[ technical difficulties ] imagine working out at the gym only to find out after your work out your car has been stolen from the parking lot. police from various south bay law enforcement agencies managed to nab the crew they believe is responsible. janine de la vega is joining us from san jose to talk about this big scheme. janine. >> reporter: we've been talking to some members at this ymca and they knew this was one of the gyms that was hit.

one of the thieves distracted a front desk employee. task force noticed a pattern of thefts and realized the thieves were stealing car keys after breaking through the locks. >> they have been breaking into cars in this parking lot. but we've also heard that they come into the gym and they go through break into the lockers and take things out of the lockers. i've mostly heard it being mens lockers. >> reporter: the mercury news is reporting police were able to identify the suspects through surveillance video and they were able to track them down. five cars have been recovered. police say the men arrest red transients. the traffic force is report thely looking for more suspects who are part of this ring. we are going to be reaching out to police if for more details on this case and coming up at 6:30, you'll hear from a victim. pam. >> it will be interesting. all right we'll check in with you then.

thank you janine. 6:03 is the time. a tense stand off in san jose with a man and woman who police say tried to run over an officer. it came to an end over night with the arrest of the two suspects. now it started when police tried to pull over the couple on mclaughlin avenue and story road at 6:30 yesterday evening. instead of stopping the suspects drove toward an officer who was on foot and just barely missed him. police gave chase after a few miles investigators say the couple rammed into a patrol car and several other parked cars. and then the suspect left their car and ran into a neighborhood. just before 10:00 last night officers found the suspects hiding in a backyard and arrested them for assault with a deadly weapon that they were also wanted on felony warrants. a trial is due to begin today in the south bay whether a school district knew about abuse going on in a classroom. two years ago craig chandler was convicted of arresting two

children. he is now serving 75 years to life in state prison. san jose mercury news reports the families of four of the victims claim the evergreen elementary schooler norred warning signs. the school district said it had no prior knowledge of the abuse. former contra costa county sex crimes prosecutor returns to da office today seven years after being accused of raping a junior colleague. michael has been on paid administrative leave since his arrest in 2008. today he will resume litigating paces as a deputy district attorney. now a judge threw out the criminal charges against him in 2011. citing procedural errors and the fact the alleged victim received a settlement from the county over the way their claims were handled. he maintains he is innocent. he is suing the county for what he calls malicious prosecution

and defamation. the city of san francisco could soon take important steps in a battle against sugary drinks. ktvu fox 2 reporter tara moriarty is joining us now from san francisco with the city's three proposals. tara. >> reporter: we know the mayor has sort of refrained from taking a stance on this particular issue. we know he is concerned that city bans on soda advertising and purchasing could have a negative economic impact. he may not have a say however if eight of the 11 supervisors vote this in. they would be placed on things like billboards. warning drinking beverages with added sugar contributes to obesity, diabetes, and tooth

decay. >> reporter: you may remember last november they spent $10 million to help squash a proposed soda tax on the san francisco ballot. the american beverage association says the soda industry plans to fight these three bills. the meeting will take place at 1:30 this afternoon. is now the state building standards voted to change development rules on friday. it's up so developers to figure out no meet the limits.

the swimming pool industry is is fighting back against increasingly tough restrictions because of the drought. water agencies but the california swimming pool says the studies show an average of swimming pool uses less watt earn grass. some water conservation experts disagree. our time is 6:08. sometime within this hour the solar impulse is expected to make an unscheduled stop in japan. bad weather over the pacific would make it really risky.

her mother's boyfriend 25-year- old juan rivera was arrested and charged with her murder. >> it's very hard because we have kids of our own and it's rough to hear about the situation and everything. >> the little girl's family is focused on raising money to pay for her funeral. rivera is the only suspect. he is scheduled to be formerly charged in court tomorrow. nine-year-old girl is -- a car suddenly veered across the traffic and jumped the curb. the 67-year-old man behind the wheel and the passenger were also hurt but their injuries are not as serious. investigator says the driver may have hit the gas pedal instead of the break. the driver also smash into a wall leaving a gaping hole in the side of the terminal building. a large side show took place in oakland over the weekend.

cars as you can see spinning their wheels this is near the high street onramp to 880 at about midnight on friday. police radio traffic revealed that officers and dispatchers discussed the incident but officers decided to take no action. this is the time of year when side show activity increases. happening today san francisco mayor ed lee will introduce his new budget plan to the board of supervisors. it's a two year spending plan. the plan includes money to pay for 400 new police officers and almost 250 new transportation workers. the mayor's budget director says there will be money in there for housing for the homeless and the poor and that the extra money is coming from the expanding city revenues. mayor lee is also set to file official papers to run for reelection. last november he announced his plans to run again.

the mayor has worked in public office in san francisco for more than 25 years including five years as the city administrator before becoming mayor. the election is november 3rd. a philadelphia man could face fines after he was caught flying a drone over a phillies game. security spotted the remote control device above third base at citizens bank park. they found the drones operator outside the stadium. he was questioned by police and security asked him to erase all the awl of the images. the faa prohibits drones from flying over sporting events. speaking of sporting events, the new york oz. moe soccer team has arrive third-degree cuba ahead of a ground breaking soccer match. pay lay arrived in hah van nap yesterday. the cosmos will play the cuban nationals team tomorrow. it will be the first game featuring an american sports team on cuban soil in 16 years.

it's a car that ran into a tree. michigan boulevard is closed. nearby on the freeways 880 south does look good. so at least the major freeways are off to a good start. 6:16 let's go to steve in the weather center. >> all right sal, thank you. lots of drizzle on this june 1st. june gloom is here in all of its glory. most locations are saying cloudy and the drizzle is adding up to measurable amounts such as kevin who knows his weather in sausalito. light rain. .1500 at 6:00 a.m.. there is a lot of reports of drizzle on the bay bridge and the golden gate bridge and plenty of low clouds to go around. they are not strong enough to give us much more than low clouds and drizzle. this is very impressive for this time of year as the system

swings in. it will translate into warmer conditions on the lows. 59 concord. mostsan jose was a little cooler and now it's a push. concord, fairfield seven degrees warmer. easterly breeze i doubt this is right but there is a south easterly breeze coming in and it's going from san jose all the way to sfo. water temps monterey inching up. system will continue to swing in a lot of cool air. that will keep temperatures well below average. low clouds will slowly retreat. temperatures will stay below average. 7-8-degree where is they should be. fog and drizzle. the clouds give way to sunshine

welcome back to mornings on 2. santa clara based intel is buying al car a. it comes after an earlier round of talks between the two companies ended in april. atera shareholders will receive $54 per share. bay area real estate prices have bounced back so much some homeowners are deciding now is the time to sell, cash out and move out of the bay area. bay area home prices jumped more than 10% in the last year. and companies that stage homes for sale and moving companies say they are busier than they have ever been. one walnut creek real estate agent who has been in the business 37 years says she has never seen such a strong market for home sellers. >> the offer prices are so much higher than the asking prices.

this one has feathers. meet kerry. an african penguin born at the california academy of sciences in san francisco about a month ago. the museum tweeted this penguin chick is their new mvp and shoots straight for the heart. a 92-year-old cancer survivor has conquered a new challenge. harriette thompson became the oldest woman to finish a marathon. there she is. she ran the rock and roll marathon in san diego yesterday in 7 hours, 24 minutes. the race is fundraising for the leukemia and lymphoma society. i hope to do a yoga marathon at 92. i don't know about running. a lake tahoe casino employee has been arrested.

kids are almost out for the summer. will we be able to swim or go to the beach or just gray weather? >> you can go there. >> bring a sweatshirt. >> bring a parka. i'm getting reports of drizzle from mendocino county to marin county. measurable amounts. .07 to .14. it's pretty impressive here. there is lots of gray to go around. that will translate into a cooler pattern. this is really something for june 1st. my goodness. to see that swing in i could have used that for january and february. you can see the spin in the atmosphere. that is what is is giving us cool air aloft and temperatures that are being held up on the lows due to the cloud cover. clouds out in antioch says overcast, light wind 2 miles an hour. if it's over cast in antioch that tells you it's a really

cool pattern. fog, drizzle, light rain. sun and clouds. an afternoon breeze will pick up later today. highs today held in check. all right sal, lots of drizzle out there. wet roads adds we like to say. >> sometime that leads to not so good commutes. let's take a look at the bay bridge toll plaza. there is already a crowd here get into san francisco and just on cue you can see water bubbling up here or on the screen. i wouldn't say it's one bubbling up it's sprinkling here. this morning's commute is just moderate as you drive north. southbound traffic is just fine. a little farther south if you are driving down hayward.

there is a fatal crash there. it will be closing mission boulevard until noon. you want to use alternate routes and avoid mission in that area. the freeways nearby are looking okay. let's go back to the desk. the national security agency they have fewer tools to help officials track potential terrorists. alex savidge is live in our newsroom to explain why the u.s. senate did not pass an extension of the patriot act before a midnight deadline. >> reporter: one republican lawmaker led the charge against the patriot act. calling it an invasion of americas privacy. officials have launched the authority to collect bulk fundraisers. >> i don't think the american people are going to take it

anymore. >> there is rand paul also a presidential candidate. paul successfully blocked renewal of the patriot act. cars are not recorded but information is collected on who people call and when they make those calls. this is a program that was brought to life by edward snowden. this may be a short lived victory for senator paul. his fellow lawmakers are expected to pass a compromised bill from the house. it would end the data collection program in its current form and in its place would be a system that allows the government to search the data held by telephone companies on a case by case basis. >> i believe this is a program that strikes a critical balance between privacy on the one hand and national security on the other. that doesn't mean the senate still shouldn't have the

opportunity to make some changes to it. >> the senate will continue debate on the proposed freedom act later this afternoon. the white house is usualing senators to move quickly in passing the bills. the director has called this a dangerous lapse. intelligence officials could find it more difficult to obtain wiretaps and court orders for business records. >> alex savidge in our newsroom, thank you. time is 6:34. later today the family of the late robin williams go to court as the battle over his estate continues. the robin williams widow susan and his three children worked out most of their differences over his personal items, but they still can't agree on how much money susan williams should get out of her lifetime.

imagine working out and then find out your car has been stolen from the parking lot. janine de la vega is joining us from san jose with how police managed to catch the crew they believe is responsible. >> reporter: we've been talking to the staff members here and they told us sometimes people would come in saying that don't have a membership and saying they need to look for somebody. now as of a couple weeks ago -- the mercury news reports two men were acting suspiciously. one of the men distracted a front staff employee while the other went into the restroom. moments later a member reported their vehicle had been stolen. members of the regional auto theft task force noticed a

pattern of theft. we spoke with the one gym member who is familiar with the crime. >> i heard guys talking about it in the pool. the guy at the pool told me his sons bike was stolen. my wife's car was opened up and rifled through. >> mercury news says other gyms were hit in the south end, north san jose but police worry to identify the suspects through surveillance video and track them down. five cars have been recovered and three men were arrested who are reportedly transients. coming up at 7:00 you will hear the story of another victim who was hit in this parking lot. pam. >> all right, thank you. we'll check back in a little bit. lake tahoe casino employee

was arrested for theft after taking $10,000 that was dropped by a gambler. >> the gambler dropped part of his $70,000 in winnings on wednesday. a janitor is accused of sweeping the money into a dust pan and stashing it in a garbage can. he told deputies he was going to turn the money in during his next break. the ban was approved last year to reduce the amount of syrofoam that is pa luting waterways. super markets selling prepackaged foods they are exempt. many bay area cities including oakland, palo alto, and san jose they already have similar bands in place. the muni challenge kicks off today.

lei. sat in the crowd for the a's yankees game. a two run homer in the sixth inning. the giants ended their big note on a losing note. it probably would have been a game ending double play. the braves took advantage with them with a three run triple. they scored four runs in the ninth. they won 7-4. >> and steph curry got a lot of grief for going to the giants game. saving water across the bay area preponderate new restrictions that go into effect today. >> plus did you see this? a bizarre accident.

welcome back to mornings on 2 it's 6:43. president obama and first lady michelle obama paid a condolence call on the family of vice president joe biden after the death of his son beau. 46-year-old beau biden died on saturday from brain cancer. he was attorney general of delaware and iraq war veteran. in a statement released by the vice president on behalf of the family he wrote quote beau biden was quite simply the finest man any of us had ever known. >> there was a lure he was called the sheriff. i think he was called the sheriff because he was always the guy that was supposed to kind of watch out for the other kids. he was the designated driver.

he didn't drink, he didn't smoke. >> funeral plans are pending. beau biden leaves behind a wife and two young children. the state department says secretary of state john kerry's surgeon is flying to switzerland. here's video of john kerry a past cycling event. he ran into a curb he was in geneva switzerland. he broke his right thigh bone. he is 71 years old. he's an avid cyclist. so much rain has fallen in texas over the last 30 days that meteorologists say it could cover the entire state with eight inches of wear. finally the forecast is is calling for sun across much of the state of texas.

officials hope the move forward with the cleanup efforts this morning. at least 27 died as a result of the storms. 11 people are still reported missing. thunderstorms, floods, and tornadoes have left a trail of damage. in indianapolis trees were knocked over. cars were thrown on top of each other. a tornado swept through the area with winds up to 90 miles an hour. all right let's check in with tori campbell. a diverse crowd will be holding a and raking in big bucks. find out how much owners are expected to make when they rent out their homes during super bowl week early next year. now back to you in the studio.

here in lafayette it's a little slow. also it's slow approaching the caldecott. the wilder exit which is one of the exits before the tunnel and traffic is going to be a little bit slow. they are moving the crash. it doesn't sound that serious but you should expect slow traffic at the bay bridge toll plaza. the traffic is backed up from the mccarthur maze. if you are leaving san francisco three right lanes on the lower deck of the bay bridge is closed. traffic had not been that bad but now all of a sudden i think a lot of people got on the road. northbound 101 is backed up like an afternoon commute from caesar chavez out to that lower deck of the bay bridge. it's causing a big backup. the other day i got caught in something like that. it takes forever to get there that. i would recommend using 280 getting down to south of market and get yourself on the freeway down on one of the entrance ramps. you will save a little time.

and i believe it. sausalito .15. it's a big fog bank out there. that tells you it's a heck of a surge. that is because of this system spinning right there. as it swipes in. it's lifting that low cloud deck 3,000 feet. giving us a really strong ramp of on shore. so 50s on the temps. these are held up. sfo 59. concord 59. san jose 57. antonio with .7. there are numerous reports of measurable amounts here from just a trace or two to .51. this system to the north responsible for it as it lifts out. is this it for the week? it will be subtle changes. it's the end of the week. there will still be rain to the north. tuesday, wednesday, and thursday look all right. this is one forecast model. it doesn't mean it's right. it's dropping another low in thursday and taps into tropical

horrifying accident. a crane dropped a massachusettsive air conditioner down to the street -- a massive air conditioner down to the streets below. but a rigging strap broke and the air conditioning fell down to the street. seven people suffered cuts and bruises but amazingly the injuries are described as minor. a police officer is hailed as a hero for rescuing not one but two people in the same day. officer nathan earnst is a police officer in holly spring. he responded to a 911 call about a man over dosing on heroin. officer earnst rushed to the scene he gave the map a shot to immediately counteract the effects of that drug. and then two hours later another 911 call this time about a house fire. earnst and another officer jumped into action.
