say the 34-year-old waiter isn't disabled. >> reporter: he wasn't talking to us but now he will have to answer to two felony perjury charges. >> very unusual. >> reporter: he says he raised red flags when he appealed parking citations for misuse of a handicap placard last year and they discovered he forged his application. >> he had a forged doctor's signature. he is not a patient. >> reporter: 2 investigates exposed abuse of handicap placard last year but he went a step further, applying to the city to install this disabled parking space outside his apartment. investigators say he also submitted a false application to get this license plate. >> he doesn't work in the media field. at all. never. >> when the dmv caught up with

him saturday he wasn't parked in his spot, he was walking his dog when they arrested him. >> reporter: [ inaudible question ] >> i can't say -- i am not supposed to discuss the medical thing, even if it is fake. >> reporter: his arrest is the latest in the special operation blue zone. >> like park free card. >> reporter: with parking so limited in the bay area investigators say access to a blue parking zone could be like gold. he is out on $30,000 bail. if convicted he could face thousands of dollars in fines and jail time. it is one of 58 cases the dmv opened since last year. >> for those cases how do you fake your way? >> reporter: a question we had. and they say that because of

medical privacy laws it prevents the dmv from asking too many questions. as long as a doctor signs off most of the time it gets approved. >> you can tell your doctor anything if you are in cahoots. >> thank you. we have an update on another 2 investigates story. the hotel in oakland is being red tagged and residents were ordered to evacuate immediately. three residents reported feeling sick from the water. east bay mud did tests and the results were positive for bacteria that indicates contamination from fecal matter that could be the cause of the illnesses. the city is trying to find places for the residents to stay and we have been told that could be within 24 hours. ktvu's jana katsuyama is following the story and will have more tonight at 10:00 p.m. and if you have a tip for 2 investigates we would like to hear from you. e-mail 2investigates@ktvu.com

or call us at 2investigates@ktvu.com or call us at (510)874-0222. now to developing news in the search for a bay area father and his two children missing for two days after a camping trip. the family planned to take a remote route home from the trip. investigators say the weather is making things difficult for searchers. crews are looking for the family off highway 49. the family was planning to drive through sierra county on their way back home to oakland. ktvu fox 2 news paul chambers is live where the man works where friends are hopeful they will be found safe. >> reporter: that's correct. nicholas vlahos is a well known barber here. and owns the barbershop behind me. i talked to his co-workers, he travels on trips and they are shocked to hear he is missing but are also hopeful. >> friends and business

partners say not only is he a great barber but he knows how to take care of his family. >> truck was super equipped. wench. all this self-rescue equipment in the truck. >> reporter: these are the last pictures posted on nicholas vlahos' instagram four days ago. you can see him with his son and daughter. sheriff's office says they were camping with family members. they were last seen in the camp site in their truck. sheriff's deputies were told the family tried to take a drive through remote areas. >> she an -- he is an incredible driver. we spent 4 days in the desert driving across pretty rough terrain. >> that is why friends believe they are okay and will be found

lightning started several fires. a tree and a few houses were struck. we saw fresh powder in the sierra. mountain resort saw 7-inches and chain requirements are in effect. and we are hearing reports of a possible funnel cloud in the north bay. our chief meteorologist bill martin, you have been hearing about this too? >> yeah. this morning. couple pictures came in. hard to determine. looks like a funnel cloud. you don't have damage on the ground. hard to do a survey. right now, it could have been a funnel cloud. unusual time of day for a funnel cloud. but we will find out more and let you know. the numbers that we had today. they were light. they happen there. mountain view .04. south bay area. gilroy, los gatos, san jose, fremont, more showers than most of us. watsonville .13. the shower activity that started in the mountains is now

working its way east to west which is an atypical direction. these systems are wrap around moisture coming in this way. it will work its way this way. expect showers. i have a few sprinkles showing up now and thundershowers or thunderstorms reported east of gilroy. in the mountain hamilton area. this activity dying down now. how does it play into the next 24 hours and the weekend? i will have that after the break. extra layers will be needed in the first stage of the women's tour of california. 84 women will circle lake tahoe tomorrow morning in the first women's race. there was more snow than sun out there today.

from the warmer top of the reservoir and from the sacramento river. it will taste and smell different. >> we wanted to preserve as much cold water as possible so that we could release it later in the year. >> reporter: regulations require the cold water be released later when salmon are spawning. east bay mud has no choice but to comply. this situation could go on for years till the drought breaks. >> definitely months to come and into next year if things don't improve. it is getting worse every year. >> from whatever source and stage the water is in the treatment, samples are taken and by the time it gates the end point -- gets to the end point it is perfectly safe. >> the water is absolutely stife drink. we continue a meet all standards. >> reporter: east bay mud tried this last month and got

police will be evaluating a woman's ability to drive after she drove through a window this morning at a business. crystal spring shopping center. the woman was trying to park but hit the gas instead of the break. no one was hurt but there was a woman sitting in the middle of the shop just moments before the car went through the window. one of the two los angeles men convicted of beating san francisco giants' fan bryan stow asked a judge for mercy today. louie sanchez on the right, the man with the glasses is marvin norwood, louie sanchez pleaded guilty to a weapons charge. his sentencing was postponed. louie sanchez wrote a letter to the judge and apologized to bryan stow and called the event an accident. he said he was angry because he thought his family was attack. the weapons charge is from the investigation of the bryan stow

case. the district attorney is expanding a task force that is investigating the scandal involving racist and homophobic text messages sent by police officers. >> extreme hate and biased towards african americans, members of the lgbt community and women. >> he announced today that three retired judges will go through 3,000 cases from the past decade to see if any bias by the officers effected the cases. the officers have been transferred to duties that don't involve contact with the public but recommendations have been sent for their termination. >> the scent passed a -- senate passed a bill that would prohibit the use of grand juries in police shootings and in which a person days to from excessive force during an arrest. grand juries in missouri and new york failed to indict white officer whose killed unarmed

black men. the bill aims to place the decision to prosecute officers with local district attorneys. the bill now goes to the assembly. law makers are speaking out today in support of an initiative that could reduce the number of mentally ill individuals behind bars. people with a mental illness are more likely to offend and get stuck in the system without treatment. they unvalled a plan that would put them into recovery problems. -- unveiled a plan that would put them into recovery problems. >> -- into recovery programs. >> getting the treatment they need to ensure they don't reoffend. >> the plan calls for reallocation of $14 million for local alternatives for those individuals. new at 6:00 p.m. a scare for a bay area woman on

a hike with her dog after something the dog ate brought them to the vet's office and they said the dog was stoned. ktvu's john sasaki with how this reflects a bigger problem. >> go get it. >> reporter: he is a playful dog. >> we go on hikes every monday and tuesday. >> reporter: this monday's hike didn't go as planned. >> walking like he was drunk. >> reporter: he got sick and once in the house things got worse. >> he goes to drink his water and his legs slid out from under him. i am like, that is not right. >> reporter: so she took him to the animal hospital. >> i am home and the vet calls me, we are not going to do testing, it is pot. i was like what, yeah, your dog is stoned. >> reporter: the park is a popular spot for dog owners.
