low cloud deck in place. 50s for everybody. had a couple of upper 40s. lake county, mendocino county, west at 21. still okay coming down a tiny bit. but there is a lot of fog out there. there are signs of high pressure inspect four counselors. it will drink the power shake and get in here by wednesday, thursday. today, morning low clouds. sunny and nice. breeze there. 60s, 70s, by the coast. all right. 7:02 on a monday. what do you have for us? >> we don't have too much slow traffic. it's a little slow in some areas. let's start off on 80 westbound in fairfield. west 80 at west texas. there is a crash. it was six cars. they moved it on the to the shoulder -- moved it to the shoulder. when you get to the bay bridge toll plaza, there is a backup

and there is a report of a stall somewhere in this mess in one of the left-hand lanes. i haven't seen it but it's probably there. traffic is backed up for a 25, 30-minute delay. and if you are driving in san jose, northbound 280 a little better than normal. 101 is slow in pockets from just before the capitol expressway. back to the desk. >> thank you. to a developing story we've been watching all morning long out of san jose. a man is holed up in a crane about nine stories high and he refuses to come down. tara moriarty live there at the scene right near city hall. tell us how the standoff began an what police are -- and what police are doing here. >> reporter: first they were yelling on the bullhorn and then not saying much. now we just saw three or four officers head up the building which is under construction, perhaps trying to make their way up toward that crane. and the streets surrounding this construction site near city hall are now open.

we are told that around 8:30 last night, a witness saw the man climbing up the crane, nine stories high. he called 911. police believe the man could be homeless, although they have not confirmed his identity. it's not clear why he went up there in the first place but witnesses say he does appear to be intoxicated. >> right now it's been by mouth, we have officers down at the base of the crane on a blow horn calling out to him, communicating with him. he's yelling down when he can. >> reporter: a couple of hours ago, officers said they were gonna sit and wait this one out but we just saw three to four officers make interest way toward the crane but we do want to mention that 6th street between santa clara and st. john near city hall is now open. so traffic is moving very nicely. live from san jose, back to you. >> okay. thank you. we're closely calling the supreme court. the justices expected to issue their ruling to decide whether states can ban same-sex

marriage. at sake here, the high court's decision involving state bans involving same-sex marriage. first the court has to decide if individual states should prohibit same-sex marriage. if it rules that states can ban the same-sex marriage, then they have to decide whether those states have to recognize same-sex marriages performed in other states. the decision can come down any time this week. most legal experts expect it to come down on one of the last days of the session. that conmonday or tuesday of next -- that could be monday or tuesday of next week. other cases, to be ruled on. the fark, subsidies and states where the federal government runs the insurance exchange. also environmental protection. whether the epa can continue to require coal and oil fired plants to reduce emissions of air pollutants. housing discrimination, whether minority groups should be able to file lawsuits claiming that housing practices an an unfair

impact on minorities and the death penalty, whether the states have use a particular sedative in part of the cocktail of the execution. days before pride celebration, a mural has been defayed against -- defaced again. brian flores is joining us live. you are in the mission district to tell us what's being done to repair the mural again. >> reporter: hi, dave. good morning. this mural on 4th and bryant, the gallery says was said to promote tolerance and understanding but as you mentioned, days before pride weekend, the mural was defaced a second time in a week. want to go to pictures of the damaged mural on the facebook page. you can see a vandal spray painted over a depiction of a lesbian and a gay couple. the latest incident is believed to have happened on saturday. now on top of this, the gallery and the artists says they have received derogatory comments and threats via social media.

this is video from the first defacement that happened last week. it was -- the mural was first unveiled two fridays ago. this was defaced on monday. volunteers spent thursday replacing the digital mural. it's a mural printed on paper and glued on the wall in sections. but then it was defaced again this past saturday. it remains unclear who was responsible but this is peaking reported as a hate crime. in the meantime, the gallery released a statement saying the defacement has only proven the credibility of its purpose, galleria de la rosa believes the dialogue about lgbt visibility awareness and acceptance in the mission district and within the greater latino communities. the gallery is asking for donations to replace the mural. there are surveillance cameras around the direction of the mural. it's been reported that the

footage has been released. we expect to have an update this afternoon. back to you. >> thank you. reports from fremont, a flasher may be on the loose. the mercury news reports there were two incidents last week of a flasher in the brook vail neighborhood. both occurred at the gateway shopping center. on tuesday, a woman told police she spotted a flasher and then two days later, another woman says a man in a parked car exposed himself. now, that car described as a white two-door, 1990s honda civic, that man described as latino in his 20s. he had a buzz cut and he was unshaven. if you have any information, call fremont police. happening today, taxi drivers are set to stage a protest outside of uber's headquarters in san francisco while mayors from all around the country will be touring that company. uber and lyft are among the spopsers of the annual mayors' conference that wrap ups in the city. they are accusing the ride sharing companies of buying off the mayors. they also say uber and lyft

carry inadequate insurance, don't do thorough background checks and pay lower wages. one mayor of madison, wisconsin plans to skip the tour at uber today. well, today is an important deadline, a big deadline for a new sports complex planned for oakland. a developing group has until today to lay out details of how it will pay for a new stadium that would be built right next to the current coliseum. the city plan suggests having football, baseball and basketball venues as well as housing, retail and office space. now, the as owner has made it clear, he does not want to share the location and baseball commissioner rob manfred said the as would not flay at the site if the raiders build a new stadium and mark davis has not signed onto that coliseum city plan. well, now to the 49ers. they have this new stadium in santa clara. and team officials team seem really interested in politics

welcome back to "mornings on 2." 7:1. we're following developing news from afghanistan. taliban fighters launched an attack right outside the afghan parliament building in kabul. a big car bomb blew up near the outer wall of the parliament compound as lawmakers were meeting inside. six taliban fighters then tried to storm the building. afghan security forces fought them off, killed all six of them. the explosion shattered glass in the parliament building but no one inside was hurt. more than 30 people outside of the parliament building, they were hurt in that attack. back in this country, the florida man who flew his gyrocopter to the u.s. capitol in washington on a mission of

protest, he's rejected a plea deal in the case. remember the postal worker, douglas hughes, he flew his single-seater aircraft right onto the lawn of the u.s. capitol on tax day, on april 15th. he told the associated press, he is rejecting an offer that included significant jail time because it doesn't seem fair for an act of civil disobedience. now, hughes has pled not guilty to charges that include two felonies. today is the last day of the muni challenge, that's the 22-day event where san francisco mayor ed lee and most of the board of supervisors promise to ride muni and tweet about it as often as possible. scott wiener would be the champion of the challenge so far with more than 100 tweets while riding community. the fewest tweets come from katie pang. she tweeted once. and malia cohen has not tweeted at all. the transit riders union issued the challenge saying having city leaders use buses and light rail would help them make

this case but for those who are still living in the margin of life. >> reporter: now, president obama, who spent the weekend in california, is once again decrying a lack of political will in washington to pass new gun control measures. but back in south carolina, another debate is taking hold. a civil war statue in charleston was vandalized with a spray painted message, black lives matter. it was then quickly covered by officials. more difficult to obscure, though, the confederate flag that flies over a bar memorial in columbia. after mitt romney said on twitter that the flag should be removed, gop candidates for president in 2016 faced their own questions. >> everyone is being baited with this question as if somehow that has anything to do whatsoever with running for president and my position is it most certainly does not. >> you can put up confederate flags everywhere or get rid of them. it's not gonna make any

up in seven minutes. a federal judge is set to hear arguments to have the def famation suit against bill cosby thrown out. he's asking for the dismissal of a lawsuit filed by three women accusing him of decades' old sex crimes. according to cosby's lawyers he was acting in self-defense because his character was under attack. they say some of the comments made by representatives are personal opinion and protected free speech. google has a new policy. for the next week, people can submit a form asking the search engine to remove nude or sexually impress it images posted without consent -- explicit images posted without consent. he's one of the stars of the gold be state warriors, later today, you fans will have

let's talk about weather and traffic. i ducked outside for you, steve. it's gray. >> it is gray. >> it's gray. a lot of gray out there. unless you are far enough, then it's already sunny. but a little cool. we had a few 40s. a lot of 50s. a decent fog bank out there. it will play into a cool forecast for the coast. although santa cruz with the sun, there are some breaks in the low clouds. temperatures, though, will rebound. chloe up in clearlake, 7:15 currently, 57. clear, light easterly breeze. high today around 90. i will buy that. triple digits by the weekend. i would say before that, i would say around thursday. low clouds today will mean not much of a temperature difference here. 50s to 60s. had some 40s. we talked about it. temperatures, though, look to be very similar to what we had yesterday, maybe one or two degrees warmer. westerly breeze in place there is a sea breeze. and a lot of fog and low clouds. but all signs point to high pressure in the four corners, beginning to flex its muscle

expected to be the swing vote and has a history of backing gay rights. there will be a rally held right here in the castro at 6:00 p.m. that evening. gasia? >> thank you, paul. and thank you for the welcome. a high school in the city will offer an lgbt studies class next fall. this is the first in san francisco to focus solely on the history, struggles and achievements of the lgbt community. the class will cover the history of gay leaders including san francisco's supervisor harvey milk and thade pandemic of the '80s. students will take a field trip to the museum. vallejo police want your help in the investigation of a deadly shooting early this morning. police were called to sonoma boulevard and indiana street half 1:00 a.m. -- just after 1:00 a.m. a 32-year-old man shot was still alive but died at the hospital. his name has not been released.

police are looking for evidence at the crime scene but if you have any information, call them directly or contact the anonymous solano crimestoppers program. we also have an update for you on that deadly balcony collapse in berkeley. there is a new report that a contractor who worked on that building had to rebuild balconies at a complex on the peninsula because of water damage. the cause of the berkeley collapse has not been released but many suspect dry rot from water getting into the wood was a factor. segway construction and a subcontractor were sued. now, according to the chronicle, segway settled out of court for $3.5 million. the bodies of the four irish students killed on the collapse have now arrived in ireland. the evgrooing families are preparing for funerals this

week. the first is funeral is expected to take place tomorrow. a 22-year-old woman from rohnert park was also killed. ♪ now, this sunday mass at saint mariy's -- st. mary's cathedral paid tribute to those killed. police have wrapped up a search for pennsylvania for two convicted killers who escaped from a new york prison two weeks ago now. a witness reportedly spotted the two men near a railroad line in friendship, new york, just north of pennsylvania. the two men have been on the run since june 6th when they used power tools to break out of the clinton correctional facility in upstate new york. >> we interviewed the witness at length and the determination was made that this investigation lead should be

investigated. approximately 300 members of federal state and local law enforcement agencies were brought in for the search. >> new york city state police said the search has been stopped without finding any evidence. the escapees were there. the man accused of fatally shooting a police officer is now in custody. he was arrested saturday for aggravated assault on a woman with a gun. officials say while he was in the police vehicle, he somehow managed to shoot officer daryle holloway in the head. he was seen spotting a bus and still wearing those handcuffs. police are trying to derm how he eluded officers and the k-9 shoot k-9. >> there was a .40 smith & wesson recovered in the vehicle which was believed to be used

in this heinous crime. >> investigators say officer holloway's gun was still in the holster and has not been used. bois is being held bought bond. caltrans and the chp they are cracking down on those drivers that they call freeway jumpers at the freeway exit. drivers would use that exit and then use the onramp to get back on ahead of other drivers. since january, there's been a sign at the end of the offramp ramp says left turn only. now there's often a chp officer out there to enforce the sign. caltrans says it has not received any complaints about the sign and it's looking at ways to add another lane to ease congestion. people all across the country should be planning to pay more for egg dishes at restaurants because of an

missing chef. walter shieb went hiking in taos on june 13th but never came back. he was reported missing the next day. state police and volunteers have been searching for him since wednesday. his body was found late last night. it was off a trail. no cause of death has been announced as of yet. sheib served as the executive chef under clinton and bush from 1994 until 2005. meantime, an investigation is underway in las vegas after a person who was attending a huge electronic dance music festival over the weekend died. now, police say this person who died was a 24-year-old man, he was among 135,000 people who attended edc which ended early this morning. police say the festival took place in record-breaking heat. that led to hundreds of medical calls out there. police also report 26 felony drug-related arrests and also

the investigation goes on into the shooting, the victim, thomas mendez. a gofundme page reports he was a cook at the katie's corner and katie's creek restaurants in san ramon and walnut creek. authorities say mendez was inside a car when someone in another car started shooting. that caused mendez's car to crash into the center divide. he died later. parents plan to protest against dramatic staffing changes. almost all of the teachers at west valley elementary in sunnyvale will be transferred to other schools in the district. now, originally west valley teachers had been told they would have to reapply for their jobs and that someone would be

left in place after that -- after what was described as tension. school district and the teachers' union decided that -- that would be unfair. now the plaen is to transfer all teachers to ear -- now the plan is to transfer all teachers to other schools. there will be a rally from parents demanding the teachers be left. napa earthquake repairs are still being made. streets that were damaged by water mains, are the main focus. there are 163 place where crews need to restore the pavement and make permanent repairs. the city will spend more than $400,000 on this pro project. most of the -- on this project. most of the costs will be covered by the state office of emergency services. a stray cat that somehow made it from australia all the way to ireland has been rue i nighted with the owners. the cat was named tigger. it was spotted in northern ireland.

a friend of mine was also in phoenix where it was 114 to 116 degrees. today in the 50s. currently 52.7. yes, there have been some incredibly hot temperatures down into arizona. record highs all over the place last week. 50s and 60s already. we had a few 40s here. now we're starting to warm up. not that much, though. still west, 20. gusts to 24. that's a decent delta breeze. no sign of that collapsing and there's a big fog bank out there. but everything says by the middle of the week, high pressure is on the way and some of that warm, hot temperatures will make it into the valley. we'll keep an eye on that. morning fog. 80s through the interior. 60s, 70s, coast and bay. i haven't heard anything yet. normal slow traffic. nothing too bad. we've heard a couple of things out there that have been very slow. but nothing major when it comes to most freeways. but the people in vacaville and fairfield have something to say

about that. we had a six car pileup on the shoulder. it was in the lanes. but traffic coming out of vacaville has been steady and slow into fairfield. that crash was put off to the side. they had some activity there. highway 37 by the way is slow out of vale heading west. when you get to marin county, southbound 101 slows near -- actually slows after 37 to central san rafael. let's go to a live picture. i want to show you the traffic on interstate 880 from our ktvu commuter cam. pardon me. north of the coliseum. you can see some slow traffic here coming up and it's -- this is just north of the coliseum here. it's gonna stay that way until you reach about 23rd. then it breaks free. also looking at the bay bridge toll plaza, that is improving quite a bit. loosening up here. it's backed up for 10, 15- minute delay. in san jose near -- right in northbound 208 that looks good getting up to highway 17. back to the desk.

>> all right. thank you. a bizarre standoff in san jose, it's now coming up on the 12th hour now. a man climbed nine stories up on a crane right near city hall and police are still trying to get him down from there. tara moriarty joining us live. you've been out there all morning, what's the latest. what's happening out there. >> we just started to see some movement. it looks like this man has now woken up. he's raised up the blind. there was this shade that was protruding at the top portion. he just put it up. he's standing up there in his shorts. he has a bottle of water. we're not sure if he's getting ready to come down. officers have been trying to make contact with him and they have blocked off 6th street between santa clara and st. john nearly hall but he's up there still. nine stories high. a witness saw him criming that crane around 8:30 last night. they called 911. police have not identified him.

morning, a san francisco art gallery is reaching out for help after the new mural was defaced for a second time. brian flores live now from the mission district. brian, tell us why the gallery thinks it's being targeted here. >> hi, gasia. good morning. the mural on 4th and bryant here in san francisco's mission district was meant to promote understanding and tolerance. days before pride weekend, the mural was defaced a second time. want to go to pictures of the damaged mural on the gallery's facebook page. you can see a vandal spray painted over a depiction of lesbian and gay couples and a transjepedzer man. this latest incident is -- transgender man. this latest incident is believed to have happened on saturday. >> i can't believe it. the displacement going on, particularly the mission district and it's unbelievable that such a beautiful piece of artwork that the community loves. >> reporter: now, on top of this, the gallery and the artists say they have received

homophobic hate speech and physical threats through social media. the digital mural glued onto the wall in sections like wall becamer was first unveiled on the 12th of this month but was defaced the first time on the following monday. volunteers spent thursday replace ig the mural and it was defaced against this past saturday. this is being reported as a hate crime. the gallery said the defacement and redefacement of the current mural has only proven the credibility of its purpose. they believe the importance of continued dialogue about lgbt visibility awareness and acceptance in the mission district and within the greater latinos. the gallery is asking for donations to replace the mural. we provided a link at ktvu.com. there's surveillance cameras where near where the mural is in the hopes that there's footage from the surveillance camera and will hopefully have leads in this case.

contact them directly or do it through the crimestoppers program. the trial of the man accused of murdering a vallejo police officer continues in about an hour from now. henry albert smith is accused of shooting and killing officer james kaput following a bank robbery in vallejo. it happened in november of 2011. smith is facing the death penalty if convicted of murder. the prosecution's system will continue this morning at 9:00. happening today, parents at a south bay elementary school will be rallying against proposed staffing changes. the teachers at west valley will be transferred to other schools in the district. originally west valley teachers had been told they would have to replay a -- reaplay for the jobs -- reapply for the jobs. the district decided that would be unfair so the plan now is to transfer nearly all of the teachers to the schools. the parents will hold a rally at the school demanding the teachers be left at west

a new study shows high-nk families are using more water. the contra costa times looked at how much water the average household uses in 16 cities. the papers report families in san lorenzo used 51 gallons per person per day. but that's just 15% of the amount used per person in the town of diablo. some of that is because homes and yards are bigger and

weather is hotter on the east side of the hills. but the study shows those using more water holds across our state. for example, oakland uses an average of 57 gallons per person per day, neighboring piedmont averages 110 gallons. on the other side of the east bay hills, the average in pleasant hill is about 79 gallons, right next door, walnut creek, well, that averages 125 gallons per person per day. the water at folsom lake is so low, boaters had to take their boats out this weekend. normal years, the boats could say docked well into september. but the water level is so low at 414 feet, the boat owners couldn't believe the boats in the water. >> i'm gonna really miss coming out and taking the kids and wake boarding and enjoying the afternoons. i guess i have to find another

tribute to those killed and injured in the collapse. five irish students an one from the bay area died when the balcony they were standing on suddenly collapsed last tuesday. seven more people who were injured in that balcony collapse remained in the hospital, as of this weekend, according to the irish consulate. >> somebody said to me today, how are you? i would say my heart is broken. broken for the suffering of these families over the past week. >> the last of the victims' families returned home to ireland last night. those grieving families are preparing for funeral services this week. the bodies of four of the irish students arrived in ireland yesterday. the first is expected to take place tomorrow. the body of the fifth student will arrive in ire land today.

89:35. firefighters -- 8:35. firefighters battling a firefighter south of markleeville near the nevada border. they called this the washington fire. at least 6500 acres have been burned, mandatory evacuation orders remain in place. at least five homes and 15 hifnl cabins are in danger and several of the local roads out there are closed down. a wildfire in san bernardino county, it's still burning out of control. this one started on wednesday about 90 miles east of l.a. more than 17,000 acres have been burned so far. the fire is only 19% contained. the cause of the fire still under investigation. >> and firefighters in madera county hope the sky fire will be fully contained by tomorrow night. this one's burning in the gold country. this is northeast of fresno near oak hurst. it's threatening at least 200 homes and buildings. it's only 40% contained. investigators think that fire was sparked by a car on
