one of the most infamous cases of all time. two baby boys, michael and alex smith, were strapped in their car seats by their mother and sent to their death into a deep and dark lake in south carolina. susan smith was convicted of killing her children. now, after serving nearly three decades in prison, she is hoping to soon walk free. but should she? in a true crime news exclusive, i sit down with melissa moore, one of the only people to speak to susan smith behind bars. what she says will shock you. >> i would like to say to whoever has my children that they please i mean, please bring them home. >> these are the lies 23 year old susan smith was spreading back in 1994. >> cain expressed how much they are wanted back home, how much we love them. we miss them. >> standing in front of cameras, telling the nation that she was by a black man while both of her

i am open to exploring that. there are other possibilities and reasons. what would make a woman who seemingly loves her children do the unthinkable? >> she is now eligible for parole after 30 years, something the lead prosecutor deeply regrets. >> i look at the case itself as a failure on my part because unfortunately, she did not get the death penalty. >> a failure because tommy pope believes smith is nothing more than a cold hearted killer. why didn't she get the death penalty? >> i think the defense did a tremendous job. they worked the public opinion, they worked the media attention to go from susan the monster to susan the victim, the victim because she was painted as a woman who was still suffering from sexual abuse at the hands of her stepfather and an untreated mental illness. >> tommy, the jury showed her mercy, but she did not show mercy to those two boys. >> absolutely not. i always say

that any case where a life is taken, there's some mental health aspects. clearly, susan's mental health that one diagnosis in the dsm, she's histrionic. she's either the victim or the princess, and she's always got to be the center of attention. >> pope says the real reason susan smith wanted her children dead while separated, she was in a relationship with her boss, who didn't want kids. >> she knows there's a lot of people that despise her and think she is a monster. she's evil. she understands that. >> smith hasn't exactly been a model citizen. her incarceration has been marred with infraction, including having sex with guards and drug use, and the man who stood beside her as she spewed her lies. ex-husband david smith telling court tv in an exclusive interview that she should stay where she is. >> i'm going to do everything in my power to make sure you stay behind bars. >> david has had a difficult, difficult time and, you know, to

his credit, has gone on with his life. but he's strong enough to make sure justice continues to be served. in this case, susan will be eligible for parole on november 4th, 2024. >> we want to know what you think. should susan smith be granted parole? take our poll at true crime news.com. now we turn to a high profile case making headlines in florida. the murder of dan markel, the father of two gunned down outside his home. true crime news has the new details. >> the driver's side window is all bashed in, and he's got blood. all over his head. >> an assassination in broad daylight. >> he was not responding to me. >> the victim lost. scholar dan markel, was in the middle of an ugly custody battle over his kids with his ex-wife, wendi adelson, nearly two years after the murder. two men are charged with first degree murder. the alleged trigger man, sigfredo garcia, and getaway driver luis

rivera. by then, rivera is in prison on another charge. he cuts a deal with prosecutors, pleading guilty, and agrees to testify against his coconspirators. in exchange for a reduced sentence. and we've got the full confession. >> we've been renting the garag. garcia jumps out. he goes around the car when he's driving denmark. he was on the phone that day, shot him twice. got in the car. we left. >> rivera says his involvement began weeks before the murder, when garcia asked him to tag along on a job in tallahassee, a seven hour drive from miami. >> my understanding when he was talking to me first, i thought it was going to be like a robbery, just a robbery. >> what gave you that idea? why did you think it was going to be a robbery? >> i was, i'm a jack boy, okay? i, i rob drug dealers, okay? >> so he was talking. he was talking in terms of a job in

tallahassee. >> so i'm thinking we got to go okay. boom. but then he's like man it's not that i'm going to go kill somebody. we want to get hired. >> hired by whom. >> katie's the one in the middle doing everything. put it like that katie magbanua. >> good morning. who is promptly taken into custody and charged with murder. >> this is a charge of a first degree murder. capital felony case. >> investigators make some startling discoveries about katie. she has two children with the shooter. sigfredo garcia. and. ready for this? at the time of the murder, she was working at a dental clinic owned and operated by harvey adelson, his wife donna, and their son, charlie. did you get that last name? adelson turns out they're the parents and brother of wendy markel's estranged wife. >> i asked him who's hiring. he, like katie, told me, this lady

is going to hire me. >> a lady who might have reason to want dan markel dead. who could that be? before long, police zero in on markel's ex-wife, wendy. >> he's not going to survive. oh my god. >> during her interview with detectives, wendy admits she and markel were embroiled in a nasty divorce and custody battle over their two suns. she wanted to move them from tallahassee to south florida, he said no. that's when her tight knit family got involved. according to police records, wendy's parents discussed offering markel $1 million if he'd agree to the move. wendy also talked about how much her big brother charlie disliked dan markel jesús joke. >> he said, i you know, i looked into hiring a hitman and it was cheaper to get you this tv. >> the tallahassee police didn't care for that joke. they started taking a hard look at the adelsons, but they all denied

their involvement and no arrests were made. and only katie face time in prison. that was before luis rivera's confession. o k's 4-1, he says katie manipulated her baby daddy. sigfredo garcia, into doing the hit. >> she'll go cheat on him. and i guess she told him, if you want me back, you got to go do this. she had him all messed up. she had him all confused. so what was katie doing? i mean, you said something about she was going to see somebody. she'd go see the dentist. >> who's the dentist that dentist, police allege was none other than charlie adelson, wendy's brother, who joked about hiring a hitman. >> and that's not all. charlie was also katie's employer and boyfriend at the time of the murder, and the man who, not long after the killing, helped her purchase brand new breast implants. but who engineered this murder for hire or was it only katie, charlie's girlfriend? the skeletons would

twist in the murder of dan markel as his ex in-laws are under suspicion for his murder. if confessed hitman luis rivera is telling the truth. dan markel's own ex-wife, wendy may have financed the job that took his life. >> you said before something about you knew that the total amount equaled $100,000 or something. >> yeah, but now that getaway driver, luis rivera, is telling police everything he knows. can prosecutors nab the real masterminds? >> court is now in session. the honorable judge, jay lane smith, presiding. >> after the gunman, sigfredo garcia, was charged, his baby mama, katherine magbanua was next. she's also charlie adelson's girlfriend. but in a probable cause affidavit, prosecutors lay out more on their theory of the murder after wendy adelson's divorce from markel, it's alleged that she and her family are determined for her to move with her two children to south florida. the

report goes on to show a series of back and forth calls between various members of the adelson family and katherine magbanua in the hours before and after the murder. in addition, the record shows that since markel's murde, magbanua a's bank account grew by at least $56,000, mostly in cash deposits. in the affidavit, authorities say wendy adelson was initially cooperative with police. but after markel's memorial service in tallahassee, the entire adelson clan leaves for south florida, where they promptly change the children's last names from markel to adelson. and they stop talking to investigators at the time, wendy's lawyer wasn't talking but accused shooter sigfredo garcia's attorney had his own theories. >> everyone here is under the assumption that the markel that the adelson's hired rivera and sigfredo to commit this murder,

okay, because that's what's sexy. it's always the wife, the wife's family. these are dentists. these aren't the sopranos, okay? they're not going to go whack a guy for, like, it doesn't make a lot of sense to me. >> at trial, five years after the murder, sigfredo garcia is convicted of first degree murder and sentenced to life without parole. after a mistrial. 6-4 barteaux baby mama katie magbanua is retried. she's convicted of first degree murder conspiracy and solicitation to commit murder and sentenced to life without parole. investigators shift focus to the people they've long suspected of being behind the hit. the adelsons. it takes nearly eight years, but the law finally catches up with them. charlie is indicted on first degree murder and other charges. he pleads not guilty and goes to trial, where prosecutors finally grill the woman at the center of this

drama, his sister wendy. >> your big brother, charles adelson. you complained to him about how bad professor markel was and how much you hated him and didn't want to be in a marriage with him. >> i definitely talked to my brother about how unhappy i was in my marriage. if that's the question, then yes, the prosecutor presses wendy about her brother's unusual behavior going behind her back when she's had relationship problems in the past and dealing with it himself. >> you understand that until you expose your brother and explain what he did, that he went behind everybody's back, that he hired a hitman to murder your ex-husband. you'll remain guilty in the eyes of the world. >> i can't speak to the eyes of the world. i can only know that i have done nothing wrong when charlie adelson takes the stand. >> state prosecutor georgia cappleman tries to rile him up against his sister. then she threw you under the bus in her interview, didn't she? >> that nobody knew a murder was going to take place?

>> she knew her husband had just been shot, and they were asking her who would want him dead. and she said, your name. are you mad about that? >> no, she said, a lot of people's names. >> after seven days of testimony and just three hours of deliberation, the jury is ready. >> the defendant is guilty of first degree murder. >> charlie adelson is also found guilty of conspiracy to commit first degree murder and solicitation to commit first degree murder. that left his parents, donna and harvey. authorities catch up with them just one week after charlie's conviction in miami international airport, as the noose tightens on the family, the next to go down is mom. donna kissed her husband, harve, goodbye as miami-dade police slapped the cuffs on her. the adelsons had a one way ticket to vietnam, which happens to have no extradition treaty with the u.s. neither harvey nor wendy have been charged with any crimes. we'll be following donna
