edington assaulted a man on a sidewalk. he pled no contest in the case and the victim said he knew he had mental health issues. >> reporter: alfonso david edington kept his face down when he went before a judge accused of kidnapping a three- year-old boy from a library on friday. he didn't know the boy and credited an alert driver for the boy's safe return. >> after he did time served and he is let go, my wife and i thought he is going to do some other crazy thing. >> reporter: he knows all about his behavior. >> he was crossing the street and stopped me in the middle. >> reporter: in february he was out getting coffee when out of nowhere he sucker punched him while crash the street --

crossing the street. he accused him of taking his wallet and took off. . >> he seemed off and he seemed confused. very bizarre. there is no crime here. >> reporter: he chased him before police arrested him. he pressed charges hoping he would get help. something he believes the courts didn't take seriously. he pled no contest in that case. serving 5 days in jail. >> that doesn't give him a chance to get the help he needed. it doesn't seem like anybody really said what is going on with this kid. >> reporter: today the da held off on requesting a mental evaluation. i asked why. it is still an ongoing investigation. >> reporter: i asked the district attorney how the case will play a role, he said they happen looking into the old case. alfonso david edington will appear back in court on monday

and if convicted on the kidnapping charge he could face 11 years in state prison. >> azenith smith in san jose, thank you. a section of the s.a.t. examine taken by thousands of students will not be scored because of a printing error. some books mistakenly gave students 25 minutes for one section instead of 20 minutes. it effected 487,000 students who took the exam on saturday as i stated, june 6. the college board it will provide reliable scores using other sections of the test. california still running dry. more than a year since governor jerry brown approved emergency spending meant to address the drought. but a new analysis found half of the $687 million has been

spent. according to the -- just a second. my apologies. only $300,000 has been spent out of 20 million set aside for projects. only 11 million has been spent out of the 21 million for housing assistance for disabled farm workers. and only 221 million spent out of the 472 million for local water infrastructure projects. however the state says there have been several success stories including drip irrigation in farm fields and new wells in los angeles. officials are also defending the pace of the spending. they want to make sure the money is used wisely. some infrastructure projects are also on hold while local

governments look for additional funding. california rice farmers meant with environmentalists to explain their dilemma during the drought. they are growing less rice this year because they are getting 25% less water. one farmer said he could use the ground water under his land but that draws water away from neighbors. >> when one area uses heavy amounts of water, costs more to pump the water and there is a reduction in the amount you can lift. >> farmers say they are trying to manage the water they have as best they can and like the rest of us they are hoping for rain. on www.ktvu.com our web team created a section that is dedicated to the drought. just look for the california drought link under news. those dry conditions mean high fire danger in the bay area and firefighters say creating defensible space

ktvu fox 2 news. police in the north bay are trying to figure out who set cars on fire at a auto dialership. this video was take -- dealership. this video was taken by firefighters after 11:30 p.m. last night. flames could be seen coming from four new cars. two cars were destroyed. two others damaged. the big question is why would someone do this. >> it could point to someone who has done this before. a customer, employee. not ruling anything out. one thing we know is it is suspicious. >> police say they are working hard to catch whoever is responsible because they worry the arsonist may strike again. a contractor was injured by a loose rock this morning inside an old east bay mine. authorities say it happened about 11:15 a.m. this morning at the black diamonds minds in antioch. work is done regularly to make sure they are safe for the

public and this morning the worker was 200 feet into a mine when he was hit by rock. >> a large rock became dislodged. landed on his chest causing major injuries to his chest area. >> co-workers brought him outside and he was airlifted to the hospital. the last of the minds closed in the 19 40s and the 6,000 acres preserve is part of the east bay regional park district. . spike in temperatures and a squirrel caused power outages yesterday. ktvu's tom vacar looks at pg&e's track record and why one expert says we may face a shortage of electricity. >> reporter: yesterday 75,000 pg&e customers were out of power, half due to heat, and high demand for electricity.

airbnb released a statement today, saying in part the majority of airbnb hosts are regular san franciscans sharing their homes to make ends meet. san francisco supervisors voted this afternoon to require health warning labels on sugary drinks. they say the city is the first in the country to take the step. the goal is to reduce health problems. the labels are go too go on drinks with -- labels are to go on drinks with 25-calories or more and it bans ads on billboards, taxis and buses but not in newspapers or the internet. the california beverage industry issued a statement in reaction today and it reads singling out one industry and one type of product does nothing to educate people about the importance of balancing calories and activity.

school district funding for them has been shaky but it appears that is about to change. thanks to berkeley's soda tax. >> i saw something green in there. i was like what is that? my plants. >> reporter: voters approved measure d a sales tax on sugary drinks. the city is projecting the extra tax will raise $1.2 million over the next year. a panel recommended $250,000 go to the garden program. the city counsel is expected to approve the recommendation tomorrow. the director says the extra money would mean students can spend more time in the garden. >> we are able to provide more opportunities to learn about where their food comes from, the importance of good nutrition. the more better habits we are able to build in. >> funding programs is what

that could produce a thundershower. later in the afternoon, dies out. you see activity up here. in the area. okay? tomorrow afternoon, things clear out. by thursday you see things clear out more. so just a little more of humidity through the afternoon tomorrow and by thursday we start to get rid of the humidity and temperatures rebound. they were big time temperatures yesterday. today we are just 80 antioch. 80 pittsburgh -- pittsburg. 75 fremont. 77 milpitas. as opposed to 100 degrees yesterday. redwood city tomorrow 75. there is a 25-degree drop off there. the five-day forecast, there it is. you can see the clouds stick around wednesday with a chance of a shower and thursday breaks out and we get back into a warmer pattern. the opportunity for perhaps a -- you know, fires, things like that. we will keep you posted.
