>> the suspected shooter in the murder of united health care ceo pleaded not guilty to new york state charges. however, he could be back in federal court in the coming days and the following and following the release of the ethics report against former florida congressman matt gaetz, he's getting support from his former district. plus, police say a man has been arrested, accused of setting a woman on fire on a subway train, causing her death. let's break down the headlines. making news with josh breslow with live now from fox. josh, thank you so much for joining us this morning. >> of course. yeah. thank you so much for having me. >> so josh, let's start with the case of luigi mangione. we just saw him in court yesterday. his next court date is scheduled for february 10th, i believe. but but he could be back in court within days. tell us about that and the reason why. >> yeah, i do want to look here. it's january 18th is going to be federal court. and then you have february 21st is over in state. so you have these two cases against him that are running simultaneously. you have the state charges and then you have the federal charges. and what's
9:37 am
interesting is when you look at the case overall, it was initially just those state charges which include the murder as an act of terrorism charge that a lot of people have been talking about. and then you had mangione, who arrived back in new york from pennsylvania last thursday, and that's when those federal charges were filed. so it's interesting, is mangione was expected to appear in court thursday in state court, but then the federal court filed the charges. so they had to push his state arraignment back. it's kind of a mess, as they're trying to figure out exactly how these cases are going to run side by side. and it sounds as though the federal one will kind of take precedent over the state one. but yeah, a lot left to figure out. now, as far as a future court date, it is possible that he will be in court sooner because there could be a bail hearing that's set at one point. i've spoken to a lot of experts who have essentially said at this point, it is almost a 100% improbability. i'll say
9:38 am
that he will be released on any kind of bond or anything of that nature, that anything would be set just based on all the charges there. >> josh, let's move on to the matt gaetz situation here. the former florida congressman here who was, you know, named by president elect trump to be attorney general. he withdrew from that. he also left congress as well. but that ethics report came out with some pretty damning information about his alleged relationships with underage teenagers, drug use, these type of things. but he is getting some support, though, from somewhere. tell us a little bit about that. >> yeah, some of the republican party is coming to his defense, and they're all saying pretty much the ones who are supporting him, his allies, that this report should never have been released. now, there are past instances where you've seen situations like this where somebody has left congress. they're not serving anymore, but a report like this one from the ethics committee is released anyway. now, he did say over the
9:39 am
weekend that he would possibly try to fill marco rubio's senate seat if marco rubio is approved. his nomination, approved by the senate, confirmed there to be on trump's administration. obviously, that is looking likely, but it's not clear who will take that senate seat. gaetz does say he would love to do that, and he also said that he'd love to run for governor of florida. we know that desantis is serving what will be his final term. so the question is who is going to run for the republican party next? and he's hoping here that despite the release of that report, that he will still have support from the republican party, and just based on the allies that we have seen come out showing their support for him, it does appear that he does still have that support to continue his political run there. when you're talking about a senate seat or even possibly the governor of florida. now, i did speak with congressman glenn ivey. he is a democrat from maryland. he has been pretty
9:40 am
vocal as he is on the house ethics committee and said this report did need to be released. if matt gaetz did plan to continue his political career, it was very important that the american people were able to see it. and we now know, of course, that it was released yesterday. and as you mentioned, there's some salacious content in that report. >> we'll see if it affects any possible potential run for either senate or governor in the future. we'll get back to that and we'll kind of keep an eye on that. but we want to move to this other story out of new york city right now. it's a pretty disturbing story here. there was a guy in a subway. he allegedly set a passenger sleeping passengers clothes on fire, watched this person burn to death. and this person has been arrested now. but the story is really catching a lot of people. tell us a little bit about that. the and the folks behind this case here. >> yeah. so it's a bizarre story. it's terrifying. we've had reports from our fox five new york station over the last several days as they're
9:41 am
gathering all of the details. but nypd saying that essentially what happened is this man and this woman were on the train, the f train, they're over in brooklyn. this was early sunday morning, and they did not know each other. that's accordingo nypd. but he walked up to her, according to police and set her clothes on fire. and jessica tisch, who is the nypd commissioner, said that the woman, her clothes and then her, they went up in flames and she passed away very quickly as a result of her injuries. now the reports from police and according to court documents, are that this guy just sat there and watched her burn and then walked away. and there are those surveillance photos that were released by police. now, as they were released, folks were able to help identify him, and eventually he was taken into custody. now, we did learn in a statement from the ice, immigration and customs enforcement, they say that he is an illegal immigrant. he entered
9:42 am
the country illegally from guatemala. so ice will be involved in this situation here. but again, a very bizarre, horrifying story. and the investigation still underway to figure out essentially why someone would do this in the first place, especially to a woman who was simply sleeping there on the subway, something many people do in new york, here in the bay area as well. >> that's why it's so terrifying to see something like this happen. josh breslow from live now from fox, thank you so much for joining us this morning and providing some insight into what you'll be covering throughout the day. we appreciate it. >> yeah. thank you so much for having me. >> coming up on mornings on two the nine, a group of caregivers spring into action to offer more than medical care. how? they're

end of christmas eve, a group of caregivers sprung into action when they realized the senior citizens they work with needed more than just medical care. >> this holiday, as ktvu andy rubin tells us, the holidays can actually be a lonely or difficult time for seniors, and that's why people are going the extra mile to spread holiday cheer. >> the lights, the decorations around the holiday. steve lawrence used to do it all at

eve officers took dozens of calls from children asking for santa's whereabouts. >> it is something that brings real joy to the members of norad. we have a network of satellites that orbit about 23,000 miles above the earth, and they are aided by the heat from rudolph's nose that helps them be able to see where where the sleigh is. >> this tradition has spread over the decades. now children and adults turn to norad every christmas eve. >> well, some nasa astronauts in space right now sent a video to everyone on earth wishing them a merry christmas. >> this year, we're going to be in orbit away from them, so we want to send our heartfelt merry christmas, and we hope you have a wonderful holiday. one also mentioned that, you know, we're not the only ones that are going to spend time away from our, our, our families over the holidays. there's a huge team on the ground that's going to support us in mission controls around the globe over the

holidays, and i want to thank them for the sacrifices that they're making. >> so from all of us to all of you, merry, merry christmas. >> so three of the astronauts there were launched into space back in june on what was supposed to be an eight day flight mission. but the boeing starliner spacecraft they were in suffered technical issues, and they have been unable to return to earth ever since. so i think the next time they could try again is a few months from now, maybe in march. >> so what a what a saga that's been. >> yes, i know, i cannot believe it. i know you know. and the space capsule is i mean, i forget anyway, one of elon musk's spacecraft was supposed to take him that couldn't do it right. so now they're stuck there a little longer, but they're making the most of it. >> it seems like they are happy spirits. which which is to be commended. all right. coming up, let's talk about new year's eve. you go out and party. are you one of those, like, who gets dressed to the nines?
