no longer have to pay a fee when withdrawals are declined immediately, such as at the atm. ktvu south bay reporter lamonica peters has more now from state lawmakers and reaction from consumers. >> back in august, the state legislature unanimously passed assembly bill 2017. the new law states state regulated banks and credit unions cannot charge non-sufficient fund fees when an attempt to withdraw money is immediately declined because of insufficient funds. tim grayson, who first served in the house and was sworn in as senator earlier this month, authored the bill. >> it has been shown that nsf fees are most likely to be assessed on financially vulnerable consumers, increasing financial strain, while also negatively affecting the consumer's overall perception of the banking system. >> ab 2017 was supported by consumer advocacy groups like california low income consumer coalition and east bay community law center. the california

credit union league was initially against the bill, but eventually took a neutral stance. governor newsom signed the bill in september. >> things happen, you know, especially in this economy, and it's $35. and then if some other check bounces, then you're stuck with another $35 fee. >> it definitely will help out as far as keeping that money back in the household versus in the bank. and then, you know, historically, the banks have done a lot of different things that us consumers have have no idea what they're doing. so i think it's a great thing. >> the consumer financial protection bureau says in 2023, u.s. banks reported $5.8 billion in fees, down 24% from the year before. still, some customers think there will be some other fee in the future. >> they're going to go off of off of whatever that we that we're not looking at into if we're not reading the fine print. so they they've made plenty of money and unfortunately they probably will make more in the future. >> governor newsom also signed

senate bill 1075, which says credit unions can't charge more than $14 in overdraft fees unless there's a lower federal limit. that law will start in 2026. lamonica peters ktvu, fox two news. >> other laws going into effect include sb 969, which allows local governments to choose zones where bars and restaurants can sell alcoholic drinks. with ab 1955, districts will no longer be allowed to create policies requiring teachers or staff to disclose a student's gender identity. sb 1283 allows school boards to limit students ability to use social media while at school, and with ab 2123, employers will no longer be able to require employees to use paid vacation time for sick leave and family leave before accessing state benefits. new at 11 a teen is in custody tonight for a dui hit and run after he crashed his car into a pole in santa rosa. we have a photo of that crash. this happened near

the off ramp at steele lane and southbound highway 101. police responded after they got called around 9 p.m. last night about the driver fleeing the scene. police found 19 year old gabriel chacon nearby, apparently intoxicated and injured. they identified him as the driver. officers also leaed that he was on two counts of pretrial supervision related to two different assault cases. the teen was then treated at a hospital and booked in jail. california highway patrol in hayward posted this video tonight. it captures the moment that two officers stopped someone who was driving in the wrong direction on i-580. this was around 10:50 p.m. on christmas eve. the officers did some sobriety tests and report that the man was so impaired that he could not remember how he got on the freeway. the man was apparently just hours away from his 21st birthday. he is now booked in santa rita jail. one man is under arrest for operating a suspected brothel in a residential neighborhood in

san jose. after receiving multiple tips from the community, san jose police executed a search warrant at a home on south 24th street last week after a one month long investigation. 44 year old zhen wang was taken into custody and booked for pimping and pandering. two female human trafficking survivors were found and provided with resources. new tonight police in alameda are looking for two burglars who reportedly stole hundreds of packages from an apartment complex. ktvu zac sos joins us now in studio after talking with tenants. and, zach, you were telling us that they said that this was not the first time this has happened? >> yeah. no. apparently not. thieves have hit this package room at the complex several times, including last christmas. a number of residents only willing to speak about their frustrations off camera. but i can tell you, two years of being left without gifts has left many. they're fed up. >> a neighbor of mine got home, came to get her packages and was literally in tears.

>> tenants at an alameda apartment complex with a real life grinch on their hands. >> that was kind of her christmas inside that room before it was taken. >> bob, who also lives at ballina village, had his stocking stuffers stolen. photos showing just a handful of gifts left in the package room after he says more than 100 were swiped just five days before christmas eve. >> the thing is, is it's just, you know, it's the holiday season. we're all, you know, working hard to pay our bills and, you know, stay above water. and then for people just to come and take from the people that work hard. >> alameda police say they're looking for two people who broke into the room. >> i'm glad that i only lost one thing. >> tenants like this woman who asked for her face not to appear on camera, relieved after being reimbursed but still scrambling to buy new nintendo gear for her nephew. >> nobody has time to reassess or to what are we going to do now that we don't have any presents to present? i spoke with another resident that lost like seven packages, so that very well could have been majority of their christmas.

>> it's the second christmas in a row. residents say their packages have been pilfered by thieves, but there were also other times in between the two break ins in the span of a mont. >> during the holidays is not easy on anybody. >> all their mail is now temporarily being diverted elsewhere on property. >> i think the complex really is doing everything that they can. >> in a vaguely worded email to tenants building management apologizing for the quote incident, adding that it's investigating what happened and exploring options to relocate the package room. >> i think, you know, one, having a package room 20 yards from the main road is not the smartest idea. secondly, you know, the notifications came out after other residents, you know, were notifying each other and we're going into the office and making gripes. >> and police right now are reviewing surveillance video from the package room. that video again showing two suspects taking off with those gifts. we did reach out to the building for comment, but have yet to

hear back. jana. >> i hope the management can help so that this doesn't happen again next year. zac sos in studio. thanks so much! while lucky supermarket in oakland's montclair neighborhood is cleaning up today after a second overnight smash and grab, police say several suspects used multiple cars to crash through the entryway glass and then steal merchandise before driving off. the thieves also broke into the atm, which is now empty and was found in the parking lot. the montclair village association says that the teams did the same type of break-in here on christmas eve. >> this is a crime of opportunity in that after hours holiday season, nobody's going to be there, and so there's now ample opportunity to be able to grab the atm machine, break it open, get the cash out of there and get out of the area quickly. >> there's no word yet on whether there has been an arrest. if you have any information about this case, you're asked to call oakland police. today was the last day

of the san francisco flower market at its longtime location south of market. the wholesale flower market dates back to 1912. the market opened at its current spot at six and brannan streets in 1956. it has become a local institution for growers, florists and floral enthusiasts. about two thirds of the vendors say that they will move to the market's new home on 16th street in potrero hill that will open on january 2nd. others are on a waiting list. one vendor said that they decided to open their own store instead. >> we don't expect a new market. a lot of vendors are not included there, so they excluded from the waiting list, i guess because we never had a clear answer from the from the manager. >> the developers who purchased the brannan street building, kilroy realty, built the new, smaller facility. and going forward, the flower market will be managed by a new nonprofit

in custody in arizona after a christmas shooting at sky harbor airport in phoenix. this story begins tonight's west coast rap. police say the man showed up to the airport with a gun wednesday night after he received a text message about an active shooter at sky harbor. he got into an altercation with an officer shortly after arriving. no one was hurt as a result of this incident. the shirtless man was booked into jail. police have not released his name, they believe. a family dispute ignited the event, but the shirtless man was not a part of it. >> i do believe that this was a family dispute that escalated. >> i didn't even hear the shots. i didn't even know there was a shot until the police said that there was. it was a shooting. >> the event was a, quote,

completely unrelated incident to a shooting that happened shortly before this, also on wednesday, in which three people were shot and one person was stabbed outside a security checkpoint at a restaurant within the same airport. officials in utah are calling it a christmas miracle. two brothers are alive today after narrowly escaping an avalanche on christmas eve. reporter chris arnold has that story. >> those guys had a had a very, very lucky christmas eve. >> toby wheat is a forecaster with the utah avalanche center. he's describing an incident that took place late tuesday morning. >> it was a party of two brothers, and they went out for a ride into the steep hollow area. one of them was riding across the slope or side, hilling across a fairly large bowl when he triggered the avalanche. >> wheat says that avalanche came down and caught. one of the brothers was carried about 150 yards by the snow before he was

buried. down below, he says, luckily, both men had all of the equipment necessary for backcountry travel. >> the brother, who was not buried, used his transceiver to find the brother who was buried, and it got him pretty close. and when he got close enough, he could see a couple fingers sticking out of the snow of his brother and was able to dig him out. >> weed says the man who was buried had minor injuries. both men were able to ride out of the backcountry. a much different outcome compared to another avalanche that happened in cache county 16 years ago on christmas eve with a party of four young men rode up providence canyon and only about maybe 15 minutes from logan, when somebody, one of the party or two of the party of four triggered the avalanche. two of the riders, 22 year old eric jorgensen and 23 year old jesse johnson, both from utah, were killed. we spoke about some things that can be done to avoid

urban and small stream flood advisories in effect up there throughout the evening hours. it hasn't rained ridiculous amounts, but a half inch to an inch and a half on mount tam. and of course the creeks are already pretty full because of the rain that we've had. and this is that picture jana was referencing the golden gate bridge. you can see some kind of light, scattered showers. if you look in the puddles, that's where you can tell right on the left side of the screen there. so we've got more rain tonight, and these are all sort of truncated weather systems like this one coming in tonight is really not an all day thing. it is a tonight thing and it's done. and then tomorrow looks like not a half bad day in terms of dry from the sky. you'll be able to get get out and get things done for your friday. saturday is going to do the same thing. kind of an overnight thing on saturday morning. and then saturday will be kind of okay during the day. sunday, same thing. so we got about 2 or 3 of these overnight kind of pulses that are going to go through and create wet conditions, but not so much during the day. at least that's how it looks today. right now here's the flood advisory in these areas. urban and small

stream flood advisory. the moisture that's this big plume of moisture. that's what went through today. and that's where we got inch and a half of rain around mount tamalpais. right. so the orographic lifting and the dynamics with that not real strong. although the winds in the north bay and parts of the hilly locations of some the sierra nevada. pardon me. 40, 45 mile an hour winds. so it's blowing up there. the winds will die down later on tonight. this is the model. here we are at 9 a.m. tomorrow morning. it's done. we're not done, but kind of done, right? most of it's gone. and then here is tomorrow night. a few scattered showers overnight. and then there's saturday morning and saturday afternoon. right. so this is very similar to what we're going to see tomorrow. and then we get into this on saturday night sunday morning and then gone. so the mountains it sticks around. so you're going to see a lot of activity up in the mountains right through the period. it won't stop during the day like here. it's going to keep snowing up there. the snow levels start

off pretty high and then they drop down as we go into tomorrow night. but they start off pretty high. so we're going to see rain at the lake too late tonight and then through the mid morning hours. then it'll cool off and the snow levels will drop. there's a five day forecast. gianna just kind of unsettled weather i'd say right through the week. >> all right. thanks so much bill. appreciate that. well new at 11. the port of oakland announced some good economic news today. port officials say that cargo volume increased 10% during the period from january through november this year, compared to the same time last year. they say that puts the port on track to return to pre-pandemic cargo levels. agricultural exports are being credited for boosting outbound cargo levels. last month marked the 13th straight month of container growth for the port of oakland. starting in january. el capitan state beach, outside of santa barbara will be closed to overnight campers for a full year. this is so california state parks can complete a $5.5 million construction project. the beach right off highway 101

and you start to see that you have a little bit less of that doming action, but it's still sort of serves serves the purpose. >> if you chop up a chocolate bar, you'll incorporate small bits throughout the cookie. that's the one on the right. on the left is the same dough, but with the baking wafers, which i hadn't tried before, i only ever use the chips. >> i buy the red bag in the grocery store. >> yeah, so that's our 63% chip. >> yeah, i can definitely see how it's there's a lot of chocolate in there. >> yeah. it kind of creates sort of a layering as well. >> baking is as much science as it is an art. and even though bad cookies are still pretty good, guittard says choosing the right ingredients and recipe will help make sure you love the outcome. as one example, she points to the contrast between regular and dutch processed cocoa the darker one on the left, so you see a different color difference in color, which is much darker. >> and then you've also got this lighter color here. and if you were to taste them, you would taste a stark difference between the two. well, let's taste them. >> let me try this one. oops.

in civic center plaza this morning. the 2025 recycling schedule runs from january 2nd to january 17th. recology crews will pick up christmas trees on your regular pickup day. just put them next to your trash and recycling bins, and we're going to take it up to our original composting facility up in vacaville, where we've been composting for 28 years, and we're going to grind them, and then the smaller pieces will get fed in with the other food scraps and sticks and leaves get fed into the composting process. well, this is a free service for san francisco recology customers. and as a reminder, crews are asking that you please remove all the tinsel, the decorations, tree stands and lights before putting your tree out there on the curb. residents and other bay area counties also can recycle their christmas trees. people who live in santa clara and san mateo counties can place their trees on the curb
