cool. >> reporter: officials issued a heat advisory. >> we just had ice cream. >> reporter: the kelly cup officials would not open till a third day in a row of extreme heat. [ singing ] she wrote this for today. [ singing ] >> reporter: tinder dry brush and garage and dry winds have firefighter -- grass and dry winds have firefighters on alert. >> fires could ignite easily and spread quickly. >> reporter: on the hottest day of the year, one family is filling in their swimming pool with dirt. they said they had it with the drought and the $400 a month expense. >> 31,000 gallons hard to heat. it was 12 feet deep. >> reporter: and it looked like

this. a stretch of cool water but he says it did leak. they are just the latest in a rising trend. replacing costly pools with drought tolerant back yards. >> we won't miss it today. i won't miss it in the pocket book. >> reporter: he says that it is costly, $15,000 or more maybe to remove a swimming pool but he can get his money back in 2- 3 years. >> hot work out there. thank you. today's heat was a factor in the emergency road work that caused a traffic jam on the san rafael richmond bridge. part of the pavement began to buckle. it was degraded by a diesel spill. two lanes were closet at 9:30 a.m. this morning and didn't reopen till 4:00 p.m.

traffic backed up. download the ktvu weather app for the latest on the heat. it is available for download. new developments now in a police shooting in the east bay that left a man dead. tonight we are hearing from the man's children for the first time. >> i want my dood know that i love him. i want him to watch over me. . >> that shooting on saturday was the first deadly police shooting since 2013. tonight the family of the man killed say officers didn't have to shoot. ktvu's cristina rendon spoke with the man's children today. heart breaking scene. >> reporter: it is very heart breaking. today we learned he had three young children. two of them and their mother spoke with us. they have a lot of questions about why an officer pulled the trigger if he had already been tased. >> reporter: in the past 72

hours they have had their world turned upside down. >> my dad was a very nice guy. >> he tried to do everything he could for us and try to provide for us when he could. >> reporter: their father was the man killed by an oakland police officer saturday morning. he was found unresponsive in a car parked on highway 5 county they spent an hour -- 580 and they spent an hour trying to wake up. officers busted out a window that lead to a confrontation. an officer tased him and another fired a fatal shot. >> why did the police shoot him? >> they did not have to do that. he was asleep in a car. they could have prevented that. >> reporter: a witness says he did struggle with officers. police also say a loaded gun

was found in his car with a magazine clip. his mom says if anything the gun was for protection in oakland. >> he was a father. he did everything he had to do. >> they say the hardest part is not having an answer for their children as to why their father is gone. an answer they want from police. >> why did you do that? would you like to explain this to our kids? they are hurting. >> reporter: that explanation can't come soon enough for these children. >> i want my dad to know that i love him. and i want him to watch over me. >> we asked police for details surrounding the confrontation and whether or not he reached for his gun and we requested video from body cameras but our request was denied because that is part of an ongoing

investigation. and now loved ones are asking for the community support. they will hold a vigil friday afternoon. >> i can't get over seeing that little girl and the tears. thank you. police arrested a san jose man following a high-speed chase yesterday. the 33-year-old now faces charges that include drug dealing, driving under the influence and probation violation but not charged for carrying this. looks like a hand gun but police say it is replica pellet gun. judge dismissed a lawsuit brought by rahm -- ray mcdonald. ray mcdonald was never charged but the district attorney's office is still investigating. she was protected because california law shields victims who report what they believe are crimes against them or others even if charges are

never filed. the day apple lovers have been waiting for. people gathered today for the apple world wild developers conference. ktvu's allie rasmus was there for the big announcement and the more basic upgrades users are excited about. >> from the lines around the building to the mad dash to fill the seats it is all part of the anticipation for the apple developers conference. >> the best way to catch up with what is new. >> reporter: no new gadgets but there were announcements. apple music was the big one. they brought out the star power to promote it. drake taking the stage. >> truly amazing to be part of something that i believe in. >> reporter: apple music includes a stream service, 24 hour live radio station and a way to connect via social media. >> gives a lot of new artists

police arrested a man who they say stole a package last

month. the package contained an awning. the homeowner looked on craigslist to see if the theft was selling it. he found and officers arranged to meet the seller and arrested him. the 39-year-old was arrested on suspicion of possession of stolen property. possession of drugs. police say the case highlights the common problem of thieves stealing packages off of porches. the mother of a girl who was killed during a street race says she hopes her daughter's death will make other kids think of what they are doing. the chp is investigating the crash as a potential crime. both drivers could face felony vehicular manslaughter charges. investigatorsneural viewed one of the drivers -- investigators interviewed one of the drivers today. the driver of the car that

struck and killed angelica contreras is just 16-years-old. >> could have been anybody's kid. >> it is unclear if the 16-year- old driver had a license. if he did it was provisional. >> reporter: b.a.r.t. plans to shut down service for two weekends this summer for track ries. the dates are the first weekend in august, and for the labor day weekend saturday to monday. they plan to have a bus bridge to get between oakland and san francisco. they will replace track, and switches. most of which dated back 43 years ago. paying the fine even if you plan to fight it. a practice in california but as of today it is no longer allowed. a new policy went into effect that bans courts from making people pay fines up front if they want to appeal. >> rob roth explains, many found the old policy was

unfair. >> reporter: at the traffic violations window there was no shortage of people with tickets. >> i have $4,000 in fines. i make $12 an hour and i have a child. >> reporter: a new policy went into effect throughout california. they banned traffic courts from forcing people to pay fines up front when they plan to fight the ticket. many say it effects low income people who can't always pay the fines at once. >> you are innocent till you are proving guilty? i am going to go old school on that. >> tiny step. >> reporter: she is an attorney in berkeley. >> people who have enough money can pay for getting a hearing and in many places people who don't have the money can't get a hearing. >> the new rule will only effect marin county and rural

counties because most traffic courts don't require up front pavements from people contesting their tickets. but a person must show up for their court dates. the policy doesn't go far enough, the state needs to help the driver whose have had their licenses revoked for failing to pay fines or missing a court appearance. >> if they want community service, want to make a pavement plan, they want to work something out, they can't do that. >> reporter: for now the state is taking this first step. rob roth, ktvu fox 2 news. jackie speier is bringing attention to the importance of service dogs for veterans battling posttraumatic stress

disorder. she appeared this morning. right nowtoday they talked about how these dogs can help. >> imagine a veteran who is still troubled by ptsd, imagine him waking up having had a nightmare and reliving a horrific experience and having a dog jump on to the bed and lick his face and calm him down. >> the va is studying the issue but she says it is time recognize a service dog could be a lifesaver for veterans with ptsd. an update on a fundraiser for dogs that help with search and rescue operations. they gave us a demonstration over the weekend. the dog quickly found a person in the truck of a car.

they raised $25,000 from the fundraiser. the money will be used for medical air of search and rescue dogs injured in the line of duty. >> that is something. they are just incredible. our weather is incredible today. so hot inland. hopefully it won't last long. a one day thing -- [ talking at the same time ] >> one shot deal. we had 109-degree record in gilroy today. that is as hot as it gets. 106 livermore valley. looks hot outside. no fog right now. we will come back. at 10:00 p.m. we will have reports of fog along the beaches there. the change will come. these are the highs from today. a bun of cities that were real hot -- bunch of cities that were real hot. it will begin to cool as we head into the evening hours. right now it is hot.

especially inland. i have checked the weren't kinds. we are seeing a brisk wind through sfo. it will be hot and humid tomorrow. tomorrow night temperature comes down 10, 15 degrees. upper 80s, no 90s. humidity brought by hurricane blanca, was a category 4, now it is just a tropical depression. you would think it would spin off this way. it will come up and fill in over the bay area tonight, mid- morning tomorrow, hate tonight you will notice -- late tonight you will notice it. 60 in napa tomorrow morning.
