50s and 60s. that should be warmer than this. it's 7:02. sal, normal slow traffic or something new to talk about? we do have normal traffic. we have an incident i'm gonna tell you about on highway 4. franklin canyon. i want to check in with the bay bridge first. that's a 15, 20-minute delay. that's normal. what's not normal is east highway 4 at franklin canyon, a paint spill. traffic is at at dead stand-- is at a dead standstill. it's not affecting as many people as it would be if it were in the westbound direction. skyfox will have pictures coming up shortly. let's go to the san jose area. northbound 280, slow traffic getting out of downtown. 280, 101 and 85 are slow on the way into the west valley. back to the desk. >> all right. thank you, sal. four people are dead and one man is hospitalized after

one of the worse crashes chp officers can remember on a road near the gilroy outlet stores. janine de la vega is in gilroy. the people died in a crash even though most of them were wearing seat belts. janine. >> reporter: yes, that's true. the male driver, is the only person who survived this crash. he's at the hospital right now but he's expected to survive. chp is over there right now. they are hoping to get a statement from him to try to find out what caused him to leave the road. at this point, we don't know if he even thoughs. all of the passengers traveling with him are dead. someone who lives nearby the crash scene on leavesly heard the crash and -- and spotted a ford mustang down a ravine. crews found the passengers all trapped. they had to cut the roof off of

the vehicle. when they did, they discovered all were dead. they are trying to figure out if the driver was speeding or misjudged the turn. three of the four passengers who died were wearing seat belts. >> one was not wearing a seat belt. the rest were. the vehicle crashed from the roof. >> reporter: the chp says the driver is in serious condition. at this point, they don't know if alcohol was involved in the crash. the identities of the victim are unknown. but officers tell us they all appear to be under the age of 25. it's possible some were teenagers. we just don't know yet. this accident caused the chp to shut down leavesly road overnight. but it did reopen at 5:00 a.m. it's a popular route that commuters use to get to highway 101 and something else the chp told us is that particular stretch of road about a quarter mile from where we're standing on leavesly road, they respond to accidents there at least once a week. they are not sure why that's

happening. but this is the worst one they've seen. >> wow. once a week is pretty frequent. >> reporter: yes. >> thank you. 7:05. well, it's daylight in philadelphia. and that's giving a better picture of the tragedy of last night's deadly deadly amtrak train derailment. a little while ago, investigators arrived at the crash scene. look at this. at least six people were killed. 146 others were hurt and taken to hospitals. many of the injured have been released already but some are still being treated and a few are listed in critical condition. this train was going from washington, d.c. to new york when it detailed, jumping off the tracks. the impact ripped apart rail cars and passengers, they were thrown from their seat es. >> most of the injuries were fractures, rib fractures, leg and arm fractures. >> mowm were in critical condition -- how many were in critical condition?

>> eight. three went to the operating room immediately. >> passengers took this cell phone video and photos. a former congressman who was one of the passengers said the person sitting next to him passed out during the chaos. although there were fbi agents at the crash site, they say this this appears to have been an accident. coming up at 7:30, we'll talk live to a reporter live there this morning. far more pleasant news, our warriors hope to retake the lead tonight against the grizzlies by winning game 4. they would regain home-court advantage. tara moriarty is live inside oracle arena. you are certainly dressed and ready for tonight. >> reporter: i am. i understand you saw some clips earlier of me shoots some hoops. >> absolutely. absolutely. >> reporter: not -- [ applause ] >> reporter: not too great,

bridge. i realize that takes you out of the way but that's the openly thing i can think of -- but that's the only thing i can think of at this moment. >> all right. nice pictures from skyfox. thank you, sal. 7:13. this morning, san francisco police are investigating a violent brawl between some art vendors and skateboarders. it happened last friday in justin herman plaza. a woman shot video. she said people were using hammers and skateboards and one witness said it looked like a riot. four people were hurt. two were taken by ambulance. not clear how it started but there are reports that skate boarders were fighting. san francisco prosecutors say drugs may have been involved in the death at the 31- year-old bomb at the chinese theater. this is the photo -- woman at

the chinese theater. this is a photo of her. officered arrested 48-year-old harris rosenbloom on suspicion of homicide. but now prosecutors are declining to press charges while they await the autopsy. rosenbloom has been trying to renovate the old theater. a wild police clays in the east bay came to a dramatic end after a homeowner caught the suspect tried to hide in his garage. police say the chase started on highway 4 in antioch early yesterday morning. the suspect drove on a regional trail and his car got stuck. so he took off. police searched the area but couldn't find him. that's when a homeowner got an uneasy feeling and decided to look in his garage where he found the suspects hiding. he said the suspect attacked him with a tool from a workbench and ut put him in a chokes it hold -- and put him in a chokehold. the son helped him. and police arrested the man when they showed up.

thieves are, taking you -- are targeting you. there are reports of all four wheels stolen from vehicles. a fire specialist says the more valuable the tires are, the more attractive they are to thief. >> with the tires and wheels come out on new cars, it's not uncommon to pay $1,000 for tires. >> now, car experts say you can put locks on your rims. they say that's not a guarantee your wheels won't be stolen by somebody who has the know-how and the -- and the tools. they say that could slow them down and they could move onto somebody else's car. let's check in with sal. some cars are not moving at all eastbound. that's not the commute

direction. that can throw people off a great deal. >> that's right. this is eastbound 4 just outside of martinez near the franklin canyon golf course. there is a point and oil spill. you can see it down there. the traffic is backed up from highway 80 to the point where the chp is not gonna let anyone on eastbound highway 4. why would they? all of these cars are stuck. all of these cars and trucks are stuck until they clean it up. the only good news, is that the caltrans was able to contain the paint and the oil and into the let it go down drains -- and not let it go down drains. but the traffic impact is horrible on eastbound highway 4. look at all of that backed up traffic. these people are not going anywhere. it's not quite backed up to highway 80 but i think people might be surprised by seeing this backup. it's not getting through at all. it's a sig-alert. let's -- westbound is not affected. this is the westbound bay

bridge. 15, 20 minutes before you get on the span. 580 westbound, slow traffic into livermore. 680 is slowing getting into fremont. 7:17. let's go to steve. sal, i just stepped outside. it's cold out there. for may, it's cold. >> i see. >> yes, sir. >> we have a very cool pattern. it looks like this will continue to the 23rd, 4th. ten-day outlook maintains low pressure much of the west coast and california. southern california could get a lot of rain saturday into sunday. the low cloud are in place. mid-level clouds. higher clouds racing to the north. there might be more in the way of sun to the south. but there's the -- the water temps are so cold. the low cloud deck has no problem forming. these are the average high temps for may 13th. nobody will be close. napa, 67. should be closer to 74. san jose, 67. 76 is what you should be.

being analyzed by the experts. now we'll hear from amtrak board member and board chairman anthony kozier. >> let me start pie saying how -- by saying how deeply saddened we are for the loss of life that occurred on the train last evening. we -- our first and major priority will be the customers and employees who have been affected by this tragedy. we've established and 1-800- number which i know has -- an 800 number which i know has been established. a thorough investigation will take place from this incident led by the ntsb. amtrak will do everything to assist in the investigation and has brought every resource in the company's ability to support that effort. this is the amtrak family. we are very saddened by what's occurred and will do everything in our power to work with the may earoffice, the -- mayor's office, the ntsb and all

search crews hunting for malaysian flight 370 off the coast of western australian

have found an uncharted shipwreck. they detected a clust her of objects -- cluster of objects. they took this picture of the anchor. there's still no sign of debris from the malaysian airlines jet. it vanished last year with 239 people on board. 7:28. closing arguments are happening right now in the penalty phase of the boston marathon bomber trial. prosecutors and defense lawyers have one last chance to make their case for either life in prison or the death penalty for dzhokhar tsarnaev. last month, the jury convicted him on 30 counts. a police officer was also killed in a manhunt after the attacks. we're also learning of a possible fifth victim. dennis simmons here suffered a head injury from an explosion during the shootout with the

at times. below-normal terps across the -- temperatures across the board. it looks like we'll be talking about some rain. there is a paint spill, steve. these pictures were taken from skyfox. eastbound 4 highway at a standstill as they try to clean up the spill near the franklin canyon golf course. there's plenty of damage. a lot of paint cans and oil cans were discovered. they are trying to open the road within the next half-hour, is what i heard. i'm reading this as we're on the air. let me just pull back on that. it looks like they are just about to reopen. i'm reading this here. the left lane is now open and right lane will be open in 15 minutes. that's pretty good. this is a look at highway 4 live from skyfox westbound as you come up to the billow pass grade. we -- willow pass grade.

we had an accident. traffic is slow. when you get to the bay bridge toll plaza, it's backed up for 15, 20 minutes. no major problems. i want to take a look at highway one coming in -- at highway 101 coming into san francisco. it's slow. there's new information about the deadly amtrak train in philadelphia. investigators are interviewing the engineer and conductor. they are looking into the passenger accounts that the train may have been going too fast when this flew off the tracks. joel waldman has more. it looks like this will be a long job to get it cleaned up. >> reporter: disturbs news out of the news kf -- disturbing news out of the news conference. some passengers are unaccounted for. they've just brought in -- amtrak has brought in heavy machinery to try to raise and lift some of these cars here to

begin this rescue/recovery effort. >> this is a nightmare. it can't be happening. >> reporter: train 188 was heading from washington, d.c. to new york city when it derailed. the impact mangled the front of the train tearing cars apart and causing others to completely overturned. >> i heard like a big bang. it was a big bang and then -- it caught my attention. helicopters and everything just started coming. >> reporter: the cause of the derailment is unknown but the area where it happened has a big curve and passengers say it was going in the curve when it began to shake. >> we were in the front seat and this huge red suitcase came flying at me. our train was on the side. it pushed me on the side of the train. >> reporter: the train was carrying 238 passengers and five crew members. one of those on board was patrick murphy, a former u.s. congressman. he described what happened after the crash. >> i flew to the other side and

landed on my head. and then i was -- i checked my body parts. i was okay. there was people who were -- they didn't care about anybody else. they were staying off the -- any were getting off the train. >> it's an absolute disastrous mess. >> reporter: now. some good news out of the -- now, some good news out of the news conference, they've got the black box. they will send that box to washington, d.c. for further analysis. >> i understand that the ntsb and federal investigators are already at the scene. is there any possibility about any -- maybe terrorism or does it just look like it was an accident at this point? >> reporter: right now it looks like a complete accident. the fbi was quick to come out last night and said that they don't see any link whatsoever to terrorism. passengers on the train say they felt that the train took a

curve too fast, the cars on the train began to shake. at that point was the moment of impact. we saw the crash. right now speed is a major concern and a worry. >> and they will be spending some time to look over that carefully. thank you, joel waldman live for us in philadelphia. we'll have continuing coverage this morning and have updates throughout the day online and on our ktvu mobile app. san francisco police are investigating a crash that left a bicyclist with life- threatening injuries. the crash happened around 8:15 last night at 6th and folsom street. investigators say two cars collided which caused one of the cars to hit a nearby bicyclist sending that that bicyclist over a fence. some children who were vaccinated in the south bay, they may have to be re- vaccinated. the palo alto medical foundation's pediatric clinic is sending 4300 letters to

parents saying a faulty refrigerator was used to store vaccines at a clinic in san jose. that refrigerator made the vaccines too cold. it may have reduced the effectiveness of the vaccines. >> what that has done, it's put into question the effectiveness of the vaccines we gave, not the safety. there's no safety concern here whatsoever. >> the vaccines were apparently given to children between february of last year and march of this year. the clinic says it has a lotline set up for parent -- hotline set up for parents who have questions and it's replacing those refrigerators. restrictions on blood donations on gay and bisexual men may soon be eased. the fda is recommending those donations be accepted for those who have not had sex for one year. that's a big change from the -- from the current lifetime ban. it also comes after advances have been made.

the human rights campaign says the new recommendation is an improvement but it's still stigmatizing gay and bisexual men. 7:39. the berkeley city council has unanimously approved an ordinance requiring cell phone retailers to warn customers that their phones could expose them to radiation. supporters say most people don't know that their cell phones already come with a warning but they say the warning is just not in plain sight. the proposed warning states if a person carries a phone in their pocket or directly against their body, they may be exposed to radio frequency levels that exceed federal guidelines. >> this is not about telling people not to use cell phones. it's just saying, here is the information you should know. and if you know it, makes your own decision about what to do. >> i don't think it's necessary because we don't have any concluesives evidence about it -- conclusive evidence about it. maybe if we had scientific data, i'm sure but not now.

>> wireless carriers are expected to file a legal challenge. the city is calling for the mcdonald's franchise owner to clean things up at the haight- ashbury location. here's more. >> reporter: well, good morning. city attorney dennis herrera says that crime at this particular mcdonald's in the haight-ashbury neighborhood has been happening for years. in fact, san francisco police have been called to this location more than a thousand times for things like drug dealing, fights and auto thefts. he's calling officials to make changes or possibly face legal action. mcdonald's on stanian street has seen more than its fair share of crime. in a detailed complaint and two- page letter directed to the ceo, the city attorney detailed the crime occurring on the property for things like fights or assaults, drinking alcohol in public, two dog attacks and

auto burglaries. drug dealing remains a major problem here as well. the city has recovered lsd, marijuana and mushrooms from dealers on the property. herrera says he's tried contacting the franchise owner but says the owner has refused to do anything about it. people we poke to said -- we poke to said it's a problem. >> they have -- every time i go by, they offer to tell me weed, every day. i see the people smoking the weed by the mcdonald's. >> reporter: he wants them to implement better security measures at the mcdonald's. he says police resources can be better used elsewhere. he also says mcdonald's is on hook for making the changes. if they don't, he says there could be possible legal action including thousands of dollars of fines and possible closure of the restaurant. back to you. 7:42. four people are dead following a horrible car crash in the

in nepal, officials with bullhorns are walking through the streets calling for people to tleev buildings damaged by yesterday's 7.3 magnitude earthquake -- to leave buildings damaged by yesterday's 7.3 earthquake. the earthquake brought down buildings that were already weakened by the april 25th quake that killed 8,000. the state department says u.s. aide workers will sep survey the -- help survey the latest damage and look for more victims. we're hearing unconfirmed reports that a u.s. helicopter missing in nepal may have been spotted. it was on a relief mission to remote villages. six marines from camp pendleton and two soldiers from nepal were on board. radio transmissions indicate the helicopter had a fuel problem. we'll continue to monitor reports. and a 6.8 magnitude earthquake hit off the coast of

nickel machine. she plans to buy a house, as you heard her. >> very smart way to spend your money. want to check in with sal. how are things looking on the east shore? >> they are a little bit slow. westbound 80. i want to show you a traffic time here on 80 westbound coming from the carquinez bridge to the macarthur maze. it's a 45-minute drive time. a lot of that is because of the slow traffic in richmond heading west toward the berkeley area. you can see the traffic is actually doing okay as you drive down to the macarthur maze. when up get to the bay bridge toll plaza, it's backed up for a 15, 20-minute delay before you make it onto the bridge. 580 is still slow in livermore and pleasanton. and in san jose, northbound 101, traffic is very slow into mountain view. 85 and 280 are moderate. let's go to steve. we do have mostly cloudy

skies. it's cold. it's chilly. there is a pretty good breeze kicking up. the low offshore is spinning in low, mid-level clouds and that breeze is onshore. westerly or southerly component for some. not as bad as yesterday. you can see the cloud cover over. that's your mostly cloudy morning there. a little bit of sunbreaks to the south and to the west. the next band of cloud cover rolls in. the best opportunity for rain is tomorrow morning. probably about santa cruz mountains. san jose south. we'll paint it in for everybody. these are the average or the normal high temps for may 134th for napa, san jose, palo alto. these are my forecasted highs for today. they will all be close. 67 or 66 way below average. coast, bay and inland. cloud cover associated with one system is lifting northward. water temps are very cold. 40s and 50s on the temps. a decent breeze. west at oakland.

west, west, west-southwest. here's kind of the key for the entire month. upper 40s, low 50s all the way to monterey at 52. 48 to 52 is cold. that means the fog forms rapidly. there's no heat in the valley. 50 on the temps out to sacramento, fresno and bakersfield. sierra, they will waiting for -- they are waiting for the system to move in tomorrow. this could be upgraded to a winter storm warning. maybe a foot of snow up to the 5 a00-foot level -- up to the 5500-foot level. i think .30 to .50 from santa cruz mountains south. it's in the mix here. a lot of cloud cover, if not. it will maintain a cold pattern. tomorrow morning, san jose. east bay, south bay, we'll wait for later and then in the late

morning/early afternoon, things will pop up. the parameters, some thunderstorms could erupt. you need heat and lift in the clouds. pie 5:00, 6:00, most of this -- buy 5:00, 6:00 -- by 5:00, 6:00, most of this will push off. it won't warm up much here. mostly sunny, breezy at times. temps staying below normal. 60s almost for everybody. if you hit 70. it will be a soft 70. brentwood, other locations, really struggle. upper 50s or low 60s. 50s, 60s coast and on the peninsula, probably the warmest is 67. cloudy, some rain tomorrow into early friday and then it's out. the weekend will be better. i just don't think it will be that much warmer. >> if it was 60s verses 90s, i will take the 90s.

involved, call police. a mother in antioch had to make a heartwrenching decision during her own terrifying counter with an intruder. she said she took this photo of a stranger standing inside her back door monday night. she said when she asked the man what he was doing, he said it was his house. the man went upstairs where her 4-year-old was. she called 911. >> my response, i know what to do but i had the police with me and they are telling me don't go upstairs. don't do this. don't do that. so i was following instructions from the police. so brave and calm, she didn't panic. >> when police arrived, the 4- year-old pointed hadder to closet to show -- pointed to her closet to show the police where he was hiding.

west at fairfield. maybe a few breaks. the low clouds have no problem forming. we keep the cloud cover in place. below normal temps, coast bay and inland. we'll cloud it up again. a lot of 60s which from this time of year is very rare. all right, sal. what do you have? >> we're looking at the south bay. we'll still look at the east bay, too. we'll start with 280 northbound as you get up to highway 17. we have slow traffic there. but i would say 280 is your best bet here, belter than some of the other -- better than some of the other freeways. you can see 280 is slowing through 17 but it does get better by the time you reach the lawrence expressway. 85 is slow from 87 to saratoga and 101 is sold out from the capitol expressway up to mountain view. 101 on the peninsula, moderate to heavy traffic in palo alto. 280 is better than 101 as you head south. let's go to the bay bridge toll plaza, that's backed up for a little bit of a wait.

15, 20 minutes. nothing out of the ordinary when you get on the bridge, it's moderate into san francisco. back to the desk. >> thank you, sal. this morning, the chp is investigating a deadly crash neesh the gilroy outlet mall -- near the gilroy outlet mall. four people died when the car they were riding in on leavesly road rolled into a ravine. janine de la vega is there. you say there have been many crashes on that road. >> reporter: yeah, there have been. that's what officers tell me. and we're here on leavesly road. about a quarter mile from where the accident happened here, the speed limit is 50 miles an hour. authorities are trying to determine whether the car involved in the accident was traveling too fast. officers tell us the crash occurred sometime around 10:30 last night. this ford mustang was traveling eastbound on leavesly when the driver lost control going around a turn.

the driver flew in the air, hit a try creek bed and -- dry creek bed and went into the ravine below. all four passengers were dead but the male driver survived. >> probably once a week collision there but not as seriously as this one usually. >> it's very tragic. we need to find our way to teach our youth, to get it through to them that they can't drive fast. these things are going to happen. >> reporter: out of the passengers who died three were female. one was male. officers say they appear to be under 25 years old. the chp says the male driver who survived was wearing a seat belt. he has major injuries but is expected to live. authorities are at the hospital trying to see if they can interview the driver to get more information on what happened. it's unknown if alcohol played a factor in the accident. there are still a lot of questions that need to be

answered. >> such a tragedy for young lives lost. thank you. about 40 minutes ago, we brought you a live news conference from philadelphia about last night's deadly amtrak train derailment. michael nutter confirmed at least six people have been killed in the crash. more than 200 others were treated for a variety of injuries. some are in critical condition. now, the rescue crews there still looking for people who may still be trapped under this wreckage. the train's black box, it's been found. it will now be analyzed as part of the ntsb investigation. >> with the six confirmed key seized -- deceased, we are heartbroken and what's happened here. we've not experienced anything like this in motd -- modern times. >> passengers took cell phone video and photos from inside the train. they are describing a violent, chaotic scene. passengers being thrown from their seats, luggage flying

around through the train cars. now, the train was going from washington, d.c. to new york city when it jumped the tracks. now, stay tuned. we will bring you a live report from the detailment -- derailment crash scene at 8:30. the san jose city council is expected to get a proposal to change the rent control laws. the city already has rent control. but it only applies to apartments built before 1979. that covers about 43,000 apartment complexes and landlord cannot raise rent there more than 8% a year. now a councilman wants to cap the rent increases at 4%. not surprisingly, silicon valley apartment owners don't like that idea. >> rent control will not bring the cost of housing down. all it will do is create more competition for housing because individuals may stay in units

it's 8:11. this morning, san francisco

police are investigating a violent brawl between some art vendors and skateboarders. it happened last friday in justin herman plaza. a woman who tells t-shirts shot this video of the mayhem. she said people were using ham edges had, skate -- hammers and skateboarders as weapons. four people were hurt. two were taken by ambulance. it's not clear hoey it started -- how it started. the situation escalated when an artist tried to break it up. san francisco prosecutors say drugs may have been involved in the death of a 31- year-old woman at an old chinatown theater. the body of the woman was found sunday. this is a photo from her google account. police say they were called to the great star theater on jackson street sunday. officers arrested harris rosenbloom on suspicion of homicide. prosecutors are declining to press charges. rosenbloom has been trying to

renovate the old theater. a wild police chase in the east bay had a dramatic ending. a homeowner caught the suspect trying to hide in his garage. now, police say the chase started on highway 4 in antioch early yesterday morning. the suspect drove onto a regional trail, his car became stuck. so he got out, started running. the police searched the area but couldn't find him. that's when a homeowner said he had an uneasy feeling. de-- he decided to look in his garage. he said the suspect attacked him with a tool from a workbench and actually put him in a chokehold. the homeowner's son came to his rescue and the two of them were able to get the upper happened until the police arrived and arrested that suspect. well, thieves in oakland, they are targeting car owners in north oakland. there are fourth reports of cars where all four wheels and the tires were stolen. this in the north oakland

neighborhood. a tire specialist says the more valuable the tires are, the more attractive they are to thieves. >> with the tires and wheels that are coming out on newer cars, it's not uncommon to pay $1,000 for a set of fires. flea markets are real common for selling stolen tires and stuff. there's no question asked. >> the experts say, you can put locks on your rims but they say that's not a guarantee your wheels won't be stolen by someone who has tools and the experience to get those locks off. but they say it may slow down a thief who might decide instead to move on and go after somebody else's car. 8:14. toyota is expanding its recall of problem air bags made by the japanese company. they are recalling 5 million carsled were. more than 630,000 of them are in the u.s. the misdemeanorles include the -- models include

view. it's improved a little bit in the south part of the bay. 85 is slow and so is 280 getting into cupertino. then we go to 680. that's very slow on 680 from concord all the way down to wonderful and on 242 as well. let's go back to the desk. thank you. daylight in philadelphia giving us a better look this morning at last night's deadly amtrak train derailment. look at these pictures of the wreckage. an official with the ntsb calls this scene a desk stating scene -- devastating scene. rescue teams are looking for possible victims buried somewhere in the wreckage. joel waldman is there. he's been giving us live pictures. we're back with joel now. you are standing a couple of hundred yards from where that train jumped the trucks? >> reporter: exactly, right at that curve where there's some concern that perhaps speed played a factor. there's also some concern that perhaps 238 of these passengers

may be unaccounted for. and clearly amtrak is taking no transchances here -- no chances. they've brought in heavy equipment and a boat load of people to scour last night's harrowing crash site. >> this is a nightmare. it can't be happening. >> reporter: the regional train number 188 was heading from washington, d.c. to new york city tuesday night when it derailed and tipped over. the impact mangling the front of the train tearing cars apart and causing others to completely overturn. >> i heard like a big bang. it was a big bang. and then -- it caught my attention. helicopters and everybody just started coming. >> reporter: the cause of the derailment is unknown but the area where it happened has a big curve. passengers say the front of the train was going into the curve when it began to shake. >> we were in the front seat and this huge suitcase came flying at me. our train was on the side. so it pushed me onto the side of the train.

>> reporter: the train was carrying 238 passengers and five crew members. one of those on board was patrick murphy. he described what happened right after the crash. >> i flew to the other side and landed on my head. and then i was -- i checked my body parts. i was okay. there were people -- they didn't care. they were getting off the train. >> reporter: mayor nutter says the destruction is unimaginable. >> it's an absolute disastrous mess. >> reporter: now, some good news as well out of that news conference, mayor michael nutter saying the black box was, in fact, we recovered. it's a black box that you would see in an airliner. it has to be brought it washington, d.c. to be further analyzed. >> joel wauldman, thank you for the -- joel waldman. ktvu will bring you coverage throughout the day, online and

through our mobile app. well, now we know the names of two men who died monday in a crash. it involved a wrong-way driver on interstate 80 in sacramento. the chp says both victims they were from the bay area r 4-year- old nicholas sharm -- 24-year- old nicholas sharma and another individual. >> he is nice to the neighbor. i see him. he come and talk to us. >> that wrong-way driver also died in that fiery crash. there have been more than ten deaths involving wrong-way drivers in northern california in just the past three months. caltrans and state lawmakers are considering ways to reduce wrong way crashes like putting up lights and a warning system when a car goes on the freeway the wrong way against traffic. san francisco police are investigating a crash that left a bicyclist with life- threatening injuries. now, this happened about 8:15

last night at 6th and folsom. investigators say two cars collided and that caused one of the cars to hit a nearby bicyclist. is sent the cyclist over a fence. drug use and other criminal activity at a mcdonald's in san francisco's haight-ashbury neighborhood has gotten so bad, the city is key manning something be -- demanding something be done. >> reporter: city attorney dennis herrera says that crime at this particular mcdonald's in the haight-ashbury neighborhood has been happening for years. in fact, san francisco police have been called to this location more than 1,000 times. for things like drug dealing, fights and auto thefts. he's calling officials to make changes or possibly face legal action. mcdonald's on the 700 block of stan stan street has seen its

fair share of crime. dennis herrera detailed a crime occurring -- the crime occurring, fights, assaults, drinking alcohol on public, two dog attacks and auto burglaries. drug dealing remains a major problem as well. the city has recovered lsd, mushrooms and marijuana. her you are raw has tried to -- herrera has tried to contact the franchise owner. but he's refused to do anything about it. >> they've got mushrooms, cocaine, crack. every day i go by the neighborhood, they offer to sell knee weed every day -- to sell me weed every day. >> basically the most heavily drug trafficked place here in america. i mean this is the spot for anything. >> reporter: herrera wants them to implement better security measures. he says police resources can be

better used elser with. he also says mcdonald's is on the hook for making changes. if they don't, he says there could be possible legal action including thousands of dollars in fines or possible closure of the restaurant. back to you. >> thank you. 8:37. berkeley city council approved a new ordinance requiring cell phone retailers to warn customers your phone may expose you to radiation. the city council -- the counsel approved a be be -- the council approved the measure. most people don't know their cell phones already come with a warning. the proposed warning says if you carry a phone in your pocket or clothing directly against your body, you may be exposed to radio frequency levels that, seed federal guide -- that exceed federal guidelines. >> this is not about saying don't use cell phones. this is the information you should know and if you know it, make your own decision. >> i don't think it's necessary at the moment. i have never heard of anything

like that. if maybe we had sign task data, i'm sure but not right now. >> this ordinance would take effect in july but the wireless carriers are expected to file a legal challenge. restrictions on blood donations from gay and bisexual men could be eebsed. the fda is recommending donations be accepted from bisexual and gay men who have not had sex for one year. that's a big change from the current lifetime ban on gay blood donors. and it comes after advances in testing for hiv. the human rights campaign says the new recommendation is an improvement but that it's still sig -- it still stigmatizes gay and bisexual men. new, san jose city college is reaching out to former heald colleges. thousands were left without when they filed for bankruptcy.

a san jose family is going public about a frightening home invasion hoping to find the men responsible. it happened on friday and was caught on their home security cameras. two men entered the home, armed themselves with kitchen knives and disconnected the phone. the men go upstairs going room to room until they find them. desperate to the get to the two ladies and the baby, the intruders actually kick a hole in the door. >> when they start kicking the door and they start to attack them with the knife and the knife was just beside her. >> it doesn't look like a regular burglary, i don't know what their intext was until they -- intention was.

until they get caught, they are very dangerous. they are armed and dangerous. the -- the intruders gave up and the women called cell phone. if anyone recognizes these men, they are urged to call police. a mother in antioch had to make a gut-wrenching decision. blitz yeager took this -- bliss yeager took this photo of a man in the house. she said what are you doing? he said it was his house. he went upstairs and she called -- she calledden in. the police said take your baby and get out. >> i have had the police -- i had the police saying don't go upstairs and don't do that. and i was following instructions from the police.

so brave and calm. she didn't even panic. >> and she says when the police got there, her 4-year-old daughter simply pointed to her closet showing them where the intruder was hiding. he was quickly arrested. that man's been identified as 21-year-old demario lopez. we're learning more details about the proposed plan for mandatory water rationing in san jose. the new monthly water allocations from the san jose water company will only apply to single family homes. not apartment buildings and businesses. the allocations will require a 30% cut in water use from 2013 levels. here is an example for the months of july, august and september. each home will be allowed 9700 gallons of water per month. those who go over will be charged more for each unit of water over the allocation. there will be a public hearing in downtown san jose in two weeks. if the state approves the plan, it would go into effect on june
