his line to get to the clerk. when he did that to get a better shot, he stumbled near the lottery machine and it was the extra seconds that allowed carlos to get out alive. >> [shots]. >> this video shows two men shooting at the clerk on may 19 it 2:40 at the gas station on 8th and harrison. they just robbed the safe and chased after the clerk firing four to five shots. jiminez says he usually works this shift alone, but switched swifts at the last minute. >> what if the guys come back, i don't know. >> fortunately the bullets missed the clerk. they drove off with a possible third person in side. both men described as

information we have about the victim. good morning jenin. >>reporter: the scene is clear there and c hp officers are working onto figure out what caused the driver to crash and who the victim was. now, they're telling us that this happened just after 2:00 a.m. a driver crashed head onto a tree. it was on the shoulder. passing motorist saw smoking flames. crews weren't able to rescue the person. the impact was so bad the engine was pushed into the victim. witnesses did not stay on scene and the only occupant in the car is dead, it's unknown if they fell asleep or if speed played a role.

it's 7:35. a cleveland prosecutor will let a grand jury decide whether to indict two white police officers for the shooting death of a young african american boy carrying a bb gun. 12-year-old rice was gunned down outside a rec center in his neighborhood last november. the two officers were responding to a 911 call about a man waiving a gun. footage from surveillance camera shows the boy reaching for the pellet gun in his waste band when one of the officers shot him twice. >> i don't think that they're terrible men. they may regret what they did. maybe they didn't do it on purpose, but they did it. when you make mistakes like that, you have to be accountable. >> this case has led to protest in cleveland and questions about police use of force. time is running out for those living in a red wood city apartment building who was told they have to get out of their homes by the end of the month.

it's 7:40. an individual vigil -- a vigil planned for a man shot by the police office. he was passed off at a 76 gas station. they say he was in a stolen car, and

had a hand gun on the seat next to him. police say they tried to wake him several time and officers broke a window which led to a confrontation and a shooting. he died at the hospital and tonight's vigil at 6:00 p.m. on lake shore avenue. this was oakland's first deadly officer-involved shooting in more than two years. a funeral is being held for a 16-year-old girl from clover dale high school. had he body was found -- her body was found near the russian bank bridge. they believe she was thrown -- one of the cars crashed into the area where she was standing. her body found 8 hours later. police are still investigating why no one searched for her after the collision. the time is 7:41. two good samaritans being praised by the chp police for saving a woman driving the wrong way on a

freeway. barbara fields was reported missing. she turned up near woodland going southbound in the northbound lanes. she stopped her car partially blocking one lane, and the center divide. two driveers parked their cars in front of her, and behind her car so she couldn't leave. investigators say ms. fields was slightly disoriented and she was checked out by paramedics and chp says the quick reaction prevented an accident. motors is claiming that gm conspired with their -- gm and the global law firm of not sharing with regulators and plaintiff's lawyers crucial information about those ignition switches. motion claims the --

12th. i'm dave clark. >> i'm tori campbell. we want to check weather and traffic. steve tells us about a heat up for the bay area. >> inland, temperatures are warming up quicker than yesterday. by the coast dealing with a lot of thick fog. 50s, 60s there. over the bay 80s and inland, 90s to 100s. i don't think it will get as hot as it good monday. monday it was hot and wednesday we had rain. today it's warming up. glen says it's going to be a hot day in glenwood. 5 degrees compared to 24 hour to go. 76 degrees. that will do it. it will be very warm and peggy said tonight, camp belinda, what can we expect. go cougars. i graduated from camp belinda high school when it was a -- >> no you didn't. >> it will be warm. upper 80s to upper 90s.

if you want to look for slow traffic in san jose, you can find it on highway 101. as you come up to the express way you have slow traffic. northbound 101 northbound 101 and a little in sunniville and a little in mount view. that's all. people out there saying, i'll take it. moving to the east bay. southbound 680 slowing in pleasant hill and slow in richmond. you're seeing lighter commutes. i promised you a look at the bay bridge. it's backed up a little bit. but it's clearing up in the 8:00 hour. it's 8:02. let's go back to the desk. thank you sal. police released surveillance video of a violent store robbery. they're accused of robbing the shell gas station, but they were caught on camera trying to gun down the

store's clerk. tara spoke with the clerk. >> carlos says he couldn't sleep for a week because he was worried these robbers might come back to the gas station because they hadn't been caught. he normally works the graveyard shift alone but swapped shifts at the last minute and says his coworker is lucky to be alive and so is he. this surveillance video shows these men shooting at the clerk at 2:00 in the morning. they robbed the safe and they began to chase clerk firing four to five shots. jimenez says his friend working was lucky to get out. >> when the younger one was pointing the gun at the man there wasn't a clear shot because there was the cigarette display. he tripped over the ice cream bar machine and lotto.

he had a couple more times to get him step as way. >> fortunately the bullets missed the clerk. a person was waiting in a car. both describes described as early 20s, 5'5" and of them had a thin mustache. the store clerk who worked here before was too traumatized to return to work. >> thank you tara. barts board of direct era proved a $1.6 billion budget aimed at improving the aging system. >> motion passes unanimously. >> bart says riders have made it clear they want better on time performance, more train cars, and cleaner stations. the budget is geared to address those concerns that includes

adding maintenance shifts during the weekend hours to get cars back in service. it will put 30 car back in service, enough for three long trains. >> that's going to be huge because during the busiest time in the morning commute you cannot get on. and then there's even busy at 10:00 at night. >> the new budget will also add more clean up crews for the trains and the bart stations and it provides for 8 more police office ares and five community service officers. time is 8:05. back to talking about the warriors. the warriors are coming home heading back to the bay area this morning. they evened up the nba finals at two games a piece. >> green throws it to livingston and back out. picked up the three and gonzalez with his first 3-pointer of the game. >> head coach steve cur figured it out. he had -- it paid off big.

the warriors won 103-82 over cleveland. dala and curry led the warriors. they had 22-points a piece. dala did a good job holding off brown. lebron got hurt. he collided with a camera. he only had 20 points and he had no points in the fourth quarter. >> make him work as hard as possible and make him take tough shots. you look at his strength and weaknesses, which way he wants to go, which way he prefers to play and you try to take him out of his comfort zone. >> we gave ourselves shots and shots goes in and everybody feels good and everybody picks up momentum and you get a ward. >> warriors reclaims home court advantage. it's the best of three -- rapper kanye west caught court yard side.

8:14. new this morning president obama made a rare surprise trip to capital hill this morning. this is new video. and an unusual twist the president is there to push for support from his own party on the so called fast track trade. it will give the president authorize to negotiate trade agreements with other countries. a final vote

expected today and many democrats are against it. you can see san francisco congresswoman nancy, you see the minority leader next to the president, democrats believes that free trade agreements cost americans jobs, but republicans support it saying without it us is at a competitive disadvantage. a union that represents federal employees says all current government workers have had data stolen along with retirees and many former workers. so far officials have said 4 million people had sensitive information such as social security numbers and birth dates compromised which is already the largest breech in federal government history -- largest breach in federal government history. a former head of the international monetary fund has been found not guilty of tipping charges in a sex scandal that began during the global

financial price crisis. you may remember that dominic was accused of assaulting a worker. the pimping charges filed in northern france. he told the court he did take part in sex parties for recreation while he was saving the world. he claims he didn't know the women involved were prostitute. the time is 8:16. two those murderers who project -- a female prison employee agreed to be the getaway driver for david sweat and richard matt, but then changed their mind. the manhunt for sweat and matt is focused on the woods a couple miles from the prison. that's where dog picked up their scent at the gas station. those who live in that area are warned to lock their doors and windows and report anything suspicious. >> they're bad guys and they'll do anything it take to maintain their freedom and if that means

harming you, that won't bother them much. >> the both men were in prison for murder. they escape last weekend. police say they used power tools to get out of their cell and into a steam pipe. there's reports it was the prison employee who gave the men those power tools. they then november gated a tunnel of pipes before they escaped out of a man hole. it is 8:17. the president of the washington chapter of the ncaa is under fire after being accused of lying about her race. her parents say rachel de lasal says she's been portraying a black woman for years. she's german. she teaches african american studies atastern washington university. >> are you african american? >> i don't -- i don't understand the question.

bridge getting into san francisco. we keep an eye on livermore commute. it's getting busier on 580 westbound as you drive-thru livermore. if you're getting on the freeway heading over to cassat valley, that's better as well. let's go to the weather with steve. >> thank you, sir. a good morning on this friday. we have temperatures that are going to be really hot. i don't know about monday hot, but maybe close. by the coast there's a lot of fog. i think sonoma will get great -- thank you. i didn't know what that was for a second. it is super foggy. super foggy is what i've been hearing. yet, bob my good friend bob warzone said it's 71. it's going to be a scorcher. i would be agree. lucy, already closed the door. really hot in the antiach.

it looks better tuesday and wednesday. look at the fog. it has worked its way up the snow coast. pretty thick and it extends well off the san mateo and i love this shot when it comes in santa cruz and monterey and goes down the valley down to solo. that's a sign that it's very very shallow. it's going to ramp up probably on saturday night into sunday, but today if you're by the coast, cool. if you're inland it will be hot to really hot. travis, i always hang my hat on travis time of year. 14 miles-an-hour, 13, 12, and 8 and now 5 this morning. i've seen this a thousand times. water temps have come way up, but there's plenty of fog. see if they cool off. the fog will pick up because it has not a chance. it did make it to santa rose that and nevada but burning off quick. a hang-back low in the sierra. will produce some

passing the oakland coal -- passing oakland coliseum. we're getting more slowing out of livermore on westbound 580 into pleasanton. let's go back to the desk. the lanes of highway 101 in south san jose is open again after a fiery early morning crash that killed one person. ktvu janine de la vega have details. >>reporter: it was the driver who died. chp said the victim was badly burned, they couldn't tell if it was a mans or woman. >> the car caught on fire and so did the tree.

other motorist who stopped could not get to the driver. the chp says the victim died on impact. it's unknown what caused that person to travel off the shoulders. officers are looking into whether speed played a factor or if the person fell asleep. there were several lanes of traffic closed while they investigated but everything is open. the coroner will work on identifying the victim. the vehicle had washington license plates and it was carrying luggage in the back. reporting from san jose, janine de la vega fox 2 news. police in palo alto want your help. they're trying to solve the case of a college student killed 14 years ago. 20-year-old maria was with her friends when hit by a stray bullet. she was in front of a nightclub on alma street. despite witnesses, police have no suspects.

investigators put this on the palo alto facebook page to have more leads. >> to have a homicide like this shocking to the community and so senseless in terms of the victim, really stays with us. >> the police as well as the family is offering a $100,000 reward for information leading to arrest to the person responsible. our time is 8:34. time is running out for people in a red wood city apartment building. they've been told they've got to get out of their homes by the end of the month. all of the residents of the 18-unit property at 910 clef ton street says they received eviction notices just a few days before the building sold in april. last night they staged this protest asking the landlord for more time. organizers say finding an affordable place to live for these families, that is going to be tough. >> a lot these families have gone out and look and they can't find a place which means they

leave the area or who knows, we have a family here this happened to before and she lived in a shelter for a year. >> the organizers say they've heard the landlord wants to renovate that building and after that the grant will probably go up. the families are asking that the landlord pay for their relocation. brand new affordable homes at the once polluted hunter's point naval shipyard is now open in san francisco. >> i think it's great. i mean, it's a place in san francisco that we can afford. we have a view of the entire skyline. >> these are newly weds. this is ryan and angela. among the first people to move in. their 2-bedroom town home is 1200 feet. ,200 feet. all of that for $60,000. the navy has spent the last 20
