a r car with -- a car with five people inside flips over killing everyone inside except the driver. he faces criminal charges. good afternoon. i'm tori campbell. the california highway patrol is investigating a crash that left four people dead, one may be a juvenile. the driver is at the hospital but understand arrest for suspicion of driving under the influence. janine de la vega takes us through what happened in gilroy and what officers are saying about that particular stretch

of road. >> reporter: a mangled ford mustang lay at the bottom of a dry creek canal off leavesly road. >> they cut the entire roof off the car to get to them and then they announced four of the passengers deceased. the driver was transported to san jose regional with major injuries. >> reporter: the chp said sometime after 10:30 it appears he lost control on leavesly and hit an embankment. the force of the impact killed the passengers even those wearing seat belts. >> one was -- one was not wearing a seat belt. the others were. >> reporter: the front passenger was a 24-year-old man. two of the females in the back were 18 years old all from chp. the chp believes the other passenger was a juvenile. the chp said they respond to accidents on this stretch of leavesly road where it curb uvs

at least -- curves once a week. but they say not like this one. >> it's very tragic. we need to find a way to teach our youth to get it through to them that they can't drive past. these things are going to happen. >> reporter: the speed limit is 50 miles an hour along leavesly. officers are also looking if he was traveling faster than that. we are told he will be in the hospital for some time but when released faces serious charges. janine de la vega, fox 2 news. seven people are confirmed dead. more than 200 were hurt when an amtrak train derailed in philadelphia last night. among the dead are a midshipman at the u.s. naval academy and an employee of the associated press. we're just getting word there are reports that the train was going more than 100 miles an hour heading into a curve where the speed limit is 50. fox news continue joel wauldman shows us what the scene looks

like now. >> reporter: passengers describe the scene as chaotic. the mayor has never seen anything like it in his life. the focus turns to what caused this tragedy on the tracks. >> reporter: daylight shedding light on the light that shut down the busy stretch of highway. passengers were violently tossed. >> a lot of people were in shock. they couldn't believe what was happening. they were just crying. >> reporter: some people were climbing. in some cases fighting to get out while others stayed to help the injured. including patrick murphy. >> i was trying to attend to them as best as i could. >> reporter: meanwhile, hospitals brace for the worst. >> most of the injuries were arms, legs, ribs. >> reporter: there's still more than a half-dozen people in

prison and right now the ntsb and other investigations are on scene searching for clues as to what caused this train coming from washington d.c. to new york city to fly off the tracks. >> the black box has been recovered. it's now in the amtrak operations center in delaware for analysis. we have no information from that particular device. >> reporter: amtrak has suspended service between new york and philadelphia creating computer nightmares, but nothing like what these people went through last night. in philadelphia, joel waldman, fox news. >> president obama is expressing condolences. he said, our thoughts and prayers are go out to the families and friends of those who we host last night and to the many passengers who today begin their long road to recovery. toyota is exspending the recall -- expanding the recall over problem air bags.

toyota is recalling almost 5 million more cars worldwide. more than 630,000 of them are here in the u.s. the corolla, rav4 and tundra are affected made between march 2003 and november of 2007. toyota says air bags in the front passenger side and front driver said can deploy be a normally. tekata is cooperating with the recall. police are investigating a violent brawl between art vendors and state vendors. it happened in justin herman plaza. a woman who sells t-shirts shot video of the mayhem. people were using hammers, and skateboards as weapons. one woman said it looked like a riot. four people were hurt. it's not clear how it started but there are reports that some some boarders were fighting and the situation escalated when an artist tried to break it up.

some children vacs named in the -- vacs nateed in the south bay -- vacs nateed in the south bay may have to be revaccinated. 4300 letters are being sent to parents saying a faulty refrigerator was used to store vaccineses in san jose. the vaccines were kept too cold and it may have reduced effectiveness. >> it's put into question the effectiveness of the vaccines we gave. not the safety. there's no safety concern here. >> reporter: the vaccines were apparently given to children between february of last year and march of this year. the clinic says it has set up a hot line for parents with questions and it is also replacing its refrank rit rater -- refrigerator. a proposal to change rent control laws is expected to go before the san jose city council. the city already has rent

control. but that law applies before those apartment complexes before 1989. landlords cannot raise rent more than 8% a year. a san jose city councilman wants to cap the rent increases at 4%. silicon valley apartment owners oppose the idea. >> rent control will not bring the cost of housing down. all it will do is create more competition for housing because individuals may stay in units longer. >> san jose mayor sam liccardo says state law bans rent control on those buildings built since 1979. 1979. we are just about seven hours away from tipoff for tonight's critical game twine the warriors -- between the warriors and memphis grizzlies.

both taliban and isis terrorist groups are claiming responsibility for a deadly attack today on a bus in pakistan. six gunmen stormed the bus in karachi and killed at least 45 people. the bus was carrying shiite muslims to a place of worship. it's the latest attack targeting the religious minority. official says the gunmen ordered the passengers to bow their heads before shooting them. investigators have not yet determined which group actually carried out the attack. the jury in the trial of dzhokhar tsarnaev could get the penalty phase of the case this afternoon. the defense is now dlibbing the closing argument. it will be -- delivering the

closing argument. this morning, the federal prosecutor wrapped up his argument and he told the jury a death sentence won't give dzhokhar tsarnaev what he wants but what he deserves. he was convicted last month of 30 federal counts in the 2013 bombings that killed three people and injured more than 260 others. the search and rescue mission continues in nepal. a u.s. helicopter is still missing. it disappeared qil providing aid to -- while providing aid to quake victims. there's no indication it crashed. here's more. >> reporter: the search continues for survivors of yesterday's deadly earthquake in nepal. second powerful quake to hit the country in less than a month. >> translator: in the last earthquake almost all of the houses were damage. >> reporter: north they are searching for a u.s. marine helicopter reported missing on tuesday. there were six u.s. marines and

of the available boats are already in use. we've got some unseasonable weather headed our way. mark has more. >> we have may rain showers to talk about. today, though, we're kind of setting the table with the clouds approaching the region. with that, partly cloudy skies over san francisco, looking out toward sutro tower. temperatures have been cool. the winds have been up all week long. winds up 15, 30 miles an hour. current temperatures right now, we have santa rosa, 64 degrees. hayward 59 and san jose checking in 63. as we widen out the view here in the pacific, just a few scattered clouds out there and also offshore. you can see the development of our system, in fact, i will point it out to you. this will actually be heading toward southern california central and southern california. the bay area is close enough that we'll be tracking rain showers in your thursday forecast. so next system we could be tracking some thunderstorms as

facebook is among the first tech giants to take a stance on min muge wage requiring contractors to pay its workers $15 an hour. right now, the dow is down 20. the s&p is down 1. drug use and other criminal activity at a mcdonald's in san francisco's haight-ashbury neighborhood has gotten so bad, it the city -- the city is demanding the fast-food giant do something. here's more. >> reporter: well, good morning. city attorney dennis herrera says crime at this mcdonald's has been happening for years. in fact, san francisco police have been called to this location more than a thousand times for things like drug dealing, fights and auto thefts. calling for a change. mcdonald's on this street has seen more than its fair share of crime. it detailed a letter directed

to the ceo. dennis herrera detailed the crime occurring on the property. drinking alcohol in public, at least two dog attacks and eight auto burglaries. drug dealing remains a major problem here as well. the city says they've recovered lsd, marijuana and mushrooms from dealers on the property. they remember da says he's -- herrera says he's tried to contact the franchise owner and he has refused to do anything about it. people say it's becoming a problem. >> they have laced mushroom, cocaine, crack. every day i go by this neighborhood, they offer me to -- offer to sell me weed. i see the people smoking right by the mcdonald's. >> basically the most heavily drug trafficked place here in america. i mean, this is the spot -- this is the spot to score anything. >> reporter: herrera says

mcdonald's is on the hook for making those changes. if they don't, he says there could be possible legal action including thousands of dollars in fines or possible closure of the restaurant. back to you. the berkeley city council approved a new ordinance requiring cell phone retailers to warn customers their phone may expose them to radiation. the council approved a measure in a 9-0 vote. supporters say most people don't know that their cell phones already come with a warning. the proposed warning says if you carry a phone in your pocket or clothing directly against your body, you may be exposed to radio frequency levels that exceed federal guidelines. >> this is not about telling people not to use cell phones. it's just saying here is the information you should know. if you know it, make your own decision. >> i don't think it's a problem at the moment because we don't have any evidence of it. i have never heard of anything like that. if maybe we had some sign task data, i'm sure.
