rict attorney's office issued a 46 page report. and images from a body camera worn by one of the officers. police arrive, finding antonio lopez on his knees. a later image shows him walking, carrying this with him, a large saw blade. and after a taser failed to stop lopez, another frame shows the officers with weapons drawn. he was shot twice and killed. >> i don't want to see antonio last breath, gasping for air. >> declined to watch the body cam video, instead, choosing to have several representatives watch for her. they had this to say about it. >> i didn't see antonio make any aggressive move toward any police officer. i saw him walking down the street. >> did he have the weapon in his hand? the knife? whatever? yes, was he pointing it at anybody? no. >> they believe there could have been a better way to resolve the situation. but determining that was not the district attorney's job. they say there's a strict legal

standard. >> the way the district attorney's office was looking at this was not how these officers trained, but how they are, how they reacted to a man coming at them with a weapon. >> in this case, the santa clara county d.a.'s office had the san mateo d.a.'s office and the state attorney general's office review their work. plans to ask the department of justice to do an investigation as well. she'll continue to fight for different results, though she can't bring herself to watch that video just yet. >> that will revictimmize me, traumatize me, and throw me over the edge and i have to stay sane for the next battle against them. >> san jose state released a statement saying the findings speak for themselves, but that because the family file add civil suit, they are limited in commenting any further. >> ann ruben in san jose tonight, ann, thank you. >> oakland police have two suspects in custody tonight in a kidnap for ransom plot at a press conference late this

afternoon. investigators said this whole thing started at 10:00 last night in oakland when a man was kidnapped. police will only say they used some sort of technology to track the victim and suspects to a home in howard. when officers arrived, the suspects took off, crashing their car after a brief chase. >> when we took the suspects into custody, we heard sounds at the trunk area. the suspect vehicle. we opened the trunk and that's when we observed the victim inside, bound. >> police haven't identified the victim, but they do say he is an older man who was not seriously hurt in this ordeal. the suspect's names haven't been released and there's no word yet on the amount of that ransom. >> a badly decomposed body was pull frd a drainage fault. the 2500 block of fairmont. the confined space of the drainage vault. investigators have not provided many details, but the sheriff's

department tells us the body had been there for quite awhile. >> an investigation is underway into an act of vandalism at an east bay dam that led to the loss of 49 million-gallons of water. john is live now in fremont and john, that's enough water to supply hundreds of homes for an entire year. >> reporter: julie, talk about water wasting on a massive scale. the alameda creek is a couple hundred yards that way. right now, it looks like a dry creek bed. all because someone decided to destroy a rubber dam. that dam held back 150-acres of water. that precious resource is long gong into san francisco bay. it was nearly 50-gallons of water, or enough to supply 500 homes for an entire year. the dam was next to niles community park and accessible to the public, despite no trespassing signs. serves 335,000 customers has plans to replace the dam, but it was not yet ready to do so.

district officials say they are working with fremont police to figure out who did this and why, and casual observers are curious to how it looks now. >> you can see the line of the rocks, it turns from a gray to lighter gray. there's the water line right there. it's down quite a bit. >> this was a malicious, senseless act that was a crime against the community that the alameda county water district serves. the amount of water that was wasted is significant. but we feel that we can manage it within the overall scheme of water demand. >> district officials say that despite being inflatable, that dam was robust, made with thick rubber. so not easily damageable. therefore, the people who did this had to work to damage that dam and send all that water into the bay. julie, back to you. >> reporting tonight in fremont, john, thank you.

a small plane went down in rural alameda county killing the pilot. wreckage from the plane was discovered in the hills south of san leandro this morning. the faa says the single engine cessna took off from buchanan yesterday. it was headed for reid hill view airport in san jose. the pilot has not been named and the only person on board. the faa and the national transportation safety board are trying to figure out what led that plane to crash. massive cleanup efforts from response teams are continuing around the clock off the coast of santa barbara. that's where crews are working at a clean up an estimated 21,000 gallons of oil that leaked into the pacific ocean. a pipeline spilled oil into the water there. and on to beaches north of santa barbara. the oil slick covers some 9 miles. federal investigators say before the pipeline, company can restart the line, it must remove the damaged section of pipe and test it and empty the remainder of the line. >> we know the community is

concerned. we know there are those who are angered over this incident. and we do truly regret that we are committed to cleaning up this incident as quickly as possible. >> a federal agency that deals with pipeline safety says it still doesn't know what caused the pipeline to rupture, spilling a total of 105,000 gallons of crude oil. the labor dispute that shut down ports all along the west coast earlier this year is now officially over. members of the international long shore and warehouse union approved a five-year deal today. earlier this year, port slowdowns and shutdowns caused major backups with ships waiting to offload their goods. karr goa cargo is now flowing smoothly. 82% of union members votedded in favor of the contract. >> this memorial day weekend, millions of americans are expected to get out for the holiday. 33million will do it by car. here's a look right now at our

live drive time traffic map. it shows a lot of red out there. that means people are traveling right now. the red you see means it's slow going and a few transit closures this weekend will make the drive even slower for some people. ktvu's tom vacar joins us now. he's live in berkeley at the interstate 80 overpass with what to look out for. tom. >> indeed, if you take a look, what you can see it's a slow roll out of town, not stop and go as it was just a little bit earlier. now while many people leave town for the holiday weekend, a lot of folks say or a lot of folks come here and there lies a problem this weekend. the san mateo bridge begins closing down at 7:00 tonight for a monday morning reopening. but that simply guarantees the traffic on the bay and dumbarton bridges will be impacted. >> the traffic impact may be slightly less than last time. however, we expect heavy traffic and we're advising people, just like last time, to plan ahead and allow plenty of

extra time. >> i'll be staying local because of madness on the freeways and trying to get in and out. >> bart will be shut down between the coliseum stations all day saturday and sunday until 8:00 a.m. monday for work. a bus bridge will be provided. bart will close down its fremont to daly city line forcing more cars out on the roads on saturday. >> definitely saw an uptick in traffic, just more cars on the road. >> the national average price for gasoline today is $2.74 a gallon, 91 cents a gallon less than a year ago. but here in the bay area, gas prices average $3.71 a gallon. that's 47 cents a gallon less than a year ago. >> how do you react to gas prices these days? >> with a smile. >> because that's still a five- year low and memorial day gas prices. the good news for consumers, crude oil prices started again. tom vacar, ktvu fox 2 news.

happy holiday. be sure to down load the app. we are also posting updates on facebook and twitter. >> started a new program aimed at saving energy and money by recycling cigarette butts. the plans call for special cigarette butt disposal boxes at freeway rest areas across the state. the creators say the design will make it easier for drivers to dump their entire ashtray into the boxes instead of throwing cigarettes out the window. >> we plan on expanding it all the way to rest areas, throughout the state, all 88 rest areas, freeway offramps and on ramps with meters so people can get rid of their cigarettes before getting on the freeway in the morning. >> the cigarette butts will go to a plant in los angeles where they will be burned to generate electricity. the ash will be used to make concrete. creators say they hope to collect as many as 6 million cigarette butts during the first year.

new at 6:00 tonight, concerned about eating raw tuna after a salmonella outbreak sickened more than a dozen people. at least 53 people have been sickened in that outbreak and most of the cases are in california. >> john fouler now with what you need to know to avoid getting sick. >> at oakland's japanese restaurant and sushi bar, ria bailey enjoyed her sushi lunch, raw tuna in a 911 roll. >> i don't think salmonella outbreak will stop me from eating raw tuna. >> she knew her spicey tuna is the disturb linked to the outbreak. >> i have been coming here for four or five years and i haven't had any issues. >> behind the sushi bar, years of training from a master chef taught him how to select fresh and safe raw tuna like this purchased daily from his supplier. >> we handle the fish first and while we're handling it, we look at the texture, the color, and the smell of the tuna.

>> he says no fishy odor and it must be bright punk pink and firm. and there's a great tip for consumers. if you're concerned about the quality of your sushi, look around the restaurant. >> your restaurant would have shipment every day. more fresh fish every day. >> chefs make spicey ground raw tuna fresh every day. the cdc says the ground tuna linked every day may have been prepackaged. the salmonella strain is similar to one traced to a factory in indonesia. while there's concern because of mercury. all commercial tuna has been flash frozen making the risk of bacterial illness very small. john fowler, fox 2 news. >> a bill that would require daycare workers to be vaccinated is one step closer to becoming law. the state senate approved the bill on a 34-3 vote. supporters say mandatory

vaccinations for daycare workers would extend protection to preschool and daycare centers and protect children too young to be immunized. parents can be notified if a daycare worker is not vaccinated. the bill heads to the state assembly. california's unemployment rate continues to fall. the state employment department reported that @ april unemployment rate dropped to 6.3%. that's down from 6.5% in march. the state added about 30,000 jobs last month. a year ago, the unemployment rate was 7.8%. despite the positive news in california, the state's unemployment rate is higher than the national average of 5.4%. >> accepted an offer today by a group of farmers in the delta to cut back their water use in exchange for no further cuts this season. the delta farmers made the offer to conserve after being warned the state water resource control board was ready to make

mandatory cuts. the farmers have until june 1 to tell regulators how they'll make the cutbacks during the coming summer. a decision on water use was delayed until at least next week. let's bring in our chief meteorologist to talk about the holiday weekend and the weather that we're looking at. it sounds like it will be nice. >> much nicer than it has been. this whole week has been cool. last week was cool. as we head towards your holiday weekend. things are shaping up. more sunshine and warmer days and beach weather. we have mark out at the marine mammal center in the headlands. he's been talking about what's going on. a big campout. >> lots of people showing up for the campout right now. i've been here for a couple hours. in fact, behind me, all this marine debris, as you look at this, keep in mind, this was found in one deceased whale. 450-pounds of this marine debris. it gives you an idea how much stuff we have in the ocean. this is what they are finding in the marine mammal center.

today. highs tomorrow are going to be warmer than these. so it was warmer today. well, some places were a degree cooler. some places were 2 degrees warmer. tomorrow will be warmer. we're going to see lots of low 70s. there's that shot. there's the oakland estuary. the golden gate bridge is in here. that's where we give you some perspective. this area here, this instability is leaving. that's great. and as that leaves, we're going to set up, you can see the flow coming more like this. that's more northerly. remember i was showing you this. i'll show you more northwest flow. and that will set us up with a warmer weekend. that's the forecast. fog and clouds along the coast. showers continue in the mountain areas. now, up around lake tahoe and up towards yow semity, it will be showery all weekend. monday should be the best day in the mountains. saturday and sunday, if you're going up there, there will be showers. around here, all sorts of cloud cover. and then you warm up.

you start seeing 80s showing up. that's how you know that low pressure is leaving. temperatures begin to warm gradually. by sunday, these oranges will be pushing their way westward, which means a warmup. so tomorrow morning, forecast, and then we go into tomorrow afternoon, more clearing, but the mountains, there's saturday afternoon. sunday morning, pretty much the same thing. sunday afternoon, more showers in the mountains, good in the bay area. so, as we look at forecast highs for saturday. 77 in vacaville. 74 in fairfield. these numbers warmer than they were today. and warmer than they have been all week. it's been a chilly week with drizzle. we got measurable precipitation. so the drizzle should be ending. temperatures should be warming and bay area holiday weekend looks pretty darn good. you know, couldn't be much better. a little bit warmer. but sunday the warmest day on the weekend. memorial day looks nice as well. and of course, memorial day, just remember while we're here, it's a very important day. remember the people that came before us and served in the

military and lost their lives and it's just a great day and it's going to be a great weekend. >> i'm glad you pointed it out. it's just a holiday. it's way more than that. >> it's important to thank them for their service. thanks. >> a very old pair of jeans has been added to the levi archives in san francisco. levi said that this pair of jeans dates back to the 1880s. they were found near a mining town in nevada and levi historian says the jeans have a few minor tears and holes but otherwise in great shape. >> all of the rivets are intact on the pair of jeans. all of the buttons are still intact, which is remarkable. they are in almost near new condition for a pair of pants that are 135 years old. >> look at the condition of those. that's incredible. the jeans are a cousin of the classic 501 jeans and levi keeps them safe in the vault

scott is in for mark tonight, warriors trying to leave for houston today, led into some problems. >> flying charter not what it used to be. game two victory, unfortunately, they with weren't flying high on the team plane. the team was slated to take off for houston about 10:00 this morning, but the aircraft had mechanical issues. they ultimately had to switch planes. didn't take off until 3:30 this afternoon. they will land in houston within the hour. too late to practice. good news, they are up 2-0 in the series after last night's crazy final sequence. >> we're not going to go anywhere. we're going to keep on standing here and swinging. that's what we do. we have to keep standing here swinging and as i said, i told our team, i said, we battle back and i'll take our best player any day of the week. >> we made our share of mistakes in the last minute or so, but you know, we ultimately
