4:01, let's go back to the desk. >> a team of investigators from the national transportation safety board is on the scene of a deadly train derailment. the amtrak train was headed from d.c. to new york city last night when it jumped the tracks. here are the latest casualty totals. at least five people were killed and reportedly 65 others were injured and taken to local hospitals. as the reporter tells us, they had no warning. >> reporter: an amtrak train crashes killing five and injuring dozens more. >> this is a nightmare. >> the regional train was headed from new washington, d.c. to new york city last

night. the um pact mangling the front of the train and causing others to completely overturn. >> i heard a big bang. it was a big bang and it caught my attention. >> helicopters and everybody just started coming. and that's when i put two and two together and figured one of these trains fell off the railing. >> passengers say the front of the train was going into that curve when it began shaking. >> we were in the front seat and this huge red suitcase came flying at me. our train was actually on its side. so it pushed me on to the side of the train s. >> the train was carrying 238 passengers and five crew members. one of those on board was former u.s. congressman, patrick murphy. he described what happened right after the crash. >> i flew to the side and landed on my head and i was checking my body parts. there were people that were

getting off the train. >> philadelphia mayor says the destruction is unimaginable. >> it is an absolute disastrous mess. never seen anything like this in my life. most personnel will say that as well. is. >> the mayor says it is unlikely amtrak service will operate through the end of the week. in philadelphia, fox news. >> and a passenger took this cell phone video from inside the train and posted it ton instagram. and just a few moments ago, you heard from former congressman, patrick murphy, who was one of the passengers. he posted these photos. the person next to him passed out during the chaos. >> happening this morning, the california highway patrol is investigating a deadly crash near gilroy that killed four people. it happened just after 10:30 last night near the gilroy outlet stores. the chp said they were in one car in monterey county. investigators say the car went

over a cliff and landed in a creek bed. >> driving at a high rate of speed. wasn't able to negotiate the turn. don't know why at this time. he left the roadway overturned and the vehicle landed. it appears four people have died in the crash. >> the chp says the driver was wearing a seat belt and did survive. no other information is being released about anyone else in the car. the chp says it's too early to say if alcohol contributedded to that crash. >> time now is 4:05, the berkeley city council required an ordinance. their phones could expose them to radiation. the council approved the measure by a 9-0 vote. most people don't know their cell phones already come with a warning, but the warning isn't in plain sight. it takes five steps before someone can read the warning on iphones. the proposed warning is if

someone carries a phone, they may be exposed to radiofrequency levels that exceed federal guidelines. >> this is just saying, here's the information you should know and if you know, make your own decision. >> i don't think it's necessary at the moment, because we don't have any evidence of it and i have never heard of anything like that. maybe we had some scientific data, sure, but not right now. >> while the ordinance could go into effect in july, the cellular industry is expected to file a legal challenge. we are learning more details about the proposed plan for mandatory water rationing in caisson jose. the water allocations will only apply to single family homes, not apartment buildings and businesses. the allocations will require a 30% cut in water use from 2013 level. an example for the months of july, august, and september, each home will be allowed 9700

yesterday's 7.3 magnitude earthquake. it caused landslides that blocked roads and slowed the delivery of relief supplies. it also brought down buildings that were already weakened by the april 25 quake that killed 8,000 people. the state department says that u.s. aide workers already in the region will now help survey the damage from the latest quake and look for more victims. >> there are also members of the search and rescue team in affected areas in the city of kathmandu as well. >> aid agencies are appealing for more international funding saying yesterday's earthquake made relief efforts more urgent. a u.s. military helicopter is missing in nepal. it was on a relief mission to some of the remote villages. six marines from camp pend lton were on board. radio transmission report that

the helicopter had a fuel problem. search teams are hoping that it may have landed, but can't get a radio signal out because of the mountains. a 6.8 magnitude quake hit off the coast of northeast japan in the same area devastated by that major quake and tsunami in 2011. this is some of the video of the office of a television station. there have been no reports of damage to the fukushima nuclear plant and no injuries reported. president obama is hosting a dinner for the leaders of five arab countries tonight ahead of talks at camp david tomorrow. the president called the meeting of the gulf cooperation council to reassure about developments in iran. some arab countries expressed concern about u.s. efforts to curb iran's nuclear plan. saudi arabia's king canceled his attendance, sending two crowned princes instead. someone called the king's

abscess a snub. the king chose to remain at home to monitor a cease fire in yemen. we know the name of two people in sacramento. the chp says the two victims were from the bay area. 24-year-old, nicholas of hayward and 25-year-old, zahid whose family owns an auto body shop in ann bruno. >> he is nice to the neighbor. he comes to say hi, hello. i've seen him down the street at a restaurant. >> the wrong way driver also died in that fiery crash. there have been more than ten deaths involving wrong way drivers in northern california in the past three months. caltrans and state lawmakers are considering ways to reduce wrong way crashes, such as lights and a warning system when a car goes on the freeway against traffic. >> bay area drivers will be dealing with another road closure. san francisco's doyle drive will be shut down for more than three days starting thursday

base clearing double. that's the most in a game by a giants rookie since buster posey. fell struck out ten batter. the a's had a big offensive day against the boston red sox to snap their six-game losing streak. they had a 4-0 lead when he was 4 for 5 on the game. eric followed that up with a two-run single and the a's ended with a 9-2 win. they wrap up their series against boston this afternoon at the coliseum. >> finally. the a's pull off a win. >> coming up, armed intruders inside a bay area home. video shows the crime in progress. coming up in 20 minutes, what they did when they found a baby and woman hiding upstairs. >> wheels and tires stolen in oakland. what you can do that may slow down a thief.

welcome back. time is 4:23. closing arguments continue today in the penalty phase of the boston marathon bomber. prosecutors and lawyers for dzhokhar tsarnaev will have the final chance to make their case for life in prison or the death penalty. last month, the jury convicted tsarnaev on 30 counts. four people died and more than 260 others were seriously injured. we are also learning of a possible fifth victim related

to the boston marathon bombings. dennis simmons suffered a head injury during a shootout with the tsarnaev brothers in the days after the attacks. a year later, he collapsed in a gym and died. now simmons family is trying to prove that his death is linked to the injury he suffered during that shootout. they applied for line of duty death benefits. the request will be taken up next month. drugs may have been involved in the death of a 31- year-old woman at an old china town theater. the body was found sunday. this is a photo from her google account. police say they were called to the great star theater on jackson street on sunday. officers arrested 48-year-old, harris rosen bloom on suspicious of homicide, but now prosecutors are declining to press charges while they await the autopsy. thieves are targeting car owners in north oakland. four reports of having all four

wheels and tires stolen since the first of the month. a tire specialist says the more valuable the tires, the more attractive they are to thieves. >> the tires coming out on newer cars, it's not uncommon to pay a thousand dollars for a set of tires. flee markets are common for selling stolen tires and stuff. there's no questions asked. >> car experts say owners can put locks on the rims. they warn that's not a guarantee your wheels can't be stolen by someone who has the proper tools to remove the locks, but it would slow down a thief who may decide to move on to someone else's car. >> stage four of the amgen tour of california begins this morning. 23-year-old, tom scugen is the overall leader after winning the 105-mile race which went from san jose to liver more and back to san jose. this is the fifth year of the
