oakland coliseum, flowing freely in both north and southbound directions down south 280 in downtown san jose. looks good. a little bit of camera wetness there, obscuring or obscuring our view, but still no congestion to speak of. those streets are slick again. then finally, the bay bridge toll plaza. it's a similar story. people have their headlights on, of course, even as dawn begins to break. we'll of course have to keep the windshield wipers handy, because we'll be using them throughout the rest of the day and for the next couple of days. happening today, santa cruz city leaders plan to give an update on the damaged wharf there. right now, beaches in santa cruz county are still closed as large swells and debris from the collapsed wharf continue to pose safety risks. the cleanup is a massive, multi-agency effort. the dangerous debris spans from seabright to beaches up to south of the pier. >> the pier pilings themselves. they're covered in creosote, which is pretty toxic. so we have to make sure that we're doing our best environmentally to dispose of these. >> state and local teams are

using heavy machinery to clear the debris from seabright and twin lakes. more debris is expected to surface over the weekend, so officials are urging people to avoid going to the beach. crews are preparing for more debris as powerful swells are expected this weekend. >> 702 is your time 2025? just a few days away now, and several new state laws go into effect in the new year. one is designed to protect bank customers who try to withdraw money from atms, but do not have enough in their accounts. the new law bans state regulated banks and credit unions from charging additional fees when an attempt to withdraw money is immediately declined because of insufficient funds. >> it has been shown that nsf fees are most likely to be assessed on financially vulnerable consumers, increasing financial strain while also negatively affecting the consumer's overall perception of the banking system. >> california's new bank fee law has the strong support of consumer protection groups across the state. it also appears to be very popular among bank customers. >> things happen, you know,

especially in this economy, and it's $35. and then if some other check bounces, then you're stuck with another $35 fee. >> it definitely will help out as far as keeping that money back in the household versus in the bank. and then, you know, historically, the banks have done a lot of different things. >> governor newsom signed this bill into law in september. the governor also signed a bill that says credit union overdraft fees can be no more than $14, unless a lower federal limit is set. that becomes law in 2026. >> some other laws going into effect include sb 969, which allows local governments to choose zones where bars and restaurants can sell alcoholic drinks. another law says school districts are no longer be allowed to create policies requiring teachers or staff to disclose a student's gender identity. starting next year, a law allows school boards to limit students ability to use social media while on campus. also in 2025, employers will no longer require employees to use paid vacation time for sick and family leave before accessing state benefits. >> well, the los angeles times reports marijuana farmers are

treating their crops with all sorts of prohibited chemicals. farmers submit monthly pesticide reports, but the l.a. times says it's unclear whether state or county regulators carefully check. the article also questions whether the data collected is accurate, making it nearly impossible to trace the origins of a contamination if there is an outbreak. >> starting january 13th, bartleby changing its schedule on the peninsula due to a construction project to replace an outdated control system after 9 p.m, crews will be working on track updates between the colma and millbrae stations. this means the yellow line will end at sfo instead of millbrae after nine. the millbrae station will only be served by a train running every 15 minutes between millbrae and sfo. this nightly service plan in millbrae is expected to last several years. happening today. it's the last day you can take a free ferry from richmond to san francisco and back. the free rides between san francisco and richmond started november 1st. it's about a 35 minute, one way ride. the richmond ferry operates 14 trips a day on weekdays and five trips a day on weekends, starting

additional units called to the scene. amanda quintana is there gathering the latest on what we know so far. amanda. >> yeah. so there has been a heavy fire and police response, but some good news. one of the firefighters just came by and said it is winding down, so his crew was released. we have seen a couple other trucks leave. so you know for us that's always good news to hear that the fire is at least under control enough that they can have some of the trucks here leave, but there are still quite a few here. at least seven trucks. there were more. more than eight, possibly ten when we first got here. but this is on gemelli way. so this is the neighborhood. it's kind of just down the street from the capitol square mall. we're at the intersection of capitol avenue and gemelli way. they have it blocked off here. the report was for a three alarm fire. we heard some people might have been trapped and needed to be rescued. we are still trying to confirm that information with

fire department officials, but multiple units here. we also saw a couple pga trucks, the work trucks that were here that pulled out right after we got here. so we're not sure if those are related to the fire and what happened here. but having two of those work trucks here next to the fire trucks is something, you know, significant that it could be related. it looks like this call came in around 515. so it has been two hours that they've been at least working on this here on the scene. but we're working to get more information about what actually happened, how many units were involved. it does look like it's kind of this complex here, where there are a bunch of buildings that are two floors, maybe 6 to 8 units in each of those buildings. so it could be one of one of these in this small, little complex neighborhood. so

we're working to get more information again, but still a lot of units on scene. i'm sure they'll still have a lot to clean up, even though they do clear some of the crews, there are still a lot of people with the fire department and with the police department still here. live in san jose. amanda quintana ktvu, fox two news. >> amanda. thank you. other top stories we're following this morning. a state appellate court tossed out the 2020 rape conviction of former san francisco 49ers star dana stubblefield. the appellate court ruled santa clara county prosecutors violated the law. when they say stubblefield race was a factor in the decision by law enforcement officers to not search his house, which is a violation of the california racial justice act. >> as azerbaijan mourns those who died in a plane crash, the first of many funerals is getting underway. the deadly plane crash killed 38 people. the aircraft was headed to russia. 29 people survived. mans under investigation, but there is speculation it may have been caused by russian air defense

systems. today is another particularly busy day at airports nationwide. the transportation security administration is warning travelers to expect long lines. tsa predicts it will screen some 40 million passengers through january 2nd. >> drones with thermal cameras helped l.a. county sheriff's deputies find a 78 year old man. deputies tell us the man suffers from dementia and got lost when he went to get his mail. he was first reported missing this past monday. the drones detected a significant heat signature on the side of a road in thick brushes. deputies say the body they found was not moving. search and rescue teams then went in. deputies say the drones helped them find the man quicker than usual. >> with the drone, you can cover a lot more area, including a lot more treacherous area and dangerous areas. very quickly. >> when the man was found, he was confused, unable to walk. he was then placed in a rescue basket and taken to a hospital. deputies say they are glad they found him because when they did, because the temperatures in that

that takes place on broadway in oakland at 530 tonight in san francisco. the lakeview cultural participation project is holding a celebration at the minnie and love ward rec center on capitol avenue. many bay area skiers and snowboarders are heading to lake tahoe this holiday weekend. heavenly mountain and south lake tahoe ranked number five in usa today's latest list of the best ski resorts in all of north america. mammoth mountain in california's mono county ranked 10th on that list. the top resort is snowbasin in utah. >> okay, we'll have to get out there. caltrans is reminding drivers change will be likely required at various times on the two mountain highways that link to the bay area to lake tahoe. if you're heading up, you should know to keep chains with you, even if there aren't chain restrictions at the moment you are leaving. there were restrictions in place earlier today. some people we talked to said they were not prepared. >> i got a little freaked out, so i called my parents and so they were like, just pull over,

sierra, but the snow levels have come up and it's a little slushy over lake tahoe this morning, where the temperatures are in the upper 30s, giving you a live look here at geyserville where we've got some clear sky, at least from this beautiful standpoint. as we get into the afternoon, we will have partly sunny, mostly cloudy, mainly dry weather the last 24 hours. here's a look at some of the rainfall amounts. san francisco almost three quarters of an inch. san jose almost 3/10. get over towards ben lomond and the santa cruz mountains. two inches reported for you there. and mill valley more than 2.5in. so we have seen a good amount of rain. a lot of it came last night into this morning, where flood advisories were popping up all over the place for standing water and low lying flooding across the bay area. we continue with the flood warning for this sonoma area from windsor, sebastopol, over towards rohnert park until 230 in the afternoon. streams, creeks, low lying areas. seeing that flooding going on in this area, the high surf advisory for the entire coastline now goes until early sunday morning. large breaking

waves not only hazardous in the water and for the surfers out there, but on the beaches. so be careful if you're going to be taking a path out there for today. scattered showers will continue to wind down. we will call for the possibility of a few sprinkles today as well as tomorrow. here's a look at the sierra, where again turning over to a mix of rain and snow above 6000 and 7000ft or so and getting into the afternoon, the winter weather advisory is going to expire at noontime, so national weather service continuing with that, at least for now. the futurecast model. there's a look at where we are right now with the wet weather from the pacific northwest into california. here's a look at another system that comes ashore on saturday. but we have a little bit of a ridge here that's going to deflect it, push it a little bit farther north. calling for just a few sprinkles on saturday, followed by another storm on sunday. this looks like it could bring us anywhere from a quarter inch to an inch, and then we are dry for the rest of

sheriff's deputies have arrested a carjacking suspect after a chase, a shooting and a stolen vehicle out of the bay area. it started late last night in rancho cordova, when deputies say they spotted a car that looked like one that was reported stolen in san francisco. anthony hurtado tried to drive away. we're told, after being pulled over by police. deputies say while the 34 year old drove away, he shot at deputies. we're told the deputies did not return fire. he eventually stopped the car and deputies arrested him for multiple felony charges. new. >> this morning, a marin county school district paying $17.5 million to settle sex abuse lawsuits filed by four former students. they accused tamalpais high school of failing to protect them from tennis coach norma burgos, despite evidence

of predatory bavior. he was eventually convicted of molestation and sentenced to 255 years behind bars. new york times reports tamalpais union high school district mailed out the financial settlements last week. a fifth case by an anonymous plaintiff goes to trial in february. in the east bay now. thieves in oakland used a number of vehicles to ram into a supermarket and steal an atm inside. this happened at the lucky supermarket in montclair. contractors working to board up the damage said it's the second time the store has been targeted. the montclair village association said the same thing happened on christmas eve, just one night before this break in. >> this is a crime of opportunity in that after hours holiday season, nobody's going to be there. and so there's now ample opportunity to be able to grab the atm machine, break it open, get the cash out of there and get out of the area quickly. >> also on christmas eve, two similar smash and grab crimes happened at a restaurant in san leandro. later the same night, police say the same group of thieves drove a car into a

gamestop. if you have information on these burglaries, please give police a call. >> to many state agencies are failing to track their budgets in accounting. the sacramento bee reports the state auditor is telling departments to shape up after a recent analysis uncovered agencies ignoring standard accounting principles. inaccuracies could lead to faulty financial reporting. examples included the employment development department overpaying $46 million to people ineligible to collect unemployment benefits. >> the new congress convenes in a week, and the house will vote on a speaker. current speaker mike johnson is under fire from both conservative and progressive lawmakers. republicans spent five days and 15 rounds of voting to elect a house speaker last year. they have only three days this year before congress is supposed to gather and certify the electoral votes for the presidential race. >> so to have a speaker's battle, all that does is a distraction and delays getting the american first policy through the promise made is that it should be the promise kept,

time of the day on a friday and there are few cars there, but not much action to speak of. the east shore freeway approaching the maze that also is doing pretty well this morning. a little bit of traffic posting maze, not much traffic heading toward richmond. we'll keep an eye on the roads for you and let you know if anything is going to cause a problem for your commute. we're following developing news in the south bay, an apartment building fire in the alum rock district of san jose. we're expecting a news briefing shortly about the fire. we plan to bring it to you when it begins. the fire broke out several hours ago on gemelli way near capitol avenue. all tenants escaped. no injuries reported here, but there is severe damage to some of the apartments, and firefighters have been on the scene for hours. we will have a live report from our man at 8:00. >> happening today. city leaders in santa cruz will hold a news conference at 11:00 this morning to give an update on their response to the collapse of a 150 foot section of the city's main wharf. it's closed indefinitely after powerful waves sent that portion of the wharf into the ocean on monday. city leaders have not yet revealed how long it will take to repair the extensive damage.

started the morning with a multiple advisories for flooding on freeways and roadways. those have expired and this is where we sit at the moment. just a few sprinkles still overhead and moving out into the afternoon. i'll have a better look at what you can expect for the second part of today, as well as the rest of the weekend, coming up in just a little bit. thank you. >> rosemary, a bit of a traffic hazard unfolding here, not too far from ktvu and jack london square. a live picture here. as in oakland, a pothole has been causing big problems for drivers. the left lanes are open here on 880 southbound, but more than ten cars have been disabled. here's the deal. there is a pothole at the oak street onramp to 880. so if you're on oak street trying to get on 880 southbound, there's a pothole there in as many as ten cars. may be more have been damaged by it. we see one police vehicle there on the roadway. keep this in mind. we don't know how long it will take to fix, but boy, those potholes do open up when we have a lot of intense rain over a long period of time. and that's what we've seen in

oakland and around much of the bay. but keep this in mind it's interesting. we can note that traffic is still flowing freely. of course, this is not your typical friday, so congestion itself is not an issue. but boy, that damage to your car can cost a lot. let's head now south to 280. in downtown san jose we see that the traffic picture is similar some slick streets, but cars making their way through both directions on 280. now to the bay bridge toll plaza, where i'm guessing things haven't changed too much. nope. since the last time we looked. of course, in broad daylight we see that there is still some wet on the roadways, but traffic congestion? not a problem as you're going from oakland to san francisco. now to developing news, we're following in san jose a fire at an apartment complex near 680 in the alum rock neighborhood. >> the fire department dispatched many units to the scene. they're still there now. amanda quintana is there at the scene gathering the latest information. good morning amanda. good morning. >> good morning. well, now that it's light out, we could get a look at the serious damage here to this apartment complex. you can see that bottom unit is where the fire started. but two units were fully engulfed when

firefighters arrived here. that one on the bottom and then the one right above it. there are eight units total in that part of the building, so all other six units are also displaced. because of this. we do have the red cross here trying to help people kind of figure out what to do now. but the good news is no injuries. so when this call initially came in this is for gemelli way. this neighborhood is just down the street from the capitol square mall. but when this call initially came in around 5:00, firefighters tell me that they heard reports that there were people trapped inside. so they called in additional units. they had a lot of people responding here, but they say luckily everyone was able to get out. there are no injuries. nobody was sent to the hospital. so that is good news. i also spoke to the man who lives in that apartment on the bottom floor where this fire started. you know, he was standing out here in his pajamas, no shoes, just soaking

wet from the rain here. he says he doesn't know how it started, but he knows that it started in his cousin's room. initially, he thought his cousin was asleep in that room. so, you know, he was he was opening the door trying to get him out. he thought, you know, his cousin might be passed out from the smoke or something like that. but luckily his cousin was not in that room he had left. so we don't know what started it. the cousin, i spoke to him as well. he says he has no idea what might have started this fire. you know, it wasn't in the kitchen or anything like that. it was in the bedroom. so that's what firefighters are investigating here. they still have, you know, a lot of work to do to figure out what actually started it. i did ask, you know, it was really rainy here outside. i asked, did that make things difficult? and firefighters are saying, yes, it did. you know, things are muddy, things are slippery. they're trying to be on ladders up there. the grass right outside,

very muddy. so it did make things difficult. but they say they train for incidents like this. they need to be prepared for everything when they get to a fire like this. so luckily no injuries. everyone was able to get out. the men that live in that apartment did go to neighboring apartments telling people, hey, there's a fire, get out! they were helping people get out. so, you know, community at this complex really coming together to try to make sure everyone is safe here. live in san jose. amanda quintana, ktvu, fox two news. >> all right, amanda, thank you. time now is 806. a twist involving santa clara county's department of family and children's services. the bay area news group reports the director, damien wright, is resigning next month. he wrote a letter to his staff telling them he's accepted a job in southern california, where he will also tend to family matters following his father's recent death. some social workers tell the paper they wanted him to accept more responsibility to several cases involving the welfare of children. in one case, the department kept three month old

phoenix castro with his parents, who were suspected of using drugs. phoenix later died of a fentanyl exposure. >> happening today, santa cruz city officials plan to give an update on the damaged wharf. right now, beaches in santa cruz county are closed as large swells and debris from the collapsed wharf continue to pose a safety risk. the cleanup is a massive, multi-agency effort. the dangerous debris spanned from seabright to beaches up to south of the pier. >> the pier pilings themselves. they're covered in creosote, which is pretty toxic. so we have to make sure that we're doing our best environmentally to dispose of these. >> state and local teams are using heavy machinery to clear the debris from seabright and twin lakes. more debris is expected to surface over the weekend, so officials are urging people to avoid going to the beach. crews are preparing for powerful swells expected this weekend. >> well, 2025 is just a few days away, of course, and several new state laws go into effect in the new year. one is designed to protect bank customers who try to withdraw money from atms, but

don't have enough in their accounts. the new law bans state regulated banks and credit unions from charging additional fees when an attempt to withdraw money is immediately declined because of insufficient funds. >> it has been shown that nsf fees are most likely to be assessed on financially vulnerable consumers, increasing financial strain, while also negatively affecting the consumer's overall perception of the banking system. >> california's new bank fee law has the strong support of consumer protection groups across the state. it also appears to be very popular among bank customers. >> things happen, you know, especially in this economy, and it's $35. and then if some other check bounces, then you're stuck with another $35 fee. >> it definitely will help out as far as keeping that money back in the household versus in the bank. and then, you know, historically, the banks have done a lot of different things. >> governor newsom signed this bill into law in september. the governor also signed a bill that says credit union overdraft fees

can be no more than $14, unless a lower federal limit is set. that becomes law in 2026. >> some of the laws going into effect include sb 969, which allows local governments to choose zones where bars and restaurants can sell alcoholic drinks. another law says school districts will no longer be allowed to create policies requiring teachers or staff to disclose a student's gender identity. starting next year, the law allows school boards to limit students ability to use social media while on campus. and also in 2025, employers will no longer require employees to use paid vacation time for sick and family leave before accessing state benefits. >> well, it's been almost a year since the 49ers beat the detroit lions to win the nfc championship last january. well, now, as the teams prepare to face each other on monday night, their fortunes look a whole lot different. in fact, the niners will finish the season below 500, while the lions are among the favorites to go to the super bowl. the 40 niners offensive line is dealing with a number of injuries, of course, and now there's concern about kicker jake moody, who has missed seven

a traffic hazard that you need to know about here if you're driving, was going to take you in the area of 880 and downtown oakland and the jack london square area. this is a slight backup happening on the southbound lanes of 880, right near the oak street exit. there's a big pothole that opened up in one of the lanes, and that's been causing problems for drivers. at least ten vehicles were damaged after hitting that pothole, and you can see northbound traffic kind of on the far side of your screen. that's moving well. but southbound 880 through the downtown and jack london square area of oakland is beginning to slow dramatically. we don't know how many lanes might be closed because of that pothole. earlier, we did see a law enforcement vehicle there sort of guarding the scene. so we'll stay on top of this, but just keep it in mind if you are going to take 880 south through oakland again, downtown jack london square area, be mindful of that pothole. those potholes opened up and there's a lot of

rain over a long period of time. and that is certainly what we've seen in oakland. >> some of the other top stories we're following for you this morning. a fire breaking out at a san jose apartment complex. it broke out just about three hours ago at the bella vista gardens apartments on gemelli way in east san jose. we've learned that all tenants have escaped and there is no injuries to apartment units are the most affected, but the people in all eight units at the complex are displaced. amanda quintana is at the scene and will have more information throughout the morning. a state appellate court has tossed out the 2020 rape conviction of former san francisco 49ers dana stubblefield. the appellate court ruled santa clara county prosecutors violated the law when they said stubblefield's race was a factor in the decision by law enforcement officers to not search his house, which is a violation of the california race act. >> today is another particularly busy day at airports across the country. the transportation safety administration warning travelers to expect long lines. tsa predicts it will screen some 40 million passengers through january 2nd. thieves in oakland used a number of vehicles to ram

into a supermarket and steal an atm that was inside. this happened at the lucky supermarket in montclair. contractors working to board up the damage said it's the second time that store has been targeted. the montclair village association said the same thing happened on christmas eve, just a night before this break in. >> this is a crime of opportunity in that after hours holiday season, nobody's going to be there. and so there's an ample opportunity to be able to grab the atm machine, break it open, get the cash out of there and get out of the area quickly. >> also on christmas eve, two similar smash and grabs happened at a restaurant in san leandro. later that same night, police say the same group of thieves drove a car into a gamestop. they have information on what happened. please call police. >> 816 now. drones with thermal cameras helped l.a. county sheriff's deputies find a 78 year old man. deputies tell us the man suffers from dementia and got lost when he went to get his mail. he was first reported missing this past monday. the drones detected a significant heat signature on the side of a

road in some thick bushes. deputies say the body they found was not moving. search and rescue teams then went in. deputies say the drones helped them find the man quicker than usual. >> with the drone, you can cover a lot more area, including a lot more treacherous area and dangerous areas very quickly. >> well, the man was found. he was confused and unable to walk. he was then placed in a rescue basket and taken to the hospital. deputies say they are glad they found him when they did, because temperatures were about to drop into the lower 40s and he could have suffered hypothermia or other cold injuries. at 817, many bay area skiers and snowboarders are heading to lake tahoe this holiday weekend. heavenly mountain in south lake tahoe, ranked number five in usa today's latest list of the best ski resorts in all of north america. mammoth mountain in california's mono county ranked 10th on that list. the top resort is snowbasin in utah. and this morning we're asking, are

reported stolen earlier in san francisco. anthony hurtado tried to drive away after being pulled over. deputies say while the 34 year old drove away, he shot at deputies. we are told the deputies did not return fire. he eventually stopped the car. deputies arrested him for multiple felony charges. new. >> this morning, a marin county school district is paying $17.5 million to settle sex abuse lawsuits filed by four former students. they accused tamalpais high school of failing to protect them from tennis coach normandie burgos, despite evidence of predatory behavior. he was eventually convicted of molestation and sentenced to 255 years behind bars, the new york times reports. tamalpais union high school district mailed out the financial settlements last week. a fifth case filed by an anonymous plaintiff goes to trial in february. >> too many state agencies are failing to track their budgets and accounting. the sacramento bee reports the state auditor is telling the departments to shape up after a recent analysis uncovered agencies ignoring standard accounting principles. inaccuracies could lead to faulty financial reporting.

happy friday. final friday of 2024 started out this morning with quite a bit of rain, even advisories for flooding across our highways and roadways. we have one area still with a flood warning. i'll show you that here momentarily. a live look over the bay where we do have mostly cloudy skies. a few scattered showers and a little bit of fog developing as this storm begins to move out. got a nice message from our colleague roberta this morning saying, in the east bay there is fog developing. it looks like near the altamont pass. the flood warning is for the north bay highway 101 near windsor, and then highway 101 over towards rohnert park, stretches over towards highway 116 and sebastopol for low lying flooding, including near streams and creeks that will go until the afternoon. and there is a high surf advisory now until early sunday morning. for those large breaking waves, not only in the water but along our beaches. going to be hazardous there for the weekend. a view here of storm tracker two the last six hours. you can see how

the widespread rain came early on and has tapered off to just scattered showers at this time. heading into the sierra. snow levels climbing above six 7000ft or so, with some rain reported over lake tahoe area. in spite of the higher level of the of snow, there is still winter weather advisory for travel that goes until noontime today. i'll have a look at what we can expect for the rest of the afternoon and the weekend, and into the extended forecast, which includes new year's day coming up in just a bit. >> thank you rosemary. let's take another live look at what's happening on interstate 880 in oakland. it appears to be a worsening situation for those on southbound 880 through the downtown and jack london square area, near the oak street exit. we see that the lanes are backed up traffic wise. that's because a pothole opened up there in the middle of the roadway. this isn't too far from the ktvu studios in jack london square. we've been told that at least ten cars have been disabled after hitting that pothole. we

don't have any word as to how long it will take for crews to fix it. but again, potholes open up after you have a long when you have a lot of rain over a long amount of time. and that's certainly what we've seen in oakland and beyond over the recent weeks. but keep this in mind, because now southbound 880 is backed up through the jack london square downtown oakland area. might be a better way to try to get around this. i don't know, 580 is your answer, but that's a tough one. we'll stay on top of the situation. traffic right now a lot slower than it looked even just about ten minutes ago. >> all right, now to this other story we're following for you. this developing news. an apartment complex fire in san jose, firefighters still on the scene. there are more than three hours after the first emergency call. they tell us two apartment units were in flames when their crews arrived. the complex is located on gemelli way near capitol avenue, east of interstate 680. so far, there's no word yet on what may have caused the fire. tenants in eight units of the complex are currently displaced. >> i just went, we went knocking on, on the neighbors doors to get them all out. and then it

injuries. we're following a traffic alert here in oakland if we can bring live pictures back in. you can see it's a dramatically different story than the last time we saw this, about ten minutes ago. the roadway is clear now. traffic is flowing freely on southbound 880 through oakland and the jack london square in downtown area. there was a big pothole that opened up and caused problems for several drivers, as many as ten cars said to be disabled. when we saw this picture just minutes ago, there was a pretty decent backup there on 880 in oakland, but that's eventually wound its way down. and so it's smooth sailing now, both south and northbound 880. a funeral service for oakland athletics great rickey henderson is set to be held in oakland this weekend. the 65 year old hall of famer died on friday. the funeral is set for the paramount theater. it's expected to draw former teammates and fellow hall of famers. it is not open to the public. >> well, the emeryville citizens assistance program calls itself the only food pantry in the bay area that's open for direct food distribution six days each week. organizers say they serve more than 10,000 meals per month.

we're joined now by natalia michiko parrish, a group volunteer, to tell us about their program, the needs, especially this time of year and an important event happening tomorrow. natalia, thank you so much for joining us today. >> thank you for having me. >> all right. so tell us a little bit about your organization, the emeryville citizens assistance program. >> it's a wonderful program. and it's been in emeryville for over 40 years. it was founded by nellie hannan, who was an emeryville. she was a city council member, and she saw the need. later, her brother bobby miller joined her, and now he is the operations manager. well, actually, he does much more than that, but and so we're still continuing to feed and so tell us a little bit about that process. >> you reach out to people that are less fortunate obviously that need to feed. talk to us a bit about that part of it and how it works. >> so what's really great is because ecap is has been around for 40 years. people know where we are. so we have folks who

line up on a daily basis. they're able to go through line and they're getting they're getting fresh fruits and vegetables, organic food, and just a myriad any food that you could get from the grocery store, basically. >> ecap receives those fresh fruits, fruits and vegetables is something that's that's sorely lacking in some communities. so it's good that there's a focus on that as well. >> oh, it's desperately needed in our communities, particularly at this time when everyone's talking about the price of eggs. so to be able to go in and get fresh fruit is and vegetables is wonderful. >> all right. so talk a little bit about the event that's happening on saturday, december 28th that's coming up here in a couple of days. what do we have. right. >> so it's tomorrow and it's going to what we're doing is we will be feeding 2500 people, upwards of 2500 people. we will be going out into encampments throughout oakland and emeryville and also berkeley, and we will have already made enough food to provide for

people who are living in these encampments. >> so this is something that you guys go out to, to the folks that are that need this food. they don't necessarily come to the organization's headquarters. >> that's correct. we go out, we caravan out, and we make the food and we process and serve it directly. >> that's a large undertaking. yeah, 2500 hot dinners to be distributed. that's a lot of work. >> turkey, ham, all the fixings. macaroni and cheese and delicious macaroni and cheese. >> it is. i'm sure it really is. but. but how many people do you have to prepare something like this? >> well, we've been planning. we plan for like, about a year. so all in all, we probably have about 100 to 150 people who donate their time and resources. >> and you guys are always looking for volunteers as well. and you say children are welcome to enjoy serving as well. >> the children love to help out on on our event date we have special projects that we have

them do. this year. we're giving away toys. and so we've we've set that aside for them to be able to package for us. >> wow. so it gives starts them early into that that habit of giving and helping others out. they love it. >> and we also feed our volunteers as well as volunteers. >> well you got the food there for the macaroni sounds. macaroni and cheese sounds really good. all right, so the event is happening. they're always looking. you guys are looking, hoping people from organizations, groups, friends, neighbors might be interested in helping you out with this event. >> yes, we have had some have some very heavy hitters. we have chick fil a, we have pixar who's also helping, and we also have our muslim friends who also are helping in such a big way. and so we have many, many resources. >> that is absolutely amazing. >> we can never have too many volunteers, which we need and come can come to 27th. well, it will be at excel. i'm sorry, is where we will headquarter your headquarter before you caravan out. >> correct. all right. there's

failure to install enough charging stations. americans spent more this year during the holiday shopping season, researchers report. holiday sales from november through christmas eve rose 3.8% from last year. much of that came from last minute shopping. in fact, the last five days of the season accounted for 10% of holiday spending. and with the holiday shopping season now behind us, the number of people returning those gifts is also expected to reach record highs $890 billion in merchandise, 17% of everything bought last year was returned. shopping mall managers say it's not necessarily a problem, because people who come in to make returns often spend the same amount or more between the gifts they're bringing back and gift cards that they've gotten. >> it combines to make like, almost like a nice coupon to buy something for themselves that they really wanted. >> studies show most people return items in the first week after christmas. some shoppers will buy clothing online, of course, in multiple sizes, and then return what doesn't fit. >> reminder if you're heading out to the coast, be careful of those high waves and advisories in effect right now. still an

pleasant hill will mark 45 years in business. it's a favorite among locals who say the small spot has quite a history. sunshine cafe is located on oak park boulevard. it's been serving up breakfast and lunch for decades. the owner, jesus diaz, first became a cook at the cafe thanks to his dad, who was a longtime dishwasher and busboy. the previous owner saw diaz's dedication and left the cafe to him after retiring. >> all of us are locals, and this is cheers for pleasant hill. it's our version, and everybody that's in here has probably come over a 25 to 30 year period of time. >> we come in and sit down. we don't even have to order. they just know what we want. he'll just say regular. >> so what is the regular? >> eggs over. qck. crispy bacon. crispy hash browns and english muffins. >> the cheers of pleasant hill, denise and john anderson have their own personalized coffee mugs, as do all the regulars.

diaz's family also works at the cafe and has expanded to have a mexican restaurant right next door. check out this video of monstrous wave crashes into a surfer in hawaii. ty simpson cain was surfing off maui's north shore when he was met with a super sized wave. in the video, you can see him flip several times before disappearing under the water. thankfully, he came out alive and was brought back to safety with the help of emergency personnel. the u.s. coast guard, credited with saving a man and his dog after their owner struggled to steer his sailboat through crashing waves and stormy winds on christmas morning, led the sailboat aground in northwest washington. deputies say they got a call about a man stuck on a boat. coast guard rescue swimmer later arrived on scene and led the dog and owner back to shore safely. >> the mega millions jackpot is up to a whopping $1.15 billion after no one won on tuesday night. the next drawing is later tonight at 8:00. it would make it the largest prize ever offered in the month of december. the winner chooses the cash option they'd get to take home $516 million before taxes. you'll be able to watch the blockbuster movie wicked at home
