourage people not to rush to judgment on this, and let's see what happens and put all the pieces together. >> police are also asking if anyone else has any information or other video involving saturday's incident to please give them a call. a woman made headlines in the past for her attempts to sneak on the airplanes is in

troubling again. maryland was arrested 10 days ago on the suspicion of misdemeaneder trespassing -- misdemeanor trespassing. in all hartman has been arrested nearly a does times for trying to board a plane. now the memphis grizzly are playing at oracle arena. it's not looking good for the warriors. they have been trailing all night long. we're going to check in with mark in a moment. first we want to go to ktvu amber lee before the game, there was a ceremony honoring the new mvp of the nba. amber. >> first let me show you what's going on out here.

who bought tickets pay-per-view. san francisco police police found a car that has been stolen. it was around 8:00 this morning. it was on the rocks and it was badly damaged. firefighters and police responded. police later said that they termed that the owner lives in berkeley and the car was stolen out of oakland. . clear skies out there right now, a beautiful shot of downtown oakland. you can't really tell but there's no fog or clouds out there. it's a beautiful night. temperature are in the 50s these are the highs that we achieved today. highs tomorrow will look a lot like these.

it's very similar we're going to see maybe a few upper 70s tomorrow. tomorrow is a lot like today and things change around a little bit. this low pressure, you see it spinning around in here, as it moves through it's going to generate an opportunity for a few sprinkles as we head into thursday into friday. here's a close up look, that's false returns there's no fog on the coast there's a few high clouds the winds have been blowing pretty much all day. it's windy. winds have been southwest of sfo, blowing over 30 miles per hour. livermore has calmed down to 3 miles per hour. upper 40s and low #r50rs. a bit of cloud and fog in the morning, not as much as we have this morning. then it burns off quickly and the daytime highs begin to warm. you're going to see the yellows which are your 70s. now not a lot of fog or cloud cover and here comes the

push. curry was off all night and he gets this incredible shot. they were within 7 in the final moments. 3:15 left in the game. now the warriors and the fans start heading to the exits after that. 2:11 left, conley with 21 points tonight, and the grizzlies have shockingly evened this series up. they go back to memphis for game 3 and they have to wait until saturday night to tone for it. as i mentioned turnovers a major problem for the warriors. what a difference for memphis having their star point guard back. the guy is playing with 5 or 6 facial fractures and a plate in his upper cheek. >> that's incredible. >> yeah, so warriors have a lot of work to do.

checked the expiration date. it's a problem that consumer advocates have been trying to enforce for years, that problem doesn't seem to be going away. >> here we go. >> it shouldn't be this easy. >> this one expired. >> this one too. >> we went to 7 bay area cities in three counties and took a hidden camera. >> this says used by september 2014. >> we checked the infant formulas. three stores checked out just fine. on the shelves with 7 others, we found expired infant formulas. >> i'm not buying it. >> sorry about that. >> state senator richard said that expired formula could pose a risk to babies that depend on it. >> if it breaks down, or rocks it it could make a baby sick. >> this is not a new problem it's been a problem for years so much in fact that in 2009,

jerry brown actually sued cvs over it. in 2011, a law dealing with expired baby formula was passed. >> as a result of that lawsuit cvs paid an 880 thousand dollars settlement and promised to strengthen their policy. >> then senator pan allowed county health agencies for finding stores, that fine up to 10 dollars a day. >> have you heard of a store facing a penalty? >> i personally have not gotten that information. >> we did and here's what we found. the state told us that since 2011 there's been no complaints registered about expired baby formula. san francisco alameda contra costa never levied any fines either and they had few

complaints. why was expired formula so easy for us to find? >> do you think the law is doing what they're supposed to do? >> the law created a mechanism that if there is expired formula, you can go to the health department and they should be doing regular inspections. >> for stores like the one we went to, regular means once a year. >> if there's a specific issue we may go out to visit those another time. >> why not go out more? >> staff. >> alameda says that staffing issues plague every county. >> everyone has that. some counties are down 25%. we're much better off than many. >> what's the point of a mechanism if no one is using it? >> we do have the mechanism and i would urge the health departments to use that mechanism. >> health departments say during an inspection, they aren't just looking at baby formula. >> that's one of many things. if you walk into a store and you

the city council voted in favor of increasing their minimum wage. pay will increase to $12.235. the minimum wage will be $14 for those who live in learninger companies. san jose has a new city manager the city county promoted him to the position after the regular nation of ed. he held a variety of other city jobs in san jose for the last 30 years. a parking lot would be transformed to a mixed use development under a ballot measure. the mission rock proposal calls
