concord, 680 still looks good from the benicia bridge to walnut creek. 6:01, let's go back to the desk. we begin with a loud demonstration that forced last nights oakland city council meeting to end much earlier than planned. tara moriarty at oakland city hall this morning with more on the project near lake merit at the center of the protest. >> reporter: we want to mention that the angry protestors took over the meeting last night. they were chanting, they had banners that they strewn across the entire room. they took over the council chambers and while many say the tactics are heavy handed, they were certainly effective. the group which calls itself black seed says its disturbed by the city's plan to sell a pot of land near lake merit. they claim that long-time oakland residents are being forced out of the city because of lack of affordability.

they say the land at 12th street and second avenue would be used for a 24 story tower. >> i think we've gone through other channels and tried to have our voices heard and other channels haven't worked out for us. and so this is the channel we saw available to us. it is illegal however it is very nonviolent. >> independent of how anybody feels about the style or tactics, the issues of affordable housing and the issue of police accountability are very important that we remain committed to taking real action. >> reporter: the protestors had planned to stay until 11:00 last night but they left around 9:00. they were satisfied their message had gotten across. you may remember back in 2012 protests shut down several council meetings after police shot and killed 18-year-old allen blueford. councilman larry reid said the policies would be changed. some new ones put into place to prevent shut downs in the

future but reid wasn't there last night and we know this wouldn't be the last time that protestors might take over a council meeting. live from oakland i'm tara moriarty. back to you. >> thank you, tara. 6:03 is the time. san francisco supervisor pushing for a moratorium on high end developments in the mission district. supervisor david campos says mom and pop businesses are being replaced by high end condos. studies show that affordable housing consisted of 12% of the construction project within the past ten years. campos wants a moratorium on any new development unless it's affordable housing. a 15-year-old bicyclist hit by a car in danville has died. it happened yesterday afternoon. witnesses say a young female driver was speeding when she hit the cyclist, knocked him 50

feet into the air and into the center divider. he was air lifted to john muir medical center and that is he later died. some new video has surfaced in san jose raising big questions about the police use of force. the video shows san jose police officers subduing a suspect over the weekend. ktvu fox 2 janine de la vega is live in our newsroom now with the video which was posted online and why this does not tell the whole story. >> reporter: a police spokesman told us it is ugly to see violence. but this is only a snapshot. the spokesman says he wasn't there but according to the report the man in the video was acting suspicious and he was in a high crime area known for drugs so that is why he was stopped. when the video starts, you can see the man is already on the

ground and officers are kneeling over him. more officers come and a baton is used and it appears an officer is punching the the side of the man's body. prior to what is seen on video, police say they saw the man toss something into bushes and when they approached him he ran and came at them in a combative manner. they claim he attacked one of the officers with a bottle and started to fight with them. >> is it disturbing? yes, it is but it is our job to try to get all the facts with what happened before, what happened during the video, and what happened after. there there is a lot of questions we need to ask. >> reporter: the man was identified as juan lopez. even after he was handcuffed and put on the gurney he continued to about violence. he was taken to the hospital when he was released he was

welcome back. time is 6:23. a woman who has made a lot of moves for trying to sneak on to planes at bay area airports she has done it again. this time in chicago. about ten days ago maryland heartman was arrested and charged with misdemeanor trespassing. she was in a restricted area with no ticket. she appeared in court after being arrested but where she is now that is not known. heartman has been arrested almost a dozen times trying to get on a plane without a ticket. last august she somehow snuck on to a plane and was then arrested when the plane landed at lax. a couple weeks after that she was arrested in phoenix for

trying to get past security and loitering in a baggage claim area. recently she was detained at a florida airport after getting on a plane in minnesota and flying to florida without a ticket. in berkeley four teenage girls were arrested this week following a bold daytime robbery. but it was not police who got to the suspects first. instead it was a group of quick thinking neighbors. police say that on sunday afternoon several witnesses saw four teenage girls beating and robbing a cal student at the corner of claremont and brook side. a neighbor who identified himself as jack saw the whole thing. >> they were punching her in the head and jumped into this white van thinking they would escape on the street. which i knew they couldn't. >> the street they were heading down was a dead end. a mom driving by in her mini van also saw the robbery. she pulled over to help. that is when jack told her to use the van to block the only way out. several other neighbors called

911. a quick thinking florida woman and her three kids they are safe this morning thanks to an online pizza order. cheryl says her boyfriend who had a knife held her and the kids hostage on monday. when the boyfriend let her use her phone to order dinner. she typed 911 hostage. help. and please help get 911 to me. >> we knew something wasn't right. i've never seen nothing like that. so i called my boss and he said call 911 immediately. we called 911 and that basically how it happened. >> the police rushed to her home. they convinced the boyfriend to surrender peacefully. it's 6:26. we're learning new details about the deadly german wings plane crash in the alps.

condos says the sale will put millions into oakland's general fund and also says it will bring local jobs, it will generate property tax revenue and it will put urban corp on the hook to make land improvements. live from oakland i'm tara moriarty. back to you. >> thank you. we'll talk to you later. investigators say the co- pilot of that german wings jet that crashed into the french alps have practiced the decent just two hours before. andreas lubitz used the auto pilot control to bring the jet down to 100 feet. the pilot had left the cockpit. that plane was already descending so apparently no one noticed a bad move. it was on the return flight when investigators say lubitz locked the pilot out of the cockpit and deliberately crashed that plane. everyone was killed on board that crash on march 24th. california warter #re

sources has approved the largest mandatory cut backs in state history. alex savidge has more on what this means for the highest bay area users of water. >> yeah, pam. it turns out some of the biggest water users in the state are here in the town of atherton and neighboring community of woodside. this is where we are on the peninsula this morning. the sprinklers just turned on here as a matter of fact. people living here will be facing some of the most severe water cuts. the private utility that serves these communities is planning to require customers to reduce water use by 36% under new state regulations or bills potentially could double. harsh penalties now looming for many across california after an a historic vote that took place last night. the state water resource control board gave final approval to new conservation regulations.

these are the mandatory cut backs first outlined by the governor last month. outdoor watering will be severely limited and the state is calling on californians to keep indoor water use to no more than 55 gallons per person per day. there are certain communities in the bay area that have already stepped up amid the drought. customers in the district cut back water use by 29% following mandatory restrictions they put in place last year. and it was the little things that made a difference. >> i put the bucket underneath the shower head and wait until it fills up and water gets by the time the water gets warm, this is pretty full. and i just take it outside and water outside the plants and the grass. >> reporter: new numbers out from the state show californians over all are not doing a good job conserving water. we save less than 4% this past mor compared with march of last

year. the state mandated cuts are expected to take effect on june 1st and the new rules should remain in place for at least nine months. customers individual customers could face fines up to $500 a day for violations and water agencies as a whole could be fined up to $10,000 a day and again here in the town of atherton and the neighboring community of woodside, some of the biggest water users in the state of california will have to cut back in a real serious way. >> yeah it's kind of interesting when you see really green grass in your neighborhood or around the area. >> might not see it for long. 6:37 is the time. the state is turning to ocean water to help during future droughts. the water board will hold a public hearing in sacramento to consider an amendment that establishes a desalination operations policy. it will address the effects with construction and operation

of sea water. the amendment supports the use of ocean water to supplement the water supply while protecting marine life and water quality. was it just a few rogue bank employees? or is wells fargo bank putting profits over the legal rights of its customers? it's a new lawsuit acausing the bank of opening unauthorized accounts for customers. brian flores is joining us live now from walnut creek to tell us about claims that this is allegedly damaged the credit of some bank customers. >> that's what they alleged. on the lawsuit filed by a los angeles city attorney claims there was a high pressure sales culture that set up unrealistic sales quotas. many felt they were forced to meet those quotas or lose their jobs. there are serious allegations claiming that employees opened up ghost accounts or accounts without the customer knowing they were open.

it alleges customers were dinged with monthly fees on those accounts. several former employees tell the l.a. times they begged friends and family to open up accounts for fear of being disciplined by managers. the former employees say they forced paper work so they couldn't be reached for satisfaction surveys. a press conference in l.a. yesterday some say their credit rating was ruined. >> imagine i see my parents in wells fargo whenever i go there. they are getting accounts opened for them. and i just feel like they have accounts anybody here anybody's parents could have accounts floating out there. if i never check my online banking, i wouldn't have known that these accounts were there. >> now the suit also claims accounts were not closed even after the customers complained because the bank pressured employees into meeting high sales quotas. wells fargo blames the problem on a few rogue employees.

prosecutors say 28-year-old donald higgins was the gunman but they are unsure of the motive for the shooting. now higgins was already in custody for shooting at a car full of people in hayward in the hours after the oakland shooting. he's accused of shooting at police during his arrest the next day. higgins is due in court on the murder charge next week. very emotional day in court for the family and friends. brian jones is accused of smashing his corvette into the backyard of an apartment complex.

the second whale to end up at sharp park beach just south of the pacifica pier in the last three weeks. this latest one is a juvenile hump back whale just yards away from the other one. it's attracting big crowds. >> you want to see them when they are alive. when they are beached. >> it's a great opportunity. we want to take advantage of the fact that this animal is on shore. >> the test on the sperm whale that beached here to weeks ago indicate that it died of natural causes. maybe old age.

but what killed the newest whale that is still a mystery. two fans who pay to watch the boxing match between floyd mayweather and manny pacquiao have filed a class action lawsuit against pacquiao. the lawsuit claims the boxer defrauded everyone who watched the fight by hiding a shoulder injury that he suffered before his loss. the suit is on behalf of anyone who bought tickets, paper view or bet on the fight. meantime boxing regulators in nevada are also looking into possible disciplinary action against pacquiao for not disclosing that injury. the giants are going for a sweep of the san diego padres this afternoon. fans celebrated as the giants beat the padres for their fifth straight win. brandon crawford was 3-3 to give the giants a 3-0 lead. they would add two more runs on an error and ryan vogel song pitched seven singhs to get the
