prepared to stick with him during a split field of opponents. he could still get the nomination in the face of these serious charges. other side is this: when he claims he has been treated unfairly. certainly unequally in a number of instances. the example is the hilary clinton case, james comey said as much. no prosecutor would bring the case. that is a case of discretion exercised in her favor in a case of striking similarities. she doesn't get prosecuted, he does. other instances, biden, pence and others who had classified documents perhaps not prosecuted. you can make an argument, trump defiant with his, they were compliant returning theirs.

hilary clinton case sticks out like a sore thumb. trump people will never think this is legitimate no matter what. >> shannon: professor, you heard from his legal team, no way he will entertain a plea deal. good chunk of this sticks, his words, he is toast. years in prison attached to them. >> yeah, shannon, problem is he has to run the table. he is 76 years old. all the government has to do is stick it with one count, crimes that have 10 or 20 year period. evidence quite strong. we haven't heard the other side. they maybe able to knock down some of these issues. some of this evidence is coming from his former counsel.

these are very damaging statements made against him. maybe hard to move those. fact is, both things maybe true, yes. department of justice may have been out to get him. he made it easy. if you look at what is being described in this indictment confronted, he couldn't have made it more easy for him. >> shannon: a lot of what is in this indictment comes from one of his attorneys. how much of that maybe boot from the trial jury that hears this. keep noting there has been no defense in this grand jury proceeding. they get to hear one side. is it possible some of this evidence will be thrown out, sealed off so a trial jury never sees it? >> well, most damming piece of

evidence to me is the audio tape. consciousness of guilt. knowledge and intent, those are the darlings of a prosecutor's nursery. that came from president trump's own mouth. jonathan is exactly right. here is what i think people are wondering, jack smith brought up hilary clinton is it therefore relevant how the bureau and department treated hilary clinton verses donald trump in a trial. will a jury get to hear about the treatment? like oj simpson, police can frame a guilty person. both of those can be true. police framed ya and you are guilty. i will be curious what a jury does. >> shannon: have you ever seen a
