traffic. was it still chilly when you came in? >> yes. very gray and cool. i don't see any changes this week. in fact, if anything, there might be more thunderstorm activity, wednesday and thursday. skies lit over lake county yesterday. mostly cloudy, partly sunny. breezy, cool, cool. a lot of clouds this afternoon. a few showers to the north again. and mostly cloudy continued cool with the possibility of more showers, later in the week. this is from chloe, lightning bolt hilt a house in clearlake, area of clearlake at 5:53. check your facebook for more. i already did. and there were a lot of reports there coming in. in fact, e-mail and facebook. good information. thank you. the moisture continues to wrap back in. things calm down. there could still be a little bit of isolated showers. light showers near modesto all asoergtsed -- associated with another low. 40s, 50s. even if you don't get any shower activity there's probably plenty clouds.

west at oakland, 13. west-southwest fairfield. west at napa. things will pick up in the afternoon. mendocino county, lake county could be in for more shower. the big screaming message, how cool it is for this time of year. way below normal. sal, you have an issue you want to get right to. that's right. hayward, southbound 88 at -- southbound 880 at winton. there's the crash on 880 south on the shoulder near winton. the damage is done. 880 will be very slow out of san leandro near marina boulevard. you can see the traffic and paul, will you tilt up for me? i want to see how bad this backup is. tilt up to 238 if you can because i want to show our viewers here and he is doing that. look at that. look at all of that slow traffic.

coming around the curb. it's backed up. see that ramp over there. that's 238 and 238 is at a standstill coming around. i mean, that ramp is just stopped. this is just terrible traffic coming in from 580 and 238 and that's because the crash was in the lanes for a while as you saw it's on the shoulder. this is what you have to deal with. use alternate routes. get yourself on the freeway. you will save a lot of time doing that. let's go to the bay bridge toll plaza now. it's backed up for a 15, 20- minute delay. there are no major problems on the bridge. we continue to follow contra costa traffic and highway 4 is slow and highway 680 is the same. it's kind of the usual slow traffic, nothing out of the ordinary. 24 is a decent drive from walnut creek to oakland. back to the desk. >> thank you, sal. police have called off the search for a driver suspected of stealing a car in contra costa county and crashing it in berkeley early this morning. tara moriarty is live in berkeley to tell us about the

bizarre phone call that the suspect made in the middle of the chase. such an unusual thing, tara. >> reporter: definitely. well, not only did he steal a car, lead police on -- chp on this crazy chase and then crash into an innocent bystander's car, but he has the audacity to call 911 and tell authorities to call off the search. now, they did not, obviously. but a couple of hours ago, they did end the search after they tried looking for him for four hours and were up able to. this is some of the damage left in his wake. he crashed into a silver suv in berkeley around midnight. the suv flipped. the victim was taken to the hospital. the took -- suspect took off. the chp said it was forced to pursue the vehicle by helicopter since he was driving the wrong way, all the way from concord to berkeley. >> ran multiple traffic breaks to attempt to stop the driver at a safe location during all

of this that was going on, he called 911 and made a few statements to our dispatch and we relayed that he wasn't going back to jail. >> reporter: the chp said it couldn't halt the search out of public safety. once he started to drive the right way, officers chased him by car. the chp and berkeley police combed the area near the crash site knocking on doors, searching backyards but the search was called off. the search is described as white, short hair, medium build between 20 and 25 years old. police say the car he was driving was stolen out of martinez. live from berkeley, tara moriarty,back to you. >> thank you. fire crews are staying busy around the bay area. overnight they were on the scene of a small grass fire in san jose that briefly threatened holes. alex savidge is live to explain what it took to control those flames. good morning, alex. >> reporter: yeah, tori, good morning to you.

a real close call for people to live in this neighborhood in san jose. we're inside a mobile home park in the area. you can see as you look here at this charred hillside, just how close the flames came to some of the homes. moved up to the backyards but thankfully crews were able to get this brush fire under control pretty quickly in 45 minutes or so before it could do any damage. it started around 9:30. it was burning in the area of curtner and communications hill boulevard. now, we also want to move and show you another fire that broke out yesterday as well. crews have been busy around the bay area. this one investigators are trying to figure out how it started near the altamont pass at 2:49 in the afternoon. it was around 580 near north flynn road. firefighters were here to help put out the flames. 75 acres burned in the area. there was also a brush fire on friday in hercules. crews have been very busy around the bay area with the

brush as dry as it is. this particular fire damaged one home and threatened several others before crews were able to get it under control. coming back here to stay, this the scene behind the mobile home park. it came very close to these homes. but again, crews moved quickly on this fire and brought it under control before it did any damage here. >> scary and a reminder that we are in fire season right now. have to be very careful. thank you. we are a week away from memorial day, what's traditionally the kickoff to brentwood's you pick cherry season but this lackluster winter is putting a damper on the fun. it's not a good year for the cherries but not only the drought. the fruit ripened early. the crops have been small. some orchards opened to the public and one farmer said his

trees are picked trees. it's not expected to open next weekend even though that's when the crowds usually show up. nine people are in dead in texas, 18 others were hurt after a shootout between several motorcycle gangs yesterday afternoon. investigators say the gangs met at this restaurant in waco, texas to settle their dispute about turf and recruiting. that's when a fist fight started. it escalated into a fight and there was shooting. police moved in. that may have helped save the lives of customers and workers inside the restaurant during the shootout. one woman called back to the freezer area where some of the waitresses were hiding. >> really, really scary. we didn't know if somebody was gonna come back. they said somebody outside of the doors had guns. >> only members of the motorcycle gang are listed among the dead. one police officer was treated for a heat-related problem.

president obama now banning the federal government from giving some military-style equipment to local police departments. this comes after growing controversy over police departments receiving armored vehicles and high-powered frirles. the task force says there is a risk of police misusing that equipment and that could undermine community trust. later today, president obama will go to camden, new jersey, he will meet with young people as well as law enforcement talking about ways to build trust between the police and the community. 7:10. the air force is investigating this deadly crash of a military aircraft in hawaii that killed a u.s. marine. 22 people were on board the aircraft when it crashed during a training exercise at bellos air force base in oahu. everyone on board was hurt. survivors have injuries ranging from critical to minor.

witnesses saw a dust cloud and flames shot up in the air. >> flames were coming up 20 feet high. a lot of people were rushing in trying to help as much as possible. there was some melly trained -- medically trained people trying to help. >> so far the military is not releasing any other information about the crash victims. there is a gofundme page to help one of the u.s. marines killed in a crash on a rescue mission in nepal. he was one of six killed in the crash the hive willed with his family in riverside county county. apple may not be getting all of the damages it won from

the western conference final set. the warriors face the rockets with game 1 tomorrow night in oakland. scott reese has a look at what lies ahead. >> reporter: warriors continue their trek through the eastern most cities in the western conference. they had their way with the rockets during the regular season, winning all four games by an average of 15 points. houston plays at a pace that's more conducive to what the doves like to do. >> i wouldn't say it will be easier. it seems like in the playoffs, things take a different shape. in the western conference

finals you have to expect that to be the same. >> reporter: the same would be just fine at a team that played winning at an elite level against the games in memphis. does the momentum carry over? >> it's hard to say. there's different strengths and weaknesses of teams. you have to feel it out as you go. i think our confidence is high and that's a big factor how you play. >> reporter: confidence is high but the stakes are getting higher. think about all the warriors have accomplished winning two playoff games for if the first time in 40 years. they've won eight. now they need to win eight more. >> it's gra et to get to where we are. but we expected to be here in a way. you don't want to rest on this. we've had success but we want have more success. >> we're half bay there. it's a long grind. that's why people are so happy when they do win a

leans down, you can see the slow traffic there. i realize it's kind of an uncomfortable position. but 238 traffic leads way down to the ramp here. look at that ramp. it's stopped and there is 880. if you want to see what it looks like on the ramp. we can do that for you. what we just saw is right there on my map. let's go to the maps so i can show you the viewers what we're looking at. see that big loop here. that's the big loop. all of that slow traffic heading down to where the crash was. that crash is on the shoulder but the damage is done. it's backing up into castro valley. we'll keep watching this for you. let's go to the bay bridge toll plaza now. that's backed up for a 15, 20- minute delay. i do want to mention -- i forgot to mention alternate routes. let's go back to the maps. 80 southbound get on the freeway -- 880 southbound get on the freeway after 92. use mission or something and you will be in much better

a paragliding accident killed a man. it happened at mussel rock beach. the man hit the cliffs and died before the rescue teams to get him back to the top. officials not releasing his name or where he lived or how much experience he had paragliding. >> with any aviation, you are taking risk. you have to think very kayfully about how to minimize that risk. >> it's safe but obviously the sport is as safe as you make it. >> there was another accident

here. the map commute shows you all of the red. it's extending all the way back into the dublin canyon because of this earlier crash. the crash is there where the icon is. it's out of the lanes. you need to give yourself extra time. you can use mission boulevard and get onto 880 afterwards. what's happening with 880, it was okay. a lot of people are getting through. it's very slow. give yourself extra time. that's probably the best option right there. 580 through livermore is gonna be slow. 680 is gonna be very slow as you head down to san jose and 680 is slow in walnut creek as well. let's go to the bay bridge toll plaza. it's backed up for a 15, 20- minute delay before you make it on the span. 7:33. let's go back to the desk. police in campbell now asking for help. they are trying to find a man who tried to kidnap a young girl over the weekend. janine de la vega joining us live in campbell and you have brand-new evidence that police

released about their investigation. >> reporter: and police are looking for any tips to help them. they don't know if this man is gonna trike again. they are especially concerned because this attempted kidnapping happened near a park as well as two schools and the man ended up grabbing this girl during the daytime. it was 10:00 a.m. on saturday morning. now, here is a look at what the suspect sketch looks like. this man is being described as being asian or liberty, mid-30s -- or latino, mid-30s. two videos confirm he was stalking the fifth grader in his silver or tan older model sedan waiting for her to cross the street on hacienda road. she was asking her dog. police say he got out of his car, grab her, pushed her to the ground. she screamed and he ran away. >> our investigators have been

working nonstop since yesterday morning. we want to identify him as quickly as possible to prevent anything like this from happening again. >> i hope it won't be somebody doing it often. i hope they catch him and give him the punishment due. >> reporter: besides the still photograph police have released this surveillance video. the neighborhood is near fisher park but detectives were given information that he was at the john morgan park. he was wearing a black and white beanie and wearing atickettive coat that was brown or tan -- a distinctive coat that was brown or tan. meantime, the suspected drunk driver whose car hit and killed a mother and her 1-year- old daughter in livermore could be charged today. on saturday, the family and friends of the victims, they

marched in downtown livermore demanding justice. es. police say brian jones was driving drunk when his car crashed into him. he was out on jail. he could face vehicular manslaughter or second-degree murder. the family and friends will remember the life of a gilroy high school girl. she was one of the three killed after the car she was in was killed. the police was -- the driver was drunk. tighter restrictions on the sale of tobacco products and e- cigarettes could be headed to santa clara county.

later this morning, ken yeager will hold a news conference to announce his proposal to raise the purchasing age of tobacco products to 21. yeager is concerned that e- cigarettes devices are being marketed to young people with unknown health consequences. several cities across the u.s., including new york city, have raised the age to buy tobacco products to 21 largely because of the growing concern of popularity of e-cigarettes. the city of berkeley is set to reveal how much money is being collected through the new soda tax. last november, residents voted in a 1-cent per ounce tax on drinks with added sweeteners. this was the first of its kind to be successfully passed in the u.s. the city is creating a committee to advise the city council on how best to use the tax revenue. it was part race, part roving street party at yesterday's beta breakers in

the investigation continues as train service continues after that hoe ren zows crash -- horrendous crash. federal investigators say the train was traveling 106 miles per hour as it headed into a curve and derailed last tuesday. eight people were killed. more than 200 were hurt.

now, this morning, philadelphia's mayor came to see passengers off on the first train out since that crash. he says he wanted to assure them that amtrak has addressed the safety issue. >> everyone knows certainly what's happened. but just the sense of reassurance for the first train going out that things are safe, secure, you should feel comfortable and there will be train service in the course of the day. >> investigators are trying to figure out if somebody hit the front of the train before the crash. there is a whole in the engine awindshield but they do not know if that has anything toe do with the re-- anything to do with the derailment. funeral services were keld yesterday for the man killed in that amtrak. he was laid to rest in hayward. he was a married father of two. he worked as wells fargo an executive in their new york commercial real estate office.

ntsb is handling the investigation. has been interviewing the engineer of the train. investigators say he's been extremely cooperative but that he says he does not remember what happened in the moments before that crash. >> all right. thank you. 7:47. growing concerns this morning about a deadly bird flu outbreak. one of the nation's biggest egg producers announced it will kill 2 million egg-laying hens because of that bird flu. it's the latest farm affected by this. so far 35 million birds in 15 states have been destroyed. it's the biggest outbreak in american history. medical experts say there's little risk to humans. >> the biggest concern is more for the producers that own those animals that are infected. >> one day your flock is good and you are getting eggs and the next day you are infected

slammed into a silver suv around midnight. that suv led to the victim being taken to the hospital and the suspect took off. chp says it was forced to pursue the helicopter by helicopter since he was driving on the wrong way on the freeway and city streets from concord all the way to berkeley the during the chase is when the suspect decided to call 911. >> he related that he knew the police were following him, that the helicopter was above and if the helicopter would stop following, he would stop his car. because of the safety to the public, our helicopter continued with it lit up that way we could alert oncoming motorists of the danger. >> reporter: once the suspect started driving the right way, officers were able to chase him by car. they say that his car was stolen out of martinez. nearly four hours, chp and berkeley police combed the area within a one-block raytyious knocking on -- radius knocked

on doors and combed backyards. they do have some lead. >> i imagine they want to get him off the streets. thank you. nine people are dead in texas. 18 others were hurt after a shootout yesterday between several motorcycle gangs. investigators say the gangs met in waco, texas at this restaurant to settle disputes about turf and recruiting when a fit fight started. it escalated into a knife fight and then someone started shooting. police knew about the planned meeting and they were close by. police moved in. that may have helped save the lives of customers and restaurant workers inside during that shootout. one woman crawled back to the freezer area where some of the waitresses were hiding. >> really, really scary. we didn't know if somebody was gonna come back.

they said people outside of the doors had guns. it was scary. >> reporter: only members of the motorcycle gang are listed among the dead. one police officer was treated for a heat rehated problem -- heat related problem. the air force is investigate osprey chopper death. everyone on board was hurt. injuries ranged from critical to minor. witnesses saw a dust cloud and flames shot into the air. >> the flames were coming up at least 20 feet high and a lot of people are just rushing in trying to help as much as possible. there was some medically trained people trying to scale over the barbed wire. the aircraft was based an camp pendleton san diego. so far the military is not releasing any other information about the crash victims.

on how that girl is doing. >> reporter: police say this girl was in fifth grade and was incredibly poised being able to describe her attacker. that's what helped make the suspect sketch. he's described as asian or latino. in his third 30s, 5'7" with a medium build. he followed the 10-year-old girl walking her dog into this cul-de-sac. these two new surveillance photos show his car, a silver or tan older modeled sedan. investigators say he asked the girl for directions and then got out and grabbed her and pushed her to the ground. she screamed and the man drove away. this is reminding some parents to think about talking to their kids about strangers. >> she's 4, i was trying to

jones was driving drunk when his car crashed into them. jones is out on bail but the district attorney says jones could face charges of vehicular manslaughter or possibly second- degree murder. later font, a gilroy -- tonight, a gill roye high school student killed in a drunk driving crash will be remembered bis her friends and family. she was one of three students killed when their car they were riding in crashed. the driver is suspected of being under the in -- under the influence. on friday, a vigil was held for the other two victims. the vigil for miss williams will be held at 8:30 at christopher high school in gilroy tonight. investigators are trying to find out the cause of a paragliding accident in daly city that killed a man. it happened yesterday at mussel rock beach. a very popular area for paragliders. witnesses say the man hit the cliffs and died before rescue

amtrak is back in service between new york and philadelphia this morning. for the first time since the deadly derailment last week. pam cook joins us in the studio with more on the investigation and what's being done to keep passengers safe. my husband just booked a trip on amtrak from new york to philadelphia next month. >> yale sure he like a lot of people are nervous. over the weekend, amtrak was ordered to expand the use of a

speed control system near the crash site. that's after investigators determined that the train was traveling at around 100 miles per hour heading into a you can be that has a recommended speed of just 50 miles per hour. now, the ntsb is leading the investigation it's focusing on the drain's 32-year-old engineer who has been cooperating with investigators. he has submitted blood samples. there's also a warrant issued for his cell phone records to see if he was distracted at the time of the crash. his attorney says the engineer has no memory of what happened in the moments right before the crash. this morning, the mayor of philadelphia met passengers as they boarded the first train out since that crash. >> everyone knows certainly what's happened. but just the sense of reassurance for that first train going out, that things are safe, things are secure. you should feel comfortable and obviously there will be train service in the course of the day. >> investigators are also trying to figure out if something hit the front of the

train right before the crash. there is a hole in the engine's windshield but they don't know if that has anything to do with the derailment. funeral services were held for a man from the bay area killed in the derailment. the 50-year-old was laid at the rest at the chapel of the chimes memorial in hayward e was a married father of two. he worked at wells fargo as an executive in their new york office. this crash will be part of the ongoing discussions. >> yes. certainly might change the tone of the discussion. >> and the funding. >> yes. >> thank you. a vallejo second grader hit by stray bullets remains in oakland children's hospital facing an uncertain future. a month ago kumar polk was an
