washington, former president trump who remains the odds on front runner for the republican nomination for the white house facing intense legal pressure. indictments in two cases and under investigation at least two others. new charges this week and a clas that accused him of mishandling classified documents. january 6th, an alleged interference in georgia. this week barricades replaced outside the fulton county courthouse ahead of possible charges there. joining us now is our legal spokesperson for former president trump, welcome back to fox news sunday. >> was that a shock to you, are you bracing for the next indictment? >> nothing is a shock to me

>> as president trump mentioned merrick garland and a group of people. let's be clear this is election interference. charges are never surprise to us because they can't stopped him. he got 18% turn of independent towards trump. this is what happens when you win in the polls and the democrats can't win. >> let's talk another poll, this showg illegal and another 20% think he did something illegal. how do you overcome that perception with jurors and also with voters. >> with the facts. let's talk about the facts that the american people need to know. they're trying to get another headline for president trump was facts that said that president trump did what? what was the obstruction of justice? no tapes

were deleaded. he turned them over and cooperated. they would like the american public to believe in these bogus indictments that there are some facts that say that president trump was obstructing justice. when he has his turn in court and when we get to file our papers. you will see that every single video, every single surveillance tape was requested was turnedover. that's something that could have been done but he would never act like that. he's the most ethical american i know. >> let's talk about the indictment, there are allegations he with a couple of employees at mar-a-lago had conversations and there were allegations about trying to get rid of surveillance videos once it was under subpoenaed. this is the new superseding indictment. the boss wanted the server deleted. trump's employee responded he did not know how to do that or did not have the rights to do

that. d.avalera wanted the boss to delete the server. what are we going to do? was there an attempt to try to make sure that didn't happen? >> well, let's be clear. if there was an attempt by somebody who lives in a home, take out president trump who owns a company. he owns the i.t. and he pays for all the employees. if there was an attempt and want something deleted, do you not think that's something he could not have gotten done. >> let's use common sense. >> that's the allegation. he did try and these employees say we may have to talk to someone else and i don't know if i can do that. >> shannon, i know the facts.

when president trumporganizatio organization turns it over. i can assure you that's not the case. >> well, innocent until proven guilty. he'll have his day in court. alina habba, thank you for joining us. >> thank you for having me. jonat jonathan turley and tommy dupre. >> great to have you back. professor, your reaction of what you heard from alina there. >> the government is not alleging that the tape is destroyed. an effort to get rid of the tape. it does not mean that the indictment is true. p what's interesting of the indictment is it seems to be an effort to broaden the bases.

one of the weaker links for this indictment is a lot of it is based on trump's own lawyer. that could pose a serious problem later. these new allegations are not as dependent on those lawyers. so, this may be a sort of effort to get cushion in case things go bad. >> there is always a presumption of innocence. one of the beautiful things of our legal system. now, we have a couple of employees who are drawn into this. how much pressure do you think it is on them to flip on the former president. >> if you are someone working at the trump organization and working at mar-a-lago and you got a call from the justice department and the special counsel summons you in. look, we suspect and have evidence that you committed some criminal activities. we think of prosecuting you and would like to hear what you know. what can you tell us of president trump? you are under pressure to cooperate and come clean and turn against president trump. here is what i have and here is

what i know. i think the special counsel is playing from a position of strengths here and sounds like he got some information close to people of president trump. he may have more to see if this case unfolds. >> there will be a separate indictment on january 6th. we'll see what the allegations are if we get one of those. meanwhile, i want to talk about hunter biden's plea deal. all the unusual portions of this and how it came over. andy mccarthy writes this. the point of the agreement is outline and detail the fuel extent of the immunity the defendant is getting in exchange for his plea. because of the biden's justice department on the same side. collective justice is to give hunter immunity as much as possible. jonathan, do you agree with that assessment? >> i do. i have never seen a plea agreement about this.

they put the immunity grand in with the gun charge which is a lot like putting your luggage tag inside your luggage. it is not what you officially look for. the court is no not the police. it looked like to her a week and a nod. the best to do is shrug, honestly, i have never seen anything quite like this agreement. it is what it is. it is not enough for a federal judge. >> there seems to be miscommunication whether or not of this deal - there is an ongoing investigation related to hunter. do you plea deal out of it? >> if you are hunter biden, you probably would and you can put these charges to rest. i agree what happened last week in delaware was extraordinary and shocking and unprecedented. in one sense the system worked,

the federal judge did her job. he was presented with this deal. a deal from if prosecutors and the biden team. she looked at it and kicked the tires at it. she did her job and there is no way she's signing off on it. see if they can work out the differences and return to court and possibly approving it down the road. >> at this point again running over national review, mccarthy says a lot of people calling for this. one of the whistleblowers called for this over and over again, making sure there is no political bias. he says that garland has to appoint a special counsel because there is a substantial basis for a criminal investigation and b, the justice department is of a conflict of interest. any chance the attorney general is considering that? >> i don't know if he's considering it. for two years he refused to admit there was an overwhelming case of the special counsel.

many of us have been writing for two years saying what are you thinking. it is not clear he's going to change that. the question is timing. right now there is a move towards an impeachment in query that's likely to move things more quickly. there is no question about that. it would tend to slow the process down. all these committees are closing in on some answers and what we know so far is deeply disturbing. i don't think congress really has a choice but to get these answers. i think speaker mccarthy is right about that. this is one of them. >> some of those answers may come from devin archer. miranda devine writing about this. devin archer is expected to

testify under oath this week. okay, so if it is phone call or stopping into say hi to kind of lending a little bit of glamour to the proceedings, what difference does it make? >> well, if the question is did president biden interfere with these business dealers? was he present and on the phone? was there money exchange? devin archer could be an absolute critical business here. he was someone closely involved and has a lot of information. the congressional committee has been doing a fantastic job. i suspect this is left for the justice department. they're not going to pursue this the way they had. i think the congressional committee has been doing a mas masterful job of what's actually

happened with president biden and his son. >> will the president pardon hunter if he needs to? here is that exchange. >> from a presidential perspective, is there any possibility that the president will end up pardoning his son? >> no. >> i just said no. were either of you surprise that door is so firmly closed? >> it is compelling the see the spokesperson had two days before changing the president's last denial over having any contact or knowledge of these business deals. nobody is taking that one to the bank. he can obviously follow what i think is a rather painful history, a president is using pardons for friends and family. bill clinton being an example of that. we have to wait to see how this unfolds. obviously, while he's running for president, he can't say he's going to pardon his own son for federal crimes. >> well, there are many steps between here and there and both of these cases we'll track them with your help. gentlemen, thank you. >> all right, much mhow.

biden's family members who was the bff of the president's son. he has of information i believe that'll be able to fact-check d corroborate with other witnesses and other whistleblowers. we had two irs whistleblowers admitting their investigations had been blocked by federal agency. is he going to tell you that joe biden is in the room via conference call or in-person, or to what extent he was involved in this mess. the american people have the right to know. >> democrat jamie raskin says, he says there was an fbi agent and he wants a transcript. there was political bias into hunter biden. he sent the letter to the chair, james comey saying this, that has not only failed of any wrong

doing of president biden but in fact uncovered substantial evidence to the contrary. he says republicans are now doing what they accused democrats of doing. he said there is no there. the accusations that democrats are going down rabbit trails and that's what republicans are actually doing now. >> well, i believe and i do believe in transparency and all the evidence of the oversight committee should be released to the american people. they don't trust congress because often it is a bunch of political gains. trust the evidence that comes out. the evidence that we have seen is overwhelmingly piling up. some of it we can't share because it is confidential. for example, the 170 plus suspicious activity reports pointing to money laundering and bribery and racketeering and corruption and whatever. we have to go find the bank records and witnesses and other whistleblowers to prove it in other way. it is really important in my estimation no matter what side of the isle you are on, release

everything. at the point that you can, release it all to the american people. >> this is sparking conversations about impeachment and political is one of the many places in dc that's reporting on this sort of within the republican party. there are republicans expressing concerns. congressman ken buck is one of them. mccarthy must play his heart who supports of the high-stake spending votes, facing reelection on turf that biden won. what about this issue of impeachment? is the party divided? >> well, i do believe we are at this point, an inquiry is different than an impeachmentment vote. every time we walk the plank, we are putting moderate members, we are putting those seats at risk for 2024. we are president putting the majority at risk and it is not just impeachment that does that. other issues like abortion also put those numbers on the plank.

we have to be better than nancy pelosi. she really politicize the impeachment process. we have to show evidence in order to move this thing forward. if we can't, we should not. if we do, we should use every tool in the toolbox to make sure the american people see for what it is and hold everyone accountable. >> what do you say no one is going to be held accountable when things happening and all these investigations. they say at end of the day, whatever it is or what it will be, what do you say to them? >> it is true. i sat on the committee, i cursed out the witness that day because they didn't come with information. they refused to answer any of our questions and they laughed at us as we were probing of $400 billion that was wasted by the federal government.

so, we have these bureaucrats and people come forward to testify and nothing ever happens. nobody ever gets fired or no one held accountable and the government goes on being in some ways of corrupt or at least not transparent with the american people wasting billions of taxpayers dollars and it is wrong. i am doing what i can to show the truth and what's happening at every level and every stage. i call out both sides of the isle straight down the middle. it is not easy. >> this one, one of the things you are calling for is more transparency with regards to what we used to call ufos which they have a fancy name. the government has remains of crashes and that's not all. here is a bit of that. >> um -- were they humans or non-human biologics. >> non-humans and they are still on the program. >> serious allegations that raised a lot of eyebrows.

do you believe them and do you think the government are being transparent of all the information of whatever it may be. >> the oversight committee, we have three credible witnesses. a retired pilot who seen things we could not explain. this is not about little green men. this is about the federal government laundering your tax dollars and paying for programs that none of us in congress are aware of and led alone the tax i - taxpayers. a lot of the information were shared and next being a private setting, which is frustrating. i want to be transparent of everything we learn from these hearings. >> please do. we have talked about this. you don't think the gop is handling this well. you described yourself as pro-life, you were frustrated

over the reason on the hill of funding for paid time off or travel expenses for women in the military who travels to get an abortion. nancy mace is a disgrace to republican women. we should not be giving them taxpayer funding for abortions to take them. so, you voted for the provision, do you think the government should be backing those expenses? >> well, i am pro-life, my voting record will reflect that. i don't believe it is okay at this time recently to post roe to target women in uniform. that's wrong and it looks bad. every time we do an abortion vote, we should also be having a vote on bills and legislation and amendments that showcase that we care about women. who are we doing to help women that have been raped. what are we doing to improve the faster care system who are unwanted when they are born. how are we ensuring women have

the adoption verses abortion. are we giving counseling to women who have abortions because a lot of women recovering after making that decision. what are we doing to find the middle ground. we can take those votes. we have not done anything in seven months of the legislative session to show that we care about women. that's for comments like that really don't breathe the room of what suburban moms and women really care about the country today. it is the number two issue. if you want to keep the majority in the house and flip the senate, we have got to be a lot smarter how we talk about women and how we show them we care. >> i know you are disappointed that we don't get to the prayer breakfast. >> i will talk about anything. we are on our way to church right now, shannon. >> thank you for stopping in here. >> thank you. >> republican candidates trying out new tactics to make the

this time? >> well, i believe that we need to focus on the things that matter the most to most americans and that's the economy. this is running about running against joe biden. we need course corrections, we need 180 degrees turn because on the economy whether it is inflation, taxes, or spending or deficit trade, all in the wrong direction. on energy policy, we should be selling our energy to our friends and allies instead of buying from our national security. it is completely unreported of what's going on down there and all of these things affecting every american. >> part of that ties together with fentanyl. you said that we are at a cold war essentially with them. a lot of american business leaders willing to put up a lot and look the other way and they gone over there for cozy

meetings with chinese leaders and elon musk and jamie diamond among those. we know that our economy are intertwine, secretary yellen has said you can't decouple. how do you address the issue? >> well, we are in a cold war with china by all definition. it is different when ronald r reagan was leading this country, we were in a cold war with russia. we were able to out-perform with our strong economy and have a strong military. we need to do the same thing. we got to get our economy sprinting and it is crawling right now. i have seen the red tape as an entrepreneur as a small business person and i have seen it runs large global businesses. the federal government is outside of its lanes and bigfooting states and businesses. we drive that forward, we get

this economy going, china is the number one economy in the world. they are interconnected. we got to be smarter of how we manage this. i will give you one horrible example. putin likely does not invade ukraine if not for having all of western europe dependent on his energy. well, then, the biden administration says we'll put sanctions on russian oil and that takes some russian oil out of our markets. russia is selling oil 20% to 30% off to who? china. china is the world's largest importer of oil and gas in the world and we are over there with blinken, yellen and kelly and nobody is talking about how we can use energy policy as a lever in our relationship in the cold war with china. >> you mentioned russia and all of those interconnected and very complex foreign policy problems. what do you consider defeat of russia, victory for ukraine, where do you see the line starting and stopping for usa continuing to flow there to ukraine? >> well, we have to have dollars

and have to have accountable across the government. we got to have more transparency and accountability. that's what we have done in north dakota. we have cut budgets in north dakota and balanced the budget. when we are talking about russia, we can't have a win for putin. we can't think about the country the way we think of ourselves. they have a fancy name, oligarchs. what's putin worth? $70 billion. they amass all these work and what the group is knowing. these guys have 64 shell companies. they're controllin of the traditional african republic. they took over 25% of syria's oil production. these are large criminal organizations and a win for putin. putin and china have had 40 meetings over the last ten years.

we are pushing these folks together and now with putin becoming china's gas station, it just exacerbating our bigger challenge which is the cold war we have with china. >> you signed the toughest abortion law in the country. you said you would not sign a federal ban, susan b. of pro-life group says, saying the issue should only be decided at the state is an endorsement of abortion up until the moment of birth in states like california, illinois and new york and new jersey. is it a cop-out to say with the interesting and some people would say aggressive cultural war issues you had in north dakota that you signed off on is now in a national race that you should not talk about it. >> it is amazing. we spent 50 years of pro-life

movement and fighting to have roe v. wade to be turned so the decisions could be returned to the state. now, we have to have the feds back involved again. i am the tenth amendment guy. there is a specific set of things that the federal government is supposed to do. the rest is reserved to the state, or to the people and importantly to the people. so much of this cultural wars, it is one group trying to stamp their set of rules on another group. we have to say hey, look - what's going to fly in new york is not going to fly in north dakota. as president, we have to focus on what matters and certainly as president, we got - i will be focusing on things that are part of the jobs description of running the federal government and shrink the size of government and some of these other issues are going to be debated at the state and local level. >> there are people who read the

candidates hit the campaign trail, young voters are listening. >> i am still undecided, i am leading towards trump just on what he's done in the past. i do not want another democratic in office. >> i want to see more policy answers. i think policy is a lot more important. >> the economy is big one and it is not doing too well. >> reporter: according to data, the number of college students who voted went out 14 points between 2016 and 2020. one expert says that growing electorate is up for grabs. >> when you look at how they vote, i know that the majority vote for a democratic candidate than federal election. when you ask which party do you belong to, a lot of people really have no -- >> if i feel like the lines are important and we are pretty conservative. >> i don't see there is a chance for that. >> reporter: what do you think the conservative movement could

do to get more young people to vote? >> market. they need to do better in marketing. >> reporter: young people i talk to say age plays a factor because they are looking for a fresh face to lead the republican party. >> time now for our sunday group. usa today, susan paige, mary harper. former bush white house rep reporter. >> welcome all of you. young voters are getting less likely to identify as dems and that spells trouble for biden. they looked at data for more than 20 years. voters under 30 are less likely to identify as democrats compares to the spring of 2019. julia, more of them are considering themselves independent. >> yes, you see a lot of that in generations and a lot of

crossovers in terms of a lot of issues of these voters. maybe younger democrats who may not be as physically liberals as other democrats. what you are seeing right now is these voters don't want to be labeled and they don't like the label particularly and gen z. they want to be able to have that choice. with that being said, we did see in 2022, that young voters overwhelmingly really turned the tide for democrats. >> this same analyst went on a deeper dive, he said ring the alarm about this group. the last four years the number of young black men and women who identified as democrats defined a jaw dropping from point of 64% to 29%. >> young voters areless likely to identify with the political party. they care a lot about climate change and gun control and gun regulation. they care about issues that

increasingly republicans are just not in line with many young voters on. when it comes to women's health, these are voters are thinking of a world where which women may not have the same healthcare options and rights that our generations had taken for granted. i think these are independent voters. republicans are struggling with them and we have seen it election after election because of their policies. it was fascinating that young voters didn't want to hear as much as cultural issues. the policies and many of young voters care about, republicans are moving away from it. that spells trouble. >> i see it, i can feel it, too. >> i didn't shake my head. >> put between 2018 and 2022, the youngest cohorts of 18 and 29 move for republicans, they're still overwhelmingly democrats. if i were a democrat, i would be

as worried as the biden white house. if you take a look at all the polls, this is a group that's most uncomfortable with the idea of an 82-year-old running for reelection as president. lack of enthusiasm among younger democrats among younger voters. that's why they continue to try for example on the student loan forgiveness, trying to bribe them. it is not working. the polling data, there are two groups that looked like a lack of enthusiasm could be deadly. the republicans nominating fresh face and those are young voters. >> let me shake my head, carl. >> the biden team is not concerned that young voters are going to vote for donald trump or the republican ticket. they're concerned they'll not vote at all or vote like cornell

>> adam smith spent years dealing with chronic physical pain coupled with anxiety and depression fighting to get the help he needed. he's got a new memoir hoping to help others. i sat down with the congressman this week to talk about his journey on our "sunday's special." >> this book is vulnerable and transparent and you were so detailed of all the different ways you were struggling and down to details of the medications and the doses you were taking. why so much transparency? >> journey that i went through a

lot of people went through. millions of people and i thought if i were to tell the story, it would be helpful to people trying to figure out how to navigate on their own journey through this. i felt that it could help and advance the conversation. the more honest and more likely you are to get to the right answer. >> everything is struggling with something. to do with against the demand of the backdrop and the divisive often on the hill, what was that part of the journey like? >> i had a great support system, the staff and my office and my family, you know? i was very lucky and i have a lot of people who were supporting me through that. but, it was still extraordinary difficult. >> it feels like you are always running and fundraising. the two years - how much did that weigh trying to manage all the physical and mental things you are going through as well. >> it stresses me out a lot. i was worried about my ability of keep doing the job and getting reelected. it added to the anxiety of my

life as a good father, good husband and good congressman. those are my responsibilities. that's what i had to do. i had to work really hard to do that and added to the difficulty without questions. >> you talked to hundreds of medical providers on mental and ys, u found that there are not easy answers a lot of times. you can't look to one person and say they got the education and they'll be able fix me and figure it out. how frustrating was the process? >> on the mental health side, the stigma that surrounds depression is a problem. i had anxiety in 2005 and i didn't tell anyone. when it came back in 2013, it would not go away and i had to try to get help. i would tell a lot of people if you are having mental health problem, it is okay to talk about it and it is okay to seek help. we need to be more supportive of it. the second thing i would say is you do have to take a little bit

of responsibility with your own healthcare. i don't know anything about this stuff particularly on the mental health side. your mind and body are yours and that person you are talking to deal with hundreds of thousands of people that are a little different. you have to work with your provider to get to the right answer. you are going to have to be involved and engaged. the third big message on both mental health and chronic pain, help exists. you can find help for men men -- mental health? >> we need problems of solving. we tend to resist of doing the hard work of okay, what's really going on here? it is part of the reasons why i think we have so many prescription drugs passed
