baja. we'll keep an eye on that. today, though, document, low clouds, some high clouds. mostly sunny and warm. temperatures 60s, 70s, coast and bay. upper 70s, low 80s inland. normal low slow traffic, sal. hey, steve, i have an answer for you. we were talking about vasco road. it was a huge piece of construction equipment blocking both sides. i'm gonna put a picture of it. our viewers are so good. they get to the bottom of things. that's what happens. let's take a look at the commute now. the traffic is moving along pretty well at the bay bridge toll plaza until you get to the macarthur maze. i guess that wouldn't be pretty well, would it? it's slow at the at the macarthur maze. yesterday, we had a terrible commute in and out of san francisco using the bay bridge. interstate 880 does look good if you are driving on traffic

here in oakland. southbound or northbound coming from past the coliseum and no major issues. traffic continues to look good. you may be wondering about yesterday. we had big delays in san francisco along northbound 101 getting to the lower deck. it's not that way today. 280 in daly city is better. 101 is better. getting to the airport looks good as you drive down the peninsula. no major problems down san mateo and heading all the way down to palo alto. a slightly different and better commute on this tuesday. back to the desk. >> thank you, sal. the search for answers continues into a fiery small plane crash in livermore. it happened around 9:00 last night in the area of hartford and north livermore avenue. that's about three miles north of the livermore municipal airport. ktvu fox 2 reporter tara moriarty is near the crash site where federal investigators have just arrived. good morning, tara. >> reporter: well, good morning. the ntsb was expected here at first light. it looks like they are scouring through the wreckage. we also noticed that the

coroner is here on scene. if you take a look behind me, you can see this is exactly where the plane went down. when firefighters arrived last night at the crash site, they found the plane in the field crashed in, engulfed in flames. the pilot was killed. investigators say the pilot of this single engine piper plane reported control problems shortly after takeoff from the livermore air. that perp was the openly person on board that we know of. neighbors noticed a weird sound coming from the plane moments before it crashed. >> felt it and heard it and actually heard the airplane's engine die and then silence and then the crash. >> at this point, we're unable to identify the pilot completely. the plane is burned beyond recognition. we can't find a tail number. we're working on that right now. >> reporter: investigators says this plane crash in the same area where another plane crashed about nine months ago,

that plane also experienced mechanical issues. it typically takes months for the ntsb to come up with a probable cause for accidents like these. live from livermore, i'm tara moriarty back to you. >> thank you. 7:05. a wanted parolee is back in custody after a wild police chase in san francisco last night. [ sirens ] >> the chase ended in a crash involving several vehicles at fifth and mission around 5:30 last night. police officers had a struggle getting the suspect out of the car. investigators say the chase started during a parole check in the bayview district. the suspect sped off striking a parole agent who was not seriously hurt. one witness said he saw the suspect's car at fifth and howard driving on the rims before he got caught in rush hour traffic. >> originally i saw it, i thought the car was going fast. and then it rounded the corner

like a bat out of hell and then you see cars getting hit and you hear the commotion. you could smell the fumes from the carriage on the ground. >> the suspect was taken to a hospital. so was another woman injured in a crash. her injuries did not appear to be serious. we're learning more about the suspect accused in a bold heist at a car dealership in san francisco. it's a story we brought you as breaking news yesterday morning. police identified the suspect as 37-year-old peter doron of san francisco. he's accused of stealing $100,000 bmw from a dealership on howard street. he drove it right through a huge plate glass window. he hit a parked car and mason. he took off. he was arrested an hour later during a domestic dispute with a woman at a different location. we're seeing a string of reports that united airlines is experiencing delays across the country due to a computer problem. this is a live picture from san

francisco international airport. an official there tells us there was a computer glitch that affected united's flight plans and it was just resolved in the last half-hour. there are reports that the faa grounded all united flights for a brief time. some passengers are saying their flights have been significantly delayed. we're told nights are taking off from sfo. no delays are or the reported at -- are reported at mineta. in the last 30 minutes, a bomb threat was determined received but they determined it was not credible. they searched a plane in philadelphia after it received a bomb threat. 88 passengers and five crew members were on that flight that left san diego last night. passengers were taken off the plane, the plane was searched. police say the search turned up no sign of explosives. there have been several bomb

threats recently against airlines but none of them have turned out to be anything. the head of the transportation security administration has now been reassigned. after a new report came out showing airport security screeners did not detect fake explosives and banned weapons 95% of the time. undercover agents were able to smuggle banned items through tsa checkpoints around the country in 67 out of 70 attempts. travelers hearing about the report say it makes them nervous about flying. >> it would be nice to know it's more secure, not just anybody can get on there. >> feel very scared on that. only because it's not just me. it's the whole plane. >> in response to the report, homeland security jay johnson has ordered the tsa to revise airport security procedures, restrain their officers, and retest the screening equipment

in airports all over the country. there is a push to crash dowk on copper thieves. you might remember in 2011, thieves stole copper from b.a.r.t.'s rail system in oakland, san francisco and along the peninsula. and just last week, new york city had 500 feet of copper stripped from its rails in the middle of the night. that forced the shutdown of the city's biggest subway line impacting about 100,000 commuters. new york's senator charles schumer is proposing legislation that would require people to prove the copper they are selling is their own. well, police in martinez want your help this morning. they are trying to capture two gunmen who robbed a subway sandwich shop. it happened last night at 7:30 at the subway on center avenue. here is the surveillance video martinez police posted on their facebook page. take a look. you should see two men in dark clothing walk into the store go up to the counter, they pull out a gun. one of the men demands money

continue. 7:25. happening today, federal transportation officials will face some pretty tough questions about train safety after last month's deadly amtrak crash in philadelphia. the hearing will focus on why technology to automatically slow down the train was not in place. that train derailed. it was going 106 miles an hour on a curve that has a 50-mile- an-hour speed limit. eight passengers were killed. about 200 others were hurt. investigators still trying to figure out what caused the crash. but there are reports they may be focusing on human error. we're now learning that the u.s. military sent sample of live anthrax to three laboratories in canada. this is part of the same batch of live anthrax spores mistakenly spent from an army lab in utah. the number of labs known to have received the samples, it's grown to at least 28 in 12 states and three countries.

south korea, australia and now canada. the lab at stanford university received one of the vials. so far, no reports of anyone surfing adverse effects from the anthrax. a neighborhood said it was simply taking action to save lives but the mayor said what they did was illegal. up next, the controversy surrounding speed bumps installed after a deadly hit and run. >> reporter: a frightening morning for a group of people in the south bay who escaped a house fire. we'll tell you what is happening now and how it is affecting traffic. we have slow traffic now in san jose along northbound 101. new crash in sunnyvale and traffic all of a sudden, not doing very well at all. the weather is doing okay. there is a lot of low cloud around. some fog, not as much as yesterday. so temperatures warming up or staying on the cool side. we'll have the answer -- coming up.

here he is mr. sal castanedo with an update on the traffic. >> thank you. we're looking at slow traffic in the south bay also looking at it in the east bay. it is better in general than yesterday but still plenty of slow traffic out there. we'll start off with northbound 101. it's very slow in pockets from the capitol expressway into sunnyvale. we do have a crash in sunnyvale on westbound 237 at mathilda. i can bring a map to show you the area. westbound 237 is going to be slower than it normally is heading out to the mountain view area because of that wreck. 280 and 85 are more normal. it's a little bit slow approaching highway 17. and then you look at the peninsula. traffic will be will be moderate heavily on highway 101. 280 is a better bet. let's go to a live picture. this time of the bay bridge toll plaza, it's about 25, 30 minutes' delay. it's moderate on the bridge. no problems leaving san francisco for oakland today unlike yesterday.

there's no roadwork and the traffic looks okay. this is highway 4 coming up to the baypoint area. it looks okay. lone tree way at the bypass at the intersection, there is an injury accident they are working on there. back to the desk. >> thank you, sal. it's been a scary and sad couple hours for people living in a south bay home that caught fire early this morning. cute fox 2's janine de la vega is at the two-story house and the people, they got out okay but everything they own is gone, right? >> reporter: dave, about 45 minutes ago, police opened up one lane of traffic here on highway 9. this is a heavily used road but firefighters still need to be here because the house is still smoldering. i want to take you over here closer to where you can still see some of the fire victims here who are being helped by the red cross. firefighters are gonna stay here on scene. they are gonna be watching this house all day.

fire started at 2:30 in the morning when everyone was sleeping. a group of friends live in the home that we are told is more than 100 years old. they woke up to smoke and they escaped. firefighters started attacking the flames from the outside. the roof partially collapsed after two hours. they had it contained. residents are being helped. they are being put in hotels by the red cross. they are still in shock. >> everything i own is in that house. i'm just -- i'm hoping for the best that we get to save a couple of things and the fire was put out before it really attacked downstairs. most of us, this is all we own. >> reporter: fire officials say the fire started on the second floor. residents say there was an artist studio upstairs where a lot of paint and materials were kept arson investigators are interviewing the residents to learn more about what may have caused the fire. at this interpo, it's too early to tell -- at this point, it's

too early to tell. it's possible for the next several hours that highway 9 right here is still gonna be one lane of traffic where they hold traffic on one side, let, you know -- let northbound go and hold the other side and let southbound go. that's the situation out here. dave? >> all right, janine de la vega, thank you. 7:35. a federal lawsuit has been filed in the case of a 3-year- old girl who was beaten to death in name. the girl's mother sara krueger and her boyfriend ryan warner they were arrested in this kate. family members filed a lawsuit claiming napa officials along with the city, the police department and child welfare failed to report child abuse. the child's grandmother reported several times that her granddaughter was not being fed or cared for and was possibly abused. a worker at a daycare center in pleasanton has been

arrested on charges of sexually abusing a former student. pleasanton police released a picture of the suspect. he's 22-year-old alexander kurtz. police say he molested a 13- year-old girl in november of last year. the leaked assault was at the -- alleged assault was at the building kids daycare sent r where kurtz was supervising an event. the former student returned for some reason. the daycare owner said kurtz was working there for three years and cleared all pack ground checks. police say he has no prior record. a deadly hawt accident in antioch prompted people in one neighborhood to take some action to make their community safer but this morning, the speed bumps out there that they installed to slow down traffic they've been removed. ktvu fox 2's paul chambers joining us live. you've been in antioch since we went on the air at 4:00 this morning. what's happening out there, paul? >> reporter: i will tell you, as you said, the speed bumps have been removed. people are signing petitions to

get them reinstalled. there's black marking right now. that's where it said slow. a little bit above that, that's where the speed bumps were installed. they were all over hee because we can see there's a makeshift memorial still right here for 47-year-old man killed last month. >> it's scary. we all have kids around here. unfortunately, it was a grown man that got killed and a good friend, neighbor and that's -- it's uncalled for. >> reporter: that was kip stevens. he gave us this picture which shows crews cleaning up after the speed bumps were moved. timothy hudson was hit and killed outside of his home. a 19-year-old driver was doing doughnuts on the street when he hit hudson later dragging him under his car before speeding off. police later arrested the teen who could be macing vehicular manslaughter and felony hit-and- run charges. hudson's mother told city council members that speeding drivers were a problem well

before her son's death. she plans to install the bumps herself in the hopes of preventing another tragedy. before she had a chance to do so the bumps were installed by a small group of men friday afternoon. yesterday, the bumps moved while hudson was being laid to arrest. neighbors -- >> pretty shameless. kind of low. the city didn't have to pay for nothing out here. >> reporter: now, according to the times, the mayor says whoever installed the speed bumps probably had a contin jens but it created a liability -- contin jens but it created a liability. neighbors say this is a dangerous situation. a tragedy has already happened and they want to prevent anything from happening in the future. >> what an interesting story. all right. thank you, paul.

7:38. the fbi according to a new report is operating a small air force with low flying planes all across the country, carrying high-tech surveillance video. that's according to the associated press. report says in a recent 30-day period, they found that the fbi flew more than 100 surveillance flights over 11 states. the fbi says the program is not secret and that the flights are for ongoing investigations. but the a.p. says the government has gone to great lengths to conceal the fact that it owns the planes and has registered them to at least 13 fake companies. happening today, the u.s. senate is due to vote on a replacement bill for the patriot act. that bill before the senate today is known as the usa freedom act. it would phase out the bulk collection of american phone records by the national security agency. the senate failed to act on the bill during a session on sunday. mainly because of maneuvering by senator rand paul who is a

republican presidential candidate. also happening today, the head of the internal revenue service is on capitol hill to answer cybersecurity questions from congress. senators are asking why the irs did not fix security flaws that it knew about. government watchdogs had warned the irs about security weaknesses in its computer systems years ago with more warnings as recently as in march. last week, the irs announced that personal information of more than 100,000 tax payers had been stolen from an irs website. a san francisco board of supervisors committee has given initial approval to three proposed laws aimed at reducing sales and consumption of soda in the city. one proposal would prohibit spending any city money on buying sugar filled drinks. another would ban soda ads on city owned property including muni buses and pus stops. a third would would many date

warnings that soft drinks can lead to diabetes and tooth decay and obesity. the board will vote next week. california-based foster farms is moving away from antibiotics in its poultry products. it's already eliminated those considered critical in fighting infixes in humans. the u.s. of antibiotics is believed to be those that sicken british experts are recommending that office workers stand for at least two hours every day working up to four hours a day. researchers say the hazards of sitting are comparable to those of smoking due to the risk of heart problems and cancer. there's a new campaign called get britain standing. organizers are trying to get more people to walk while on

the phone at work to stand during meetings or to have access to desks where you can stand. the campaign is spreading to other countries including the u.s. 7:41. federal investigators are beginning to comb through the wreckage of a deadly plane crash in livermore. in 23 minutes, what eyewitnesses saw just before the small plane went down and what firefighters found at the scene. but next a backlash over a new perk for california politicians. the service providing a free ride home to state lawmakers who may be too drunk to drive.

muslim woman denied a job because of her headscarf won the support of the u.s. supreme court. abercrombie & fitch was the company. the high court ruled 8-1 that the company violated the civil rights act. the decision sindz the case back to appeals court for further consideration. 7:4 a. a new perk for california state senators is attracting criticism even from one of the lawmakers who would benefit. ktvu fox 2's pam cook in the studio now with this new program and why some say it's a big waste of tax payers' money. >> yeah, they argue it's basically a designated driver for drunk senators.

"mornings on 2." tori and dave? >> thank you. 7:46. want to check in with sal. see how things are moving. what's it like at the bay bridge toll plaza? >> slow, tori, and dave. it's slow getting into san francisco. we don't have that backup we had yesterday getting out of it which is good. reverse commute that's caught a lot of people by surprise. you will be happy to know it's not there but getting into the city is a little bit slow. we have a 15, 20-minute delay at the toll plaza which is not bad considering. we haven't had any issues there. let's go to interstate 880 northbound and southbound, you will see the traffic is going to be busy as you drive northbound. it's getting slower passing the coliseum and then getting over to the high street exit and going up beyond to downtown oakland. i will tell you what's not doing that well is northbound 101 in san jose. it's backed up from the yerba buena exit. it slows to mountain view. they were clearing an accident at mathilda.

northbound 208 backed up. this is not a great commute today. but at least we don't have any major incidents on the roads. 7:47. let's go to steve in the weather center. all right, sal. we have a lot of low clouds in place. not as much as yesterday. there are some breaks from san francisco, oakland to the bay. some to the north -- some breaks to the north. it will burn off sooner. not anything close to yesterday. that system has moved well to the north. yesterday santa rosa was only 71. today we'll go 78. livermore did make it to 77. that's below average today. just bumped up up 1. 78 concord, 7 a. today up 4 to 79. san jose, 75 yesterday. again, just 1 degree warmer at 76. still plenty of low clouds around just not the coverage we had yesterday. the system there, you can see kind of like right there just rotating around. that enhanced that marine deck. gave us the light rain drizzle.

a few high clouds, high pressure -- weak high pressure noses in. 49 santa rosa. yet 59 walnut creek. low 60s livermore, san jose is close. sfo is 56. half moon bay, 58. half moon bay is a 6. a little bit of a westerly breeze or swerlbry breeze in -- southwesterly breeze in place. bodega bay, 51. south of that, san mateo, santa cruz coast, 57 to monterey's 59. we'll see if those warm up or cool down. the key will be if they warm up, it will be like last june, then ze stayed there for about a -- they stayed there for about a year. one low moves out. we'll get a break for a few days. another low will drop in. head down to southern california and then might tap in the remains of what looks to be tropical storm blanca but probably a hurricane. a lot of moisture coming up moving up towards baja. that will play into the weather the next 72, 96 hours and that low may tap into the moisture. if you are heading up to the seer, there is our low troping

oakland police want to find the driver responsible for a deadly hit and run. 47-year-old royce von was killed at -- at 11:00 friday night on 28th street near san pablo avenue. investigators say he was probably at a nearby bar or restaurant. they are hoping someone who saw him before his death can shed some light on what happened out there. now, police say the vehicle involved is a white 2013 toyota fj cruiser. this photo is a tan version of that model. if you have any information, call oakland police. well, people in santa rosa's fountain grove neighborhood are angry that a new $4 million firehouse has not been allowed to open. building inspectors say the reason is the fire station doesn't meet the standards of the americans with disabilities act. some of the problems are the kitchen counters are too high and doors that don't open wide enough for a wheelchair. now, neighbors say they live in

a high danger area for wildfires. they were counting on that fire station being open to help protect their homes. the city has fire hired a consultant to look at the problem and come up with some answers and solutions. it's also looking into why the fire station was not built to meet the standards of the americans with disabilities act in the first place. the nba says it will investigate the league's concussion protocol following two high-profile head injuries to the warriors' top stars. steph curry slammed his head hard against the floor in game 4 and in game 5, klay tomorrowson suffered a -- thompson suffered a concussion. he was cleared to practice yesterday and was checked out by a trainer every 15 minutes. if he remains sim tom-free he can play on thursday. the nba averaged about 13 concussions a season over the past four years which is far

found out about the pilot. stay tuned. good morning. welcome back to "mornings on 2." it's tuesday, junend. i'm dave clark. >> i'm tori campbell. want to check on weather and traffic with steve. actually see some sunshine out there this morning. >> a little bit more today than yesterday. foes shor sure. when -- that's for sure. it will burn off sooner today. temperatures look to be near average. especially coast and bay running above. the water temps have warm up off the coast. their lows are not as cold. a little cooler, though, off the north bay. but already a lot of sun out there. a 5 san francisco to start. we'll go 68 for a high. what's normal 65 degrees. oakland downtown, starting off with low clouds as well. a few clouds already. we'll go 71 slightly above average. and san jose running a little bit below average. high today is 76, east san jose around 78 or 79 degrees but these are close to where they should be. the system yesterday is already to the north. that's allowing high pressure to build in. santa rosa went from 49 to 56. they are warming up quick.

already low 60s. fairfield is in there. concord, livermore, san jose. mountain view, sfo at 60. it's kind of a mild start here. low clouds, burning off sooner, then sunny, mild, warm. we'll get a sea breeze here nothing outrageous or crazy. upper 70s or 80s. 60s or 70s by the water. we had the problem on vasco road involve, that's solved. what else is going on. let's take a look at slow traffic in the east bay. on the commute. the eastshore freeway from the carquinez bridge to the macarthur maze, 33 minutes. yesterday it was almost an hour. i think some of the wet weather really slowed things down. today when you get to the bay bridge tacoma, you will see some slow traffic especially to the far right-side. it's about a 20, 25-minute slowdown before you make it on the bridge. some slow traffic on 680 as you drive from concord to walnut creek. you see slow traffic here and making the turn down into

danville. again, slow traffic area. highway 24 still slow coming over the hill to concord. 580 is slowing down as you drive from livermore to dublin. 680 looks okay out of pleasanton. 8:02. back to the desk. >> thank you. ntsb investigators are now combing through the wreckage of a plane crash in livermore. ktvu fox 2 reporter tara moriarty is live with the new information we're learning about the pilot. good morning, tara. >> reporter: well, good morning. we have learned that the pilot is a 74-year-old man from pleasanton. they are not releasing his name just yet. his body was removed here by the coroner about a half an hour ago. as you take a look behind me. you can see the field where the plane crashed. we know investigators are gonna be using evidence in this field combined with eyewitness reports to figure out exactly what went wrong. here is a photo from the scene posted by jessica rose of livermore. when firefighters arrived at the crash site, they found the plane crashed and was engulfed

in flames. the pilot was killed. here is a look at skyfox. investigators say the pilot reported control problems shortly after takeoff from the livermore airport. that person was the only person on board that we know of. neighbors noticed a weird sound coming from the plane moments before it crashed. >> there are witnesses who did report the airplane going down at a high rate of speed and there was a considerable impact and subsequent fire. we are talking to those people and i'm sure the federal authorities will be talking to them as well. >> somebody crashed here nine months ago to the left of where this accident happened in this field. >> reporter: investigators say that plane experienced mechanical issues as well. now, it typically take months for the ntsb to come up with a problem cause for -- probable cause for accidents so it could be some time before we figure

out what happened here in this field. live in livermore, tara moriarty, back now. >> it looks like a large area. thank you. 8:04. now to breaking news we've been following for about an hour. >> we've been following this for just over an hour. united airlines says a computer problem forced the faa to ground all of united's flights nationwide for a brief time this morning. want to show you a live picture from san francisco international airport. an official there says the computer glitch affected united flight dispatch system starting at 6:00 a.m. pacific time. one passenger is telling us his flight was delayed at least an hour but we're told the problem is resolved and united flights are now taking off from snowe. the head of the transportation security administration has been reassigned. this after a damaging report showed the screeners failed to detect fake bombs and banned weapons 95 where is of the time

-- 95% of the time. alex savidge is live at snowe to tell us how -- sfo to tell us how passengers are reacting to the news. >> reporter: good morning. if you can well imagine, travelers concerned after hearing about this report. this was an internal investigation done by the tsa. it found major security failures at airports all across the country. what's unclear is if there are any lapses in particular here at sfo. but undercover agents were able to smuggle prohibited items, things like fake explosives and weapons through checkpoints in 67 out of 70 attempts. these investigators are what's known as a red team and their goal was to test the effectiveness of airport security. in one case an undercover agent with a fake bomb strapped to his back set off a machine but in a subsequent patdown, the screener failed to find the device. passengers say it's difficult

to understand but it won't stop them from flying. >> i don't think you can have perfect security without it coming at a huge cost. i think we just take a risk. i think the government is working a lot of other ways to stop terror and i think that the tsa is one aspect of that. >> reporter: now, in response to this report, homeland security secretary jay johnson has ordered the tsa to revise airport security procedures, retrain officers and retest security equipment at airports nationwide. now, last year about $7 billion was uth abouted for the tsa. lawmakers in washington, d.c. will be -- was budgeted for law if. lawmakers in washington, d.c. will be studying this. most terror plots are foiled by good intelligence as opposed to

the patdowns. so something to bear in mind. all right. thank you. le it. a wanted parolee is back in custody after a wild police chase in san francisco. [ sirens ] >> the chase ended in a crash involving several vehicles at fifth and mission around 5:30 last night. police officers had a struggle getting the suspect out of the car. investigators say the chase started during a parole check in the bayview district. the suspect sped off,ic strooing the parole agent not seriously hurt. one witness told us he saw the suspect's car at fifth and howard driving on the rims before the suspect got trapped in rush hour traffic. >> originally when i saw it, i thought the car was going fast and it rounded the corner. all of a sudden, you start to see cars getting hit and you hear the commotion and you can smell the fumes from the carriage on the ground. >> the suspect was taken to the hospital. so was another woman who was injured in the crash.

her injuries did not appear to be serious. we're learning more about the suspect accused in a bold heist at a car dealership in san francisco. it's a story we brought to you as breaking news yesterday on "mornings on 2." police identified the suspect as 37-year-old peter doron of san francisco. he's accused of stealing $100,000 bmw from a dealership on howard street. he drove it right through a huge plate glass window. he later hit a parked car at mason and post streets. police say he took off but was arrested an hour later during a domestic dispute with a woman at a different location. there is a push to exrak down on copper thieves targeting commuter railways. back in 2011, thieves stole copper from b.a.r.t.'s rail system in oakland, san francisco and along the peninsula. and then just last week, new york city had it 500 feet of copper stripped from the rails in the middle of the night. that forced the shut down of the city's biggest subway line.

it affected about 100,000 commuters. new york city charles schumer is proposing legislation that would require people to prove that any copper they are telling is their own. 8:09. new research finds that the millennial generation is getting the bulk of its political news from facebook. more than 60% of those in their early 30s and under get most of their political news on the social media site. that's raising questions about how facebook's news feed ail go richts -- algorithms work. snoor five people very lucky. any escaped a fire at a home in the south bay. coming up in 20 minutes what any say woke them up in time to get pay way from those -- to get away from the flames.

the husband of the woman who brought nationwide attention to the right to die movement is in the bay area. britney mainard was diagnosed with a brain tumor in 2013 and given only months to live. after searching her condition, an oregon's death with dignity law, she and her family moved from alamo to oregon to control her dying process. maynard died last year surrounded by friends and family. now her husband has moved back to alamo and is speaking on behalf on the right to die movement. the california senate will vote on the issue sometime this week. five states, oregon, washington, new mexico, montana and vermont have right to tie laws in -- die laws in place. seismologists are trying to fix a software problem that gave them false alerts about

earthquakes in california over the wskd they say earth sensors in northern california read energy waves from deep earthquakes in alaska and japan and mistakenly identified them as local earthquakes near willits and san simiyon they issued alerts to help emergency responders. they were quickly deleted and the usgs is investigating the problem. >> these earthquakes are on an automatic processing system. >> they say that software is being tweaked now to help make the system more reliable. >> the city of menlo park may consider changing the police camera policy when they meet at the city council tonight. the change would make it possible for people to have videorecordings of themselves deleted. right now the policy requires the police department to keep all video for at least two and a half years. a city councilman and the

police chief they've worked out a compromise that would allow people to request video to be deleted if that video has no investigative relevance and if they are willing to sign a legal waiver. this morning people crossing streets in one south bay neighborhood may be wondering what happened to the popular crossing flags. the organizer of the pedestrian safety flag program in the willow glen neighborhood said seven of eight canisters used to hold brightly colored flags disappeared from utility poles sometime between sunday night and yesterday morning. for more than two years, the flags have been helping people safely cross busy lincoln avenue. the woman responsible for them says they work. >> so yeah, you feel dorky but i've driven down the treat a hundred times at least and you can't see people. with the bright, orange flag, you can seal them. so dorky or not, i don't want to be in the hospital. >> holly says she doesn't know

if it was a prank or somebody being mean-spirited. she's looking into replace the flags which cost about $3 each. >> it seems simple but -- >> i've been in this one town up in washington where any do have them. you feel strange doing it but you would rather look dorky but stay out of the hospital for sure. >> yes. 8:17. let's check in with sal. you taking care of the folks on 880? >> it's a little slow, dave and tori getting up to the jack london square area. northbound 880 at 5th. we go to the picture and see that northbound 88 on the right- hand side of your screen is slowing down past the coliseum. this is not as bad as i've seen it. it's still slow on the way upper that. 580 westbound is moderate as you drive to the lakeshore curve and over to 980. let's take a look at some of the other commutes in the east bay. the bay bridge you will see the traffic is backed up from the maze to the metering rights.

10, 15, maybe 20 minutes. things are getting betterrer. you can tell by looking at the approach from 880. that's beginning to clear out. when that starts, usually the rest of it is soon to follow. from 880 south from 92 to hayward and fremont, you will see traffic heading down to the south bay. right now, 880 is just moderate. 8:18. let's go to steve in the weather center. a lot of low clouds in place. plenty of breaks. a drizzle yesterday. the light rain. nothing like that compared to yesterday like we had. today, it's just kind of a combination of some fog. low crowds and plenty of breaks. few high clouds in there. but overall, it looks like a better day. system that gave us that light rain yesterday is up here. up yonder. but another low is set to move in on thursday as the pattern continues. you can see the weak high pressure nosing in. but the next system moving in will be here again on thursday

and may linger in the weekend. 50s on the temps of we did have upper 40s for santa rosa. i don't think livermore got below 6 or or 61 and san jose around 59, 60 all morning long. temperature change from 4 hours ago is not that extreme. at one time it was, 7, 8 degrees. now everyone is leveled off in the 8:00 hour. not much of a difference, west, west, west at 12. we get the onshore breeze. that's in plate. water temps have -- that's in place. water temps have warmed up. 57, 59 bodega bay north cold. that's something to watch. monterey is already 59. water temp is 59. system is moving out. we get two days of weak high pressure and then the next system drops in and then we'll have to keep an eye on it for maybe moisture from what will probably be hurricane blanca moving up towards baja. as it moves north, it falls apart. some of that moisture -- the low looks like it will end up

around l.a. or santa barbara. that's it right there coming in. we'll get drizzle on thursday. it goes south. here comes the moisture up towards southern california. the sierra will be dealing with thunderstorms. aim for northern california. it looks close for us. >> i think starting friday. it will be a close call here. i think especially on sunday. there will be plenty going on up in the mountains. be advised. there will be a lot of rain down the four corners. but a lot of has to come together. but there are already signs that that might happen. low clouds, fog, then sunny and warm here. afternoon breeze. it's a westerly breeze. temperatures near normal average to slightly above. 60s, 70s and low 80s. no sign of any big warmup. that's for sure. 60s, 70s, coast and bay and then upper 70s, low 80s inland. the temperatures are near where they should be. a little bit above for coast and bay. they should be 65 for san francisco. we'll go 68. 70s on the peninsula, including redwood city. low clouds back on wednesday

-- i lost it for about a week. >> morgan had a difficult time talking about the loss of his friend, jimmy mcnair and the night a walmart big rig hit their limo last june. he and two other friends were serious inalreadied. walmart reached a confidential settlement with morgan last week. he says even though the days is over, the pain of the crash will never go away. he said he would like to get back to comedy but for now he wants to toe cussed on feeling -- to focus on healing. there will be questions on technology about slowing down the train in philadelphia noes in place before that crash. investigators say that train was going 106 miles an hour on a curve that has a 50-mile-an- hour speed limit when it jumped the tracks. eight passengers were killed, about 200 others were hurt.

was south, south, southeast. so today, even with a little bit of sun. probably be kieler. a lot of cloud cover over us. highs today, 60s, 70s and a few low 80s. sal? i know you have the usual stuff. anything new? no. just the usual slowdowns and some areas are getting better. some areas are getting worse. but for the most part, a general better commute than yesterday. as you come up on the bay bridge toll plaza, we have improvement here, especially if you are driving in on 880 approach. that would be the best approach, the one i would use getting over to the toll plaza. then you can get onto the bridge with less delay than other lanes. also looking at 880, we see slow traffic coming in from san leandro. it stays that way. we had an earlier accident northbound 880 at fifth.

that's been cleared out. talk about the san jose commute in the santa clara valley. it has not been great. we have very slow traffic from the capitol expressway all the way up to mountain view. one solid line of traffic. 280 is getting better. so is 85 but if you can put this commute off and hang out for a little longer. these things tend to get better barring any major crashes in the valley. back to the desk. >> thank you. we're on the scene of still developing news in the south bay. an early-morning fire destroyed a home shared by five friends and they've lost everything they own. janine de la vega is live at the home and you just talked to the arson investigator. what did you find out? >> reporter: dave, the arson investigator has not been able to go into the house because the second floor collapsed. it's not safe for him to enter. but he's been talking to the people who used to live here. now, the house is located right here on highway 9 which is also

known as los gatos/saratoga road. this whole area was shut down to traffic. they opened up one lane and in the past hour, they've now opened two lanes of traffic here. it's still slow going for all of people who use this to avoid 280 to get to mountain view. the fire started at 2:30 in the morning when everything was sleeping. a group of friends live in the home that we are ally told is more than 100 years old. they woke up to the smell of smoke and crackling and popping noises. they were able to escape. firefighters starting attacking the flames from the outside. the roof collapsed. they had this fire contained. the residence are being hended by the red cross -- are being helped by the red cross. they are uninjured but say two cats are missing. >> like in shock. everybody got out. human life is more important. hopefully i find my cat. >> i panicked. i didn't even grab my purse. i just -- i had no idea what was going on.

get everyone out of the house as soon as possible. fire officials say the fire started on the second floor but no one was on the floor at the time. the investigator said because of the collapse, he may not be able to determine how the fire started but he told us preliminarily he believes the cause may be electrical. the house was built in the early 1900s has not been remodeled. firefighters are expected to be here for most of the day just keeping an eye on it to make sure nothing sparks back up. dave? >> all right. thank you. 8:35. a federal haught has opinion filed in the case of a 3-year- old girl who was peaten to death in -- beaten to death in napa. the girl's mare, sara kruegerndary her boyfriend, ryan warner, were arrested in the case. family members filed a federal lawsuit. they same napa officials along with the city, the police department and child welfare services failed to fully investigate reports of child abuse. the child's grandmother said

she sold authorities several times her granddaughter wasn't be fed or cared for and was possibly abused. a worker at a daycare center in pleasanton has been arrested on charges of sexually abusing a former student. pleasanton police released a photo of the suspect identified as 22-year-old alexander kurtz. police say kurtz molested a 13- year-old girl in november of last year. the alleged assault happened at the building kids daycare center. kurtz was supervising an event there. the 13-year-old returned for some reason. she told her mother who went to the police. the owner of the daycare center saw the arrest. >> we were here in a meeting. we saw him being arrested. we rushed out and the detectives told us he's being taken to the jail and will not be coming back to work and i should let the parents know. >> now, kurtz was fired. the owner of the daycare center

said he had been working there for three years and cleared all background checks. police say he had no prior record. police in martinez need your help to capture the two gunmen who robbed the subway sandwich shop. it happened around 7:30 at the subway on center avenue. martinez police posted this surveillance video on their facebook page. it shows two men in dark clothes walk into the store up to the counter and pull out a gun. one of the men demands money at the register while the other walks into the back of the store to get more money. 0 both men were seen leashing in a silver colored four-er to honda civic heading towards highway 4. if you have any information, call police. new this morning, president obama is awarding the medal of honor to two world war 1 soldiers. the they will be honored. you can see the ceremony is taking place right now.

people who pushed for the medal to be awarded to these men say because one was jewish and one was african-american, they were never properly honored for their actions during their life times. there are the photos of the men being honored. this is a tremendous honor of receiving the medal of honor. president obama is presenting them -- presenting it to them and -- it's history. and it's something that's nice to watch. we wanted to take you live to the white house to watch it as it happens. you see the president holding the awards here and presenting it posthumously. >> very nice thing for their families to have. >> many years later. a deadly hit-and-run accident in antioch prompted people in one neighborhood to take action to make their community safer but now the speed bumps they installed to slow down traffic have been

planned to install the bumps herself to avoid another tragedy. before she had a chance to do so, the bumps were installed by a small group of men friday afternoon. one of the men said he talked about it the day before his death. >> he said one of these days something is gonna get -- somebody is gonna get killed. i didn't think it would be him. >> reporter: yad the bumps are removed while hudson -- yesterday, the bumps were removed while hudson was being laid to rest. residents out here say they want to get the mayor out the office because of the speed bumps. they have another petition to reinstall speed bumps because they don't want to see another tragedy happen out here.

when we're out here, quite a few cars were speeding through this area like it was just the highway. luckily, the neighbors have come out and asked people to slow down. >> certainly a problem. thank you. 8:40. a san francisco board of supervisors committee has given initial approval to three proposed laws all aimed at reducing sales and consumption of soda in the city. one proposal would prohibit spending any city money on buying sugar filled drinks. another would ban ads on muni buses and bus stops. a third would mandate warnings that soft drinks can lead to obesity, diabetes and tooth decay. the beverage industry says they are being unfairly singled out. california-based foster farms says it is moving away from antibiotics in its poultry products. it has already eliminated antibiotics that are considered critical to fighting infections in humans. it plans to do away with most
