welcome back to "mornings on 2." 2 investigates went shopping for baby formula. we went inside ten different stores in three different counties, checking on four retail chains. there's claudine. in seven of the stores we found expired baby formula on store shelves. >> reporter: this one expired isn't of 2014 -- september of 2014. does that happen a lot? >> not usually. >> reporter: even though there

was a lot in twine 2009 -- in 2009 over this same issue. dr. richard pann sponsored a law regarding this. >> we do expect our health departments to follow through and again i think the purpose of the bill was to establish a mechanism through which the stores would actually face a penalty for doing this. >> reporter: have you heard of any stores facing a penalty, though? >> i personally have not gotten that information. >> that's interesting. now, ktvu's claudine wong obviously here. you did get the information. you are hear to tell us what you found. >> here's the thing -- we know it's a problem because it was pretty easy to find all of this formula. we just walked into stores randomly. it wasn't that difficult. but the california department of public health from 2011 hasn't lodged any complaints.
7:16 am
they've never levied any fines. we talked to county agencies saying, are you hearing about this? are people calling you? they said no. obviously it's a problem, because all we had to do was walk in the store and find it. the question for us, why isn't this law working. >> were you surprised how easy it was to find it? >> yes. i thought i'm sure a few stores have it on the shelves. but people were saying after seeing this, there it is. it was very easy to find which leads to the bigger question can anything be done about this. >> and fines, there is a law that said there could be fines. anybody dropping the ball? >> well, that's a more complicated question. the fine if you really break it down, it's $10 a day. it's not a huge fine.
7:17 am
we talked to the health departments and say we're trying to work with these, you know, stores to make sure it's not something they are doing on purpose. they do hand out these sheets explaining the law to everyone. they have check lists that go through everything. they don't track it. so for the health inspectors, we're finding a lot of this on the store shelves. we don't really know they don't take it. here is the other reality. talk to the county department of public. 16 inspectors. 6500 food facilities that they are supposed to look at. they are saying they are grossly understaffed. we saw the same thing at other county health departments. alameda county are trying to hire people. they do inspect formula but they are also doing refrigeration, they are doing restaurants, mole food trucks -- mobile food trucks. so where this lands on the scale of what they are looking at, it's on the list. but it's a long list. >> you and i are both parents.
