suzanne simpson, investigators have uncovered new dna evidence that could prove simpson was murdered by her husband. brad. and even brad's own brother wants him to fess up. >> my hope is that brad will do the right thing and come forward and tell us everything he knows, so that we can end this awful ordeal for the children and all the rest of us. >> true crime news was in the san antonio courtroom, getting the first look at brad simpson in the flesh, handcuffed and wearing a red prison jumpsuit, indicted on murder and other charges. he faced the judge nearly ten weeks after his wife, suzanne, was last seen alive. after witnessing brad in court, his own brother, barton simpson, revealed how the family is coping. >> it's horribly frustrating and very frustrating for all the

kids. >> frustrating because brad has not cooperated with texas authorities since reporting his wife of 25 years missing on october 7th. >> that is why i'm so sad because my brother will not do that. i just want him to get it right. >> police say brad did not get it right when they first questioned him about the last time he saw suzanne changing his story several times before refusing to comment further. okay. >> eansor are you brad? chandler simpson? yes. >> a grand jury handed down the indictment last week, charging brad with murder, aggravated assault, tampering with evidence, and tampering with a human corpse. even though suzanne has never been found, brad is also accused of trying to hide a fully automatic firearm and what's called a reciprocating saw, which allegedly has suzanne's dna on it. the type of saw is

important, says former prosecutor josh ritter. >> the type of tool that would be able to dismember a body so that someone could more easily dispose of that body and perhaps dispose of that body at different locations. it's obviously going to be very interesting to the police, and they're going to want to do all sorts of forensic and genetic testing. >> that testing could help prosecutors convince jurors of his guilt, even without her remains. >> when you don't have an autopsy, you don't have the body. there are obviously going to be some hurdles that the prosecution has to get past and convincing of the jury that this person is, in fact, dead. in this case, it's a clear example of all of the steps a person will take after the fact to conceal the dead body. >> for his part, brad's public defender is trying to get the entire case thrown out, calling the charges fatally defective and claiming the state's case is vague, indefinite, ambiguous and

uncertain. >> the arresting document in this case is incredibly detailed. it gives a lot of specifics. it gives us a lot of information to understand how they pieced together this case and the in the tremendous amount of investigative work they've already done. >> suzanne simpson, a 53 year old mother of four, was last seen on the night of october 6th at her olmos park home. a neighbor told police he heard a physical fight outside and then the next day, suzanne never arrived to pick up their five year old daughter from school. brad then reported suzanne missing, but when police arrived to question him, they say he was inconsistent and then stopped cooperating in the early morning hours, about 1:30 a.m, we arrested mr. simpson, just 36 hours after reporting suzanne missing. police arrest brad simpson for assault and unlawful restraint. it was enough to hold him as they continued to

investigate and eventually uncover a payload of highly suspicious surveillance footage and more. october 7th, 9:12 a.m. brad's truck is seen at a fast food drive through. the warrant states that in the truck bed, they observed trash bags, a heavy duty trash can, an ice chest, a large, bulky item wrapped and secured in a blue tarp, and a metal rack seemingly to conceal and weigh the tarp down. 9:53 a.m. brad is captured on a home store camera, purchasing two bags of cement, an orange construction bucket, a box of 32 count trash bags, one bottle of 30 ounce clorox spray, and insect repellent. detectives were able to place his truck later that morning at a solid waste facility about 30 miles north of boerne, texas, at 3:27 p.m, brad is seen on camera picking up daughter charlee at

school, but cops say surveillance cameras show the blue tarp and the firewood rack were gone. volunteers and law enforcement from around the state spent days in the hot texas sun looking for suzanne, but came up empty. >> i do believe that law enforcement has done an outstanding job, but as for the family, they are holding on to each other. we're doing as well as can be expected. i mean, the brad children are surrounded with love and caring and compassion, and they're doing as well as i think you could for somebody in this situation. >> barton still holding out hope that his brother will decide to cooperate. >> there's grace for every raudy, but you have to be honest to achieve grace. you have to come clean. and that's my hope for my brother that he wants grace. >> we will continue to follow

when chris thomas got a text from his 22 year old son cole, wishing him a happy thanksgiving, he had no idea that would be the last time he would ever hear from him. and while his body has never been found, chris has never stopped searching for answers about what happened to his son. and he's asking for your help and is offering a $50,000 reward. he's the last person you would expect to go missing in the middle of the night, in a strange town far from home. >> he got out of the car by himself and just took off. >> 22 year old cole thomas disappeared without a trace and a story about his traveling companions defies belief, raising deep suspicion among cole's loved ones. >> he hadn't used his bank cards. he hadn't used his phone. he hadn't used anybody's phone. he hadn't contacted me. i feel like something's happened to him. >> there's not one second, not

one minute. not one hour that i don't think about him. >> there was hardly a more clean cut kid than cole thomas, an honor student in high school with a scholarship to the university of florida. cole was close with his family and the young woman who loved him. >> he could be very ambitious whenever he had his mind set to something, he would definitely get it done. >> so it's a complete shock to cole's parents when he suddenly drops out of college and heads up to minnesota. he's traveling with a friend and plans to work with him as an apprentice electrician. >> we were upset that he decided to take a break from school because he was so close to finishing. >> but cole keeps in close contact with family over the next few months, his aunt darla remembers the last time she talked with him a few days before thanksgiving. >> when he called that sunday night, he said, hey, andujar, you told me to keep in touch, so i'm calling you.

>> later that same week, he sends a text to his dad on thanksgiving day. >> he just said, happy thanksgiving. i love you dad. and i text him back and say, i love you too. >> early that thanksgiving morning, cole volunteers to drive two of his coworkers on a long distance trip more than 1000 miles south from pine island, minnesota, to durham, north carolina. his family has no idea he's on the road, and they know nothing about these coworkers. >> he knew both of the guys in the vehicle with him for two and a half weeks, approximately. >> later that night, this chilling surveillance image is recorded in a convenience store in mount olive, north carolina. it's one of the last times cole thomas is seen alive. three days later, cole's girlfriend gabrielle gets a chilling facebook message from a mutual friend. >> she said cole is missing and we think he's dead. my heart literally sank to my chest.

>> gabrielle contacts cole's family immediately. >> my mom comes outside and said that she had gotten a call, that he went to north carolina and that he was dead. and i said, i don't believe that. >> but moments later, a second call from the police in benson, north carolina, about 30 miles from where cole was seen on that store surveillance camera. >> they told me that he was registered as a missing person. i didn't know what to think. i was shaking. >> cole's dad arrives home from running errands to his stunned family. >> i knew something was wrong, and i got out and they said cole was missing. he went missing friday morning after thanksgiving from 1 to 3. sometime. >> his parents drop everything and head to north carolina to search a 500 mile drive on a holiday weekend. >> we weren't thinking the worst. i think we were praying

for the best. >> the moment they get to benson, they march straight into the police station at about 3 a.m. looking for answers. >> there was a sergeant on duty that let us in, and he immediately starts calling. one of the guys that cole had been with starts getting information from him. >> they walked over to the officers and told them that my son got out and had a panic attack and took off. >> just took off from the car and disappeared. that's the story. cole's travel buddies report to police, but it makes no sense at all to cole's family. >> they said in the beginning that he got out of the car by his self. we've seen the video surveillance and he was with somebody else walking at that time. >> when we come back. cole's father pushes his son's friend for answers. >> every time i would say something or give him a serious question, he would act like he didn't hear me. >> as the trail of clues g s

did happen to his son. according to chris, cole's coworkers invited him to go home with them for thanksgiving. here's the catch. it's more than 1100 miles away near durham, north carolina. a 17 hour drive. >> the reason the story was, was to go to thanksgiving with one of the coworkers family, go to his house for thanksgiving. >> honestly, i didn't even know that he was taking this trip. the last time i talked to him was the day before, and he never mentioned it to me. >> the family learned they left before dawn on thanksgiving morning. this is one of the last known images of cole at 1130 thanksgiving night. it's from a surveillance camera inside a convenience store 100 miles south of durham. >> it was definitely him. >> from there, the three men head north again toward benson, north carolina, but made one more stop along the way. and that's what allegedly fills cole's dad with fear. he says

the guys were going to north carolina to purchase drugs. cole's dad learns that court records in florida show that one of cole's coworkers was charged with conspiracy to traffic in methamphetamines and trafficking methamphetamines back in 2009. those charges were dropped, but cole's dad is not comforted, especially after speaking with one of them. >> every time i would say something or give him a serious question, he would act like he didn't hear me. >> but cole's dad claims one of cole's coworkers told him his son wanted nothing to do with what is alleged to be a drug >> i believe they went to a to get drugs. they all got strip searched and cole freaked out. after they got the dope, they left. he was nervous and didn't want no part of it. cole thought

somebody was following him from the guy's house. they'd just come from. >> after that, chris was told cole got out of the car and left the others. sure enough, a surveillance camera captures who chris believes is his son. walking through late night benson. shortly after 1 a.m. the man on the right is the last known image of cole tomás. >> you still couldn't hardly see his face, but it was his clothing that he had on in the mount olive surveillance video. >> they keep walking until they stop near a church, and that's where the story spirals into the realm of the unknown. >> he said cole had to use the bathroom. i went around the back of the church to get on my hands and knees and pray, and i said, pray for what he said because i threw the dope out the window. and these ain't good people. he got up, went around the front of the church to look for cole. he didn't find him, so he said, well, maybe he went back to the car and about five minutes into

his walk, he heard two gunshots. he said, i hope that ain't what i think it was. and i said, well, what'd you think it was? he said, well, i thought maybe somebody shot cole. >> chris says he does believe much of what he was told by the coworkers about the events that night, including suspicions about the alleged drug dealers. >> he said, hey, where the hell y'all been? if my boys would have seen you out here in this neighborhood, it wouldn't have been good and there wouldn't have been nothing i could do about it. he told me right then, mr. chris, i'm telling you, i know that them boys come to that neighborhood and done something to cole. i just didn't see it. >> for now, that's the only account chris has. about the last time his son was seen. >> i think cole is dead because he's been missing for this long. >> i just would like to be told, you know, if we checked into this and we ruled this out, you know something? just anything. >> i'm a die hard for the. you know, everybody has a chance to
