good evening i'm julie haener. >> and i'm frank somerville. america's highest court has spoken. the justices ruled 5-4 that same-sex couples have a constitutionally protected right to get married. and tonight a nationwide show of solidarity. look at the white house there, lit up in rainbow colors. >> and we have team coverage tonight beginning with ktvu's amber lee. she's live in the castro where the celebrations are well under way this evening. amber. >> reporter: julie tonight the castro is living up to it reputation that it knows how to party. the high court ruling is just adding to that joyful celebration. the decision day rally inspired reflection about the long legal

struggle for marriage equality. many same-sex couples married 11 years ago only to have their unions later voided. today is a new day. >> we're a family. you know we have a child. so the idea that you can move from one place to another in this country and somebody can say you don't count here: that's gone now. >> reporter: and a new perspective. >> we're celebrating being americans for the first time. we've been included by our country as same class citizens like everyone else. it's an amazing place to be. >> reporter: this boy and his family came to the castro came to support same-sex couples. >> i feel very strongly that when same-sex couples weren't afforded their own rights that i have, they didn't have the same rights that i had.

>> love won. >> reporter: a serenade by a street musician on this historic day. a joyful celebration but with eyes to the future. a banner reads it's not over. >> there's a lot of work to do for equal protections in housing and employment and all kinds of areas. there's much more work to be done. >> reporter: but for now a long awaited decision in their favor. this couple has been together 32 years. >> it's a relief. i'm relaxed. it's over. and now we don't want to check to see if the state we end up retiring in is one where we're still married. >> reporter: for the people here tell me it's just an incredible feeling to have the nation's highest court say that lgbt community deserves equal rights. now the rally is over. but the celebration is just getting started. >> many people waiting a long time for this, amber. thanks very much. >> people were also waiting to

celebrate in the south bay about 100 people gathered outside of san jose city hall tonight at 6:00. many told us they felt a warm glow after the ruling was handed down. mayor sam licardo remembered the people and small steps taken to finally reach full equality. now to the ruling itself from a deeply divided court. it was justice anthony kennedy who was the swing vote. jana katsuyama is live with the legal argument that they used to come up with the ruling. >> reporter: in the end it showed some big differences in the way that the nation viewed the u.s. constitution. votes by the public and the supreme court. moments after the supreme court's decision the feelings outside were as divided as inside.

>> it's a hope that gay marriage is a thing of the past, that from this day forward, it's just be marriage. >> one of the corner stones is freedom of speech and consciousness of all americans we're hoping that corner stone not withstanding today's decision remains. >> reporter: the ruling shows how the justices used the swing vote. >> he's been very much involved in looking at the issues of the liberty interest. >> reporter: >> reporter: in our government the courts are the backstop and they protect individuals and he sees this as an issue of gay and lesbian people not being able to have their full rights.

>> chief justice roberts showed a different view. >> chief justice roberts sees it in a different way this is all about politics. let this play out and if people like gay people more, they will win in time. >> reporter: following the ruling, president obama spoke from the white house. >> this decision affirms what is millions of americans already believe in their hearts. when all americans are treated as equal, we are all more free. >> reporter: legal experts say that kennedy's opinion did address the first amendment rights and would not be required to perform same-sex marriages. >> jana, thank you. one of the most talked about parts of the supreme court ruling was the final paragraph.

justice anthony kennedy summed up his support for same-sex marriage by writing, no union is more profound than marriage for it enbodies the highest ideals of love, fidelity, the devotion, sacrifice and family. marriage enbodies the life that may entour even past death. it would misunderstand these men and women to say they disrespect the idea of marriage. their plea is that they do respect it. respect it so deeply that they seek to find its fulfillment for themselves. their hope is not to be condemned to live in loneliness, excluded from one of civilizations oldest institutions, they ask for equal dignity in the eyes of the law. one attorney known for helping defend california's on and off again ban criticized the court's majority in today's decision. >> anthony kennedy and the other four justices have done

here's a look at the 13 states where gay and lesbian couples weren't allowed to get married. you can see here we have north and south dakota, nebraska, texas, georgia. just some of those states today where same-sex marriages were not allowed but now those same- sex couples got married for the first time. >> from this day forward. >> as long as we both shall live. >> >> two lesbians were among the first to get married in tennessee. shortly after the rulings, tennessee's governor and attorney general said they would not try to block marriages and they gave clerks the go ahead to issue licenses. >> in texas, some gay couples went straight to the marriage license bureau in dallas county. one man said he felt real joy and utter happiness. another said he is proud to be an american and proud to be a texan. but not all counties in texas

are issuing licenses just yet. some said they're waiting for new forms, others said they're waiting from guidance from the state attorney general. the first same-sex marriage was performed in san francisco city hall 11 years ago today following that historic ruling hundreds gathered there again to celebrate the landmark decision. as rob roth shows us knew, the city helped lead the way through unchartered territory. >> reporter: marriage vows inside san francisco city hall. >> it's my joy that i pronounce you legally married. >> reporter: for this same-sex couple. what turned out to be a historic day. >> it was ironic this is happening today in the middle offed pride. on a day that we're choosing to do this. >> reporter: the difficult journey began in this very place in february of 2004. that's when then mayor gavin newsom ordered the city to issue marriage licenses to couples of the same age. >> when you have literally

thousands and thousands of couples representing tens of thousand people in every part of the country and they all went back home with a different kind of connection to the issue and cause and people saw that in their living rooms for weeks and weeks and weeks. >> reporter: hundreds got married only to have their marriage be ruled unofficial. >> i got teary eyed when i heard the news at 7:04 this morning. i thought if only. but it wasn't meant to be that he would be here to see this. >> reporter: and also stewart and lewis who were married. >> today really is the fruition of a personal journey for stewart and me. a collective journey for the san francisco community but a

a huge development today involving those two escaped inmates in new york. today one of them was shot and killed. but tonight the other one is still on the run. david lee miller reports now on how richard matt was found and how he died. >> reporter: the intense man

hunt for at least one of the convicted killers has come to an end. a tip to authorities where the shooting then took place. >> law enforcement responded to that area. they saw matt, there was a gun battle ensued. >> reporter: richard matt has been killed. the deadly encounter taking part in malone new york. >> a couple of so armed police with their rifles raised walking through somebody's front lawn. >> reporter: the town is just 20-miles from the canadian border where the convicts were believed to have been headed. >> we have no reason to believe that mr. sweat was not with mr. matt at the time. but we don't have any confirming evidence that he was either. >> reporter: some 1,100 federal and state officers were involved in the search. >> tactical team from customs and border protection met up with matt in the woods, challenged him. and he was shot dead by border

patrol at that time. >> reporter: authorities are taking calculated measures as it is believed at least one of the men took weapons from hunting cabins in the area. >> in the case of the burglary we had on last week in the hunting camp, we do believe a 20 gauge shotgun was taken and it's a weapon -- the weapon or a similar weapon to the one that we recovered today from matt. >> reporter: the next step in the investigation, finding out how the inmates were able to pull off the escape and who may have assisted them. at least two prison workers face criminal charges. in malone new york, david lee miller, fox news. a man who was injured in a violent rampage near uc santa barbara is now suing the parents of the killer. the suit says keith young suffered a severe brain injury and broken bones when he was hit by a speeding car on his bicycle. elliot roger was driving that car. roger stabbed, shot and ran people down killing six uc santa barbara students and injuring more than a dozen

others before killing himself. the lawsuit argues rogers parents were negligent in letting him use the car and that no one investigated warnings that roger was dangerous. >> these are not minor or casual or accidental violations. massive illegal marijuana growing operations busted. in fact, 86,000 plants were seized. over four days this week, authorities raided pot farms in what is known as the emerald triangle. that's trinity, mendecino and humble counties. the focus this time was on water as well as weed. >> many of these grows were absolutely in your face. >> reporter: too bold and too big. mendecino sheriff say that grows were so far off the grid law enforcement had let them slide until this week. >> this has to do with weed,

and environmental. >> reporter: authorities had heard complaints but were surprised when they flew the area. >> i thought we were going to see a dozen hoop houses. i saw well over 100 hoop houses 100 feet long each one had 300 plants in it. >> reporter: big grows aren't unusual in this region. neither are big raids, this one happened in the summer. >> i saw areas that were some of the most devastated areas i'd ever seen. >> reporter: water pipes, tanks, holding ponds, almost 100 environmental violations noted. mostly diverting streams that flow to the eel river. >> the amounts of gallons of water and tanks that were out there was unreal. >> reporter: five gallons a minute into this bucket. farmers may face agricultural charges. >> that's someone who is thumbing their nose at the law. >> reporter: after four years of drought, the river is

already stressed. those plants seized would drink a half million gallons of water every single day. the eel below the farms was stagnant, warm and full of algae. >> it just comes back to the neighbor collaboration and dialogue. >> reporter: growers who try to work with authorities say their multibillion dollar industry needs better regulation not raids. >> the enforcement perspective doesn't deal with it. doesn't solve the situation. it continues to pound nail with a saw. if it worked i would be all for it but it doesn't work. it doesn't have any effect. >> we support legitimate medical marijuana. >> reporter: the sheriff says the raids will continue and doubters need only look at the pictures. >> i just don't see how you get rid of all this stuff in the middle of where it is. >> reporter: shacks, pesticide, pollution that could end up in the water shaft when it rains again. debora villalon, ktvu fox 2 news. the fog rolls back in and

temperatures tonight a good 10, 15 degrees cooler than last night. there are the low clouds and fog above this. there's some high clouds moving in. those clouds will bring chance of thunderstorms into the lake tahoe area. here we are looking at what is happening. you see some of the high clouds coming in and here's the fog along the coast. we're going to see more high clouds. more fog and temperatures trending down after a very hot day today. with temperatures into the upper 90s in many places. tomorrow we're going to see the warmest spot in the upper 80s, low 90s. much cooler tonight than it was last night. a good 10 degrees cooler in most even inland bay valleys. the winds are blowing the right way. 23-miles-an-hour that's blowing the cool moist air. the fog is blowing it right on shore. not so windy at sfo. as you go through the microclimates tomorrow. temperatures cooler, nice though. in berkeley you're going to get

amazing grace. grace a word woven through the jewely for reverend and south carolina senator pinckney. reverend pinckney and eight church members were slain last week at emmanuel church. the suspect said he wanted to start a racial war. the suspect went unnamed by the president. >> the light of line that's shone as they opened the church doors and invited a stranger to join in their prayer service. >> reporter: days after the shooting debate flaired on the flying of the confederate flag at the south carolina state house with the governor calling for his removal. a move praised by the president. >> for too long we were blind to the pain that the confederate flag stirred in into many of our citizens.

>> reporter: he spoke on the moral choices america is struggling with yet another shooting. and words on racial bias, even when subtle. >> so that we're guarding against not just racial slurs but we're also guarding against the subtle impulse to call johnny back for a job interview but not jamal. >> reporter: the eulogy was for pinckney but for all the other eight killed. which the president says he hopes they find grace. also in attendance the first lady, vice president biden and high ranking members of congress. >> that was really something. we got chilled when the president started speaking there. that was really powerful. ken, thank you. coming up, our coverage continues of today's landmark decision on same-sex marriage.

pride weekend tradition. the march started at dolores park and the crowd then headed to dolores plaza. organizers welcome everyone and everyone to join them. they say it's a family friendly event. those with special causes involving transgender people use the march to get their message out but it's also just about having fun. other events this weekend, tomorrow the pink triangle will be involved in twin peaks at 10:30. the san francisco night march begins at noon at dolores park. the pink party will be held from 3:00 to 8:00. then the big event, the pride parade starts sunday morning at 10:30. and how about this headline for pride weekend. here is the front page of tomorrow's chronicle with the big headline we do.

an update to a possible dog poisoning incident we told you about in the willow glen area earlier this month. back on june 2nd a woman walking her dog says her dog ate some pet food that looked like it had been laced with a white powdery substance. the dog owner told us that she rushed her dog to the vet but that her dog was okay. now a sample of that powder turned out to be harmless. >> this is a huge weekend at uc davis as the northern california special olympics summer games are now open. >> way to go, way to go, way to go. >> hundreds of athletes from across bay area and the state marched into the opening ceremony tonight. they will be competing tomorrow and sunday in sports from track

three separate terror attacks on three different continents after a call for violence. the deadliest was at a beach resort in tenesia.

gunmen started shooting on the beach killing 38 people and wounding 36 others. many of them were tourists from europe. isis claimed responsibility for that attack. in southern france a truck driver crashed into an american owned company. he then decapitated the boss and placed the head on the fence. in kuwait, a suicide bomber killed himself during a blast in a mosque. it is the first terrorist attack in kuwait in more than 30 years. a posting on twitter says it is the work of an isis affiliate. 15 great white sharks spotted swimming together at a state beach in aptos. they were less than a mile offshore. azenith smith tells us though, despite that sighting the beach is open and is going to stay open this weekend.

>> reporter: aerial video captures great white sharks swimming in the beach near aptos. giancarlo thomae was on that helicopter and saw the sharks. >> i have been going into the ocean pretty much every day in the last 20 years and i have not seen or heard of anything like this. >> reporter: thomae says the sharks appeared between eight to 15-foot long. juvenile to adult. out of an abundance of caution, officials issued a warning. >> they're out there. that's their home. whenever you go in the ocean you just have to be aware of your surroundings if you see anything suspicious. >> reporter: it's unusual for sharks to be this far north and

are likely feeding at night. >> she's sharks are starving dying on the beach. there's been tiger fish off this capitola wharf. there's warm water currents further north than usual. >> reporter: as you can imagine, the sightings are the talk among beachgoers. this family visiting from chicago is opting to stay out of the water enjoying great sharks from a distance. >> i don't want them any where near the sharks. we're not meant to be in the water today, that's fine. >> reporter: the beach remains open. the only time they ever closed the beach is if there's an actual shark attack. tracking the numbers today. it was a little cooler out there. you probably notice that and it's a lot cooler right now. there's a lot of fog out there. 89 today in santa rosa right. so that was down a few degrees fairfield down a couple of

degrees. 97. hot spot was marysville. pushing a lot of cool moist area into our region. tropical moisture this is the way it's going. see it's streaming up this way. there's a red flag warning going into effect in the mountainous areas in southern california. lightning strikes could be an issue with fire and that's what we're concerned about. fire danger and lightning strikes. these are high clouds. there's the dole gray trapped along the coast. these are the higher subtropical moisture clouds coming in. those clouds are going to be here all weekend. that will filter the sunshine and will allow temperatures to continue to cool. it's 10 degrees cooler right now in concord than it was last night at this time. 9degrees cooler in livermore. temperatures significantly down from last night. as we go outside, we're going to see more clouds and high

clouds. the temperatures are going to be cooler both saturday and sunday. the fire range fires up again with highs in the upper 90s. we're back into the heat and increased fire dangers we head into next week. tomorrow slightly cooler if you want heat you can still find it. you just get into the central valley there. it's all getting pushed against the hill there the west slope. as we head into next week, low pressure continues to intensify and push those high clouds north. filtered sunshine for the weekend in the sierra nevada. a chance for thundershowers and for us just that increased humidity. this is fog, so that's a big push right. forecast highs tomorrow. the colors come up. we're in the 100s. not even in sacramento. mostly 80s around here. 70s and 80s. the 100s are down in modesto. the cooling helps. that helps fire danger. tomorrow high clouds, coastal fog, more high clouds tomorrow night.
