no. he left out a side door and ducked into the police station. he says he has no comment about what happened. >> reporter: this was how ray mcdonald left the jail. he posted bail 4:45 p.m. but he did not want to talk. >> no comment. >> reporter: he had several bushes with the law. this time police say they responded to a disturbance at his home about 3:45 a.m. this morning 467 467 -- morning. >> he fled. >> reporter: he was later picked up in san jose that home of former teammate justin smith. police say he is facing charges of domestic assault and child endangerment. >> what i can say while the victim was assaulted she was holding a child. >> reporter: his lawyer disputes this. he identified the victim of the

mother of his son. someone who made a previous allegation against him. in that case charges were never filed. according to a witness in this case there was no physical contact between the two. and he believes this is an effort to manipulate their custody and support issues. he was transferred to the county jail this afternoon. the chicago bears who picked him up in the off season announced they were releasing him because he did not meet their standards. the gm said we believe in second chances but when we signed him we were clear what our expectations were. >> there should be strict standards across the board. >> reporter: fans have high expectations too. >> here we go again. good for the bears. it starts with character and ends with character. >> reporter: as for why he was in town his mother tells ktvu

he comes to visit his son who was born in march. >> ann rubin live in the south bay, thank you. in the past 9 months ray mcdonald had several run ins with law enforcement. in december before the 49ers dropped him a woman accused him of sexual assault. san jose police have not yet charged him or cleared him. august 31 he was arrested for domestic abuse that involved his fiance but he was never charged. and 2010 he was arrested on suspicion of driving under the influence. an effort to keep protesters and businesses safe is coming under fire. protesters are unhappy with the direct -- [no audio] >> saying it is illegal.

ktvu's cristina rendon with more on what the protesters are saying. >> reporter: this is taken out of oakland's crowd control policy. a way tobalance multiple interests and keep people safe. but the protesters say they could only back fire. >> protest in oakland. keeping demonstrators off the streets and on sidewalks after dark. >> reporter: the mayor says keeping people on sidewalks prevents vandalism and violence and keeps people safe. >> this is not a new policy. this is just making better use of the policy we currently have. >> reporter: protest organizes feels it is distracting. >> she can play whatever games she wants to but it is a new

policy. she cannot enact a new policy so we will resist it. >> reporter: she says what the city is doing is illegal because the approach needs approval from her organization and the aclu. >> people will cause damages to business, that is not going to happen in the middle of the street. forcing people on to the sidewalks could only exacerbate that problem. >> reporter: she feels oakland will see escalating injuries and arrests and liability. >> reporter: we spent a lot of -- >> we spent a lot of time analyzing and we are confident this approach is fully within our policy and the law. >> reporter: they say what is most important is the message. but they disagree on what should be allowed on the streets of oakland. >> we are encouraging and asking people to stay in the

streets to push the issue. i imagine that is what is going to happen. >> reporter: in the past several nights of protesters there were no businesses damaged but there were multiple arrests. >> cristina rendon live in the news room, thank you. police arrested two men accused of burglarizing a home. they were taken into custody about 10:00 a.m. this morning. police say a neighbor called to report two suspicious men and officers saw them running into home. investigators say a door to the home was pried open and the belongings were ransacked. president obama today honored all the u.s. troop whose died fighting for our country. he layed a wreath that tomb of the unknowns at arlington national cemetery and he said the country must never stop trying to repay our debt to those who gave their lives fighting for our country and this is the first memorial day

vietnam. . >> reporter: the free lunch is their memorial day picnic. >> brings a tear to my eye because a lot of my friends that i went to training with are not here now. >> reporter: those friends died fighting in vietnam. when the war ended some had nothing to come back to at home. >> i traveled around a lot. just traveled around. >> reporter: he has been homeless for 12 of his 59 years. >> hard to maneuver with two bags. >> reporter: always traveling but going nowhere. >> reporter: this is what he calls home. a sidewalk outside the mcdonalds near at&t park. he holds a sign letting you know who he is. >> in need of help.

happy memorial day weekend. thanks for the memories. >> reporter: and hope for a better future. >> i am trying to move forward. >> reporter: in san francisco, noelle walker, ktvu fox 2 news. a special observance that uss hornet museum paid tribute to those who died at sea. a wreath was tossed into the sea. it began with performances by the hornet band this morning. the ceremony began at 1:00 p.m. this afternoon. the highway patrol identified a man who went scuba diving this weekend was a chp lieutenant. according it the chp facebook page he was diving with friends

fish. a popular swimming spot is expected to remain off limits till wednesday because of a dangerous algae. visitors to the quarry lakes are still able to enjoy the park and fish but swimming is banned. officials say the algae can cause skin rashes, pain and other allergic reaction and harmful to dogs. a fog flu expanded to 12 states and made a thousand dogs sick. most of the cases have been seen in illinois but there are cases reported in california. the virus spreads from nose to nose or direct contact between dogs. signs include a cough, a running nose and a fever. something that has become familiar, a familiar sight on beaches, coming up, why they think another dead whale washed ashore. >> and what muni is doing to speed up service for riders. >> and tracking the warm up

for the 8th time in two months another dead whale washed ashore on a bay area beach. a young 28-foot gray whale. it was discovered saturday off of highway 1 in sonoma county. ktvu's christien kafton went there today and tells us what they plan to do next and why so many whales are washing up on bay area beaches. >> reporter: this 28-foot gray whale is the latest to day off the california coast and washled ashore.

-- washed ashore. they discovered the whale saturday and it is drawing a lot of attention from beachgoers. >> when i was over there i saw people looking at it. i thought that something was down there. like a sea animal. >> reporter: what did you think when you saw it? >> it was sad. >> reporter: no word about what killed this whale but they are worried about what is killing the whales. more than a half dozen dead whales washed on to bay area beaches beaches and that follows a long winter that saw hundreds of malnourished sea lions. they are worried this whale is a symptom of a larger problem. -- larger problem. >> like in the minds, the bird in the cage. all these pieces come together that show there is something happening to our world. you know, what are we going to do about it? >> reporter: researchers sell ktvu the number of whales dieing is within the normal

amount they expect to see. >> we are trying to puzzle together more information as the information comes in and see if there is another pattern that would link to all of these. >> reporter: she says the whales are migrating off the california coast. some show signs of being hit by boats, aorts attacked -- others attacked and some malnourished. >> they have a research vessel going out this weekend, we will look at data and see is there food out there. >> reporter: last thursday the body of a gray whale washed ashore and dragged back out to sea. the plan for this whale is to let the tied pull the body back out to sea as well. may marks the end of the migration season so they hope we will be seeing fewer whales wash ashore.

christien kafton, ktvu fox 2 news. service is faster on muni now that they are implementing double stopping. two trains trains pull in about the same time. then when the first train leaves the second train lets new passengers on. muni says double stopping is safe, and eases congestion. car dealers pulled out all the stops today. millions went shopping coast to coast. ktvu's tom vacar tells us the cars are selling like hot cakes. >> reporter: no accident the papers are filled with car ads. dealers don't spend this money unless they expect a return and that is is what we saw at car dealers this afternoon. >> memorial day, labor day, our

week. 61 napa. 69 fairfield right now. normally -- this would normally -- this time of night, current temperatures, this time of year, it would be lit up, warm. but it is not. tomorrow will be like today except more sunshine and warmer. and then into wednesday and thursday and friday temperatures peak. it is going to feel hot. we will get upper 80s. low 90s by friday. when you have been dealing with 60s it will seem hot. forecast for the morning. oranges. 80s. they will working their way west. this is how it is supposed to go. how it should go. 70 napa. tomorrow is a transition. i think tomorrow will be warmer. more sunshine will help. i think it will be warmer than today. and then on wednesday it is noticeable. the warm up. the five-day forecast with your bay area weekend in view. right there.
